Cpl � �� SOUTHOLD TOWN 'CONSERVATION ADVISORY COUNCIL MINUTES MARCH 22, 1994 The Southold Town Conservation Advisory Council met TUESDAY, MARCH 22, 1994 at the Southold Town Hall, Main Road, Southold, New York. The meeting was called to order by acting chairman Stephen Angell at 4:06 P.M. Present were: Stephen Angell, Acting Chairman John "Jack" Hagerty, Member Robert Keith, Member Patricia Isaksen, Member „ Allan Connell, Member Betty Wells, Member (4:30) Linda Cooper, Secretary Absent was: Bruce Loucka, Chairman (Vacation) The minutes of the February 1994 meeting were approved with the following amendment: No.. 1117 DANIEL B. LYONS 90-4-22 amend recommendation . to read "The .CAC_-`.suggests the applicant plant the exposed bank with spartina alterniflora below the MHW mark and spartina patens above the MHW." UnderFine _represents amendments. - REPORTS Jack Hagerty .reported on his progress with the swan project. He has been, in contact with the state and has been assured that the state will support limiting the swan population. The count at Christmas time was not the •best, spring time would show a more accurate count. - Along with: `any. `project the., CAC may do" to diminish the swan population, education'of.fihe general public is very important.. RECOMMENDATION OF WETLAND APPLICATIONS Minutes - March 22, 1994 No. 1121 Moved by Robert Keith, seconded by John Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATIONS the Wetland Application of ANNA STALZER 128-2-5 to ' reconstruct, in-kind; 106 feet of timber bulkhead,. within 18 inches of the existing bulkhead and backfill the bulkhead with approximately 40 cubic yards of clean fill. 6190 Peconic Bay Blvd., Laurel The CAC recommends approval with the requirement that the applicant plant beachgrass in the 10'. flat area behind the. bulkhead for stabilization. Vote of Council: Ayes: All Motion carried. No. 1122 Moved by Stephen Angell, seconded by Allan Connell, it was RESOLVED to. recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATIONS of the Wetland Application of WILLIAM KELLY and SANDRA LEE SIKORSKI 79-4-62 to clear area needed to construct a single family dwelling; excavate for foundation and septic; backfill and final grade all disturbed areas; stabilize fresh fill with seeding grass and supply temporary stabilization with straw mat; berm pond area with hay bales to prevent erosion of bank; and thin out all dead wood. Brigantine Drive, Southold The Council recommends approval with the stipulation that the applicant provide the Trustees with a survey showing the extent of the building envelope plan and that the envelope not be lower than the 15' contour line and that any clearing should be within the building envelope; also, all areas that are disturbed (exposed soil) for more than one month be ,planted with annual rye grass. Vote of Council: Ayes: All Motion carried. No. 1123 Moved by Stephen Angell, seconded by Robert Keith, it was RESOLVED to recommend to the Southold Town Board of Trustees , APPROVAL WITH STIPULATIONS of the Wetland Application of- DANIEL AND EVELYN McCONLOGUE 31-12-4 to construct a two bedroom, one bath extension to existing house; build catwalk over existing walk; and replace and repair existing dock. 900 Trumans Path, East Marion The Conservation Advisory Council recommends approval of the addition. The CAC can only recommend approval of the walkway and dock with the following stipulations: a 1 . The walkway must go straight down from the top of the bluff to the dock. No angles. Page 2 Minutes - March 22, 1994 2. Walkway must be at least 3' above the grade to allow growth under the walkway and prevent erosion. 3. All disturbed areas should be planted with a mixture of tall fescue, red fescue and perennial rye grass. Vote of Council: Ayes: All Motion carried. No. 1124 Moved by Stephen Angell, seconded by Robert Keith, it was RESOLVED Ao recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATIONS of the Wetland Application of DENNIS KEDJIERSKI 53-5-12.2 to 1 . Reconstruct an existing single family dwelling, adding a second floor and a 7'- front and side porch. 2. Construct a 27' x 20' two-car garage on the existing concrete parking area and remove approximately 2000 sq. ft. of concrete parking area from in front of the house. 3. Remove a small, concrete block smoke house and shed. 4. Construct a gravel driveway to the proposed garage.. 5. Remove approximately 1500 sq. ft. of concrete patio and two concrete. ramps from the rear and side of the house as per submitted drawing, and replace it with a 12' x 20' timber deck and stairs attached to the rear of the house. Also construct a second: level 12' x 18' deck located above the lower deck. Construct a 4' wide walk connecting the side porch, lower deck and garage to the pier. Clean out rubble at each side of the pier and naturalize the whole area made bare by these activities as suggested by a site specific- recommendation by the USDA Soil Conservation Service. 6. Replace the solid filled timber pier with , an open piling pier, or reface the solid filled pier to within 18" of the existing structure. 7. Construct a 6' x 40' floating dock (with -a 51. x 10' extension for a gangway) on four pilings at the end of the existing pier. 8. Install water and electric service to the dock per applicable codes. Sage Blvd., Greenport. The Council recommends approval provided the applicant: 1 . Advise ,the Trustees of any underground storage tanks. 2.. Contain as much runoff as possible. 3. Remove ALL concrete, including under decks. Concrete increases runoff. 4. . No pier. Removed and replace pier with catwalk to floating dock. 5. Strictly adhere to the Soil Conservation Service's planting guide. Vote of Council: Ayes: All Motion carried. RECOMMENDATION OF NON-JURISDICTION LETTER REQUESTS NJ 1 Page 3 Minutes - March 22, 1994 ( } Moved by Stephen, Angell, seconded by Allan Connell, it was RESOLVED not to make a recommendation to the Southold `Town Board of Trustees of the request for a Letter of Non-Jurisdiction from ROBERT B. CALHOUN, JR. AND JEAN N. CALHOUN 3-2-2 to construct a pool patio, walk, sanitary system, drive parking an.d truck in approximately 200 c.y. of clean fill and sand for regrading. East End Road, Fishers Island The Council is unable to make a determination from the material received. Vote of Council: Ayes: All Motion carried. NOTE: The CAC feels a project such as this should never require a waiver. or Fetter of non-jurisdiction.. This type of project .should either need a permit or not need a permit-. NJ 2 Moved by Stephen Angell, seconded by Patricia Isaksen, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the request of DONALD AND JOAN BREHM 35-5-27 for a Letter of Non-Jurisdiction to build a deck addition with steps, a planter and a lattice screen. 1010 Maple Lane, East Marion The Council recommends denial because it ' would be inappropriate, the project is within the Trustees' jurisdiction and should require a; permit. The Council recommends approval of the application for a permit, if submitted properly. Vote of Council: Ayes: All Motion carried'. NJ 3 Moved by Stephen Angell, seconded by Allan Connell, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the request of CINDY BENEDETTO 35-5-26 for a Letter of Non-Jurisdiction to build. a 16 x 22 addition to house on the Dawn .Lagoon side which will be in the same place as an existing deck; also put in a concrete patio and a new set of concrete steps to the the basement. 910 Maple Lane, East Marion The Council recommends denial of the request because the project- is- within the Trustees' jurisdiction and should require a permit. The Council would recommend approval of the Wetland Application provided the applicant construct a deck instead of a concrete patio. The. CAC would be opposed to al'l impervious surfaces. Vote of Council: . Ayes: All Motion carried. Page 4 _ Minutes - March 22, 1994 SET NEXT MEETING AND INSPECTION DATE The next meeting of the Southold Town Conservation Advisory Council was scheduled for TUESDAY, .APRIL 26, 1994 at 4:00 P.M.
