New York 11971 (516) 765-1801 ®1 _SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL MARCH 23, 1995 The Southold Town Conservation Advisory Council met Thursday, March 23, 1995. The meeting was called to order at 4:00 P.M. by Chairman Stephen Angell. Present were: Stephen Angell, Chairman Bruce Loucka; Member Robert Keith, Member Jack Hagerty, Member Patricia Isaksen, Member Allan Connell, Member Betty Wells, Member Linda Cooper, Secretary Also present at the early part of the meeting were Supervisor Wickham, Trustee Peter Wenczel, Bayman Steve Latson, and Community Development Director James McMahon. They were present to discuss Jim Homan's Bay Scallop Legislation Proposal. After several views were discussed it was decided that Supervisor Wickham would respond to Mr. Homan's proposal and would state that general opinion was that the current system was working well and the various groups saw no reason to change. CHAIRMAN'S ANNOUNCEMENTS The CAC would continue to be involved with the testing of water samples to aid in the opening of certain waters for shellfishing. Jack Hagerty and Bruce Loucka will continue to work with the DEC and coordinate "runners" for the water samples. MINUTES Moved by Stephen Angell, seconded by Bruce Loucka, it was RESOLVED to accept and approve the minutes of February 14, 1995 as submitted. Vote of Council: Ayes: All Motion carried. r .Meeting of 3/23/95 RECOMMENDATION OF WETLAND APPLICATIONS No. 1225 JOHN C. MULHOLLAND AND MICHAEL BRONTJE 57-2-23 E 24 to, maintenance dredge 400 yards to 3' below mean low water on Mulholland and Brontje parcels (privately owned bottom), remove 200 yards each for 400 yard total; dispose on Mulholland parcel above mean spring high water (existing landscaped lawn area); add and restore a 4' x 30' open pile dock to Mulholland and twin pilings to each on remnant piles near waters edge of Mulholland property. The CAC had tabled the application at its February 14, 1995 meeting and requested additional information. The CAC has received only part of the requested information and thus has TABLED the application until it receives plans for the dock and indication of the pilings -and details of the dredge spoils which should include the contour elevation of the spoils. The Council will not make a recommendation to the Trustees until the requested information has be provided. 725 & 802 Island View Lane, Greenport No. 1230 Moved by Allan Connell, seconded by Jack Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATIONS of the Wetland Application of SALLY HAEFFNER 70-10-26 to construct a 'one family dwelling, sanitary system, well bluestone (or similar pervious) driveway, underground utilities. Approximately 175 c.y. of clean fill will be trucked in from an upland source. The CAC recommends approval with the stipulation that the 50' buffer be maintained from a Trustees established wetland line (the CAC disagrees with the line shown on the submitted plan); that there be no further disturbance of the buffer than that which has already occurred; that roof runoff be controlled by installing drywells; and that silt fence with haybales be used during construction. 1950 Clearview Avenue, Southold Vote of Council: Ayes: All Motion carried. No. 1231 The Southold Town Conservation Advisory Council did not make an inspection of and therefore cannot make a recommendation concerning the Wetland -Application . of LOUIS M. BACON 134-3-5 to restore South Pond (SH-5). Phragmites and root mass shall be removed (excavated) and trucked to an upland site (greater than 100' from freshwater wetlands and greater than 300' from tidal wetlands) for disposal. For disposal a pit shall be excavated, material shall be placed in pit, covered with a PVC liner and a 4' - 6' layer of soil shall be placed on top of liner. In restoring pond, approximately 17,000 c.y. of soil shall be removed to create depths of 1 1/2' - 161. Pond shall be planted with rooted emergent vegetation. Existing road located within adjacent area shall be utilized during excavation then replanted and abandoned. Greenbrier and dead vegetation shall be removed from adjacent area (100') and a wetlands transitional area shall be created. An area of Phragmites located southwest of pond along Great Peconic Bay shall be hand cut to assure that no seed material returns to pond. Approximately 1,000 c.y. of clean sand shall be placed in area located between pond and Great Peconic Bay Page 2 a Meeting of 3/23/95 to strengthen shoreline from storm surge. Area shall then be planted with American Beach Grass. Robins Island No. 1232 Moved by Robert Keith, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH CONDITIONS of the Wetland Application of ' MICHAEL SLADE 110-7-26 to construct approximately 135' of new bulkhead joining two existing bulkhead structures. Excavate and dredge small area adjacent to new bulkhead, using spoil to backfill bulkhead. The CAC recommends approval with the assumption that the side with the slips is zoned M1; if it is not then the CAC recommends disapproval of the dredging. 