HomeMy WebLinkAboutCAC-11/15/1988 y Town Hall, 53095 Main Road Ln Telephone Dy P.O: Box 1179 (516) 765-1801 Southold, New York 11971 SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL TUESDAY, NOVEMBER 15, 1988 The Southold Town Conservation Advisory Council held a meeting on Tuesday, November 15, 1988 at 4:30 P.M. at the Southold Town Hall, Main Road, Southold, New York 11971 . Present were: John Holzapfel, Chairman Betty Wells, Member Bruce Loucka, Member Daniel Kujawski, Member John Tuthill, Member Heather Tetrault, Member Margaret Feeney, Member Mark McDonald, Water Advisory Committee member Linda Cooper, Secretary The meeting was called to order at 5:00 P.M. by Chairman Holzapfel. Chairman's Announcements Chairman Holzapfel announced that the Southold Town Board had approved the budget submitted by the Southold Town Conservation Advisory Council which included a payment of $7,000 per year for a .part-time environmentalist, who would be the chairman of the CAC. Mr. Holzapfel asked members to give the matter some thought and advise him if anyone on the Council was interested in the position. Guest Speaker Mark McDonald, a member of the Southold Town Water Advisory Committee, appeared before the Council to present the Core Watershed Protection Area report. The report suggested proposed regulations and zoning as a means of protecting the core watershed area. The zoning would impose mandatory clustering and Transfer Development Rights on large, undeveloped properties within the zone. A receiving zone would be created to handle the TDRs. The report was devised as a means of insuring a healthy water supply for the town by controlling development along the largest source of water within the town which runs along the middle of the North Fork. By imposing zoning restrictions and instituting regulations for the area at the water's source, the water supply for the future would be safeguarded. Mr. McDonald asked the Council to study the report and if the Council feels so inclined, to support the report. 11 /15/88 Page 2 Reports John Holzapfel reported that he would be unable to attend the Southold Town Trustees' meeting on Thursday, November 17, 1988. He requested that a CAC member volunteer to attend the meeting as a CAC representative. Margaret Feeney agreed to represent the CAC at that meeting. Heather Tetrault stated she would also try to attend. Heather Tetrault reported that she had completed the work plan for the 1989/90 Fiscal Year State Aid Application. The Council went over the plan and approved the work she had done. The final draft of the plan would be typed up and sent to Sophie Morris of the NYS DEC for her comments before being officially submitted. The.-work,plain: and budget requires the CAC chairman's signature, the Town Supervisor's signature, and a cover letter from the Supervisor to. be officially submitted. Once Ms. Morris deems the budget and work plan acceptable, it can be sent in to the CEQ. : .The CEQ must submit a letter to be sent to the NYSDEC,along with the budget and work plan, commenting on the proposed work plan. All of the papers must be submitted to the NYS DEC's regional office on or before January 16, 1989.- John 989.John Holzapfel suggested to the Council that the newspaper articles which he had written be printed up into a pamphlet form and distributed to the public, in the: same manner as the environmental pamphlets which the CAC developed last year. The articles contained common sense information and suggestions for use by the general public. Many organizations have requested copies for distibution to their membership. By putting the articles into pamphlet form it would greatly facilitate distribution to the public at large. A letter will be sent to the Town Board asking permission to use funds in the CAC budget to print the pamphlets. The Council discussed the tremendous work load it has been facing and agreed to set up two meetings each month to allow more time to be devoted the projects the; Council .wishes to pursue and still allow time to discuss and make recommendations on wetland and;'sub.division applications. One meeting would be devoted entirely to applications and another would involve discussions of environmental problems and projects. Heather Tetrault asked for the Council'',-s:, approval regarding a letter to be sent to the Southold Town Planning Board requesting that procedures used for new major subdivisions be revised to include setting guidelines for construction and setting stipulations regarding the sites ,of:houses on a lot, plantings and environmental considerations recommended, etc. This could streamline the process for the