The regular meeting of the Southold Town Conservation Advisory Council was held Friday, March 20 , 1987 at 7 : 00 P.M. at the Southold Town Hall, Main Road, Southold, New York. Present were: Martin Garrell, Chairman John Holzapfel, Member John Tuthill, Member Ralph Condit , Member - Betty Wells , Member Jeanne Marriner, Member Heather Cusack, Member Linda Cooper, Secretary Also Present : Paul Stoutenburgh, Southold Town Councilman The next regular meeting of the Southold Town Conservation Advisory Council was scheduled for Thursday, April 23 , 1987 at 8: 00 P.M. at the Southold Town Hall. Group inspections were scheduled for Thursday, April 23 , .1987 . Members will meet at 3 : 00 P.M. at the Southold Town Hall. DISTRIBUTION OF NEW APPLICATIONS No. 509 - John Tuthill Inspection tDaniel and Irene McKasty) Construct a private dock 70 ' long, 40 ' wide. 13220 Maine Road, East Marion. No. 510 - Group Inspection James E. Fitzgerald, -Jr. , Pres. , Broadwaters Cove Association, Inc. - Replace existing bulkheading, return, and replace three existing pilings, bulkheading March 10 , 1987 - Page 2 catwalk; add approximately 20 ' of open catwalk; maintenance dredge docking area; add three floating docks with four fingers . South side of east end of Mason Drive, Cutchogue. No. 511 - Ralph Condit Inspection - Alan Cardinale Installation of new floats as per amended sketch plan submitted to Council. Foot of Bridge Lane at Nassau Point on Wunneweta Pond, Cutchogue. No. 512 - Group Inspection - Michael M. and James B. Sueiro Maintenance dredge 40 c.y. and install two 20 ' x 5 ' floating piers . Wiggins Lane, corner of Dawn Drive , East Marion. No. 513 - Group Inspection - Harold Reese Clear property of brush, briars , and undergrowth to be able to walk on property and provide access to surveyors. Fronting Long Island Sound and Dam Pond, East Marion. No. 514 - Martin Garrell Inspection - Old Mill Inn Repair existing bulkhead, install pilings for I-Beam, install 4 pilings for deck and build deck. End of West Mill Road, Mattituck. No. 515 - Group Inspection - Christian B. Salminen Addition of 16 ' x 20 ' deck, ground level and step to East Marion Lake shoreline. 240 Lakeview Terrace, East Marion. No. 516 - Heather Cusack Inspection - Joseph Lestingi Construct a stairway down facae of bluff fro access from yard to beach. A 10 ' x 10 ' equipment storage room will be attached at lower end of stairway. 1150 Sound Drive, Greenport . REPORTS Long Island Sound Study - Martin Garrell The study has be very active and has turned up some very inter- esting sidelights . The area in the western section lacking oxygen is much deeper and larger than orginally expected. An additional surprise was the discovery that the oysters are carrying an extremely large amount of zinc. As a result of the study, the Federal government may put guidelines on the amouont of heavy metals in shellfish. Group for the South Fork - Jeanne Marriner The group formed to save Peconic Bay has been upset with the lack of monetary support by Local, State or Federal Governments . Thus far all funding has been going to Long Island Sound studies and without support the Peconic Bay could die . C_ 1 Marc ?0 , 1987 - Page 3 Riverhead CAC Meeting - Jeanne Marriner Mrs . Marriner attended a regular meeting of the Riverhead CAC and reported that the Council in Riverhead has a set of maps with overlays . By utilizing the maps and overlays that Council can determine the topography of an area to aid in the decision- making process . The Riverhead Council faces the same problems as Southold regarding the huge suge in building and the desire to build on parcels which at one time were considered totally unsuitable for building purposes. Chairman Martin Garrell stated that he sould like to consult with the Riverhead CAC regarding funding by the State CAC . Southold Town Master Plan - Jeanne Marriner Jeanne reported that the Souothold Town Board has been facing pressure from the local marinas regarding the CAC ' s recommend- ations for altering the Master Plan to include a Marine Recre- ation designation. Martin Garrell advised Mrs Marriner to continue to attend all Master Plan meetings . At that time Councilman Paul Stoutenburgh explained his presence at the meet.ip_g. He had been_:rfteet ftq with the town planner Dave Emilita, Coucilman Penny and the marina owners to devise a workable solution for the Marina Business/Marine Recreation designation in the Master Plan. Through a series of compromises they came up with a Marine I and II to separate marinas on creeks from marinas established on large bodies of water, like the bay. Councilman explained in detail the limited uses and restrictions which would be placed upon marinas in creeks to protect the creek waters and surrounding ares without hurting the marinas financially. APPLICATIONS AND RECOMMENDATIONS On a motion made by Martin Garrell, seconded by Ralph Condit , it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 489 submitted by Geddes Parsons to construct a single family