Box 1179 TELEPHONE °��®� �� Southold, New York 11971 (516)765-1801 r S.OUTHOLD TOWN CONSERVATION ADVISORY COUNCIL October 16 , 1986 The Southold Town Conservation Advisory Council held its regular meeting Thursday, October 16 ,. 1986 at 7 : 30 P.M. at the Southold Town Hall, Main Road, Southold, New York 11971 . Present were: Martin H. Garrell, Chairman John Tuthill, Member Heather Cusack, Member Jeanne Marriner, Member John Holzapfel, Member Ralph Condit , Member .. Betty Wells , Member Linda J. Cooper, Secretary Also present : Allen Connelly, U.S. Dept . of Soil Conservation Paul Stroutenburgh, Town . Councilman GUEST SPEAKER Mr. Connell explained the Dept . of Soil Conservation assists county districts in dealing with soil and water problems and conservation planning. Services are supplied on a voluntary approach. Mr. Connelly explained the vast range of services available to residents , landowners and agencies in ,dealing with water and soil problems- such as erosion, runoff, and associated problems . He stressed that conservation planning is, an on going responsibil- ty. The Dept . of Soil conservation has handled approximataely 500 conservation plans in the past ten years. The department is constantly revising and updating plans to utilize changes in technology. In addition to his oral presentation he also presented a slide and video tape program showing. a,hydroseeding of a local bluff. The seeding used four different species of plant , along with fertilizer, wood plastic mulch and water. The Council found the program to be very informative and expect to utilizethe department ' s services in the future. REPORTS Jeanne Marriner and Martin Garrell had attended the Project Oceanology presented by the Long Island Sound Study. It was a cruise on the Sound to simulate an ocean going project which involved taking samples of the life forms and bottoms conditions . The cruise was set up as an intoduction to the activities of the LISS. Jeanne Marriner reported on the progress she has made on the revisions the CAC will suggest in regard to the Master Plan. Mrs . Marriner presented her suggested revision of the Marine Business designation. She has separated the zoning into two separate designations: Marine Business ( as it stands in the proposed Zoning Ordinance) and Marine Recreation. (Original proposal of the Master Plan listed both designations but were later combined under the Marine Business designation. ) The Council suggested some altefations to the proposal and then agreed to have Jeanne Marriner draw up a covering letter and transmit.,;the proposal to the Southold Town Board with the Council ' s support . NEW BUSINESS Martin Garrell announced the New York State Association of Con- servation Commission will hold a conference in Albany, New York November 21 through November 23 , 1986 . Betty Wells said she would try to attend. The Council approved a suggestion made by Council Chairman, Martin Garrell, to urge the Southold Town Board to allocate funds for an environmental in-house attorney to aid the Trustees , CAC, Zoning and Planning Boards . Mr. Garrell will submit aletter to the Town Board urging the acceptance of the proposal. Heather Cusack, in response to a request by the Southold Town Trustees will do a listing of wetland species located on the Koke property in Orient . ( Re: Wetland Application No. 373 ) Heather will made an inspection of the site and submit her findings to the Trustees at their October 31 , 1986 meeting. APPLICATIONS AND RECOMMENDATIONS On a mtion made by Martin Garrell, secibded by John Holzapfel, it was RESOLVED to recommend to the Southold Town Trustees approval and denial of wetland application No. 437 , No. 438 and No. 439 submitted by The Land Use Company On behalf of Stanley Chase to: - Page 3 - 10-16-86 No. 437 - construct a 4 ' x 130 ' fixed dock a minimum of 4 ' over existing marsh leading to a 3 ' x 16 ' ramp leading to a 6 ' x 20 ' float dock which shall be secured to two 8" spiles . Home Pike Road, Mattituck. No. 438 - construct a 4 ' x 140 ' fixed dock leading to a 3 ' x 16 ' ramp leading to a 6 ' x 20 ' float dock which sahll be secured by two 8" spiles. Fixed dock shall be constructed a minimum of 4 ' over existing marsh. Home Pike Road, Mattituck. No. 439 - construct a 4 ' x 45 ' fixed dock leading to a 3 ' x 16 ' ramp leading to a 6 ' x 20 ' float dock. Said fixed dock shall be a minimum of 4 ' over existing marsh which shall be secured by two 8" piles . South Drive, Mattituck. The Couoncil recommends that only one of these appllications should be approved by the Trustees, the other two should be denied No need is shown for all three docks . The applicant may choose whichever application he prefers approval for. Vote of Council: Ayes: All Motion carried. NOTE: As a result of the these three applications the CAC suggests the Trustees establish a policy regarding the grantin:gf of permits on vacant properties and granting permits without need being established. On a motion made by Ralph Condit , seconded by Heather Cusack, it was RESOLVED to recommend to the Southold Town Trustees approval of wetland application No. 440 submitted by Costello Marine on behalf of J. Lane Curry toarmour 210 ' of existing bulkhead with 1-2 ton rock at 2-3 tones per foot . Paradise Point , Southold. RESOLVED to recommend to the Southold Town Trusstees approval of wetland application No. 441 submitted by Constello Marine Contractiang Corp, on behalf of J. Lane Curry to emergency repair in-kind, in-place 130 ' deteriorated and broken timber bulkhead with ( 2 ) 27 ' returns and backfill with 110c.y. of sand.Repair bulkhead within 18" . Paradise Point , Southold. . Vote of CouncilL Ayes': All Motion carried. On a motion made by Ralph Condit , seconded by Jeanne Marriner, it was RESOLVED to recommend to the Southold Town Trustees approval of wetland application No. 442 submitted by Peconic Contractiang on behalf of Grace K. Bourgin to construct typical bulkhead. 