CONSERVATION ADVISORY COUNCIL
JULY 22, 1993
A meeting of the Southold Town Conservation Advisory Council
was held Thursday, July 22, 1993 at 4:00 P.M. in the Conference
Room at Southold Town Hall, Main Road, Southold, New York.
Present were: John Holzapfel, Chairman

Absent was: Patricia Isaksen
Guest: Thomas Samuels
The meeting was called to order by Chairman John Holzapfel.
Mr. Samuels was introduced to the members. He spoke to the Council
about placement of structures, especially along the Sound. The
Council was assured by Mr. Samuels that he would be available for
advise whenever needed.
REPORTS
Reports were dispensed with due to lack of time.
RECOMMENDATION OF WETLAND APPLICATIONS
(Bruce Loucka had to leave at 5:30 P.M. )
Moved by John Holzapfel, seconded by Robert Keith, it was
RESOLVED to recommend to the Southold Town Trustees APPROVAL
WITH STIPULATIONS of Wetland Application of MATTHEW
McKIERNAN 86-5-11.5 to construct a 1 112 story residence. All
material is to be redistributed on property to establish proper
grade. Construct a 4' x 50' catwalk over marshland (to be minimum
3' over reeds in meadow) and install post to secure small boat.

The Council recommends approval provided the house is located at
least 75' from the wetlands. ' The Council recommends approval of the "
dock provided it does not hinder navigation.

Motion carried.
Moved by John Holzapfel, seconded by John Hagerty, it was
RESOLVED to recommend to the Southold Town Trustees APPROVAL
of the Wetland Application of PAUL RACANO 63-7-35 to construct a
timber dock consisting of a 4' x 72' fixed, elevated (4' over grade
of marsh) walk; 3' x 16' hinged ramp; 6! x 10' float with 6' x 30'
outer float arranged in "T" configuration. A 4' wide x 60' +/- path
to be cut through brush on slope leading to dock and surfaced with
wood chips.

Motion carried.
Moved by Stephen Angell, seconded by Robert Keith, it was
RESOLVED to recommend to the Southold Town Trustees APPROVAL
WITH STIPULATIONS of the Wetland Application of JAMES AND
CAROL CASSEL 56-5-40 to construct a single family dwelling,
associated sanitary system, gravel drive, decking, to truck in
approximately 750 c.y. of clean fill for grading and sanitary
system. Permanent natural buffer zone shall 'also be maintained all
in accordance with submitted plans.
The Council recommends approval provided the house is moved
landward 10' to allow a larger buffer zone.

Moved by John Holzapfel, seconded by Betty Wells, it was
RESOLVED to recommend to the Southold Town Trustees APPROVAL
of the Wetland Application of ONNIK ARSLANYAN 44-2-17 to replace
storm damaged bulkhead.

Moved by Robert Keith, seconded by Stephen Angel, it was
RESOLVED to .recommend to the Southold Town Trustees APPROVAL
of the Wetland Application of KENNETH RATHGEBER 104-13-5 to
construct approximately 160 I.f. of- timber retaining wall plus (2)
15' returns-. Wall to be approximately 8" back of face of existing
bulkhead which will be trucked in from upland and delivered over
bank. To will then be planted with Rosa rugosa, bayberry,
sw:itchgrass, etc. Purpose of project- is to restore bank which was
eroded by waves which overtopped bulkhead during 12/11/92 storm.

Moved by John Holzapfel, seconded by Stephen- Angell, it was
RESOLVED to recommend to the Southold Town Trustees
DISAPPROVAL of the Wetland Application of ANTHONY SCARMATO
31-16-9 to replace (within 48") 124 I.f. of timber retaining wall.
Repair in place 73 I.f. of easterly return. Approximately '100 c.y.
of clean fill to be trucked in from upland source. Construct a 4' x
4' platform, 4' wide "Steps ' from proposed retaining wall to beach.
Distance between new and " old retaining wall is necessitated by
presence of improvements such as fish pond located close behind
existing wall which will 'not allow tie back system to extend very far
landward. To compensate, new wall. will be 4' out so a 10' tie rod
and deadman system can be utilized to afford adequate lateral
stability.
The Council strongly recommend disapproval because the applicant is
proposing to take 4' of beach; there is a strong chance the beach
would be destroyed; and would create . "pockets" along the side of
structure. The Council suggests replacement be in kind/in place or
within 18".

