Box 1179 TELEPHONE ��/®1 a�0 Southold, New York 11971 (516)765-1801 SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL The Southold Town Conservation Advisory Council held its regular meeting on Thursday, June 18, 1987 at 8:00 P.M. at the Southold Town Hall, Main Road, Southold, New York 11971. Present were: John Holzapfel, Member John Tuthill, Member Heather Cusack, Member Ralph Condit, Member Betty Wells, Member Jeanne Marriner, Outgoing Member (8:00 P.M. to 8:30 P.M. ) Daniel Kujawski, New Member Margaret Feeney, New Member Linda Cooper, Secretary ANNOUCEMENTS Jeanne Marriner thanked the Council members for their support and welcomed the newly appointed members. Jeanne distributed to all members a 1987=1989 CAC agenda(see attached) . She also discussed the objectives of the CAC and the impact of the Council on the future of Southold Town. SELECTION OF NEW CHAIRMAN On a motion made by Heather Cusack, seconded by JOhn Tuthill, it was RESOLVED to appoint John Holzapfel the Chairman of the CAC. Vote of Council: Ayes: All Motion carried. On a motion made by John Tuthill, seconded by Heather Cusack, it was RESOLVED to appoint Ralph Condit the Assistant Chairman of the CAC. Vote of Council: Ayes: All Motion carried. Jeanne Marriner left after the members voted in the new Chairman and Assistant Chairman. REPORTS John Tuthill attended an inspection of the Koke/Kerb property located in Orient. Mr. Tuthill submitted'-a grid-map-showing existing wetland species ' une 18, 1987 - Page 2 Located on the property and a description of same which was drawn uup by Trustee Bredemeyer. Chain Holzapfel inforft4he Council that the DEC will be holding a meeting regarding solid -waste which will be held in Nassau County. John will furnish further information to any interested member. DISCUSSION AND RECOMMEENDATION OF WETLAND APPLICATIONS On a motion made by John Holzapfel, seconded by Ralph Condit, it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 510 submitted byJarres E. Fitzgerald, Jr. , Pres. , Broad- waters Cove Association, Inc, to replace existing bulkheading return, and replace three existing pilings, bulkheaded catwalk; add approximately 20' of open catwalk; maintenance dredge dock-ing area; add three floating docks with four fingers. South side of eastern end of Mason Drive, Cutchogue. Vote of Council: Ayes: All Motion carried. Application No. 521 submitted for John L. Bagshaw is continued tabled pend- the co-ordination of the application betweenthe Southold Town Trustees and Southold Town Planning Board and receipt of the requested information from the applicant. On a motion made by Ralph Condit, seconded by Betty Wells, it was RESOLVED to recommend to the Southold Town Trustees approval with stipulations of Wetland Application No. 522 submitted by Michael S. Gillilund to build a new single family dwelling. The Council approves with the stipulation that it be mandatory that applicant does not disturb the natural vegetation buffer between the house and bluff except for clearing a pathway to the beach. Sound Drive, Greenport. Vote of Council: Ayes: All Motion carried. On a motion made by Heather Cusack, seconded by Ralph Condit, ti was RESOLVED to recommend to the Southold Town Trustees approval with stipulations Wetland Applicatiaon No. 527 submitted by The Land Use Company on behalf of Mr. and Mrs. John land to replace a 3' x 20'dilapidated caatwalk with a 4' x 65' fixed dock leading to a 3' x 15' ramp and 6' x 20 float dock. Said fixed dock shall be elevated a minimum of 4'over existing vegetation. The Council approves provided the project does not disturb the spartina wetland and care is used around the naatural vegetation. 190 Oak Street, Cutchogue. Vote of Council: Ayes: All Motion carried. On a motion made by Ralph Condit, seconded by John Holzapfel, it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 528 submitted by The Land Use Company on behalf of Mr, and Mrs. Alan Watson to construct a 4' x 20; fixed dock leading to a 3' x 16' rampand two 5' x 20' floats. Wells Road, Peconic. Vote of Council: Ayes: All June 18, 1987 - Page 3 On a motion made byRalph Condit, seconded by John Tuthill, ti was RESOLVED to recommend to the Southold Town Trustees approval of Wetland ApplicationNo. 