515 Watersedge Way, Southold. S• - Page 4 - 10/16/86 On a motion made by BettyWells , seconded by Ralph Condit , it _ was RESOLVED to recommend to ithb- Southold Town trustees approval with stipulations wetland application No. 445 submitted by J. H. Geideman on behalf of David Merz to construct a 10 ' x 25 ' deck at lower level; 150 ' bulkhead, ramp, 4 floats and repair existing dock. The Council recommends approval if the Bulkhead goes behind the grasses already there. Robinson Road, Greenport . Vote of Council: Ayes: All Motion carried. On a motion made by Heather Cusack, seconded by Ralph Condit , it was RESOLVED to recommend to the Southold Town Trustees approval v,rith_stipulat• on wetland_ application'- No. 449 submitted by Louise Tashjian to construct a private dock on premises . Approval is given if the dock is elevated the standard 4 ' . The Council also suggestss the applicant maintain a natural vegetation buffer between the house and marsh with beach grass and similar species and that drainage be diverted from the wetlands . 4955 Stillwater Avenue, Cutchogue. Vote of Council: Ayes : All Motion carried. On amotion made by Ralph:,.Condit , seconded by Heather Cusack, it was RESOLVVED to recommend to the Southold Town Trustees approval with stipulations*. wetland application No. 448 submitted by Carole and Albert Roke to remove tree stumps within 75 ' of water. Clear- ing to establish a lawn on waterside to floatiang dock. Approval is recommended if the appllicant maintains a 35 ' buffer of natural- vegetation from the high water mark. 2955 Wells Avenue, Southold. Vote of Council: Ayes: All Motion carried. On a motion made by Martin Garrell, seconded by Ralph Condit , it was RESOLVED :to table wetland application,,No. 435 submitted by Robert N. Durso to construct a house. Recommendation cannot be made without knowing the location of the cesspool. Cedar Beach, Southold. Vote of Council: Ayes : All Motion carried. On a motion made by Heather Cusaack, seconded hby Ralph Condit , it was RESOLVED to recommend to the Southold Town Trustees approval with stipulations of wetland appllication No. 436 submitted by Irene and Daniel McKasty to construct a one story garage and 20 ' x 40 ' in groud pool. Approval is recommended if the applicant-- Page 5 - 10/16/86 plants vegetation such as junipers and beachgrass to avoid runoff. (The Council suggests the applicant follow the same type of land- scaping as the neighbor twohouses down. ) 132-20 Main Road, East Marion. Vote of Council: Ayes : All Motion carried. On a motion made by Martin Garrell, seconded by Jeanne Marriner, it was RESOLVED to table wetland application No.._=443 submitted by The Land Use Company on behalf of Grace A. Finora to construct a single family dwelling and associated septic system. The -Council cannot make a recommendation without knowing the location of the septic system and well. N/E corner of East Legion Avenue and Bay Avenue, Mattituck..- Vote of Council: Ayes : All Motion carried. On a motion made by Heather Cusack, seconded by Ralph Condit it was RESOLVED to recommend to the Southold Town Trustees approval with stipulation ,wetlaiid application No. 444 submitted by The Land Use Company on behalf of Helen Reiter ( The Original Barge ) to consstruct within 30" of existing .strom damaged structure, approximately 27 ' of timber retaining wall. East side shall have an 8 ' return and west side shall have a 12 'return. Said structure shall then be backfilled with approximately 5 c.y, of clean sand. The Council approves if the applicant plants spartina or a similar floara for protection. Main Road, Southold. Vote of Council: Ayes : All Motion carried. On a motion made by John Tuthill, seconded by Ralph Condit , it was RESOLVED to recommend to"..-the Southold Town Trustees approval with resstrictions wetland application No. 447 submitted by Daniel S. Natchez and Assoc. on behalf of Brewer Yacht-Yard at Greenport . to maintaindnce-dredge, installation of pool within ' 75 ': ;-,)f i_nter- zidal marsh, deposit -fill within 75 ` - of freshwater wetland. Approval is recommended if the drainage and runoff is confined to the site; ;care is used to protect the pond form fill; and vegetation ios planted alongithe low bulkheading. Sterling Basin, Greenport ; St Agnes property north of Manhasset Avenue, Greenport . Vote of Souncil: Ayes: All Motion carried. Page 6 - 10/16/86 NEXT MEETING AND INSPECTION DATES The- next regular meeting of the Southold Town Conservation Advisory Council is scheduled for Thursday, November 18, 1986 at 8: OOP.M. at the Southold Town Hall. , Group inspections are scheduled for Thursday, November 13 , 1986 at 2 : 00 P.M. - DISTRIBUTION OF NEW APPLICATIONS No. 446 - Peter and Barbara Herz - Group inspection No. 450 - C & L Realty - Group inspection No. 452 - Stephen Eich - Ralph condit inspection No. 453 - Walter H. Burden III - John Holzapfel inspection No. 454 - Friedrich Krug - Group inspection No. 455 - Frederic Endemann ---Jeanne Marriner and Heather Cusack inspection WAIVER REQUESTS The Council recommends approval of the waiver request of John Wickham. There being no further business to come before the Council, on a motion made by Jeanne Marriner, seconded' by Ralph Condit , it was RESOLVED to adjourn the meeting at 10 : 35 P.M.
