A meeting of the Southold Town Conservation Advisory Council was held Tuesday, January 24 , 1989 at the Southold Town Hall, Main Road, Southold, New York 11971 . Present were: John Holzapfel, Chairman John Tuthill, Member Betty Wells , Member Daniel Kujawski, Member Margaret Feeney, Member Bruce Loucka, Member Linda Cooper, Secretary The meeting was called to order at 4 : 35 P.M. by Chairman John Holzapfel. He began the meeting by discussing a study the CAC would like to have done to determine the extent of use of plastic bags by local businesses . It was suggested that the Council could contact young men wishing to earn their Eagle Scout Public Service Badge to survey retail stores in the town. Margaret Feeney also suggested that her husband ' s Economics class may be utilized also. Daniel Kujawski would head the study with assistance from Margaret Feeney. The survey would be part of a project to encourage the use of biodegradable "plastic bags" . Betty Wells suggested the Council consider the use of "spin wheels ' to inform the public about the use and disposal of hazard- ous materials found and used around the house. She reported that Supervisor Murphy had recieved a sample of the wheel. Chairman Holzapfel requested that Betty Wells check into the matter further to determine costs , etc. DISCUSSION AND RECOMMENDATION"OF WETLAND APPLICATIONS On a motion by John Tuthill, seconded by Margaret Feeney, it was RESOLVED to recommend to the Southold Town Trustees approval with stipulations of Wetland Application No. 11-88-104-13-5 of Enconsultants , Inc. for Kenneth and Christine Rathgeber to remove and replace ( in same locations and configuration ) 211± l. f. of retaining wall which is to connect to existing walls to north and south. The figure includes sections around exist- ing concrete block "bath house" which is being undermined. 1/24/89 Page 2 Approximately 1 , 490 c.y, of clean sand and loam to be trucked in from an upland source to be used as backfill and rehabili- tation of existing eroded slope. Following grading, slope is to be planted with such species as Rosa rugosa, bayberry, beachgrass , etc, to stabilize. The Council approves with the stipulation that applicant put the retaining wall in line with the neighbors ' , install drywells to contain roof run- off, and suggest , if necessary, terrace the sloping area. Nassau Point road, Cutchogue. Vote of Council: Ayes: All Motion carried. On a motion by John Tuthill, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Trustees approval with stipulations of Wetland Application No. 11-88-104-8-1 . 1 of Connie Cross for Environmentals Nursery to install two 10 ' x 30 ' bermed areas, with natural rock outcroppings and appropriate plantings at entrance to Nassau Point . Teh Council approves with the stipulation that the applicant limit the height of the berm to no higher than 2 ' .' Nassau Point Road, causeway area, at Nassau Point property line, Cutchogue. Vote of Council: Ayes : All Motion carried. On a motion by John Holzapfel, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 11-88-136-1-41/42 of James E. Fitzgerald Jr. for Ira Wechterman to construct a wood deck attached to the house extending to line of retaining wall; construct walkway 34 ' x 3 ' , hinged ramp 12 ' x 3 ' , and floating dock 12 ' x 41 ; install two piles: to••sec.ure_ floating dock. 630 Oak Street , Cutchogue. Vote of Council: - Ayes: All Motion carried. On a motion byJohn Holzapfel, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Trustees approval with a stipulation of Wetland Applicaiton No. 680 of En- Consultants , Inc. for Lew Edson to construct a one-family dwelling, sanitary system, deck, bluestone driveway, and well, as shown on submitted plans . (No additional fill to be required. ) The Council approves with the stipulation that no clearing be done within 50 ' of the water e.,;cept for a footpath to allow the owner access to the water. Cedar Point Drive West , Southold. Vote of Council: Ayes: All Motion carried. 1/24/89 Page 3 DISTRIBUTION OF NEW APPLICATIONS No. 11-88-78-2-42 of Joseph J. Verwayen to construct a private boat dock consisting of fixed ele--ated ( 3 ' above grade of marsh) catwalk, hinged ramp and two floats secured by pilings . 2750 Glenn Road, Southold. John Holzapfel inspection No. 11-88-113-6-11 of Enconsultants , Inc. for Gerald Wood to construct a timber dock consisting of a 4 ' x 104 ' fixed elevated (minimum 3 .5 ' ) walk with outer 5 ' x 36 ' "L" to west . Imi ler end of dock will be approximately in line with two existing timber pilings and 15 ' west of them. Proposed dock will extend a distance equal to existing adjacent dock to east . Holbrook Lane, Mattituck Margaret Feeney inspection. No. 1-'1-89-127-68 of John and Eleanor Bastone to construct a floating dock and landing. 