Box 1179 TELEPHONE0 a Southold, New York 11971 (516)765-1801 SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL AUGUST 20, 1987 The regular meeting of- the Southold Town Conservation Advisory Council was held Thursday, August 20, 1987 at 7:30' P.M, at the Southold Town Hall, Main Road, Southold, New York 11971 . Present were: John Holzapfel, Chairman Ralph Condit , Vice-Chairman Margaret Feeney, Member Daniel Kujawski, Member Heather Tetrault , Member Betty Wells, Member Linda Cooper, Secretary Absent was: John .Tuthill, Member REPORTS Heather Tetrault attended a meeting by the DEC regarding Freshwater Wetlands .. A mapping of Freshwater Wetlands in Southold 'Town is being done and the CAC has been asked 'to advise if it knows of any Freshwater Wetlands that are not on the list . Margaret Feeney attended the annual Town Board meeting on Fishers Island and reported on same. Ms . Feeney was able to make several Wetland Application inspections while she was on Fishers Island. Ralph Condit attended the July Trustees meeting and reported on the Public Hearing regarding the Gritical -Environmental Habitats Mr. Condit reported that it appeared that in most cases the Town Trustees had agreed with the CAC recommendations regarding Wetland Applications . John Holzapfel reported on the meeting held at the Peconic Senior- Youth Center regarding Southold Town ' s water situation and support for the Suffolk County' s acquisition of the Pine Barrens . The meeting was sponsored by the Town ' s Water Advisory Council and Suffolk County.. Acting County Executive was the guest speaker at the meeting. John Holzapfel also reported on the International Shellfish Confer- ence held at Hofstra University in August . Au---:,t 20, 1987 - Page 2 Heather Tetrault reported that due to circumstances beyond her control, she was unable to pursue State funding for this year however will she will obtain the neccessary forms to submit next year. John Holzapfel reported that he received, in the mail, material from the Council of Environmental Quality which is a countywide committee that deals with environmental buildings and projects . Chairman Holzapfel discovered that until now Southold Town has never been involved with the . CEQ. He plans to attend meetings especially when agenda items concern Southold Town. UPCOMING EVENTS The New York State Conference .on the Environment is scheduled for October 23 , 24 and 25 , 1987 at Albany, New York. The CAC hopes to send a member to the conference. This will be discussed further next month. The next regular meeting of the Southold Town Trustees is scheduled for Thursday, August 27 , 1987 at 7 : 00 P.M. John Holzapfel wi11 represent the CAC at the meeting. NEW BUSINESS The CAC discussed possible projects for the future. They are checking into the possiblity of publishing an informational pam- phlet to help the town in an environmentally conscience way. The secretary was asked to write to all the Suffolk and Nassau County towns requesting any pamphlets , booklets , etc. they have published regarding this matter which the CAC may use as a guide in its own endeavor. On a motion made by Heather Tetrault ,seconded by Daniel Kujawski RESOLVED to request that the Southold Town Board approve of expenses incurred by CAC members in the future to attend pertinent meetings . This would include mileage and possible registration expenses . On a motion by Margaret Feeney, seconded by Ralph Condit , the minutes of July 16 , 1987 were approved. . Au-119t 20, 1987 - Page 3 APPLICATIONS FOR DISCUSSION AND RECOMMENDATIONS Re: Wetland Application No. 539 submitted by William Pymm to construct a single family residence, pool with decking and sanitary systsem; to construct a 4 ' x 20 ' fixed (elevated over grade) leading to a 3 ' x 8 ' ramp and a 6 ' x 20 ' float dock. Reeve Road, Mattituck. This application was tabled at the July 16 , 1987 meeting of the CAC until placement of the pool was determined. Ralph Condit attended the July meeting of the Southold Town Trustees and at that time viewed a diagram showing the place- ment of the pool It was determined that the pool would not have an adverse effect on the environment and advised the Trustees that the CAC would recommend approval to the project . On a motion by Margaret Feeney, seconded by Heather Tetrault it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application NO. 542 submitted by Reynold duPont Jr. , President , Goose Island Corp. to replace dilapidated fuel dock and transient dock to indlude offshore pilings . West Harbor, Fishers Island. Vote of Council: Ayes: All Motion carried. On a motion by Ralph Condit , seconded by Betty Wells, it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application NO. 553 submitted by Charles Sidorowicz to install approzimetely 80 tons of 6" - 14" run stone a total of 74 ' inlength and keyed in a minimum of one foot below grade. The rip-rap to have a minimum of one foot vertical to 2 feet horizontal slope. Work to occur landward of tidal wetlands . 