1435 West Road, Cutchogue Vote of Council: Ayes: All Motion carried. No. 1233 Moved by Stephen Angell, seconded by Robert Keith, it was RESOLVED to recommend to the Southold Town Board of Trustees PARTIAL APPROVAL of the Wetland Application of WILLIAM PYMM 122-9-7.9 to reconstruct two timber groins, in kind/in place. The eastern most structure is 150'; the western 50'. There is no filling involved with project. The CAC recommends approval of the reconstruction in kind/in place of the 150' groin. The Council recommends disapproval of the 50' groin as it is not functioning at all and has no apparent benefit to keep the channel clear. No. 1234 Moved by Stephen Angell, seconded by Patricia 1 saksen, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATIONS of the Wetland Application of NARROW RIVER MARINA 27-2-4 to reinstall Coast Guard approved channel markers in accordance with current Coast Guard permit, previous Corps of Engineers permit, and as per previously issued Town of Southold permits and authorization. The CAC recommends approval to mark the channel however the Council recommends that the sites of the permanent markers be replaced with floating seasonal buoys. Narrow River Road, Orient Vote of Council: Ayes: All Motion carried. No. 1235 Moved by Betty Wells, seconded by Jack Hagerty, it was Page 3 Meeting of 3/23/95 RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH SUGGESTIONS of the Wetland Application of DAVID AIR 24-2-27 to reconstruct existing 1st floor west facing covered porch. Renovate existing 2nd floor residence with addition and roof deck over 1st floor. west facing covered porch. The CAC recommends approval of the submitted plans but suggests the Trustees request the applicant to submit plans showing the sanitary facility and if the system is a cesspool system the Trustees should request applicant to replace the existing system with a septic system. 2072 Village Lane, Orient Vote of Council: Ayes: All Motion carried. No. 1236 Moved by Jack Hagerty, seconded by Stephen Angell, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Application of EDGAR J. AND SUZANNE K. SMITH 24-2-9 to remove 10' projection on waterfront side of house and replace with 3' deep bay window; add 3' onto rear side of house as per submitted plans. Bay Avenue West, Orient Vote of Council: Ayes: All Motion carried. No. 1237 Moved by Stephen Angell, seconded by Jack Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH CONDITIONS of the Wetland Application of RICHARD R. PRIETO 87-3-44 to replace existing dock by constructing fixed walkway 39' x 3' with 6' x 3' fish cleaning station and steps to beach, hinged ramp 16' x 31, floating dock 20' x 61, two single piles and one two-pile dolphin to secure floating dock, and one single pile as a storm pole. The CAC recommends approval of the dock, however, it recommends disapproval of the fish cleaning station as it is a violation of DEC regulations allowing freshwater to run into the bay. 2750 Minnehaha Blvd., Southold Vote of Council: Ayes: All Motion carried. NOTE: The Conservation Advisory Council strongly urges the Board of Trustees to require soundings be submitted as part of the wetland application. No. 1238 Moved by Stephen Angell, seconded by Patricia Isaksen, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATIONS of the Wetland Application of WILLIAM PISARELLI 138-2-26 to install 3 piles in water to secure float (removable); construct walkway on property to access same. The CAC recommends approval provided the applicant follow the standard procedure and install a catwalk, ramp to floating dock configuration. The Page 4 Meeting of 3/23/95 walkway should be elevated at least 3' and disturbed areas should be planted with spartina. (The CAC realizes this is a substandard lot and that the 10' sideline/setback requirement cannot be followed.) 815 Sterling Road, Cutchogue Vote of Council: Ayes: All Motion carried. SET NEXT MEETING AND INSPECTION DATE AND TIME The next meeting of the Southold Town Conservation Advisory Council was scheduled for Thursday, April 20, 1995. The meeting will begin at 4:30 P.M. 'instead of the usual 4:00 P.M. This is to allow all members enough time to get to the meeting. Group inspections, if required, will be at 3:30 P.M. Respectfully submitted, Linda J.
