APRIL 26, 1994
The meeting of the Southold Town ,Conservation Advisory Council was held
TUESDAY,` APRIL 26, 1994 at 4:00 P.M. in the Conference Room at Southold
Town Hall, Main Road, Southold, New York.
The meeting was called to order by Chairman Bruce Loucka.

CHAIRMAN'S ANNOUNCEMENTS
Chairman Loucka - reported that the Peconic Estuary Program's (PEP)
Citizen Advisory Committee need a CAC representative. Betty Wells
volunteered to represent the CAC at the PEP meetings.
Chairman Loucka also - reported that the Board of Trustees' Shellfish
Advisory Committee had been formed and were working on two creeks, Goose
Creek and Mill Creek. The Committee would need CAC volunteers to once
again do water sampling at the two creeks.- The Shellfish Committee's project
would work in two phases. Phase I would identify the areas where counts are
high. Phase II would focus on water sampling.
REPORTS
Due to the number of applications for discussion, reports. were dispensed
with this meeting.

RECOMMENDATION OF WETLAND APPLICATIONS
No. 1125
Moved by Bruce Loucka, seconded by Stephen Angell, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH PROVISIONS of the Wetland Application' of CHRIST STRATAKIS
33-4-5 to reconstruct an existing stairway and platform arrangement from top
of bluff to beach. - A 6' x 6' shed will be built adjacent to the stairs for
storage of an outboard motor, oars, life vests, etc.
The CAC recommends approval provided the disturbed• soil and fill
behind seawall is revegetated and steps be 4' above slope.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH STIPULATIONS. of the Wetland Application of. RICHARD BURDEN
122-4-15, 16 to replace (within 18") 107 l.f. of existing timber bulkhead and
add 15' return on west side_ and 20' return on east side.
New "bulkhead will be 18" higher than existing. Dredge up to 10' in front to
maximum depth of 3' below MLW. Approximately 50 c.y. of spoil will be
placed behind bulkhead as backfill.
Construct a swimming pool and decks landward of bulkhead as shown on
submitted site plan of Van Tuyl. An additional 75 +/- c.y. of fill will be
trucked in from an upland source.
WAIVER REQUESTED for all work landward of bulkhead.
The CAC recommends approval provided the applicant allow a 10' buffer
of natural vegetation and the pool is moved to the southeast sideyard.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH PROVISIONS the Wetland Applications of MR. &- MRS. THOMAS KELLY
111-5-1 to erect a new prefabricated 8' x 12' wood storage shed adjacent to
existing patio and bulkhead; and repair existing wood stair to beach at
bulkhead.
The Council recommends approval provided the shed is placed adjacent to
the guest parking area and not on the edge of the bulkhead; the area at- the
beginning of the footpath to the beach be bermed off and tied to existing
slope on each side to prevent runoff into the bay.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH STIPULATIONS of the Wetland Application of THOMAS AND ROBY
GLUCKMAN 111-5-2 to construct a swimming pool with appurtenant deck and
pool house.
The CAC recommends - approval with the stipulation that. the area below
the pool be bermed off and plant beach grass on the berm and bluff; all
runoff is to be contained on site; move pool to 75' away from existing bulkhead
(swing pool area 90 degrees and adjust) .

111-1-21 to replace pilings, floating dock and walkway damaged in December
1992 storm. 6' x 20' dock, 4' x 16' ramp.
The CAC recommends approval with the stipulation that spartina
patens by planted. on the bare area of the beach above the Mean High Tide
mark; make catwalk 3' wide with railings and elevate catwalk to 3 •1/2' above
grade and extend the elevated catwalk to within 5' of road to'_ ramp to allow
vegetation of the beach area.

The CAC recommends approval with the stipulation that upland of - the
Mean High Tide Mark, the elevate the ramp to 4' 'above.grade.

RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the Wetland Application of RONALD STRITZLER 94-1-14
to construct a retaining wall 410' long, typically 6' ,above grade, with returns
at each end. Length of returns. estimated .from survey to be 12' at west end
and 22' at- east end; actual lengths to be determined during construction by
intersection of top of retaining wall with face of bluff. Smooth face of

bluff, in accordance with recommendations of Suffolk County Soil and' Water `
Conservation District, to permit revegetation and minimize further erosion
from run-off; use material resulting from smoothing as backfill behind
retaining wall.
. The CAC recommends disapproval because it is not needed. The CAC
suggests the applicant stop .the runoff from the lawn and provide a buffer , of
natural vegetation or a berm to prevent the runoff. The Council also suggests
the applicant stop throwing lumber and other materials off the, cliff.

