TOWN CONSERVATION ADVISORY COUNCIL The regular meeting of• the Southold Town Conservation Advisory Council was held Tuesday, October 27, 1987 at 7: 30 P.M. at the Southold Town Hall, . Main Road, Southold, New York 11971. Present were: John Holzapfel, Chairman Ralph, C. Condit II , Vice-Chairman Daniel Kujawski, Member John Tuthill, Member . Margaret Feeney, Member Heather Tetrault , Member Betty Wells, Member Linda Cooper, Secretary REPORTS Chairman John Holzapfel announced there will be a SEQRA Review update held at the Legislative Building in Hauppauge on November 5 , 1987 from 1 : 00 to 4 : 00 .P.M. and 7 : 00 to 10 : 00 P.M. He encouraged all interested CAC members. to attend. A scoping session was held in reference to the Connors ' application Mr. Connor' In attendance was the Trustees, Mr. Connors and Mr. Connors ' attorney. Due to last minute notification, John Holzapfel. was unable to attend or have someone from the• CAC attned in his place. John Holzapfel also reported on the Trustees ' meeting which he attended in September. Among some of the decisions rendered that evening was one which- the CAC had recommended disapproval of a bulkhead and groins in Laurel... Chairman Holzapfel had checked with Jay Tanskio.f Sea Grantwho 'stated that standard engineering procedure is that groins should be 2 or 3 times the distance between them as there are length. Also standard procedure is to fill between the groins. Ralph Condit reported on inspection of The Cove at Southold held with the Trustees and Conservation Department and determining the high water line .which had been disputed. Daniel Kujawski reported on the 'Annual Conservation Conference held in Albany, New York. It appears the many of the State CACs are encountering the same types of problems whchface the Southold Town CAC . ` Oct(-;' r 27 , 1987 - Page 2 John Holzapfel, who is a member of the Citizen ' s Advisory Committee on the Brown Tide, reported on a meeting he attended Thursday, October 22 , 1987 . Money has been received to do a clean water study. COMMUNICATIONS The CAC received a note from the Supervisor ' s Office requesting comments in reference to a letter from the Nassau Point Property Owner ' s Association which made suggestions about limiting access of commercial shellfishing in the creek adjacent to their property, .limiting the amount a commercial shellfish permit holder would be allowed, and raising the fee for a commerical shellfish permit . It was decided that Ralph Condit would compose the written comments and present them at the next CAC meeting. DISCUSSION AND RECOMMENDATIONS Planning Board Referral - Sharyn and Philip Ofrias , Jr. - Minor Subdivision, Arshamomaque Island, Southold. The CAC felt that this referral was the same as the Council had previously received from the Planning Board and Valerie Scopaz . Ms . Scopaz had advised the CAC that the Planning Board would appreciate being advised if the CAC knew of any particular area of concern ( freshwater wetlands ) that was not indicated on the submitted plans . If the Council should be aware of any such area the would then advise the Planning Board. After a brief discussion, the CAC felt there was nothing it-could advise. Wetland Application No. 574 On a motion made by John Tuthill, seconded by John Holzapfel it was RESOLVED to recommend to the Southold Town Trustees approval of-'Wetland Application No. 574 submitted by Peconic Associates oon behalf of Youngs Marina to enlarge and rebuild the marina for 138 boats , to include 4 main docks and 69 finger piers and approximately 2900 c.y, of -dredgingas per submitted plans Approval with with the stipulations that : 1There be no dredging- in the shallow areas with grasses. 2 . There be close inspection of the dredging on a daily basis . 3 . Extreme care is used that the landward edges not be undermined. Vote of Copuncil: Ayes: John Tuthill, John Holzapfel and Daniel Kujawski Nays: Ralph Condit , Heather Tetrault , Margaret Feeney Abstain: Betty Wells Motion lost . Oct �r 27 , 1987 - Page 3 On a motion by Ralph Condit , seconded by Heather Tetrault , it was RESOLVED to recommend to the Southold Town Trustees disapproval of Wetland Application No. 574 . The Conservation Advisory Council feels this should be declared a Significant Impact . The CAC recommends disapproval until a study has been. made to determine the effects of a 50o increase in the boat population. Also to be determined,, the effects dredging may have on the sediment load and whether dredging would cause an undermining of the shallow areas around the edges which could result in the collaspe of the marsh bank. Wetland Application No. 575 On a motion made by John Holzapfel, seconded by Daniel Kujawski, it was RESOLVED to recommend to the Southold Town Trustees disapproval as