builder/owner and alleviate the need for some variances and wetland applications. The Council approved her letter and recommended it be sent to the Planning Board with copies to go to the Town Board, Trustees, Town Planner, and Town Attorney. Discussion and Recommendations of Wetland Applications On a motion by John Holzapfel, seconded by John Tuthill, it was ' 11 /14/88 Page 3 RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 667 of Robert G. Kassner on behalf of Nunnakoma Waters Association Inc. to dredge channel, approximately 3600 c.y. of material to be hydraulically removed and pumped to adjacent beach as nourishment. Corey Creek, Southold. Southerly end of Wampum Way. Vote of Council: Ayes: All Motion carried. On a motion by John Tuhtill, seconded by Daniel Kujawski, it was RESOLVED to recommend to the Southold Town Trustees approval with stipulations Wetland Application No. 668 of Mattituck Inlet Marina for proposed dock and dredging. The Conservation Advisory Council approves with the stipulation that the proper gradient is maintained to prevent the distruction of the bank and grasses. Also, due to the large number of boats and the popular use of the marina the Council feels the Southold Town Trustees should require a pumpout facility at the marina. Mill Road, Mattituck. Vote of Council:_ Ayes: All Motion carried. On a motion by Margaret Feeney, seconded by John Tuthill, it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 669 of Marie Nerosyan to remove and replace (,in same location and configuration) 23 I.f. of existing timber bulkhead and attach to existing bulkheads to north and south. An 8' return to be constructed ion north side. Replace an-.:existing stairway and 8' x 11'f,fixdd dock with a 4' x 20' walk. Maximum 10 c.y. of spoil to be removed from in front of bulkhead to 3' below MLW and used as backfill. Mesrobian Drive, Laruel. Vote of Council: Ayes: All Motion carried. On a motion by Margaret Feeney, seconded by John Tuthill, it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 670 of George Anderegg;: Jr. to' remove and replace (in same location and configuration) 57 I.f. of existing timber bulkhead and two 4'returns. Backfill with concrete to be brought in. Bulkhead to be removed is second existing bulkhead, first bulkhead will remain. 9045 Nassau Point Road, Cutchogue. Vote of Council: Ayes: All Motion carried. On a motion by John Tuthill, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Applicaiton No. 671 of Daniel C. Mooney to install and maintain three fence posts and 16' of split rail fence. The C6unci,1'CW,i.shes to state, for the record, that it feels that this type of application is not necessary and the applicant should be refunded the application fee. 450 RAbbit Lane, East Marion Vote of Council: Ayes: All Motion carried. (NOTE: Council was informed by Chairman John Holzapfel that Wetland Application No. 671 had been waivered by the Southold Town 7r:.ustees however, the Council wishes to have its recommendation withJcomments remain on the record.) 11/15/88 Page 4 On a motion by John Holzapfel, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Trustees disapproval with recommendations of Wetland Application No. 678 of Geoffrey L. Penny to add a retaining wall around a man-made boat basin and maintenance dredge. The Council recommends disapproval of the retaining wall because no need is shown and the Council has a policy not to recommend retaining walls on protected areas in creeks. The Council does recommend, however, the following: 1 . Two angled returns which area continuation of the existing bulkhead. Returns should be angled to minimize wetland intrusion, and fill behind the returns. 2. Dredge area should not be 4' to MLW. Recommend a gentle slope be established to shoreline. 3. Recommend the applicant keep a 20' to 30' natural buffer zone. Mason Drive, Cutchogue. Vote of Council: Ayes: All Motion carried. Wetland Application No. 640 of Gardiners BayEstates Homeowners Associations, Inc. to maintenance dredge an existing-boat channel (1100' x 201) to a maximum depth of 4' below the plane at MLW continue to be TABLED. Planning Board Application The proposed site plan of Neted of America, Ltd. for Oyster Farm Associates, located on southeast side of Shipyard Lane, East Marion has been placed on hold by the Council. Distribution of New Applications No. 672 - Young's Marina - To extend existing steel bulkhead 45' to prevent further erosion. Dredge approximately 100 c.y. from existing channel (maintenance dredging) - 1670 Sage Blvd., Greenport. Group inspection No. 673 - David C.Creato - Restore pond filled in by runoff and silt from area farms and reduce road flooding. 