CONSERVATION ADVISORY COUNCIL
THURSDAY, JANUARY 15 , 1987
The regular meeting of the Southold Town Conservation Advisory
Council was held Thursday, January_ 15 , - 1987 at 8: 00 P.M. at the
Southold Town Hall, Main Roadr;-i; Southold New York, 11971.
Present were: Martin H. Garrell, Chairman

Also present : David Strong, Strongs Marina, Matttuck, New York
Absent was: Betty Wells, Member
Mr. Strong of Strongs Marina in Mattituck, New York met with
the Council to discuss the Council ' s objections to the Marine
Business designation regarding the Master Plan. The Council
has proposed a Marina Recreation designation. be added to- the
MasteroPlan.
Mr. Strong conceded that he agrees with some points made by the
CAC regard!-ng limited used fragile creekfront areas . Motels
and restaurants do not belong on _creeks with marinas except by
Special Exception. He does take exception to some points int.
the CAC ' s proposals . To make almarina economically feasible
Certain uses must be allowed. Among those which should be listed
under Permitted Uses for a Marina-Recreational Zone and are not
are: Boat repairs, Retail sales of accessories or equipment ,
Sale and brokerage of boats.
After a lengthy discussion the members agreed that Mr. Strong
had p.r.esented-� a:!..strong case on behalf of the creekfront marinas
and the Council would amend its proposed Marina-Recreational
Zone to includd the prevaiots,slieted uses as permitted.
In addition, the thectopic,-!of "pumpout stations" at marinas was
discussed. The CAC has always stressed the need for these stations
at marinas . Mr. Strong informed the . Council that he too was
in favor of pumpout stations until he tried to install:::one at
his marina. Due to differing State and Federal regulations it
was virtually. impossible for a pump-out station to be installed.

NEW BUSINESS
Februaray 5 , 1987 - Meeting with Sophie Morris of the DEC regarding
procedure to become an official State CAC and be eligible for
state funding. Cooperative Extension, 3 : 00 P.M. Riverhead, New
York.
February 25 , 1987 - Joint meeting with the Riverhead CAC. 8: 00 PM
at Riverhead Town Hall.
Master Plan Public Hearing scheduled for the 22nd.
Thursday, Februaray 29, 1987 - Trustees Public Hearing regarding
the Cramer property.
Thursday, February 29 , 1987 - DEC at Town Hall to discuss topics
of interest .
DISCUSSION AND RECOMMENDATIONS OF APPLICATIONS
OOn a motion by John Tuthill, seconded by Martin Garrell it was
RESOLVED to recommend to the Southold Town Trustees approval with
modifications of Wetland Applicaiton NO. 456 for John R. Dempsey
to construct a timber dock consisting of a 4 ' x 16 ' hinged ramp
and a 6 ' x 20 ' float secured by ( 2 ) 8" pilings . The CAC recommends
approval only if the plans are modified as follows: applicant
must shorten float and ramp and dig out in fromt . The plans ,
as submitted, will impede neighbors ' navigation.

On a motion by Heather Cusack, seconded by Jeanne Marriner, it
was
RESOLVED to recommend to the Southold Town Trustees approval
withstipulations Wetland Applicaiton No. 462 submitted for Rita
Gledich to add an addition and deck to existing structure .
The CAC recommends approval with the stipulations that applicant
does not plant a lawn; upgrade the septic system and contain
all runoff on site.

On a motion by Martin Garrell, seconded by Jeanne Marriner, it
was
RESOLVED to recommend to the Southold Town Trustees approval
with suggestions Wetland Application No. 471 submitted for
Cheng Yu to construct a stone revetment 200± l.f. long with ( 2 )
20 ' returns . Revetment will be approximately 12 ' from tow of
bluff and landward of spring J.W. Approximately 350 c.y. of
clean fill will be trucked in for backfill. Purpose of project
is to prevent further erosion to toe of bluff. The CAC recommends
the applicant heed the advise of the Soil Conservation Dept .
The CAC feels that if the advise goes unheeded the applicant
may lose everything.

On a motion by Martin Garrell, seconded by Heataher Cusack, it
was
RESOLVED to table Wetland Applicaiton NO. 472 submitted for Alfred
Cooke to restore pre-existing floats and pilings . The CAC cannot
make a recommendation until it receives a detailed map or speaks
with the applicant to determine exactly what the applicant proposes
to do.

On a motion by Jeanne Marriner, seconded by John Tuthill, it
was
RESOLVED to recommend to the Southold Town Trustees approval
ofWetland Application NO. 473 submitted for Jacqueline Grassi
to reconstruct within 18" approximately70 ' of timber bulkhead
and to backfill said structure with approximately 25 c.y. of
clean sand to be trucked in from an upland source.

On a motion by Martin Garrell, seconded by Ralph Condit , it was
RESOLVED to recommend to the Southold Town Trustees approval
with qualifications of Wetland Applicaiton No. 474 submitted
for Robert E. Johnson to register an existing bulkhead with replaced
an 82 ' bulkhead destroyed by Hurricane Gloria. The CAC feels
applicant should be fined for completing project prior to approval.
Permit should not be issued until fine is paid.

