Box 1179 a Telephone Oy Southold, New York 11971 (516) 765-1801 S.OUTHOLD TOWN (CONSERVATION ADVISORY COUNCIL MAY 20, 1993 A meeting of the Southold Town Conservation Advisory Council was held Thursday, May 20, 1993 at 4:00 P.M. in the Conference Room at Southold Town Hall, Main Road, Southold. Present were: John Holzapfel, Chairman Bruce Loucka, Member Stephen Angell, Member Betty Wells, Member John Hagerty, Member Pat Isaksen, Member Linda Cooper, Secretary Absent was: Robert Keith, Member The meeting' was called to order by Chairman John Holzapfel. REPORTS Bruce Loucka gave a brief report of the April meeting of the Board of Trustees. As a result of his report, it was decided that Mr. Loucka would again request that the Trustees not make assessments until they have received comments from the CAC. RECOMMENDATION OF WETLAND APPLICATIONS Moved by Bruce Loucka, seconded by Betty Wells, it was RESOLVED to recommend to the Southold Town Trustees APPROVAL of Wetland Application of GEORGE BRAUN 53-4-11 to rebuild storm damaged lawn retaining wall (approximately 3' high) and move the wall approximately 6' out to be in line with neighboring property walls. 2005 Bayshore Road, Greenport. Vote of Council: Ayes: All Motion carried. 5/20/93 Page 2 Moved by Bruce Loucka, seconded by Betty Wells, it was RESOLVED to recommend to the Southold Town Trustees APPROVAL of Wetland Application of RICHARD MAUTER 53-4-12 to rebuild storm damaged Fawn retaining wall (approximately 3' high) and move wall to match existing wall of adjacent neighbors. 2055 Bayshore Road, Greenport Vote of Council: Ayes: All Motion carried. Moved by John Holzapfel, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Trustees APPROVAL of the Wetland Application of NUNAKOMA WATERS ASSOCIATIONS, 'INC. 87-2-40.1 8 40.2 to.construct a timber retaining wall 170 +/- I.f. overall (including returns) generally at or above line of apparent high water and backfill with 170 +/- c.y. of clean sand .to be trucked in from upland source. Wall is necessary to prevent further loss of land and protect road lying close to eroded bank which provides access to marina and beach for members of the association. Existing docks will be unusable due to loss of fill and shoaling of dockage area. Wampum Way, Southold Vote of Council: Ayes: All Motion carried. Moved by Stephen Angell, seconded by John Holzapfel— it was RESOLVED to recommend to the Southold Town Trustees DISAPPROVAL of JOHN S. DOROSKI, JR. 32-1-3 to construct a new single family dwelling with sanitary system and driveway. The Council recommends disapproval because the cesspool system would be a contaminant to the pond; the house is too close to the pond area; 'and human activity would have a detrimental effect on the pond area. In the opinion of .the CAC a Type I action is indicated. Madison Avenue, Greenport Vote of Council: Ayes: All Motion carried. The Wetland Application of CLEAVES POINT VILLAGE 38-7-4.2 & 8 and .38.2-1-45 to modify an existing dock consisting of a fixed pier, hinged ramp, floating docks; floating wave curtain. Proposed dock to retain existing 9' 6" fixed inner section; and will extend existing 6' x 90'6" fixed pier to 6' x' 235' with an outer "L" of 6' x 32'. The overall length of the proposed fixed pier is equal to the length of the present fixed pier, ramp, float and floating wave curtain. A tongue a groove wave curtain will be attached to center of fixed pier (MLW). A new 6' x 8' fixed platform to be added to the west side of fixed pier and the existing g3' x 14' ramp and (6) 6' x 20' floating docks placed at various distances west of fixed pier; (5) pilings to be placed 20' east of fixed pier to create slips. Additional pilings will be needed for fixed pier and floats. 5/20/93 Page 3 Purpose of project is to create a more secure dockage for boats of condo owners. The CAC TABLED_ the application. 'The applicant appears to be adding new slips, if so, is the applicant creating a marina and wouldn't the applicant need to apply for a Change of Zone to allow a marina? The Council cannot make• a recommendation without these questions being resolved. 