CONSERVATION ADVISORY COUNCIL
MONDAY, DECEMBER 19, 1994
4:00 P.M.
A meeting of the Southold Town Conservation Advisory Council met
Monday, December 19, 1994 at 4:00 P.M. at the Southold Town Hall, Main Road,
Southold, New York.
The meeting was called to order by Chairman Bruce Loucka.

CHAIRMAN'S ANNOUNCEMENTS
Bruce Loucka reported to the Council that $30,000 designated for
correcting runoff problems had been moved from the Highway Department and
to the Board of Trustees in the 1995 Budget. The- Trustees have stated that
they will reimburse the Highway Department for work on runoff problems or
hire outside contractors if the Highway Department does not have the time and
manpower. One area to be addressed will be Goose Creek.
REPORTS
Allan Connell reported meeting with the Trustees on the 319 Grant which
involves a proposal for Arshamomaque Pond. James McMahon is working on a
grant for Goose Creek.
Betty Wells reported that she way able to attend part of the Public Land
Trust Seminar and found it very informative.
APPROVAL OF MINUTES

Moved by Robert Keith, seconded by Bruce Loucka, it was
RESOLVED to approve the minutes of November 20, 1994 with the following
amendments by Allan Connell:
No.-1210
Remove - "The Council suggests the Trustees also require the
applicant to address the runoff at the top of the bluff, contain runoff by
planting appropriate materials."
Replace with - "The Council suggests the Trustees also require the
applicant to address the runoff at the top of the bluff by construction a berm
or by sloping the top away from the bluff."

Add - ". . .to prevent runoff from entering the creek." at the end
of the recommendation.
Vote of Council: Ayes: All

RECOMMENDATION OF WETLAND APPLICATIONS
No. 1213
Moved by Robert Keith, seconded by Patricia Isaksen, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Wetland Application of STRONG'S MARINA 122-9-3 + 6.1 and 122-4-44.2
to (A) erect 190' long x 12' deep x 20' high boat storage racks and (B) to
replace 75' of existing timber bulkhead which is giving way.

Moved by Allan Connell, seconded by Robert Keith, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH CONDITIONS of the - Wetland Application of WUNNEWETA POND
ASSOCIATION 118-1-11 to dredge 20' x 170' area in channel to a maximum
depth of 4' below ALW. Approximately 375 c.y. of resultant spoil will be
spread evenly over irregularly shaped area on adjacent property to southeast.
Material to be removed with backhoe.
The Council recommends approval provided the applicant replant the area
disturbed by the heavy equipment and plant all spoil to beach grass in line
with existing vegetation to extend in a northerly direction to include the 70'
x 86' area on plot plan.

Moved by Robert Keith, seconded by Patricia Isaksen, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH PROVISIONS of the Wetland Application of NANCY L. FOOTE
115-17-17.13 to construct a single family dwelling, swimming pool, deck,
driveway, sanitary system, water service, walkway, and dock.

The CAC recommends approval provided
1 . The dock is located so it is not less than 15' from the property line.
2. The project description states that "No offsite fill is required." but
plans call for 250 c.y. of fill. The CAC is concerned about the
discrepancy and feels the Trustees should seek clarification.
3. Wetland limits remain undisturbed because of runoff.

RECOMMENDATION OF-WAIVER REQUESTS

Moved by Bruce Loucka, seconded by Jack Hagerty, it was
RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the Waiver Request of PORT OF EGYPT ENTERPRISES
56-6-4 6 6.1 to install a swimming pool, terrace and cabana facilities instead
of boat storage building which a permit was issued but never used.
The CAC feels this project needs to go through the permit process.

RECOMMENDATION OF AMENDMENTS TO PERMITS

Moved by Bruce Loucka, seconded by Jack Hagerty, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH CONDITIONS of the request for an amendment to a permit by MICHAEL
LEAHY 64-3-4 to extend his walkway and ramp reach suitable water depth.
The Council has concerns about the length and recommends that the float
be turned so it is parallel to the shore and that the length of the project
does not interfere with the navigation of others.

Moved by Robert Keith, seconded 'by Bruce Loucka, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the request for an amendment to a permit by BLUEPOINTS COMPANY INC.
140-1-23.1 to eliminate the 2000 gallon per minute pump enclosed in a 5' x 5'
structure and replace with two 1000 gallon per minute submersible pumps to be
placed at the end of the 100' x 4' open pile pier. Two davits to be installed
at the end of the pier for pump servicing.

Moved by Robert Keith, seconded by Patricia Isaksen, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of th'e' request to amend a permit by STRONC'S MARINA 122-9-6.2 to amend
permit to'use a 4' high cement initial bulkhead and have a graduated level of
plantings.

RECOMMENDATION OF LETTER OF NON-JURISDICTION

Moved by Bruce Loucka, seconded by Jack Hagerty, it was
RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the request for a Letter of Non-Jurisdiction by PETER
HAEFFNER 70-10-26 to construct a one family dwelling, sanitary system, well,
bluestone driveway and underground utilities. Work is in excess of 75' of
nearest wetland.
The CAC recommends disapproval because the project should go through
*the permit process; the building activity will be within 75' of the wetlands.
The CAC also is concerned because clearing has already taken place without a
permit.

NEXT MEETING DATE
The next meeting of the Southold Town Conservation Advisory Council was
scheduled for MONDAY, JANUARY 23, 1995 at 4:00 P.M. Members will call
Linda Cooper to advise if group inspections are necessary.
There being no further business to come before the Council, the meeting
was adjourned at 4:55 P.M.
