Box 1179 (516) 765-1801 �f'�Ol ���� Southold, New York 11971 SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL TUESDAY, NOVEMBER 15, 1994 A meeting of the Southold Town Conservation Advisory Council was held Tuesday, November 15, 1994 at 4:00 P.M.. in the Conference Room at Southold Town Hall, Main Road., Southold, New York. Present were: Bruce Loucka, Chairman Stephen Angell, Member Robert Keith, Member Jack Hagerty, Member- Patricia Isaksen, Member Allan Connell, Member Betty Wells, Member Linda Cooper, Secretary CHAIRMAN'S ANNOUNCEMENTS Chairman Bruce Loucka announced that he would be stepping down as chairman effective January 1., 1995 and asked ,if anyone - would be interested in taking the position. Moved by Bruce Loucka, seconded by Robert Keith, it was RESOLVED to recommend to the Southold Town Board that Stephen Angell be appointed Chairman of the Southold Town Conservation Advisory Council for 1995. Vote of Council: Ayes: All Motion carried. REPORTS There will be a conference entitled THE PUBLIC TRUST DOCTRINE ON LONG ISLAND held December 15, 1994. Betty Wells requested that she be sent to the conference. A letter of request will be sent .to the Town Board for their approval. Bruce Loucka received a memo , from Supervisor Wickham concerning 1994 NYS Nonpoint Source Implementation Grants Program. The CAC Meeting of 11/15/94 discussed the issue and felt that the priority list of runoff areas would fit the request. Robert Keith volunteered to contact James McMahon concerning this matter. APPROVAL OF MINUTES OF OCTOBER 20, 1994 The minutes of October 20, 1994 were approved with the following corrections. No. 1200 Moved by Allan Connell, seconded by Jack Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Application of ANDREAS PALIOURIS 59-9-4.2 to construct a single family residence within building envelope shown on submitted survey. Private Road off Soundview Avenue, Southold Vote. of Council: Ayes: Jack Hagerty, Patricia Isaksen, Betty Wells, Allan Connell Nays: Stephen Angell RECOMMENDATION OF WETLAND APPLICATIONS No. 1207 Moved by Allan Connell, seconded by Jack Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Application of ROBERT AND BARBARA .HOLLEY 53-3-13 to construct a 20.5' x 16' single story addition 54' from the upland edge of tidal wetlands landward of an existing dwelling and relocate an existing shed (approximately 10' x 101) as shown on submitted plans. Bay Shore Road, Southold Vote of Council: Ayes: All Motion carried. No. 1208 Moved by Bruce Loucka, seconded by Robert Keith, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH CONCERNS of the Wetland Application of AQUAFOOD PROPERTIES LTD PARTNERSHIP 38-7-7.1 to replace (within 18") 1047 +/- I.f. of existing timber bulkhead. Maintenance dredge 228 +/-' (maximum) x 245 +/-' (maximum) basin and 50 +/-' x 170 +/-' channel to a maximum depth of 10' below ALW. Approximately 3800 c.y. of resultant spoil to be used both for backfill and temporarily deposited in open field to east of channel previously used as spoil site. Spoil deposited in stated location to be removed and deposited at approved upland source. Multi-year maintenance permit requested. The CAC recommends approval however, it has concerns about the underground fuel tank and suggests the Trustees investigate the situation and pass along the information to the appropriate town agency. Page 2 Meeting of 11/15/94 2835 Shipyard Lane, East Marion Vote of Council: Ayes: All Motion carried. No. 1209 Moved by Allan Connell, seconded by Jack Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATIONS of the Wetland Application of FRANK AND VIRGINIA ZIMMER 19-1-18.3 E 20-3-1.2 to open path in area of dike -for access to Long Beach Bay and install one mooring stake. The CAC recommends approval with the stipulations that the pathway be allowed to human foot access only; that the pathway be restored and limited to a 3' width; and the dike be repaired. The Council has concerns of the "conditional" nature of Hallocks Bay and the threat of horses, and therefore suggest that no horses be allowed over -the dike to the Hallocks Bay section. The Council also suggests the Trustees levy a fine for actions taken without obtaining permits. Main Road, Orient Vote of Council: Ayes: All Motion carried. No. 1210 Moved by Allan Connell, seconded by Patricia I saksen, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH PROVISIONS of the Wetland Application of RONALD MCGREEVY 99-3-4.5 to construct 155 +/- I.f. of timber bulkhead to be tied into adjacent bulkhead to east. Construct a 15 +/-' return at west end