2820 Shipyard Lane, East Marion Moved by Stephen Angell, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Trustees DISAPPROVAL of the Wetland Application of FRANCIS McLAUGHLIN 94-1-3 to construct approximately 100' of timber bulkhead with a 20' return at its eastern end. Structure to then be backfilled with approximately 350 c.y. of clean sand which shall be trucked in from an upland source. Applicant also proposed to reconstruct stairs and landings which, along with the bluff, had been damaged during the past winter storms. The Council recommends disapproval of the bulkhead because the house is not in jeopardy therefore the bulkhead is not warranted; there is no policy for bulkheading along the Long Island Sound and although there is no established policy the long range effects of bulkheading along the Sound must be considered. The Council approves the stairs and landing. 505 Soundview Avenue, Mattituck Vote of Council: Ayes: All Motion carried. Moved by Stephen Angell, seconded by Patricia Isaksen, it was. RESOLVED to recommend to the Southold Town Trustees APPROVAL WITH CONDITIONS of the Wetland Application of WILLIAM EDGETT 115-12-3 to construct 4' x 40' catwalk (elevated 4' over grade of marsh), 3' x 12' ramp and 5' x 16' float. The CAC approves provided the catwalk is elevated 4' above the grade of marsh as stated in the project description and not 4' above low water as shown on the plans. 200 Deep Hole Creek Drive, Mattituck Vote of Council: Ayes: All Motion carried. Moved by Stephen Angell, seconded by John Holzapfel, it was RESOLVED to recommend to the Southold Town Trustees DISAPPROVAL of the Wetland Application of SHELDON SALZMAN 71-1-5 to construct approximately 104' of timber bulkheading with a 20' return at each end and to backfill structure with approximately 100 c.y. of clean sand which shall be trucked in from an upland source. The Council recommends disapproval because no need is indicated; the bulkhead would be a detriment to the environment; the beach is adequate; and the are no other bulkheads in the area. Moved by Bruce Loucka, seconded by John Hagerty, it was RESOLVED to recommend to the Southold Town Trustees APPROVAL of the Wetland Application of ARTHUR TORN 52-2-22 to reconstruct an existing stairway which consists of a 3.25' x 3.25' landing, 3' x 12' stairs, 6' x 5.5' landing and 3' x 11 .5' stairs. New stairway shall be reconstructed 'in same dimensions except existing 6' x 5.5' landing shall be enlarged to 6' x 81. Applicant also proposes to construct a 4' x 24' catwalk (elevated 4' above grade), 3' x 12' ramp, 5' x 16' float and to install two 2 pile dolphins. - Ruch Lane, Southold. Vote of Council: Ayes: All Motion carried. Moved by Stephen Angell, seconded by John Holzapfel, it was RESOLVED to recommend to the Southold Town Trustees DISAPPROVAL of the Wetland Application of STRONG'S MARINA 122-9-6.2 to construct new bulkhead, dredge in front of new bulkhead, backfill behind new bulkhead and grade parking away from bulkhead. The Council recommends disapproval because no need was demonstrated for the bulkhead and, in fact, proposed project would eliminate a potentially important marshland area which is already developing. The CAC suggests the road runoff be contained on the property. This would eliminate the erosion and alleviate the need for dredging and bulkheading. Camp Mineola Road, Mattituck Vote of Council: Ayes: All Motion carried. Moved by John Holzapfel, seconded by Patricia Isaksen, it was RESOLVED to recommend to the Southold Town Trustees APPROVAL of the Wetland Application of SANDRA ZATARAIN 31-16-8 to reconstruct deck and home within the existing foot print of same. Add wave attenuation gabion revetment within the foot print of the existing deck. Bay Avenue, East Marion Vote of Council: Ayes: All Motion carried. Moved by Stephen Angell, seconded by, Bruce Loucka, it,was RESOLVED to recommend to the Southold Town Trustees DISAPPROVAL of the Waiver Request of ROBERT AND DEBORAH CELIC 123-8-29 to raise the house to the required tidal flood plain elevation for the V-4 zone, elevation 81MSL. The existing house and decks will be raised and placed on a pile foundation. 5/20/93 Page 5 The Council recommends that the Trustees require that the applicant go through the full wetland application process, showing the septic system, well, etc. Park Avenue Extension, Mattituck Vote of Council: Ayes: John Holzapfel, Stephen Angell, Bruce Loucka, John Hagerty, Betty Wells Abstain: Patricia Isaksen Motion carried. Moved by John Holzapfel, seconded by Bruce Loucka, it was. RESOLVED to recommend to the Southold Town Trustees DISAPPROVAL of the Wetland Application of GEORGE BUCKLEY 71-1-8 to replace erosion on embankment due to 100 year storm in December. The CAC recommends disapproval because .no need is shown. 