Box 1179 (516) 765-18010�- Southold, New York 11971 _SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL MINUTES MAY 24, 1994 A meeting of the Southold Town Conservation Advisory Council was held TUESDAY, MAY 24, 1994 at 4:00 P.M. in. the Conference Room at Southold Town Hall, Main Road, Southold, New York. The meeting was called to order by Chairman Bruce Loucka Present were: .Bruce Loucka, Chairman Stephen Angell, Member Betty Wells, Member Allan Connell, Member Linda Cooper, Secretary Absent were: "Jack" Hagerty, Member Robert Keith, Member Patricia Isaksen, Member The Southold Town Board of Trustees. has requested a planting recommendatio by Allan Connell for the Searl application on Fishers - island. Stephen Angell and Allan Connell will make arrangements to fly over to Fishers Island within the next week-or two. CHAIRMAN'S ANNOUNCEMENTS Chairman Loucka updated the members ' on the Shellfish Advisory Committee's and Trustees' creek project and again mentioned that the CAC would be needed to take water samples. The Bay Constable will provide transportation when the samples are needed from . the middle of the water .instead of along the beach. The Trustees'. are. confident that the project will get grant money from PEP. j . Minutes May 24, 1994 REPORTS Stephen Angell, reported that his work on a policy concerning bulkheading along the Sound is coming along nicely except for a need for support on the species habitat issue. Allan Connell suggested Stephen contact Jay Tanski of Sea Grant.. Betty Wells reported, that she had attended a PEP meeting and that they are a hard working group and she would have more to report in the future. APPROVAL OF M.INUTES OF APRIL 26, 1994 Moved by. Stephen Angell,. seconded by Betty Wells, it was . RESOLVED to approve 'the minutes of April 24, 1994 Vote- of Council: Ayes: All Motion carried. RECOMMENDATION OF WETLAND APPLICATIONS No. 1151 Moved by Stephen Angell, seconded by Allan Connell, it was RESOLVED to recommend to the So-uthold Town Board of Trustees. APPROVAL of the Wetland Application of DOMINICK L. SECRETE. 111-14-22.1 for the installation of a removable floating ,platform tied to the existing bulkheadstructure as per submitted drawings. 4270 Wunneweta Rd., Cutchogue Vote of Council: Ayes: All Motion carried.-- No. arried. -No. 1152 KATHERINE HALE 10-9-6 to reconstruct 55 +/- I.f. of 6 foot wide .fixed wood dock replacing stone- filled ,wood cribs with driven piles for support and maintain a 16' x 10'. floating dock including support piles and associated ramp. The Gloaming,, Sterling St., Fishers Island NO RECOMMENDATION, THE CAC WAS UNABLE TO MAKE AN INSPECTION No. 1153 Moved by Bruce Loucka, seconded by Betty Wells, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL. AS SUBMITTED the Wetland Application of - LOUIS BACON/ROBINS ISLAND 134-3'=5 to reconstruct existing deteriorated 1'2' x 285' fixed timber dock; reconstruct offshore 6' x 64' "L" section with the installation of a wave -curtain to protect docked vessels from North, Northeast and Northwest winds; reconstruct offshore 32' x 32.'-filled dock; replace two- 6' x 24' floats and add. three additional 6' x 241 floats, with associated mooring pilings, for island visitors/government officials, emergency vessels, caretakers, etc.; install four 7-pile dolphins to safely berth ferry boar and/or supply bargee. Robins Island Vote of Council: Ayes: All Motion carried. Page 2 Minutes —` May 24, 1994 - No. 1154 JOHN STRIP 7-279 to construct a single family dwelling,, sanitary system, pool as per . plan dated. August 2.7, 1993: A staked row of hay bales to be maintained during construction. Private Road, Fishers Island NO RECOMMENDATION. THE CAC WAS UNABLE TO MAKE AN INSPECTION. No. 1155 Moved by Bruce Loucka, seconded by Allan Connell, it was RESOLVED . to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATIONS of the Wetland Application of JOHN J. FIORE 91-1-5 to construct a 16' x 321 swimming pool inground surrounded by wood decking.. and chain link fence; to regrade, seed and landscape around pool area. The CAC will recommend approval provided the application remove the concrete ramp and regrade existing" shoreline away from the creek and provide a sand drain to allow water to percolate into the ground. 5050 Sunset Way, Southold - Vote of Council: Ayes: All - Motion carried. No. 1156 Moved.by Allan Connell, seconded by Bruce-Loucka, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH PROVISIONS of the Wetland Application of DONALD AND VIRG,INA BAYLES 5T-1-16.1 to resheath 220' bulkhead landward side, replace backing system;. backfill 10 yards clean , fill, replace' seven pilings in-kind, in-place. The CAC recommends approval provided- the applicant create, ' along the affected area, a berm effect with a sand drain landward to allow control runoff and allow water to percolate into the ground. 785 Albacore Drive, Southold Vote of Council: Ayes: -All Motion carried. No. 1157 Moved by Allan Connell, seconded by Betty Wells, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Application of THERESA CASAMISINA 57-2-19 to obtain permit , for 37' long bulkhead which is already butit in 1978 ' The CAC sees no need for the bulkhead but is concerned for the damage which could occur ,if the present bulkhead is ripped out. 1195 Island if Lane, Greenport Vote of Council: Ayes: All Motion carried. No. 1158 Moved by Betty Wells, seconded by Allan Connell, it was RESOLVED to recommend to the Southold Town Board of Trustees. APPROVAL of the Wetland Application of LI.NTON AND DIANA DUELL 24-2=12 to obtain a grandfather permit to reconstruct dock and piling, 31 x 601. 