Box 1179 TELEPHONESouthold, New York 11971 .(516)765-1801 SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL TUESDAY, JUNE 13, 1989 A meeting of the Southold Town conservation Advisory council was held Tuesday, June 13, 1989 at the Southold Town Hall, Main Road, Southold, New York. Present were: John Holzapfel, Chairman . Daniel Kujawski, Member , MargaretcFeeney, Member Stephen Angell, Member Bruce Loucka, Member John Tuthill, Member Betty Wells, Member Linda Cooper, Secretary The meeting was called to order at 5:05 P.M. by Chairman John Holzapfel. RECOMMENDATION OF WETLAND APPLICATIONS No. 728 On a motion by John Holzapfel, seconded by Daniel Kujawski, it was REOSLVED to recommend to the -Southold .Town Trustees APPROVAL WITH STIPULATIONS of Wetland Application No. 5-14-89-118-2-11.2 submitted by the Lagoon Association to maintenance dredge bulkhead to the lagoon to continue free. tidal flowand safe passage- for small boats . Spoil to be placed north of inlet to 'provide beach nourishment . The CAC approves the dredging however., itquestions the necessity or reasonableness of the excavation which could create problems with the downdrift . Lagoon at Nassau Point , Cutchogue. Vote of Council: Ayes: All Motion carried. N6. 729 On a motion by Bruce Loucka, seconded by John Tuthill, it was RESOLVED to recommend to the Southold Town Trustees APPROVAL .of Wetland- Apglicat!on No 5-9-89-90_4=14­submitted by Joseph Spitaliere to--'construct- a 4 ' - x 30.1 catwalk- (elevated 4 ' over IM) ; a 3 ' x 8 ' ramp; and 6 ' x 20 ' float . Orchard Lane, Southold. Vote of Council: Ayes : All Motion carried. Page 2 No. 730 On a motion by Bruce Loucka, seconded by John Tuthill, it was RESOLVED to recommend to the Southold Town Trustees APPROVAL of Wetland Application No. 5-10-89-90-4-19 submitted by Joseph Spitaliere to construct a 4 ' x 60 ' catwalk (elevated 4 ' over existing marsh) ; 3 ' x 8 ' ramp; and 6 ' x 20 ' float . Orchard Lane, Southold. Vote of Council: Ayes: All Motion carried. No. 731 On a motion by Daniel Kujawski, seconded by Bruce Loucka, it was RESOLVVED to recommend to the Southold Town Trustees DISAPPROVAL of Wetland Application No. 5-13-89-57-1-33 submitted by Barbara Burke to 120 ' retaining wall above SHW and attached corners of adjacent retaing walls; approximately 200 c.y. of clean fill to be trucked in for backfill. The CAC recommends disapproval because no need is shown; there is no evidence of erosion; and there is thriving vegetation. 1150 Blue Marlin Drive, Southold. Vote of Council: Ayes : All Motion carried. No. 732 On a motion by Stephen Angell, seconded by Daniel Kujawski, it was RESOLVED to recommend to the Southold Town Trustees DISAPPROVAL of Wetland Application No. 5-11-89-35-8-5 .3 submitted by Peter Fakiris to maintenance dredge a 90 ' x 100 ' docking area to 8 ' at MLW; resultant spoil (approximately 675 c.y. ) to be disposed of on applicant ' s upland property. The CAC recommends disapproval because the dredging would have a defilious effect on the clams and bottom organisms and no need is shown . The project would be creating a "pothole" effect on the bottom. ROW off Shipyard Lane, East Marion. Vote of Council: Ayes : All Motion carried. No. 733 On a motion by Stephen Angell, seconded by Margaret Feeney, it was RESOLVED to recommend to the Southold Town Trustees APPROVAL WITH CONDITIONS of Wetland Application No. 5-2-89-56-6-7 submitted by Armando Cappa to install floating docks for six ( 6 ) boats to be used for restaurant patron docking ( seasonal only) . The CAC recommends approval with the condition the applicant adjust the plans to reflect that the project will stay in line with others and not be out in the dredged channel. The CAC would also like to suggest the applicant not put in grass to the edge of the bulkhead, the council suggests the applicant plant natyural vegetation. This would be a perfect opportunity to show the public what should be done in a bulkheaded area. Old Main Road, Southold. r Page 3 Vote of Council: Ayes : All Motion carried. No. 734 On a motion by Stephen Angell, seconded by John Tuthill, it was RESOLVED to recommend to the Southold Town Trustees APPROVAL of Wetland Application No. 5-12-89-139-10-25 submitted by Ali Agarabi to install a new catwalk, ramp and dock. 365 West View Drive, Mattituck. Vote of Council: Ayes : All Motion carried. No. 735 On a motion by Margaret Feeney, seconded by Stephen Angell, it was RESOLVED to recommend to the Southold Town Trustees APPROVAL of Wetland Application No. 5-8-89-123-8-24 . 