residence 55 ' from tidal marsh. Approval is with the stipulations as per the letter from John Thatcher, Fishers Island Conservancy. West Harbor, Fishers Island. Marc- 20 , 1987 - Page 4 Vote of Council: Ayes : All Motion carried. On a motion made by John Tuthill, seconded by John Holzapfel, it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No.490 submitted by Peconic Associates on behalf of Sal Prato to construct a 30 ' x .40 ' building and a 30 ' x 50 ' fenced in storage area. Kerwin Blvd. , Southold. Vote of Council: Ayes: All Motion carried. On a motion made by John Holzapfel, seconded by John Tuthill it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Appllication No. 491 submitted by Nick Tsouris to armour 125 ' of eroded Sound fron bluff with 3-4 ton rock .-.@,- 3 ton/lineal foot . Install core stone and filter cloth base 1 ' below MLW and 5 ' seaward of 3ton toe stone. Install 24 ' returns at each end of property. The Council recommends approval but suggests the applicant work with the Southold Town Kenny' s Beach Erosion Committee. First house east of Kenny' s Beach, Southold. Vote of Council: Ayes : All Motion carried. On a motion made by Ralph Condit , seconded by Martin Garrell, it was RESOLVED to recommend to the Southold Town Trustees approval with conditions the Wetland Application No. 492 submitted by Ralph Levy to place 3/4 gravel aat the area next to the creek at a depth of 2" - 3" in an area 6 ' x 75 ' . The Council suggests the permit be withheld until possible violations have been rectified. (Upon inspection of the property it was discovered that a 4" diameter hose was being used to drain water from the driveway into the creek; also there is a deck being con- structed but no permit is displayed. In addition there are questions as to whether the dock on premised has been issued a permit . ) 885 Arshamomaque Avenue, Southold. Vote of Council: Ayes: All Motion carried. On a motion made by Martin Garrell, seconded by Ralph Condit , it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 493 submitted by En-Consultants , Inc. on behalf of Bernhard Peper to rebuild existing damaaged dock of dimensions 4 ' x 32 ' ; fixed elevated ( 3 .5 ' above grade or marsh) walkway; 4 ' x 12 ' hinged ramp; 6 ' x 20 ' floaat secured by two 8" diameter pilings . 955 Lupton Point Road, Mattituck. Vote of Council: Ayes : All Motion carried. Marr, 20 , 1987 - Page 5 On a motion made by Martin Garrell, seconded by Ralph Condit , it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 494 submitted by En-Consultants, Inc, on behalf of Joan LaCaille to construct a timber dock consisting,,-:df .:a A '- 12 ' fixed elevated ( 3 .5 ' above grade of marsh) walk; 4 ' x 10 ' hinged ramp; two 4 ' x 20 ' floats with a 6 ' x 20 ' outer "T" . Floats will be secured by 8" diameter pilings . 1255 Waterview Drive, Southold. Vote of Council: Ayes : All Motion carried. On a motion made by Ralph Condit , seconded by John Tuthill, it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Appllication No. 495 submitted by Gull Pond Dawn Corp. to construct a single family dwelling-, deck, sanitary and/or well. East side of Dawn Drive Vote of Council: Ayes : All Motion carried. On a motion made by Ralph Condit , Seconded by Heather Cusack it was RESOLVED to recommend to the Southold Town Trustees approval with stipulation Wetland Application No. 496 submitted by Deep Hole Creek Association tomaintenance dredge a channel 180± x 75± to 6 ' below MLW. Approximately 2000± c.y, of spoil will be removed by dragline crane and deposited on beach above MHW. The Council approves if the spoil is placed on east side of beaach. Deep Hole Creek, Mattituck. Vote of Council: Ayes : All Motion carried. On a motion made by Martin Garrell, seconded by Ralph Condit , it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 497 submitted by the Land Use Co. on behalf of Nicholas Micciche to construct a 3 ' x 30 ' catwalk leading to a 3 ' x 16 ' ramp leading to a 5 ' x 40 ' float dock. 260 Oak Street , Cutchogue, Vote of Council: Ayes : All Motion carried. On a motion made by Martin Garrell, seconded by Ralph Condit , it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 498 submitted by Dana Fox to con- struct a dock, floating platform and walk. 305 Private Road, ( 2500 ROW) opposite Deer Road, Mattituck. Vote of Council: Ayes: All Motion carried. Marc' 20 , 1987 - Page 6 On a motion made by John Tuthill, seconded by Martin Garrell, it was RESOLVED to recommend to the Southold Town Trustees approval with stipulations Wetland application No. 499 submitted by Henry Stasiukiewicz to build a new home and add 150 yd. of fill tolivel depression on property. The Council approves with the stipulation that the applicant leave a 35 ' natural vegetaation buffer between house nad creek. Cases Lane Ext . , Cutchogue, Vote of Council: Ayes : All Motion carried. On a motion made by John Holzapfel, seconded by Ralph Condit , it was RESOLVED to recommend to the southold Town Trustees approval with qualifications of Wetland Application No 500 submitted by Anthony and Carolyn R. Leggio to register terracing and landscaping. The Council approves but suggests the Trustees withhold the permit pending any possible penalties for completing work without any attempt at obtaining the proper permits . 