Box 1179 TELEPHONE Southold, New York 11971 (516)765-1801 SOUTHOLD.TOWN CONSERVATION ADVISORY COUNCIL SEPTEMBER 18, 1986 The regular meeting:cof,the Southold Town Conservation Advisory Council was held Thursday, September .18, 1986 at 8:00 P.M. at the Southold Town Hall. Present were: Martin Garrell, Chairman Jeanne Marriner; Member Heather Cusack, Member John Holzapfel.,Member John Tuthill, Member Ralph Condit, Member Betty Wells, Member Linda Cooper, Secretary REPORTS Martin Garrell reported that the PROJECT OCEANOLOGY will sponser a Long Island Sound workshop-cruise on Saturday, October 11; 1986. They will' leave from Mattituck Inlet at 9:30 A.M. and will return at 12:30 P.M. Copies of-';.the•. letter will be distributed to the Trustees and Town Board. Martin Garrell reported on the Long Island Sound Study. Conclusions so far have indicated the problem of lack of oxygen at lower depths is more severe than previously thought. Ralph Condit reported that he_spent the day planting clams in Town waters. NEW BUSINESS A public informational meeting of Hallocks Bay disignation as a Critical Environmental Habitat will be held Wednesday, September 24, 1986 at . 7:30 P.M. at Poquatu'ck Hall in Orient., New York. Martin Garrell suggested that John Tuthill attend the meeting. RECOMMENDATIONS ON WETLAND APPLICATIONS On a motion made by Ralph Condit, seconded by Heather Cusack, it was RESOLVED to recommend to the Southold Town Trustees disapproval of Wetland Application No: 431 submitted by Glenn E. Juist on behalf of Frank Frankola to construct approximetely 300' of timber bulkhead which shall include a 20' x 30' boat basin and a 30' return. Applicant also proposes to dredge said boat basin to 3' at MLW, with this approximately 20 c.y. of spoil shall be removed form below MHW and approximately 93 c.y. from above MHW. Said spoil shall then be used as backfill for timber bulkheading. Page 2 9/18/86 The Council recommends disapproval because exactly where applicant plans to put his dredged out boat slip is a large thriving stand of spartina and there is spartina growing along beach and would most probably be destroued by the bulkhead and filling. This is a Significant Impact type action. Glenn Road, Southold. Vote of Council: Ayes: All Motion carried. Note: The Council has some questions regarding this applicant (Frank Frankola) . They w6nder who owns all the boats? is this property being used asp:,a marina? On a motion made by Jeanne Marriner, seconded by Heather Cusack it was RESOLVED to recommedd to the Southold Town Trustees approval with stipu- lations fo wetland Application No. 429 submitted by Richard A. Luhrs to construct and install a catwalk and floating dock. The Council approves the application only with the stipulation that the applicant elevates the catwalk by the standard 4' above the wetland. 360 N. Riley Avenue, Mattituck Vote of Council: Ayes: All Motion carried. On a motion made by John Tuthill, seconded by Ralph Condit, it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application NO.432 submitted by Magdalen Levas to construct wooden stairs from top of bluff to beach area. The Long Way, East Marion. Vote of Council: Ayes: All. Motion carried On a motion made by Ralph Condit, seconddd by Heather Cusack, it was RESOLVED to recommend tb;-the Southold Town Trustees disapproval of?._Wetland Application No. 433 submitted by Mark Baxter to mow vegetation. The Council disapproves of the action already taken (the vegetation has al- ready been mowed down right to the water',s edge) . In the future, applicant cannot cut natural vegetation within 35' of marshland and must leave the established plant community. Applicant must understand thath.heccannot cut down the vegetation again. 3135 Main Bayview Road, Southold. Vote of Council: Ayes: All Motion carried. On a motion made by Jeanne Marriner,seconded by Ralph Condit, it was RESOLVED to recommend to the Southold Town Trustees disapproval of WEt- land Application No. 343 submitted by Harold Wilsberg to clear land of small brush. Council disapproves of the action already taken and the applicanttmust understand that it must not happen again. Ole Jule Lane, Mattituck. Vote of Council: Ayes: All Motion carried. Page 3 9/18/86 WAIVERS Discussion The Council feels waivers should only be granted in an extreme emergency situationor if the project is very small and mundane. The Council feels that the majority of waiver requests should go through the wetland^application process.. Waiver request 29 - John Williams to excavate and build concrete block perimeter foundation for residence and build new dormers with windows. John Tuthill will inspect and notify Martin Garrell of his findings. Martin will give the recommendation of teh CAC as to whether the project should be waived or not to the Trustees at the September Trustees' meeting. Waiver request 39 - Silver Sands`-;Mot&l to hook into the Village of Greenport Sanitary System. Martin Garrell will check into the situation and notify the Trustees of the CAC's determination at the next Trustees' meeting. Waiver Request 38 - Clifford Cornell to construct a single family house on property on Mattituck Creek. Recommendation is to denyywaiver. Waiver request 33 - Cecilia Z. Loucka to construct a single family dwelling. Recommendation is to deny waiver. Wiaver request 11 - Robert G. Egan to reconstruct wxisting residence with new deck. Recommendation is to deny waiver. Group Inspections are scheduled for Thursday, October 16, 1986 at 2:00 P.M. Heather Cusack will contact Allen Connelly of the Soil Conservation Service to speak at the October meeting of the CAC. Topics for discussions are runoff prevention programs and buffering on Long Island Sound. Page 4 9018/86 DISCUSSIONS Betty Wells brought to the attention of the Council that something should be organized similar to the Farmland Preservation Program in which vital wetlands are protected but granting some compensation to the property owners. Heather Cusack stated that the DEC has funds for that purpose however, there was not much action taken. The members felt that property owners felt it would be more profitable to sell waterfront properties to private individuals than to participate in any goverment progra. There being no further business to come before the Council, on a motion made by John HOlzapfel, seconded by Ralph Condit it was RESOLVED to adjourn the meeting at 9:30 P.M.