255 North Parish Drive, Southold Vote of Council: Ayes: All Motion carried. Moved by Patricia Isaksen, seconded by Stephen Angell, it was RESOLVED to recommend to the Southold Town Trustees APPROVAL WITH STIPULATION of the Wetland Application of SCHUYLER BERGEN 119-1-2 to repair/replace as necessary 100+/- I.f. of timber bulkhead and 3' wide stairway. Approximately 200 c.y. of clean sand will be trucked in from upland source via Anderegg parcel for backfill. All bulkhead repairs will be in kind and place. The Council recommends approval provided all work in in kind and in place and not placed in front of existing bulkhead. 9525 Nassau Point Road, Cutchogue Vote of Council: Ayes: All Motion carried Moved by Patricia Isaksen, seconded by Stephen Angell, it was RESOLVED to recommend to the Southold Town Trustees APPROVAL WITH STIPULATION of Wetland Application of MARIAN ALES 119-1-20 to repair/replaces needed a total of 106 +/- I.f. of timber bulkhead and 3' wide stairway from top of bluff to beach. Approximately 200 c.y. of clean sand will be trucked in form upland source via Anderegg parcel for backfill. All bulkhead repairs will be in kind and place. The CAC recommends approval provided all work is in kind and in place and not placed in front of the existing bulkhead. 8925 Nassau Point Road, Cutchogue Vote of Council: Ayes: All Motion carried. Moved by Patricia Isaksen, seconded by Stephen Angell, it was RESOLVED to recommend to the Southold Town Trustees APPROVAL WITH STIPULATION of Wetland Application of ARISTEDES SPERES 119-1-76 to remove and replace (in same location and configuration) 5/20/93 Page 6 100 I.f. of existing timber bulkhead' and backfill with 200 of clean sand to be trucked in from an upland source via Anderegg parcel. Replace 3' wide stairway. The CAC recommends approval provided the work is done in kind and in place and not placed in front of the existing bulkhead. Moved by Patricia Isaksen, seconded by Stephen Angell, it was RESOLVED to recommend to the Southold Town Trustees APPROVAL WITH STIPULATION of Wetland Application of JOSEPH MANDELBAUM 119-1-75 to remove and replace (in same location and configuration) 92 +/- I.f. of existing timber bulkhead and backfill with 200 +/- c.y. of clean sand to be trucked in from upland source via Anderegg parcel. Replace 3' wide stairway form top of bluff to beach. The CAC recommends approval provided the work is done in kind and in place and not placed in front of the existing bulkhead. Moved by Patricia Isaksen, seconded by John Holzapfel, it was RESOLVED to recommend to the Southold Town Trustees APPROVAL of Wetland Application of THOMAS P. LOSES, SR. 118-4-2 to remove and replace (in same location and configuration) 100 I.f. of retaining wall and 3' wide stairway. Approximately 200 c.y. of clean fill will be trucking in from areas upland. 7425 Nassau Point Road, Cutchogue Vote of Council: Ayes: All Motion carried. Moved by Patricia Isaksen, seconded by John Holzapfel, it was RESOLVED to recommend to the Southold Town Trustees APPROVAL of the Wetland Application of JOHN TOBIN 118-4-3 to remove and replace (in same location and configuration) 100 I.f. of retaining wall and 3' wide stairway. Approximately 200 c.y. of clean fill will be trucked in from areas upland. 7525 Nassau Point Road, Cutchogue Vote of Council: Ayes: All Motion carried. Moved by Stephen Angell, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Trustees DISAPPROVAL of the Wetland Application of VIRGINIA MEYRAN 99-3-1 to construct 106 I.f. of timber retaining wall plus 20' return on west side. On east side, wall will connect to adjacent bulkhead. Approximately 375 c.y. of clean sand will be trucked in ti b 5/20/93 Page 7 via Bailie Beach Road to west. A 3' wide stairway from west of bluff to beach will be repaired/replaced as appropriate. The Council recommends disapproval because the retaining wall/bulkhead is not warranted. Also there is no established policy concerning the bulkheading of property along the Long Island Sound, the long range effect on the Sound must be considered. The Council approves the repair of the stairs. 175 Soundview Avenue, Mattituck Vote of Council: Ayes: All Motion carried. SET NEXT MEETING AND INSPECTION DATES The next meeting of the Southold Town Conservation Advisory Council was scheduled for Thursday, June 17, 1993 at 4:00 P.M. in the Conference Room at Southold Town Hall, Main Road, Southold. Group inspections were scheduled for the same date, Thursday, June 17, 1993. Members will meet in the lobby of Southold Town Hall at 3:00 P.M.
