CONSERVATION ADVISORY COUNCIL
THURSDAY, SEPTEMBER 22, 1994
4:00 P.M.
A meeting of the Southold Town Conservation Advisory Council was held
Thursday, September 22, 1994 at 4:00 P.M. in the Conference Room at Southold
Town Hall, Main Road, Southold, New York.

Absent was: Bruce Loucka, Chairman (Vacation)
Due to Bruce's absence, Stephen Angell performed the duties of chairman.
The meeting was called to order by Stephen Angell.
Valerie Scopaz of the Southold Town Planning Department met briefly. with
the Council to request its assistance concerning a report on erosion. The
Town may receive a $25,000 matching grant for the program. The town would
match by using in house services. The CAC would be part of the servics.
REPORTS
Stephen Angell reported he had sent a report of the the Goose Creek
Project to the New York State Association of Conservation Commisssions Projects
Awards Program.
Mr. Angell also reported that he had submitted, to the Trustees, the final
Bulkhead Policy by the CAC which included the additions from last month's
meeting.
Jack Hagerty is continuing the water sampling project.'
Allan Connell reported on the Cornell Cooperative Extension's Ecological
Restoration Sites in Coastal Area Field Trip on Monday, September 19 in which
he was a participant.

APPROVAL OF MINUTES OF AUGUST 19, 1994
Moved by Robert Keith, seconded by Patricia Isaksen, the minutes of August
19, 1994 were approved as submitted.

RECOMMENDATION OF WETLAND APPLICATIONS
No. 1183
Moved by Robert Keith, seconded by Stephen Angell, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH CONDITIONS of the Wetland Application of MATTI TUC K-SALTAI RE
ASSOC. INC. 94-1-5 to replace existing stairs to beach (top flight only) after
storm damage by erosion, 40' x 41. Repair balance of stairs to beach in kind
and in place being careful of existing growth on hillside, with a 6' x 4'
platform at top of stairs.
Council recommends approval provided the stairs are 4' above ground level
and the area beneath is planted with beach grass. Also, the dumping of
vegetative debris over the edge of the bluff should stop. The debris is
smothering the vegetation on the bluff.

RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the Wetland Application of ' GERALD P. RAFFERTY
104-3-16.1 to erect a snow fence 30' in length as shown on survey and post
signs.
The Council recommends disapproval of the snow fence because no need is
shown. The Council does recommend the Board of Trustees allow the applicant
to post a sign.

Moved by Stephen Angell, seconded by Allan Connell, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH STIPULATIONS of the Wetland Application of BETH_ BLEVINS 104-5-23
to relocate existing house to parallel property lines, 24 x 24 garage on east
side, 12 x 33 deck on west side. Enlarge existing second floor, enclose
existing screened porch, full concrete foundation below raised house
(excavation only for footings, area inside foundation to be a crawl space above
grade) . Existing cesspool on west side to remain.
The Council recommends- approval provided the following stipulations are
followed:
1 . Move the cesspools to the front yard near test hole No. 2, as far away
from the wetlands as possible.
2. Restore natural vegetative buffer.
NOTE: Violation - land clearing should be stopped immediately!

Moved by Allan Connell, seconded by Stephen Angell, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL.
WITH CONDITIONS of the Wetland Application of THOMAS BOYLE 59-1-7 to
construct 170 +/- I.f. of stone revetment and backfill with 2500 +/- c.y. of
clean sand to be trucked in form an upland source. Purpose of structure is to
prevent further erosion to property and concrete wall which is collapsing.
Letter of Non-Jurisdiction requested for construction of one-family dwelling,
sanitary system, driveway, as shown on submitted site plan.
The Council recommends approval provided the property owner maintain 50'
east of his revetment (equal to the 50' currently eroded on east side of
owner's property) . This will protect his property from northeast storms and
will avoid damage to the Southold Town Beach.
The Council recommends disapproval of the request for a Letter of
Non-Jursidiction for the single family dwelling. Project needs to go through
the application process.

RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the Wetland Application of EDGAR DEBANY 88-5-58 to
construct 100 I.f. of timber retaining wall in line with and attached to
adjacent wall to west. A 12' return will be constructed on east side. Eroded
bank up to 12' landward of proposed wall location will .be regraded and 75 c.y.
additional sand fill will be trucked in from upland source via owners
property. An existing 3' x 15' stairway down bluff will be removed and
replaced with a 3' x 10' stairway from wall to beach. Proposed wall will be
landward of AHW and is to correct erosion of bluff.
The CAC recommends disapproval because no need is shown, there is no
erosion problem. The CAC suggests applicant grade the existing bluff to a 1
to 1 slope and plant with beach grass. Maintain the top of the bluff sloping
toward the house. Take fill from the grading and use to fill around the jetty.
Remove concrete rubble during grading process
The CAC recommends of the stairs provided they are placed 4' above the
ground and beach grass planted underneath.
The CAC recommends the applicant contact the Soil Conservation for a
planting guide.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL .
of the Wetland Application of LEONARD ROSEN 78-2-12 to construct 'a timber
dock consisting of a 4' x 24' fixed elevated (4' above grade of marsh) walk; 4'

x 14' hinged ramp; 6' x 20' float secured by (2) pilings. A 5' wide path from
house and dock to be cleared through the brush.

Moved by Allan Connell, seconded by Stephen Angell, it was
RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the - Wetland Application of ROBERT E. CENSEL 64-3-2.2
to replace, in-kind, in-place, 55' of 2 1/2' high wooden retaining wall which
is normally above mean high water. No additional fill will be necessary.
The CAC recommends disapproval because retaining wall is not
necessary. Applicant should plant spartina in front of the existing bulkhead
to avoid the risk of erosion.
Applicant should also be required to meet the current Town Code by
planting a buffer behind the bulkhead.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Wetland Application of. ROBERT ALCUS 92-1-2.1 to construct a single
'family dwelling a minimum of 75' from the landward limits of tidal wetlands,
install a sanitary system greater than 100' from the tidal wetlands boundary
and install a pervious driveway all in accordance with the submitted surveys
dated 5/14/94 which were previously approved by the Trustees under Permit
No. 3884. Furthermore, applicant will conform to the conditions set forth
within the permit previously issued.

of the Wetland Application of VINCENT MANETTI 80-3-5 to construct a single
level deck approximately 880 square feet (40' x 281).

The CAC did not inspect the application of ELIZABETH PEISHOFF 10-7-21 to
obtain a grandfather permit for an existing dock structure and repair and
therefore has NO RECOMMENDATION.

RECOMMENDATION OF WAIVER REQUESTS

RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the Waiver Request of YENNECOTT PARK PROPERTY
OWNERS 55-4-25.4 to relocate dam approximately 10' east of original dam and
foot bridge in its original location.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Waiver Request of RITA GALLO 76-1-13 to construct a 10' x 20' deck
as shown on submitted survey.

RECOMMENDATION OF AMENDMENT TO PERMIT

Moved by Stephen Angell, seconded by Robert Keith, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Amendment to permit of DENNIS KEDJIERSKI 53-5-12.2 to amend
permit to meet conditions to issuance of DEC permit.
1 . Replace the existing 44' x 10' solid filled pier with a 44' x 6' open
piling pier and a 40' x 5' floating dock.
2. - Due to concern about runoff, remove existing concrete from the property
and replace with a ground level timber deck connecting the house to the pier.
Also, remove rubble east of pier and 40 s.f. of the top of the bank be cut
bank and approximately 30 s.f. of lower bank be filled with 3 c.y. of clean
sand and plant with spartina.
3. Add a set of stairs leading from the upper deck to the ground level to
provide a means of egress from the upstairs living area of the house. The
stairs would come off a 416" x 3' platform at the northwestern corner of the
deck and descend along the western face of the house. Stairs would be
constructed over an area which is presently covered with concrete and
therefore would not disturb any natural vegetation. Area beneath stairs would
be planted with shrubs and grass.

The Southold Town CAC will hold its next meeting THURSDAY,
OCTOBER 22, 1994 at 4:00 P.M. at the Southold Town Hall, Main Road,'

Meeting of 9/22/94
The members decided to use a phone check-in system to determine whether
a Group Inspection would be required. Any member with an application
requiring a group inspection would contact the Linda Cooper by WEDNESDAY,
OCTOBER 19, 1994. All other members would call Linda on THURSDAY,
OCTOBER 20;:, 1994 to find out if any group inspections were requested.
This would alleviate the need for members to report to Town Hall at 3:00
P.M. if nothing required a'o. group inspection.
There being no further business to come before the council, the meeting
was adjourned at 5:25 P.M.