submitted Wetland Application No. 575 submitted by En-Consultants for Harriet Freedman, Bruno Ilibassi, and Thomas Ball to construct 300± l. f. of timber retaining wall entirely aboveline of MHW. Backfill with 2700 c.y. of clean sand to be trucked in from an upland source. Wall- to extend from existing bulkhead return 7 ' n/o corner and end in 10 ' return on east side. The CAC recommends the applicant resubmit for. a rip-rap to be placed against the bluff and natural vegetation planted. The CAC also suggest a filter cloth be placed under the rip-rap. The Council disapproves a bulkhead because it would result in the loss of beach. Arshamomaque Avenue, Southold. Vote of Council: Ayes: John Holzapfel, Heather Tetrault , Ralph Condit , Margaret Feeney, Daniel Kujawski, Betty Wells Betty Wells Nays: John Tuthill ^ctober-27 1-987 -Page^_4" _ NEW APPLICATIONS No. 576 - Richard Mohring, Jr. - to fill with 3000 yds. of fill and to construct a house that will be more than 75' from the bulkhead, and to extend the berm parallel to the bulkheading and to be placed approximately 40' landward of the existing bulkhead. Lot #1, Paradise by the Bay, Southold Daniel Kujawski Inspection No. 577 - Anthony W. alnd Carolyn R. Leggio - Register a floating dock and ramp 2300 Glenn Road, Southold. John Holzapfel Inspection No. 578 - Anthony Robustelli - Deck addition. 5 Haywaters Road, Cutchogue. Heather Tetrault Inspection No. 579 - Michael J. Schulam (submitted by Glenn E. Just/JMO Consulting) - reconstruct approximately 118' of timber bulkhead which is located above the SHT line. New Structure to be reconstructed in line with adjacent bulkheads to either side. Existing lawn area to be graded to backfill the new structure. Knollwood Lane, Mattituck. Margaret Feeney Inspection No. 580 - Stephen Perricone - Clear and -construct a one family dwelling 75' from wetlands. Decks and necessary sanitary system 68' from waters edge. Lupton Point Road, Mattituck. ** Group Inspection No. 581 - Stephen Perricone Clear and construct a' one family dwelling 65' from wetlands, decks and necessary sanitary system .50' from water's edge. Lupton Point Road, Mattituck. ** Group Inspection No. 582 - Marjorie Todd (submitted by JMO Consulting ) - reconstruct within 18" approximately 70' of timber bulkhead and to backfill said structure with approximately 30 c.y. of clean sand which shall be trucked in from an upland source. Bayview Drive, East Marion. John Tuthill Inspection No. , 583 - Joseph Berardino (submitted by Glenn Just ) - construct a 14' x 16' timber dock. Sound Avienue, Greenport. Daniel Kujawski Inspection No. 584 Wunneweta Pond Association (submitted by En-Consultants, Inc.) - Replace ( within 18") 85', of existing timber jetty on east side of channel to Wunneweta Pond. Proposed bulkhead will be lower in elevation than old and will equal height of outer section which will-remain. Bridge Lane, Cutchogue. Ralph Condit and Heather Tetrault Inspection No. 585 - John Dwyer - Replace (within .18") existing bulkheads on west and north sides of- property. On west side, 87± I.f. and on north 75± I.f. will be- built. These include sections on NW corner which have washed out, • October 27, 1987 - Page 5 _ Approximately 250 c.y. of fill will be trucked in for backfill. NOTE: Application states: Project is emergency as erosion has reached foundation and has-caused it to crack. Bulkhead on N/S is being held up by cable attached to basement of house. Old Mill Road, Mattituck. Margaret Feeney Inspection No. 586 - Manfred E. Kuerner (submitted by Patricia C. Moore) - construct garage and extension to existing residence. Carole Road, Southold. John Holzapfel Inspection No. 587 - Dr. . Veljko J. Krstulovic (submitted by JMO Consulting) - To reconstruct within 18" approximately 174' of timber bulkhead and returns and to backfill said structure with approximately 71 c.y, of clean sand which shall be trucked in from an upland source. South Drive, Mattituck. Betty Wells and Margaret Feeney Inspection No. 588 - Ellen Guiton (submitted by the Land Use Company) - construct 310' of timber retaining wall with a 20' return at either end and to backfill structure with approximately 350 c.y. of clean sand to be trucked in from an upland source. ROW off of Grand Avenue, Mattituck. ** Group Inspection No. 589 - John F. McGillian (submitted by JMO Consulting Corp.) - To repair a Beverly damaged bluff by repairing the stone wall located at the bottom of the bank then by filling the eroded area with trucked in sand and loam (approximately 750 c.y. ) and then revegetate the filled area 'iAth various species of seaside vegetation. Southold Town Hall, Main Road, *Southold. Group inspections are scheduled for 3 : 00 P.M. ,Thursday, November 19 , 1987 . Members will meet at the Southold Town Hall.