3539 Cox Neck Road, Mattituck Group inspection 4 No. 674 - William Corwin - Construct an irregular shaped wooden deck on the north and east of the single family dwelling as shown on submitted site plan. (Project shown on plan was recommended by NYSDEC) New Suffolk Avenue, New Suffolk Heather Tetrault inspection No. 675 - Oyster Farm Associates - To dredge, enlarge, and bulkhead existing marine basin. East side foot of Shipyard Lane, East Marion. Previously inspected 11 /15/88 Page 5 No. 676 - Gus Wade- - Install a 65' x 8' (clear) prefabricated steel bridge to span former underwater (now filiedupland) of Trustees. Bridge will be supported by concrete vertical members at each end. Approximately 175 c.y. of clean sand and loam fill will be truckend in and capped with 15 c.y, of gravel to creat sloped "ramps" at each end. Purpose of baridge is to allow access to proposed house of applicant for which permission is also requested. House will be "pedestal" type and.will have associated sanitary system, bluestone driveway, etc. All work to be. as per submitted site plans. End of East Road, Cutchogue. Group inspection No. 677 - Village Marine - Construct an 8' x 40' accessory building within existing parking area for use in equipment storage and services. Building will be located adjacent to existing structure. 175 Bay Avenue, Mattituck Margaret Feeney and. Betty Wells inspection No. 679 - Frederick Krug - Maintenance . dredge indented area 8' x 58' to 4' below MLW. Approximately 18 c.y. will be removed and placed on owner's property. Budds Pond Road, Southold. John Holzapfel inspection No. 680 - Lew Edson - Construct a one family dwelling, sanitary system, deck,bluestone driveway, well as shown on submitted site plan. No additional fill will be required. Cedar Point Drive West, Southold. Group inspection No. 681 - Philip Salice - Add two 6' x 10' extensions to easterly ends of existing floating docks. Extensions' are needed as existing water depths are insufficient to keep boat afloat at all tidal stages. Bayview Avenue, Mattituck. Margaret Feeney inspection - No. 682 - John J. Stack - Construct. a 20' x 50' in ground swimming pool and 60' x 120' tennis court which will be in excess or 100' from small man made pond to west of subject parcel. Nassau Point Road, Cutchogue Heather Tetrault inspection No. 683 - Dr. Frank Sciotto - Construct pool, decks and gazebo as shown on - submitted plan. Waiver requested as all work to be landward of bulkheads. 3350 West Creek Avenue, Cutchogue. Betty Wells inspection No. 684 - J. Trataros - Construct 1 4' x 30' timber catwalk (elevated 4' over existing marsh) , 3' x 16' aluminum ramp, 6' x 20' float and install two 2" x 20' galvanized pipes as mooring poles. Private ROW off Main Road, East Marion. John Tuthill inspection No. 685 - Frank and Sandra Curran - Build pool and deck. 780 Haywaters Road, Cutchogue. Heather Tetrault inspection. 11 /15/88 Page 6 Waiver Requests of Wetland Applications Thomas A. Palmer to build (replace) 53' x 3' catwalk and 16' x 8" float and additional work to. dwelling. Deep Hole Drive, Mattituck James Manos to rebuild stairway leading to dock on Great Pond; rebuild existing deck structure and stairway of ±420 square feet; and replace existing kitchen door and window with sliding patio door. 2147 Lake Drive, Southold. Lloyd K. Chanin to replace deteriorated catwalk and dock (replace with floating dock) . Haywater Cove, Cutchogue. After reviewing the waiver requests listed above, the Southold Town Conservation Advisory Council recommends the requests be granted as submitted. Placement of Dam Pond on list for acquisition The Council discussed the letter to the' NYS DEC from Supervisor Murphy requesting that portions of properties around Dam Pond be placed on the list of possible acquisitions of land under the Environmental Quality Bond Act in Southold Town. The Council fully supports the proposal and would like the Town to know that further efforts along that line would be greatly appreciated. Suggestions for future proposals should include Richmond Creek Set Next Meeting and Inspection Date The next regular meeting of the Southold Town Conservation Advisory Council was scheduled for Tuesday, November 29, 1988 at 4-30 ' P.M. at the Southold Town Hall. The purpose of the meeting is to deal solely with applications and recommendations. Group inspections were scheduled for Tuesday, November 29, 1988. Inspections will begin at 3:00 P.M. Another meeting was scheduled for Monday, December 12, 1988 at 7:00 P.M. The purpose of that meeting would be to discuss projects and in depth environmental problems.
