CONSERVATION ADVISORY COUNCIL
TUESDAY, SEPTEMBER 20-, 1988
The Southold Town Conservation Advisory Council met Tuesday,
September 20, 1988 at 4:30 P.M. at the Southold Town Hall,
Main Road, Southold, .New York.
Prior to calling the meeting to order, Chairman Holzapfel and members
met with Councilwoman Ellen Larsen and discussed possible wetland
violations which were discovered during the course of the Council's
regular inspections.
The meeting was called to order at 5:20 P.M. by Chairman John Holzapfel.

REPORTS
Margaret Feeney and Betty Wells attended the Council on Environmental
Quality held August 31, 1988. Margaret reported that those present
were supportive of plans to have Peconic Bay designated a critical environ-
mental area. Also on the agenda was a proposal for the protection
of established fisheries. The proposal was, supported by most and
it was suggested that the shellfish industry fall under the same protection.
Also discussed was the possibility of banning plastic "six-pack" rings
which are causing harm to birds and fowl when their heads get intangled
- in the rings. Most were against the proposal because it did not truly
address the problem. The proposal would require the rings be made
of biodegradable material but would still allow the same configuration
which has been causing the problem.
Betty Wells, who also attended the meeting, stated that she felt the
Southold CAC should stay involved with the CEQ. (Southold CAC is
allowed a vote on issues which are of concern to Southold Town.) It
was decided that John Holzapfel would pass the agenda for the meetings
which are of importance to Southold Town along to the CAC secretary
so she could distribute to members. Since the meetings of the CEQ
are scheduled during the day, CAC members would decide who would
be available to attend.

Daniel Kujawski brought in a ,biodegradable, "plastic bag" which are
used extensively in the New England States. The bags are made of
cornstarch and have the same advantages of a regular plastic bag without
the problems of disposal., The bag costs 30% more than the regular plastic
bag but cost:=20o -less than a regular paper bag. Mr. Kujawski plans to
research the matter further, getting technical information, etc. Once the
CAC has all the information, it would then contact the local grocery stores
and businesses and try to encourage them to use the biodegradable bag.
Heather Tetrault reported on the runoff situation. Each year the Town
budgets for one runoff project. The cur-rent project is at Hobart Road,
Southold. She reported there is a bill before the -County Legislature to
bar the Suffolk County Department of Public Works from using pipes to carry
runoff into waterways. Ms. Tetrault may send letters to the County, State
and Town government asking them to discourage the use of pipes carrying
runoff into waterways.
Heather Tetrault and John Holzapfel reviewed maps obtained by John
Bredemeyer in aiding the Brown Tide Study.

taken care of by state funding.
Daniel Kujawski and Betty Wells received approval by the Town Board to
attend the Annual Conference on the Environment held Upstate New York.
Betty Wells stated she would not be able to attend. Daniel Kujawski will
be going and will have a report for the next CAC meeting.

RESOLVED to recommend approval of the minutes of August 23, 1988.

RECOMMENDATION OF APPLICATIONS
On a motion by Heather Tetrault, seconded by Margaret Feeney, it was
RESOLVED to recommend to the Southold Town Trustees approval of
Wetland Application No. 641 of Laughing Waters Property Owners Association
to reconstruct in kind/in place, approximately 227' of deteriorated timber
bulkhead. An area 3' seaward of said structure shall be dredged to a
depth of 3' at MLW. The resultant spoil, approximately 50 cubic yards of
sand shall be utilized as backfill for the new bulkhead.

On a motion be Daniel Kujawski, seconded by Margaret Feeney, it was
RESOLVED to recommend to the Southold Town Trustees approval with
a stipulation-:of-Wetland: Application No.J 642W. Paul -Ferdenzi to-construct.
a walkway 20' x 4', hinged ramp 12' x 41, and floating dock 16' x 61;
install two 8" piles to secure floating dock. Approval is with the stipulation
that the grass between the lawn--and ,the water be disturbed as little as
possible.

The Council tabled Wetland Application No. 643 of Nicholas Theoharides
to construct a timber dock consisting of an 8' x 8' raised platform with
bench/locker to store gear; steps; 4' x 20' fixed elevated (4' above grade
of marsh) walk; 4' x 16' hinged ramp; 6' x 16' float secured by four 8" J
diameter pilings. Dredge a 30' x 30' area around float and 10' x 140'
channel, all to maximum depth of 4' below MLW to connect to previously
dredged area of: Henry Smith to south. Approximately 200 c.y. of spoil
to be removed by barge mounted crane and off loaded to upland site.
The Council wishes -to,await'j the.-answers to questions posed by the New
York State Department of State before making a recommendation.