Moved by Robert Keith, seconded by Stephen Angell, it was
RESOLVED to recommend to the Southold Town Trustees APPROVAL
WITH STIPULATIONS the Wetland Application of PAUL J. CAREY
123-8-27 to rebuild existing dock.
The Council recommends approval provided the structure is raised 4'
above the marsh.

Moved by John Holzapfel, seconded by Stephen Angell, it was
RESOLVED to TABLE the Wetland Application of ROBERT JOHNSEN
68-4-3.3 & 3.4 to build a house.
The Council has tabled the application until an inspection can be
made with the house and building envelope staked.

RESOLVED to recommend , to the Southold , Town Trustees
DISAPPROVAL of the Wetland . Application of EUGENE BURGER
104-3-4 to construct 'a timber dock consisting of a 4' x 40' fixed .

16{ hinged ramp; 6 x 16 float secured by two pilings. Place
approximately 10 c.y. of sand and grade into a berm approximately 3'
wide at the base and 1 .5' high to extend the width of the parcel (68
+/- '), above AHW and wetlands. Following grading, berm will be
planted with Ammorphilia breviligulata on 18" centers. Purpose of
berm is to prevent occasional flooding of upland as occurred during
12/92 and 3/93.
The Council recommends disapproval of the berm because it could
destroy the existing marsh. The Council recommends approval of
the dock.

RESOLVED to recommend to the Southold Town Trustees APPROVAL
WITH STIPULATIONS of the Wetland Application of DONALD, AND
LORNA TUTHILL 53-3-28 to seek approval of a building envelope for
a single family dwelling.
The Council recommends approval provided the house is move 10'
nearer the road to keep it out of the 75' buffer.

Moved by John Holzapfel, seconded by John Hagerty, it .was
RESOLVED to recommend to the Southold Town Trustees APPROVAL
of the Wetland Application of NINA S. FISCHER 86-7-8 request
GRANDFATHER PERMIT for approximately 110' of' bulkhead and stairs.

Vote of Council: Ayes: All

Moved by John Holzapfel, seconded by John Hagerty, it was
RESOLVED to recommend to the Southold Town Trustees APPROVAL
of the Wetland Application of DR. ROBERT I. KAPLAN 92-1-7 to
remove damaged sheathing from lower level bulkhead and add new
bulkhead system within 18".

Vote of Council: • Ayes: All
Motion carried.
RESOLVED to recommend to the Southold Town Trustees APPROVAL
WITH STIPULATIONS the Wetland Application of ROBERT ALCUS
92-1-2.1 to construct a 4' x 30' timber dock elevated a minimum of
4' over grade with a 3' x 10' ramp and a 6' x 20' float for the
private dockage of a recreational vessel.
The Council recommends approval with the stipulation that the project
does not hinder navigation.

GENERAL DISCUSSION
CAC members were invited to the Southold Town Board meeting
on Fishers Island on Wednesday, August 4, 1993. Tentatively
scheduled to attend were John Holzapfel and John Hagerty.
SET NEXT MEETING AND INSPECTION TIMES AND DATE
The next meeting of the Southold Town Conservation Advisory
will be held THURSDAY, AUGUST . 19, 1993 at 4:00 P.M. in the
Conference Room at Southold Town Hall, Main Road, Southold, New,
York.
Group inspections will begin at 3:00.-P.M. on Thursday, August
19, 1993. Members will meet in the lobby of the Southold Town Hall.
There being no further business, the meeting was adjourned at
6:10 P.M.