3300 Cox Neck Road, Mattituck. Vote of Council: Ayes: All Motion carried. On a motion by Heather Tetrault , seconded by Ralph Condit , it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Applicaiton No. 554 submitted by the Land Use Company on behalf of Christopher W. Karb to construct a 120 ' x 3 ' catwalk leading to a 3 ' x 16 ' ramp and 6 ' x 16 ' float dock. Approval is whith the stipulation that the catwalk be elevated the stand- ard 4 ' above existing marsh. West Creek Avenue, Cutchogue. Vote of Council: Ayes : All Motion carried. On a motion by Margaret Feeney, seconded by Ralph Condit , it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Applicaiton NO. 555 submitted by the Land Use Company on behalf of Peter Steil to construct a single family dwelling, pool and associated sanitary system. Fishers Island. Vote of Council: Ayes: All Motion carried AL-11st 20, 1987 - Page 4. .On a motion by Daniel _Kujawski, seconded by Heather Tetrault , it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application NO. 556 submitted by the Land Use Company on behalf of Harvey McMahon to construct a 3 ' x 28 ' catwalk leading to a 4 ' x 14 ' ramp and 6 ' x 16 ' float dock. 420 Beachwood Lane, Southold. Vote of Council: Ayes: All Motion carried. On a motion by Margaret Feeney, seconded by Ralph Condit , it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 557 submitted by The Land Use Company on behalf of Rola B. Campbell to construct a swimming pool, deck and fencing as per submitted plans . Fishers Island Vote of Council: Ayes: All Motion carried. On a motion by Margaret Feeney, seconded by John Holzapfel, it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 558 submitted by Royston P. and Helen T. Rind to construct a dock with ramp and float . Catwalk - 4 ' x 80 ' ; ramp - 4 ' x 161 ; float - 6 ' x 16 ' . Length, including catwalk, 96 ' to HWM. Howard Avenue and Meday Avenue, MMattituck Vote of Council: Ayes: All Motion carried. On a motion by Ralph Condit , seconded by Daniel Kujawski, it was RESOLVED to recommend to the Southold Town Trustees disapproval of Wetland Applicaiton NO. 559 submitted by Inez B. VAil to con- struct a concrete retaining wall consisting of 91 ' with leg 25 ' . The 25 ' leg at the property line to be 8" wide. Construction to height of surrounding ground. Depth to be whatever is necessary to prevent undermining. The Council recommends disapproval by following the-,policy set by the DEC that no permanent structures be placed on . ,property where there is not a similar structure on neighboring properties. The Council sugtgests the applicant plant natural beach species to help control erosion and undermining. In addition, the CAC also suggests runoff be contained on site by the removal of the pipe draining into the creek and suggests applicant install drywells. Wells Avenue, Southold. Vote of Council: Ayes: All Motion carried. On a motion by Heather Tetrault , seconded by Ralph Condit , it was RESOLVED to recommend to the Southold Town Trustees approval with stipulations of Wetland Applicaiton NO 560 submitted by George L. Penny Inc. to clear, grade and apply a stone blend for employee oparking. The Council suggests applicant build a small berm on the edge of the property and install dry wells Au—st 20, 1987 - Page 5 in an effort to contain any runoff which may occur during heavy rains . Kerwin Blvd. , Greenport . Vote of Council: Ayes: All Motion carried. On a motion by Margaraet Feeney, seconded by JOhn Holzapfel, it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application NO. 562 submitted by Glenn E. Just on behalf of Joseph W. Henderson to construct a 6 ' x 20 ' fixed dock, 3 ' x 16 ' ramp and an 8 ' x 20 ' float dock. Private ROW, East End Road, Fishers Island. Vote of Council: Ayes: All Motion carried. WAIVER REQUESTS ( Received 7-16-87 through 8-20-87 ) Donald Brenner - Granted Waiver by Southold Town Trustees William and Patricia Brennen - Granted waiver by Southold Town Trustees James Homan - Granted Waiver By Southold Town Trustees James Meskouris - Waiver Denied - Wetland Application NO. 568 Theodore Metalios - CAC recommends Wetland Application process Richard 1!ohring Jr. - CAC recommends granting waiver Paul Ferdenzi - No decision by 'Trustees (Wetland Application No.570 ) Michael J. and Elizabeth A. Lademann - No decision by Trustees - (Wetland Applicaiton No. 572 ) Chairman John Holzapfel will make CAC recommendations regarding certain waiver requests to the Trustees at their next meeting. GENERAL DISCUSSIONS Southold Town Trustee Ellen Larson joined the Council for appox- imately fifteen minutes and discussed the Connors application (Wetland Application No. 543 ) . Ms Larson stated that the Long EIS had been received by the Trustees and suggested that the CAC request a copy from the Trustee secretary. Trustee Larson was questioned by the CAC regarding the Trustees ' policy in regard to waivers and how the Trustees determine how and to whom a waiver should and could be granted. Ms . Larson stated she would discuss the matter with the Trustees : John Holzapfel said he would bring the matter up with the Trustees at their next regular meeting. 4145 ust 20, 1987 - Page 6 Distribution of New Applications **Minor Subdivision - Paymond and Eleanor Kerester - Planning Board .Referral •13.85 acres which extends from the north side of North Bayview Road.and the west side of Paradise Point Road, Southold. Peconic Bay Blvd., Laurel. : Group Inspection **No. 564 - Eugene and Barbara Perino to construct a house and deck within 75' of water; to grade around deck and minimal landscaping along -top of bank to stabilize. 820 Truman's Path, East Marion. Group Inspection No. 565 - Joseph Perricone to construct a deck. 2060 Clearview Avenue, Southold. John Holzapfel. Inspection **No. 566 - Gerard H. Schultheis by the Land Use Company to reconstruct - -- within 1811, approximately 245' of dilapidated timber bulkhead and .to backfill same with approximately 80 c.y. ofclean sand which shall be trucked in form an upland source. Applicant also;)proposes to construct a.3' x 12' ramp and 4' x 36' float 'and to dredge a 10' x 30' area along bulkhead to a depth.,--of 41. at MLW, resultant spoil shall be .trucked to the Southold. Town Landfill. Applicant 4 -also proposes to :,construct a 61 " x 2416" addition to the existing" house and extend the existing deck 6'4" to the north. The north line of the addition shall conform to the northern most line of the present structure.. . A 13' timber return shall be constructed from the N/E. corner of the house to 'the bulkhead. The proposed deck shall be constructed over an existing concrete patio which is located landward of a timber bulkhead and a concrete retaining wall.