1 submitted by Frederick A. Ross to construct a 100 ' x 4 ' fixed dock. The CAC recommends .APPROVAL WITH THE STIPULATIONS that the dock go out no further than the neighboring docks and not the proposed 100 ' ; also the catwalk should be elevated 4 ' above the grade of the marsh. Bungalow Lane , Mattituck, Vote of Council: Ayes : All Motion carried. No. 736 On a motion by Margaret Feeney, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Trustees APPROVAL of Wetland Application No. 5-71-2-11. 1 submitted by James Campbell to construct and place at a bulkheaded mooring lot a 6 ' x 20 ' float and 3 ' x 10 ' ramp for use by small pleasure boat . 350 Harbor Lights Drive, Southold. Vote of Council: Ayes : All Motion carried. No. 737 On a motion by Daniel Kujawski, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Trustees APPROVAL of Wetland Application No. 5-6-89-70-13-20 . 1 submitted by Douglas Rose to build and float an attached dock to existing piles and residential bulkhead. (4 ' x 10 landing; 3' x 12 ' ramp; 6 ' x 20 ' float ) . Kimberly Lane, Southold. Vote of Council: Ayes : All Motion carried. No. 738 On a motion by John Tuthill, seconded by Daniel Kujawski, it was RESOLVED to recommend to the Southold Town Trustees APPROVAL of Wetland Application No. 6-1-89-35-5-33 submitted by Rhoda Weston to add a 4 ' x 5 ' platform; a 3 ' x 10 ' ramps; and 6 ' x 20 ' float .e Page 4 to an existing bulkhead. 450 Snug Harbor Road, Greenport . Vote of Council: Ayes : All Motion carried. No. 439 The Council did not have an opportunity to inspect Wetland Appllication No. 6-2-89-7-5-4 . 1 submitted by Mrs . George de Menil to renovate an existing garage/apartment by constructing 800 s .f, wood frame addition on sono tube piers . No excavation to be done except for piers . Fishers Island, New York. No. 740 The Council did not have an opportunity to inspect Wetland Application No. 6-3-89-3-7-5 submitted by Mrs . W. G. Rafferty to renovate existing garage/apartment and construct 400 s .f, addition. No excavation except piers and new septic system. Middle Farms Pond, Fishers Island. TABLED AT MAY MEETING No. 718 Wetland Application No. 4-9-89-78-4-15 of John O'Hagan to construct a private single dock, catwalk and mooring. The CAC will still continue to TABLE the applications until it receives clarification regarding the ownership of land. Foot of Corey Creek Lane, Southold. No. 719 On a motion by Margaret Feeney, seconded by Stephen Angell it was RESOLVED to recommend to the Southold 'Town Trustees DISAPPROVAL of Wetland Application No. 4-13-89-56-6-11 of William Geraghty to fill and grade approximately 9000c.y. fo clean fill to complete filling of parcels to LIRR embandment . The CAC has determined the area contains marsh and applicant proposes to fill the marsh area. Main Road, Southold Vote of Council: Ayes : Margaret Feeney, Stephen Angell, John Holzapfel, Daniel Kujawski, Burce Loucka, Betty Wells Nays: John Tuthill - Feels the disapproval is "a wasate of time, won't do anybody any good to disapprove" . Motion carried. Page 5 Since the meeting started late and due to the number of applications which had to be discussed it was decided that the CAC would hold a special meeting to cover items on the agenda which the Council did not have an opportunity to discuss. NEST MEETING DATE The next meeting of the CAC was scheduled for June 20, 1989 at 4 : 30 P.M. at the Southold Town Hall. The meeting was adjourned at 6 :35 P.M.