WITH . STIPULATIONS of the Wetland Application of RICHARD K. FRERKING
115-12-9 to erect catwalk and floating dock per submitted plans next to area
previously used as a boat mooring (stakes still exist. Catwalk 50' x 4'; ramp
4' x 121; 6' x 12' float in "T" configuration.
The CAC recommends approval with the stipulation that the catwalk be 3'
wide and elevated 4' above the high tide mark; also the Council is concerned
by the length-of the project, The length of the project- should be determined
by need and must not extend beyond what is shown on the application.'

93-2-2.4 tb conduct scientific research relating to the growth of. cordgrass
in fixed height intertidal shelves. In order to conduct the research
applicant proposes to construct four intertidal wooden shelves to hold sand.

construction activity to take place a minimum- of 55' from freshwater wetlands.
A continuous line of staked hay bales shall be installed prior to and
maintained during all phases of construction activities and an area of "no
disturbance" shall be maintained.

ROBERT CALHOUN JR. 3-2-2 to construct a swimming pool, terrace, stairs,
decking and pool backwash all at a point greater than 75' from existing tidal
wetlands line. To install a sanitary system as per SCDHS standards at a
point greater. that 125' from existing tidal wetlands line. To truck in
approximately 200 c.y. of clean fill for regrading and the installation of a
stone (pervious) parking area on what is now a dirt parking area approximately
40' from existing tidal wetlands line. Parking area shall be in the same
footprint as existing parking area, existing catch basin shell be utilized or
reconstructed. Entire limits of construction shall be enveloped by a
continuous line of stated hay bales which shall be installed prior to and
maintained during all periods of- construction activity.

of the Wetland Application of PETER WERTZ 88-6-15 to clear land and
construct a one family structure with septic and leaching pools. Property to
be graded and planted with appropriate shrubs, grasses and trees to protect
and .prevent erosion and loss of soil.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Wetland Application of NEW SUFFOLK SHIPYARD 117-5-29.1 to demolish
an existing boat storage and replace with a smaller metal building. New
structure to be further from water than existing building (56' vs. 33') and
will have drywells which present structure does not have. Remainder of area
of old building will be covered with b.luestone to_ match existing yard. Area
shown on survey as "covered shed" with "X" (on submitted plans)' will be used
for installation of outdoor boat storage racks.
The CAC suggests the outdoor boat storage racks, when stored with
boats, be no higher than the shed.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH CONDITIONS of the Wetland Application of CUTCHOGUE HARBOR
110-1-12 to remove existing pilings, piers, floating docks and ramps and
install new floating docks, pilings, and ramps.
The Council recommends approval of the project provided the total number
of slips does not exceed the number of any previously approved slips.

RESOLVED to TABLE the Wetland Application of HAROLD AVENT 115-10-2
to secure a building footprint to construct a one family dwelling.
The CAC tabled the application because it was incomplete. It was
unclear where the 75' wetland line was and the location of the house in
• relation to the wetland line.

THOMAS RUSSELL 6-1-2 to reconstruct/upgrade an existing rock revetment
by installing a 65' x 18' rock slope. 2. to 4 ton boulder shall be utilized by
placing them atop filter fabric and a 1' layer of rack chips (4" x 6" tailings)
and a 1 1/2:1 slope will be created. No grout of any type will be used and
any disturbed areas will be filled with loam and seeded.

130' timber catwalk which shall be constructed 3 1/21 over grade of existing
marsh.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH RECOMMENDATIONS of the Wetland Application of ALICE MIGNEREY
81-3-21 to reconstruct within 1811, approximately 80' of timber bulkhead and to
backfill structure with approximately 20 c.y. of clean sand which shall be
trucked in from an upland source. Upon completion of project any disturbed
areas located landward of bulkhead shall be replanted with Rosa rugose 18"
on center.
The CAC recommends approval provided the application plant beach
grass in front of the bulkhead. The CAC suggests the applicant consider
repairing the bulkhead. There is no apparent need for a new bulkhead, the
existing bulkhead appears to be in good shape.

RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the Wetland Application of ROBERT GARBEN 70-4-5 to
install a floating dock from bulkhead out 60' toward channel in Jockey Creek
(3' wide x 60' long).
The CAC recommends disapproval of the plan as submitted because, at
low tide, the 60' floating dock would set on the bottom. The Council suggests
the applicant install a 3' wide -catwalk beginning at the top lip of the
bulkhead leading to a floating- dock(20' x 61). The new configuration should
not exceed the original 60' intrusion into the creek.

WITH CONDITIONS of the Wetland Application of DAVID GORDON 123-3-10
.for additions and alterations to an existing house. New second story addition
over full house. New one story extension on north west elevation, and at
north corner at existing porch, a new wood deck on northwest side, 'new two
story extension over existing "root cellar".
The Council recommends approval provided the applicant install a berm to
contain runoff on the property. Also, keep all new septic installations at
least 150' from the wetland line.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH SUGGESTIONS of the Wetland Application of VINCENT GERAGHTY
56-4-13.3,. 13.4 and 14 to construct a two story building a minimum of 17' from
the edge of the existing fill. Parking will be located south of the building
and will be - bluestone. Sanitary system will be as close to the easterly
property line as possible and a minimum of 100' from wetlands. The existing
upland to the west will be used only as a boat display area. Access between
the two sections of upland will be via a 4' x 85' pedestrian bridge that will
span the wetlands and the drain ditch. None of the wetlands will be filled or
otherwise developed. All in accordance with revised plans dated December 21,
1993.
The Council recommends approval but has concerns about the runoff and
drainage ditch. The CAC suggests the applicant investigate a way to isolate
the entire drainage system from discharging into the water or try to find a
method of filtration of the runoff into the drainage ditch.

of the Wetland Application of CHARLES E. FRASER 118-4-1 for a
Grandfather Permit for 100' existing bulkhead - built prior to 1939.
Reconstructed approximately 1958 (Rambo). Also approximately 70' jetty built
approximately 1969.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Wetland Application of NARROW RIVER MARINA 27-2-4 to remove high
spots at the entrance to_ the marina that was originally included and authorized
for maintenance dredging in Trustee Permit No. 3805 issued 2/23/90 and
extended to 2/23/94. Reason- for work not being done are (1 ) Owner's original
decision not to have the contractor return to complete the work (owner changed
his mind after receiving complaints of boats striking the bottom in the area of
low tide; (2) Contractors availability for such a small job and difficult
access; and (3) ice conditions that prevented work being done in January of
1994 as scheduled by the contractor.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH CONDITION of the Wetland , Application of OLD COVE YACHT CLUB
117-5-13, 14.1 & 14.2 to construct approximately 65 I.f. of new timber
bulkheading and backfill with approximately 50 yards of sand. Place
approximately 100 c.y. of sand on beach seaward of bulkhead as beach
nourishment. Reconstruct a new 6' x 150' timber dock.
The CAC recommends approval with the condition that all exposed areas
be revegetated. The Council also suggests the Trustees check into the town
installing a bulkhead at the end of the road.

RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the Waiver Request of RICHARD BURDEN 122-4-15,16 as
requested in the Wetland Application No. 1126.
The CAC had recommendations concerning the Waiver Request aspects of
the project and made them with the Wetland Application recommendation.

The Council feels a full application is required.

The CAC recommends . disapproval because the applicant 'has not
presented a project plan. Applicant should decide and then apply for a permit.

The CAC tabled the request because it needs additional information. It

DISAPPROVAL of thea request of WILLIAM RILEY 90-1-4 Permit No. 4061 to
amend permit to install approximately 145' of rock revetment instead of the
approved dock.
The CAC disapproved the original permit and still feels the project is
not needed.

(2) electric and water lines to the end of the fixed dock; (3) Reposition the
proposed 6' x 20' floating dock .in a north-south configuration.
The Council recommends approval provided the applicant shorten the fixed
dock so the new configuration does not exceed the original. intrusion into the
creek.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the request of BOPP, JOHN J., JR. 89-3-11.5 Permit No. 3795
(submitted by previous owner Roscoe Corey) to raise height of the dock and
the catwalk to 3 1/2' above the ground level and the four 6" locust stakes 'will
be replaced with 6" pressure treated poles, an additional 6' x 16' floating
dock 12' away from current dock held by two 6-8" pressure treated poles, a 3'
wide ramp connect the dock to the floating dock.