2300 Glenn Road, Southold. Vote of Council: Ayes : All Motion carried. On a motion made by John Tuthill, seconded by Ralph Condit , it was RESOEV.ED to recommend to the Southold Town Trustees approval of Wetland Application No. 501 submitted by Charles Bowman to creatae two 3acre lots and construct a single family dwelling and sanitary system on eaach. Approximately 2500 c.y. of fill will be installed at the site to raise the grade for flood plain and SCDHS requirements . applicant also proposes to install two fixed docks leading to ramps and floatsper submitted plans . Vote of Council: Ayes : John Tuthill, John Holzapfel Nays: Jeanne Marriner, Ralph Condit , Martin Garrell, Heather Cusack, Betty Wells MOTION LOST On a motion made by Ralph Condit , seconded by John Holzapfel, it was RESOLVED to recommend to the Southold Town trustees disapproval of Wetlands Application No. 501 submitted by Charles Bowman to ( see above ) . The Council cannot approve the application as submitted but would suggest the application be amended to allow one house onthe northerly parcel. The Council totally disapproves of the house on the southerly parcel. Main Bayview Road, Southold Vote of Council: Ayes : All ✓ Maarc,- ?0 , 1987 - Page 7 On a motion made by Heather Cusack, seconded by Ralph Condit , it ws RESOLVED to recommend to the Southold Tpown Trustees approval with stipulation of Wetland Application No. 502 submitted by the Land Use Company on behalf Anthony Gambino to construct a 30 ' x 50 ' single family dwelling plus attached decks a minimum of 60 ' landward of high marsh. Install a samotaru system a minimum of 100 ' landward of high marsh, and install a well. The Council recommends approval with the stipulation that the applicantleave a 35 ' natrual vegetation buffer between the house and marsh. Lupton Point Road, Mattituck, Vote of Council: Ayes: All Motion carried. On a motion made by Martin Garrel, seconded by Ralph Condit , it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 503 submitted by En-Consultants , Inc. on behalf of Cleaves Point Village Condo Association to construct 607± l.f, of low profile timber retaining wall plus 15 ' return on west side and 30 ' return on east side. Back fill with 400± c.y, of clean sand and loam to be trucked in form commercial upland source. Wall will be above spring high water. Shipyard Lane, Greenport . RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 504 submitted by Port of Egypt Enterprises , Inc.to place two floating timber dock: 1 . 5 ' x100 ' with eight 3 ' x 20 ' finger docks ; 2 . 5 ' x 60 ' with five 3 ' x 20 ' finger docks . -Main Road, Southold--"- RESOLVED to recommend to the Southold Town Trustees approval of Wetland -AppYlication No. 505 submitted by En-Consultants , Inc. on behalf of Louis Sulich to construct a timber dock consisting of a 4 ' x 100 ' fixed elevated ( 4 ' avoce grade of marsh) walk;4 ' x 12 ' hinged ramp; 6 ' x 20 ' float secured by two 10" diameter pilings . Broadwaters Road, Cutchogue. RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 506 submitted by En-Consultants, Inc. on behalf of Philip Salice to construct a timber dock consiting of a 4 ' x 40 ' (with additional 4 ' x 4 ' offset at outer end) fixed elevated walk extending form existing bulkhead; 4 ' x 16 ' hinged ramp; 6 ' x 50 ' floaat oriented N-S and two 6 ' x 30 ' floats oriented E-W to vorm "V" . Dock over area behind existing bulkhead ( 30 ' x 99 .5" ) and construct a 12 ' x 15 ' gazebo. Bayview Avenue,Mattituck Vote of Council: Ayes : All Motion carried. Marra`-'20 , 1987 - Page 8 On a motion made by Ralph Condit , seconded by Heather Cusack, it was RESOLVED to recommend to the Southold Town Trustees approval with stipulations Wetland Application No. 507 submitted by The Land Use Company on behalf of Jerry Bady to install three mooring npiles as per supplied plans and to maintenance dredge a 20 ' x 45 ' area to 6 ' at MLW with approximately 88 c.y. of resultant spoil to be disposed of at a suitabel upland disposal site. The Council recommends approval with the stipulation that there be no dredgeing. Also the CAC suggests the Trustees withold the permit until appropriate action has been taken regarding the work already completed without first obtaining the proper permits . 1775 Calves Neck Road, Southold. Vote of Council: Ayes: All Motion carried. On a motion made by Martin Garrell, seconded by Ralph Condit , it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 508 submitted by The Land Use Company on behalf of William Horstmann to resheath approximately 164 ' of timber bulkhead. Also to extend the return located at the east end of the bulkhead an additional 4 ' landward. Little Peconic Bay Blvd. , Southold. Vote of Council: Ayes : All Motion carried.