450 West Bay Avenue, Orient Page 3 Minutes May 24, 1994 Vote of Council: Ayes: All Motion carried. RECOMMENDATION OF WAIVER REQUESTS WR-9 Moved by Stephen Angell, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town' Board of Trustees DENIAL of the Waiver Request of WILLIAM CHILDS 145-4-2.1 to erect a 12' x 24' storage shed. The CAC recommends denial as submitted due. to the size of the structure and its proximity to the water. Also the CAC has concerns for the intended use and storage of the structure. 1760 Peconic Bay Blvd., Laurel Vote of Council: Ayes: All , Motion carried. WR-1-0 Moved by Stephen Angell, seconded by Allan Connell, it was RESOLVED 'to recommend to -the Southold Town Board of Trustees DENIAL of the 'Waiver Request of OSCAR AND.BETH BLEVINS 104-5-23'for changes to existing conditions: (1) the existing house will be rotated to be parallel with Mason Drive in order that a 24' x 241 garage may be built on the east side of the house, (2) a 12' x 33° deck is proposed on the west side of the house, (3) presently the house sits on concrete block piers. A full foundation is proposed. (4) enlargement of the existing second floor is proposed. A dormer on the north side of the house as well as a second floor area over the existing screened porch is proposed. (5) the existing' screened porch is proposed to be enclosed to provide space for the relocated kitchen. The existing kitchen area will become a dining alcove off the living room: The CAC recommends denial due to the scope of the project and feel a permit is absolutely required. They are concerned about the 'sediment into the creek -and concerned about the sanitary system. ( When the application is filed the applicant should be required to show the septic system. ) 640 Haywater Drive, Cutchogue Vote of Council: Ayes: All Motion carried. WR-11 Moved by Allan Connell, seconded by Stephen Angell, it, was RESOLVED to recommend to the Southold Town Board of Trustees DENIAL of the Waiver Request of ,CINDY BENEDETTO 35-5-26' concerning the revised plans for a previous request. Will -not put in a patio and will instead put in a concrete walkway around the addition to. obtain easier access to. the new concrete basement steps. The CAC recommends denial because there should be no concrete. The Council recommends and would approve any surface (brick, 'gravel, bluestone, etc. ) that. would allow water to percolate into the ground. 910 Maple Lane Vote of Council: Ayes: All Motion carried. Page 4 Minutes May. 24; 1994 WR-12 Moved by Allan Connell, seconded by Stephen Angell, it was RESOLVED to recommend to the Southold Town Board of-Trustees DENIAL of the Waiver Request of ANN BERRYMAN 18-2-1 to construct a 6' high vinyl fence along western property line a minimum of 55' long. Fence would extend -onto 'the beach to prevent pedestrian traffic and keep deer from cutting through property and eroding beach. Denial was recommended. because no need is demonstrated for the proposed action. The installation of a fence could create an erosion problem. 2100 Youngs Road, Orient Vote of Council: Ayes: All. Motion carried. - WR-13 Moved by Bruce Loucka, seconded by Betty Wells, it was RESOLVED ' to recommend to the Southold Town Board of Trustees APPROVAL of the Waiver Request of PIERRE CAZARIAN 26-2-47 to build a fence. with gate at stairs on top of the bulkhead. 860 Willow Terrace Lane, Orient - Vote of Council: Ayes: All Motion carried. WR-1-4 Moved by Bruce Loucka, seconded by Betty Wells, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Waiver Request of DAVID AND CLAIRE AIRE 24-1-27 to install a 4' high picket fence along the southerly property line on top of the retaining- wall. Village Lane, Orient Vote of Council: Ayes: All Motion carried. ' RECOMMENDATION OF REQUESTS FOR LETTERS. OF NON-JURISDICTION NJ-8 Moved by Allan Connell, seconded by Betty Wells, it was RESOLVED to recommend to the Southold Town Board of Trustees DENIAL of the request for a letter of Non-Jurisdiction of SUSAN TSAVARIS 30-2-53 to construct a 15' x 30' inground pool beyond the 75' setback from high water line on Long Island Sound. Denial is recommended because, although the location of the pool itself is not within Trustees' jurisdiction, the required fence -would be within Trustees' jurisdiction according to information supplied by the applicant. Due to -the fence's proposed location a Wetland Application should be required and the application -should show the Coastal Zone Hazard- ,line. 2.170 The Strand, East Marion Vote of Council: Ayes: All Motion carried. RECOMMENDATION OF REQUESTS- TO AMEND PERMITS Page 5 Minutes May 24, 1994 A-5 Moved by Stephen Angell,• seconded by Bruce-Loucka, it was RESOLVED to recommend to the Southold Town Board- of Trustees APPROVAL WITH PROVISIONS of the request to amend the permit of BARBARA CIEPLINSKI 89-3=9 & p/o 8 to relocate structure slightly northward and reoriented to reach a 3' depth in accordance with NYS DEC requirements. As stated in the CAC's original recommendation concerning this application, approval is recommended provided the project does not block the navigation of the neighbors. The Trustees' may wish to have the Bay Constable make a_ determination -as to the fullest limit possible without causing obstruction. P.M. in the Conference Room at Southold Town Hall. Members will meet at 3:00 P.M. in the lobby of Town Hall for Group Inspections.