On a motion by Daniel Kujawski, seconded by Betty Wells, it was
RESOLVED to recommend to :the Southold Town Trustees approval of Wetland
Application No. 644 of Thomas E. Boyle to repair an existing concrete wall
be reinforcing with rip-rap in front .of and behind existing wall in an
attempt to prevent collapse. Truck in fill from an upland source to place ..
behind existing wall.

RESOLVED to recommend to the Southold Town Trustess approval of
Wetland Application No. 645 of Thomas E. Boyle to construct a rock bulkhead,
approximately 901.

On a motion by John Holzapfel, seconded by Margaret Feeney, it was
RESOLVED to recommend to the Southold Town Trustees approval with a
stipulation of Wetland Application No. 646 of Robert E. Mitchell to construct
a walkway 12' x 41; hinged ramp 12' x 31; and floating dock 16' x 61. Install
two 2-pile dolphins to secure floating dock. The Council recommends
approval with the stipulation that the walkway be elevated 4' above grade
of marsh.

The Council tabled Wetland Application No. 647 of Kenneth Rock to replace
(within 1811) 193 linear feet of existing timber bulkhead.. Remove and
replace (in same location and configuration) 27' and 7' bulkhead section .on
extreme east and west sides. Maintencance dredge basin and channel
(total dimensions 170' x 251) to maximum depth of 4' below MLW. Approximately
300 c.y. of spoil to:be removed by barge to upland site. The Council
needs the response to the questions listed on the DEC sheet.

RESOLVED to recommend to the Southold Town Trustees approval of
Wetland Application No. 648 of Harold Knight to construct a 16' angled bulkhead
return on north side of property and backfill with 7± c.y. of clean loam to be `..;rv,
trucked in from an upland source. Return is needed to prevent further loss
of backfill from existing damaged bulkhead.

On a motion by John Holzapfel, seconded by Betty Wells, it was
RESOLVED to recommend to'.-the Southold Town Trustees approval with
stipulations of Wetland Application No. 649 of Alfred Nadel to approve
completed project. Construct 127± Lf. of timber bulkhead above MHW to
connect to existing akjacent bulkheads 11' from corner of westerly, 6' from corner
of easterly and backfill with 50 c.y. of clean upland fill. Construct timber
pier, 4' x 18' catwalk, minimum of 3' above grade, 4' x 12' hinged ramp,
6' x 16' float anchored by two piles. Approval is with the stipulation that
the catwalk be elevated the standard 4' above grade of marsh and that
runoff from roof and lawn be contained on property (suggest use of dry
wells, etc.)

Wetland.-Application No. 650 of Joseph Policano to clear 75' x 120' of dead
trees and underbrush at Inlet View Estates, Lot 13 was waivered by the
Southold Town Trustees.
On a motion by Heather Tetra.ult, seconded by Daniel Kujawski, it was
RESOLVED to recommend to-the Southold Town Trustees approval with
stipulations Wetland Application No. 658 of Port of Egypt Enterprises, Inc.
to erect a 25,440 square foot boat storage building. The stipulations are:
1 . Use a pervious driveway surface.
2. Suitable drywell system for roof runoff.
3. Add pumpout station.

bulkheads and may be supplemented by 20± c.y. to be trucked

No. 664 - Canning Elliffee - Remove and replace 32 I.f. of existing bulkhead

by 20 ± c.y: to be trucked! in from an upland source.

Group Inspection
No. 665 - Southold Shores Boat Basin, Inc. - Enlarge an existing private non-
commercial mooring facility to allow for 21 slips, one for each home
owner in Southold Shores. This shall include the addition of an
additional 385' of 4' wide float docks as per submitted plans.
Foot of Blue Marlin Drive, Southold.
Group inspection
No. 666 - Arthur J. Bujnowski - Construct a timber groin of approximately
35' in length. Jetty will be of;low profile design. The vertical
elevation of the structure will not exceed the level of MHW, the
most seaward pile shall be at=-a vertical elevation of 3' above MHW.
The compartment between the proposed structure and the one
to the east shall be completely filled with clean sand. Said fill
activity will be perforned periodically to minimize adverse downdrift
effects by supplying sank to the littoral transport system.. -At
the initial time, approximately 60 c.,y. of sand will be placed in
the compartment. The source of said sand will be from a commerical
sand and gravel company.

Betty Wells presented her listing of the different environmental groups to
the Council. . It was suggested that a copy of the CAC's Environmental pamphlet
be sent to each group.

The next regular meeting of the Southold Town Conservation Advisory
Council was scheduled for Tuesday, October 18, 1988 at 4:30 P.M. at the

Group inspections were scheduled for 3:00 P.M. on Tuesday, October 19, 1988.
The group will meet at the Southold Town Hall.
There being no further business to come before the Council, the meeting