1810 N. Oakwood Road, Laurel. Margaret Feeney inspection. No. 10-88-123-4-5 of Thomas Palmer to build (replace ) 53 ' x 3 ' catwalk and 16 ' x 8 ' float and additional work to dwelling consist- ing of 12 ' k';37 ' wood deck to rear of dwelling, 8 ' x 37 ' extension and 11 ' x 22 ' garage to front of dwelling and ,move existing 8.4 ' x 8.4 ' shed to west side of lot further from HWM. SET NEXT MEETING DATE The next regular meeting of the Southold Town Conservation Council was scheduled for Thursday, February 16 , 1989 at13 : 30 P.M. at the Southold Town Hall, Main Road, Southold, New York. Since there were no group inspections scheduled, the Council did not set up a time and date for group inspections . GENERAL DISCUSSIONS Chairman Holzapfel discussed the budget and State Aid application with the members. Ifuthe=-State'_application is approved, vouchers will haver�to be submitted for ,reimbursement . The Council suggested that the paid position which the Town Board approved should include being responsible for submitting the vouchers. John Holzapfel will check with the Supervisor or Town Board for a redefinition of the position which the CAC had entered into its budget . Chairman Holzapfel intends to check with the Suffolk County Department of Health Services to ascertain how the new Italian restaurant located on the bay was able to install a cesspool 1/24/89 Page 4 which is virtually in the water. Mr. Holzapfel also intends to check with the Town assessors to determine if docks and bulkheads are being assessed. Since the structures can improve the value of a piece of property by thousands of dollars, it is felt that some of the property tax burden should be shared by the structures . Margaret Feeney stated that New York State law provides for the assessment of this type of structure -on private property. John Holzapfel had checked with several towns and found that most west end towns and Riverhead assess the.--structures . Chairman Holzapfel suggested the Council pursue the road runoff problem. Since many recent studies have determined that road runoff has been a major contributor to water pollution, more should be done by the town to alleviate the problem. The biggest stumbling block was lack of funds. John Holzapfel would like to see a referendum of some sort to finance the repairs. He was advised that an engineer would have to do a study to deter- mine the cost for the repairs . Also to be checked into is the availibilty of funds to use in the clean up. He asked members to think about how to approach the problem and to obtain the funding: Margaret Feeney reported she had been in contact with Steve Sanford of the NYSDEC regarding the freshwater wetland maps . Although the target date for the maps was October 1988 , the project has run into some problems and the State cannot give any target dateat this point . Since Daniel Kujawski had attended the course for understanding aerial maps , it was decided that he would review the towns ' s aerial maps to determine whether any new freshwater areas could be located for inclusion .in the state ' s list Discussion moved into the CAC ' s role with the Zoning Board of Appeals and the Planning Board. Although a letter was sent to the ZBA to advise it that the CAC would be available, that Board has not requested the services of the Council. Since the juridiction of the Sound has been removed from the Town Trustees and nplaced solely under the ZBA, the Council assumed the ZBA would require recommendations and opinions from the Council. It was decided that Margaret Feeney would act as liason between the CAC and ZBA, receiving the minutes and agendas to determine if any environmentally sensitive issues are before that board. Along the same lines, Bruce Loucka would concentrate on actions before the Planning Board of Appeals and will advise the Council of any sensitve applications before that Board. Chairman Holzapfel shared infugmation concerning the problem of inground oil tanks and the possibilities of leakage. He will study the subject further and report back to the Council. John Tuthill suggested the Council,-request the Town Board appoint a farmer to the position on the Council which was recently vacated by Heather Tetrault . Members felt that they were not in a position to make recommendations to the Town Board about the 1/24/89 Page 5 replacement , but suggested Mr. Tuthill urge any interested farmers to apply. Mr. Tuthill brought up the subject of the Core Watershed Protection Area study being done by the Water Advisory Committee. He stated that Transfer Development Rights concept should not be considered unless they are bonded in such a way that the holder of a TDR would be guarenteed just compensation for his development rights. Also, he suggested that the TDR folder be protected against any loss of value for the TDR due to any up- zoning which could occur in the Town. He suggested that both of the matters should be addressed by the Water Advisory Council before proceeding any further. . Chairman Holzapfel discussed the Marine Bay Club progress with the Council. Although he represented only himself at a recent meeting concerning the Marina Bay Club, several newspapers identified him as a member of the CAC . Heoadvised the Council that he had brought up three major concerns at the meeting: 1. Desalinization and the problems which coucl arise from heavy saltwater settling in the bottom of the bay in that area. 2 . The applicants would like to move the dock out approximately 150 ' into the bay. The section to be involved is an excellent scalloping area. 3 . Blots used as- houseboats Before adjourning, John Holzapfel-,gave a brief list of projects and tasks the Council would be undertaking before the next meeting. Among those already discussed, he also mentioned that Betty Wells was to compose a letter to send to the groups she had listed for an earlier project . Also she would be checking with the pump-out committee and reporting back to the Council any progress being made.