On a motion by Martin Garrell, sedonded by Ralph Condit , it was
RESOLVED to recommend to the Southold Town Trustees approval
with qualifications of Wetland Applicaiton NO. 475 submitted
for Anna Parlamis to rebuild sections bulkhead destroyed by
stroms with a concrete bulkhead 25 ' long, 18" wide, with 2 ' above
and 2 ' below. The CAC feels applicant should be fined for complet-
ing project prior to approval. Permit should not be issued until
fine is paid. ,

On a motion by Ralph Condit , seconded by Heather Cusack, it was
RESOLVED to recommend to the Southold Town Trustees disapproval
of Wetland Applicaiton NO. 476 submitted by Paul Ferdenxi to
dredge an access channel to dock. Proposed channel will be 40± '
x 20± ' to maximum depth of 5 ' below MLW. Approximately 400 c.y.
. of spoil will be removed by hudraulic dredge during the dredging
of Mud Creek by the SCDPW. Spoil will goto approved area on
Fisherman Beach, Nassau Point . Add a second 6 ' x 16 ' float to
existing dock; add ( 3 ) 8" diameter mooring pilings 15 ' n/o dock.
The CAC feels dredging will destroy the shellfish producing bed
and do irreversible damage to the bottom. As an alternative
measure the CAC suggests applicant either apply for a mooring
elsewhere in the creek or seek docking at Boatman' s Harbor.

On a motion by Jeanne Marriner, seconded by John Holzapfel, it
was
RESOLVED to recommend to the Southold Town Trustees approval
with stipulations Wetland Applicaiton NO. 477 submitted for Larry
and Sandy Stahl to install swimming pool within 75 ' of tidal
wetlands with deck and fence according to code. . The CAC approves
with the stipulations that applicants use haybales to avoid runoff;
putin more plantings as used elsewhere on property; have the
Bay Constable do frequent inspections during construction.

On a motion by Jeanne Marriner, seconded by John Tuthill, it
was
RESOLVED to recommend to the Southold Town Trustees approval
with stipulations Wetland Applicaiton No. 478 submitted for
Elizabeth Yaro to construct a one-family house, sanitary system,
driveway, and well, etc. as submitted. Approximately 450 c.y.
of fill will be used to raise grade to required flood plain
elevation ( +8 ' ) . The CAC recommends approval with the stipulation
that applicant strictly adheres to the DEC regultions; use down-
spouts; drywells, etc. Have the Bay Constable check during constrction
to be sure guidelines are adhered to.

On a motion by Jeanne Marriner,seconded by Ralph Condit , it was
RESOLVED to recommend to the Southold Town Trustees approval
of Wetland Applicaiton No. 479 submitted for Salt Lake Association
Inc. to maintainence dredge an area approximately 80 ' x 120 '
to depth of 6 ' below MLW. Approximately 1000 c.y. will be removed
and placed in intertidal area and above on beaches to east .
Ten year maintainance dredging permit is requested.

On a motion by Heaather Cusack seconded by Ralph Condit , it wwas
RESOLVED to recommend to the Southold Town Trustees approval
of Wetland Applicaiton No 480 Submitted by Nunzio and Stephanie
Reale to construct a 5 ' x 32 ' fixed dock leading to a 3 ' x 10 '
ramp leading to a 6 ' x 20 ' float dock to be attached to two 6 '
x 20 ' floaat docks .

On a motion by Heather cusack, seconded by John Tuthill, ; it
was
RESOLVED to recommend to the Southold Town trustees approval
of Wetland Applicaiton No. 481 submitted for Howard and Carol
Safin to construct from an existing cement retaining wall a 6 '
x 65 ' fixed dock ( a Minimum of 4" over grade) leading to a 3 '
x 10 ' ramp leading to an 8 ' x 20 ' float dock.

Motion carried.
On a motion by John Tuthill, seconded by Ralph Condit , it was
RESOLVED to recommend to the Southold Town Trustees approval
of Wetland Applicaiton NO. 482 submtted by Floyd King, Pres . ,
Orient Wharf Co. , Inc, to set out 8 floats in place of existing
piles for mooring of small boats .
Foot of King Street , Orient .
Vote of Council: Ayes: All
MOtion carried.
WAIVER REQUESTS
The CAC recommends that the Southold Town Trustees deny the waiver
requests of Henry Stasiukiewicz and Deborah Stasiukiewicz .
The CAC would like to meet with John Wickham before making a
recommendation for a waiver.

NEXT MEETING AND INSPECTION DATES
The next regular meeting of the Southold Town Copnservation Advisory
Council is scheduled for Thursday February 19 , 1987 at 8: 00 P.M.
at the Southold Town Hall.
Group inspections are scheduled to begin at 2 : 00 P.M. Members
will meet aat the Southold Town Hall at 2 : 00 P.M. on Thursday,
February 19 , 1987 .
There being no further business to come before the Council, on
a motion by Ralph Condit , seconded by John Tuthill, the CAC adjoured
at 9: 50 P.M.