of bulkhead and backfill with 250 c.y. of bank run sand to be trucked in from approved upland source. Also, to construct a 4' x 14' section of fixed walk to tie into existing stairs down bluff; construct 4' wide steps to beach. The Council recommends approval provided the applicant follow the Trustees' policy for bulkheading along the Sound by placing the bulkhead at the toe of the bluff to tie in with the neighbor's return and that the bulkhead is buried and maintained. The Council suggests the Trustees also require the applicant to address the runoff at the top of the bluff by constructing a berm or sloping the top away from the bluff. -250 Lloyds Lane, Mattituck Vote of Council: Ayes: Bruce Loucka, Robert Keith, Jack Hagerty, Patricia Isaksen, Betty Wells, and Allan Connell Nays: Stephen Angell Motion carried. . No. 1211 Moved by Bruce Loucka, seconded by Stephen Angell, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A STIPULATION EDWARD S. KONDAK 30-2-54 to construct wood stairs from top of bluff on sound to base of bluff to gain access to beach. Construction to consist of 32' x 3' walkway with hand Page 3 Meeting of 11/15/94 rails on top of bluff connected with three sections of railed stairs 3' in width and joined with two intermediate level sections. The CAC recommends approval with the stipulation that the walkway be elevated at least 4' above the face of the bluff. 2090 The Strand, East Marion Vote of Council: Ayes: All Motion carried. ' No. 1212 Moved by Stephen Angell, seconded by Patricia Isaksen, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH PROVISIONS of the Wetland Application of JOHANNA SMITH 104-7-5 to resheath (on landward side) 478 +/- I.f. of existing timber bulkhead. Remove 96 +/- I.f. of existing timber bulkhead and construct 30 +/- I.f. of new timber bulkhead to expand existing irregularly shaped boat basin. Maintenance dredge and 20' of its mouth to a maximum depth of -4 ALW. Approximately 100 c.y. of resultant spoil to be deposited on owner's upland. Excavate upland area adjacent to existing basin (approximately 27' x 401) to expand boat basin. Approximately 150 c.y. of resultant soil and sand to be used as backfill. The Council recommends approval provided the applicant maintains a 20' buffer as stipulated in the Town Code. Also, the CAC recommends that the excess spoil be used to build a berm along the outside edge of the bulkhead to prevent runoff from entering the creek. Mason Drive, Cutchogue Vote of Council: Ayes: All Motion carried. WAIVER REQUESTS WR-20 Moved by Allan Connell, seconded by Betty Wells, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Waiver Request of JOSEPH DUGGAN 35-5-31 to construct a 10' x 62' deck to attach to an existing single family dwelling. Said deck to be located a minimum of 19'3" on the north end and 51 1/2' on the south end from the existing bulkhead. Application also includes a 15' wide buffer planting area seaward of the proposed deck as required by NYSDEC. Snug Harbor Lane, Greenport Vote of Council: Ayes: - All Motion carried. No. 1205 Moved by Robert Keith, seconded by Jack Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Waiver Request of ALFRED AMEND 90-2-4 to remove existing garage (21' x 19'); build new two story extension (25' x 191) . 380 Midway Road, Southold Page 4 Meeting of 11/15/94 Vote of Council: Ayes: All Motion carried. No. 1206 Moved by Robert Keith, seconded by Patricia Isaksen, it was RESOLVED to recommend to the Southold Town Board of Trustees` APPROVAL of the Waiver Request of FRED RENGANESCHI 107-7-4 to build an addition to an existing residence consisting of a wrap-around roofed porch 7' in depth on landward front of house 32'6" from existing garage then 23'3" in a westerly direction which includes a 7' storm foyer over existing stoop. 2005 Westview Drive, Mattituck Vote of Council: Ayes: All Motion carried. AMENDMENTS TO PERMITS A-10 Moved by Stephen Angell, seconded by Allan Connell, it was RESOLVED to recommend to the Southold Town Board of Trustees .APPROVAL WITH A STIPULATION of the Amendment of Permit request of SERGE ROZENBAUM 59-5-12 to modify permit to allow permittee to reconstruct his dock 'at 3.51. x 76' at 3.5' over ,grade instead of the approved 2.5' x 76' at 3' over grade. CAC recommends approval to widen the dock to 3.5' only if the it is raised to 4' above the grade. 1295 Lake.Drive, Southold Vote of Council: Ayes: All Motion carried. NEXT MEETING DATE The next meeting of the Southold Town Conservation Advisory Council was scheduled for MONDAY, DECEMBER 19, 1994 at 4:00 P.M. at Southold Town Hall.