529 submitted by Hide-A- Way Boat Basin to build a floating dock for private use consisting of steps plus 8' x 4' ramp 60' x 4' walkway (2) 16' x 3' T floats, (2) 18' x 3' T floats, 13 pilings. West finger of Mattituck Creek, Mattituck. Vote of Council: Ayes: All Motion carried. On a Motion made by Rlaph Condit, seconded by John Holzapfel, it was RESOLVED to recommend to the Southold TYown Trustees approval of Wetland Application No. 530 submitted by The Land Use Company on behalf of West Lake Association to maintenance dredge an 85' x 60' area to a depth of 4' at MEW. Resultant spoil to be trucked to an upland location. Lake Drive at West Lake, Southold. Vote of Council: Ayes: All Motion carried. On a Motion made by John HOlzapfel, seconded by Ralph Condit, it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Applilcaiton No. 531 submitted by En-Consultants, Inc. on behalf of Alex- ander Koke to construct a timber dock off existing bulkhead consisting of: 4' x 4' fixed platform, 3' c 16' hinged ramp, (3) 6' x 20' floats secured by (4)8" diameter pilings (on inside) . Over all project involves construc- tion of a house,pool, sanitary system, bluestone driveway, estension of berm parallel to bulkhead and approximately 40' fromit. Only aspect of the overall project the applicant is applying for in the Wetland Application is the berm and filling (overall amount 3500± c.y. ) . Pine Neck and North Bayview Road, Southold. On a motion made by John Tuthill, seconded by Ralph Condit, it was RESOLVED to recommend to the Southold Town Tr5ustees approval of Wetland Applicaiton No. 532 submitted byJ. H. Geideman on behalf of Gardiners Bay Property Owners Association to construct a bulkhead 3' landward of MHW totie into existing bulkhead on the northend and to remove the existing catwalk on the property::. Foot of Orchard Lane, East Marion. Vote of Council: Ayes: All Motion carried. On a motion made by John Tuthill, seconded by Betty Wells, it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 533 submitted by Yan H. Rieger to construct a low profile timber retaining wall above HWL and fill 60± c.y. 370 Harbor Road, Orient. Vote of Council: Ayes: All Motion carried On a motion made byRalph Condit, seconded by John Tuhtill, it was RESOLVED to recommend to the Southold Town Tustees approval with qualifications Wetland Application No. 534 submitted by Daniel F. DRagonetti for Peter Fakiris (Gusamr Realty Corp. ) to construct a 200' long dock, 4' wide for private docking facility of pleasure craft,secured by 36 pilings. This part of the application has the Council's approval. The amendment to the application to include approximately 800 c.y. of upland fill and approxi- J,me 18, 1987 - Page 4 17' of bulkhead is disapproved by the Council. The Council has not problem with the dock but feel the bulkhead is not needed. The Council suggests the applicant extend the ramp from the base of the dock up further and that would eliminate the need for the bulkheading. The CAC does not approve of the bulkhead because there are no other bulkheads in the area and the bulkhead could create erosion problems. Shipyard Lane, East Marion. On a motion made by Ralph Condit, seconded by John Tuthill, ti was RESOLVED ro recommend to the Southold Town Trustees approval with stipulations Wetland Application No. 536 submitted by John C. W. Campbell to clear a lot for building a single family residence. The Council approves provided that a 50' natural vegetation buffer is maintained between the house area. and bulkhead. Betty Wells Inspection No. 551 - Walter Smith - Repair an:'existing inclined boat ramp of irregular dimensions as shown on work plan. Repairs will consist of removal and replacement of side walls, decking, tie-rods, supports pilings, etc. 370 Williamsburg Drive, Southold. Daniel Kujawski inspection. BettyWells inspection ** Denotes Group Inspections =- June 18, 1987 - Page 6 DISCUSSION The Council discussed the Suffolk County dredging projects which have and will be taking place in Southold Town. The requested the secretary to find out if the Council could obtain a list of the dredging projects and when the projects would take place. The Council also discussed the matter of Waivers being issued by the Southold Town Trustees. This matter will be investigated further. NEST MEETING AND INSPECTION DATES The next regular meeting of the Southold Town Conservation Adviosry Council is scheduled for Thursday, July 16, 1987 at 7:30 P.M. at the Southold Town Hall, Main Road, Southold, New York. Group inspections are set for Thursday, July 16,1987. The Council members will meet at the Southold Town Hall at 3:00 P.M. There being no further business to come before the Council, on a motion made by John Tuthill, seconded by Ralph Condit, it was RESOLVED to adjourn the meeting of the Southold Town Conservation Advisory Council at 8:55 P.M. ADVISORY COUNCILS ..IN NEW .,.,RK STATE HAVE AS THEIR PRIME OBJECTIVE: To promote the intelligent use of New York's natural resources through .education and action which will provide and protect a wholesome environment for every citizen of the State The CAC advises on environmental matters, promotes conservation of our finite resources, and educates the public to the fact that pollution and depletion of natural resources costs the taxpayers money. The Cac speaks as a united voice, provides consulatation services, and develops educational materialsfor their specific areas. In Southold Town, we are guided in decision making by the WetlandsOrdins and the Southold Town Code and the goals of the Master Plan and Coastal Plan, and the Andros Patent The Andros Patent authorized the annual election of trustees for "Free- holders and Commonalty" and entrusted them with unappropriated lands, including marshes, beaches, harbors, inlets and creeks to be held for "the use, benefit and advantages" of the residents and taxpayers, their heirs and successors... The original premise indicates that the Trustees were responsible to maintain the public trust rather than to enhance thei private profit. ' This is the Stewardship concept . In recent years, the concept benefitting the public interest appears to have been badly eroded because local governments have regarded the water- front areas. as primarly a substrate ripe for private development and profit rather than for the public good. Enlightened local governments define "highest and best use of land" as to be measured by the effect of such use on the quality of life in the community rather than by the highest economic return to the developer. There are substatntial citations in the Albany law review publication on the SEQRA process which prove that govt . policies promoting stewar:dsh of natural resources hold up in court . The CAC, as an advisory body, should continue to advise Town officials to make a public commitment to preserving and protecting the Town' s environment because so much of the Town' s economy depends on a sound environment . Protection of private property rights can be considered in accordance with overall consideration of the public health and protection of resources which are necessary for the public health (groundwater, etc . ) Resource management decisions must take into account growth and current and future needs and inherent characteristics and carrying capacities of the area. The CAC should encourage govt . officials to use resource inventori in making land use and development decisions. Attachment 2 CAC ' ,NDA 1987-89 Ji 1. Enforce Wetlands Ordinance by advising on applications. To do . this appropriately, it would be helpful to have an inventory on all wetland areas and a set of overlay ,maps. If we accept that the future quality of life in Southold Town is dependent in large part upon the quality of its marine environment, -then we must realize that increased activity in t coastal zone (50% of the Town) will result in a drastic increase in pollu tion and loss of those recreational pleasure which contribute to the quality of life, and make. our decisions accordingly. 2. Establish policies to help obtain our prime objective: Preserve and ensure water sheds, water- tables, wetlands, beaches, bluffs, flora & .faun fish and shellfish. 3. Educate the public as to the economic benefits of a sound .environment. Educate waterfront owners, bluff owners and developers. 4. Continue to work in coalition with the Peconic Bay Emergency. Action Coalition for -solutions to the Brown Tide and a Peconic Estuary Study and Management Plan which addresses the bays and creeks as a system 5. Recommend policies to address: Dock-o-miniums; water recreational needs; protection of waterways from pollution/traffic. 6. Continue to recommend acquisition of property by all levels of govt. t a. Preserve waterfront and open space b. Prevent saltwater intrusion into groundwater c. Provide public access to beaches and .water d. Reduce pollution of bays, creeks, and wetlans from point and non-point sources. (Water conservation, Recycling, etc..) 7. Monitor and Make Recommendations on: a. Southold Master Plan and Zoning Amendments 2. Coastal Management Plan - Coastal Waterfront Revitalization Program 8. Continue to work toward identifying run-off.. 9. Continue to oversee waterfront development such as: Young's Marina, Marina Bay Club (proposed) , . S.trongs Marina 1988 expansion Narrow River Marina, Broadwaters Cove Area 10.
