The Southold Town Conservation Advisory Council met Thursday, April 20, 1995. The meeting was called to order at 5:00 P.M. by Chairman Stephen Angell. Present were: Stephen Angell, Chairman Bruce. Loucka, Member Robert Keith, -Member Jack Hagerty, Member Patricia Isaksen, Member Allan Connell, Member Betty Wells, Member Linda Cooper, Secretary CHAIRMAN'S ANNOUNCEMENTS Chairman Stephen Angell reported that he had attended the Trustees' meeting. The Trustees' had disapproved the Wetland Application No. 1238 of Pisarelli for a dock because the lot was substandard in size. If they approved the project, others would be able to do the same thing and create a marina atmosphere. REPORTS Patricia Isaksen stated that she had observed conditions at some of the beaches in Southold Town and felt the CAC could become involved in a project dealing with the beaches (cleaning and planting beachgrass). The CAC agreed that an "Adopt-A-Beach" Program would be appropriate and that the CAC could spearhead ' such a project. Patricia Isaksen and Betty Wells will work on setting up a program.. Bruce Loucka expressed concerns about dumping at road endings. He . feels part of .the problem is a result of changes at the disposal area (e.g. there are . no longer bins for small pieces of wood, metal, etc) . He will draft a letter to Supervison Wickham and- Alice Hussie with some suggestions for curbing the problem. opt Meeting of 4/20/95 Bruce also reported that he will begin doing water samples at Arshamoneque -Pond. Robert Keith reminded the CAC that, due to the number of applications for that location, the CAC needs to make an inspection of Robins Island. Chairman Stephen Angell said he would speak to `the Trustees' Clerk Jill Doherty to arrange something. Allan Connell suggested that CAC arrange to have a group (Boy Scouts, 4-H) replant the beach at South Harbor Road. Suffolk County should be responsible for suppling the seeds and plantings since it is responsible for the destruction of the beach area. Allan also reported that, at the request of the Southold Town Board of Trustees, he developed a planting plan for the Keely project. Jack Hagerty reported that he had transported samples to the DEC at the request of Steve Latson. Also, he would be taking water samples from Goose Creek after the next rainfall. APPROVAL OF MINUTES ,Moved by Bruce Loucka, seconded by Jack Hagerty, it was RESOLVED to approve the minutes of March 23, 1995 as submitted. Vote of Council: Ayes: All Motion carried. RECOMMENDATION OF WETLAND APPLICATIONS No. 1239 NEW SUFFOLK SHIPYARD 117-5-29.1 to replace all bulkheading on southwest_ side of marina/shipyard. From east to west: replace (within 18") 3 sides of travel lift slip, 361, 26', 341; replace (within 18") 34' section on south side of boat storage building and 22' section on west side of boat storage building; construct 102' section, easterly 43' of which will be located immediately south of one story frame office building to replace a deteriorated retaining wall located on the north side of that structure; remaining 60' west will be built 18" - 30" in front of existing bulkhead due to bulges in present bulkhead; replace (within 18") 33' and 15' bulkhead sections. Dredge an area up to 10' off 118' of bulkheading to maximum depth of 4' below MLW. Resultant 10 +/- c.y. of spoil will be used to backfill between new and old bulkheads. Remove existing 3' x 60' of fixed walk located along southerly bulkhead. Build a 4' x 4' platform, 3' x 20' hinged ramp, 6' x 60' float. Pour a new 6' x 12' concrete pad for a gasoline dispenser which -will replace a prior gas pump which was removed. Existing tank buried in upland will be retained and used. Purpose of project is to create a stable base for one story frame office building now suspended over the water on locust posts. These and deteriorated bulkhead at north side of building are allowing building to settle Page 2 Meeting of 4/20/95 and crack. As new foundation cannot be installed under building without moving it, applicant believes this to be' the only method to correct problem. New Suffolk Road, New Suffolk CAC was advised .that the application- was WITHDRAWN. No recommendation. No. 1240 Moved by Stephen Angell, seconded by Allan Connell, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATIONS of the Wetland Application of JOHN SCHLECHT 44-1-24 to construct 110 +/- l.f. of stone revetment against eroded bluff and backfill with 100 +/- c.y. of clean sand to be trucked in from upland source. Construct 4' x 35' fixed walk and stairway over revetment for pedestrian access. (See Marianne Clarke #1241 and Beryl Wilcox #1242) 56425 'North Road, Southold The CAC- recommends approval with the stipulation that the sand buried rocks be planted with beachgrass and plant any backfill with non-turf buffer. Vote of Council: Ayes: All Motion- carried. No. .1241 Moved by Stephen Angell, seconded by Allan Connell, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATIONS of the Wetland Application of MARIANNE CLARKE 44-1-25 to construct 103+/- I.f. of stone revetment against eroded bank and backfill with 75+/- c.y._ of clean sand to be trucked in from upland source. Construct a 4' x 35' fixed walk to stairway for pedestrian access over revetment. Remove existing damaged deck. (Also see #1240 and #1241) 56525 'North Road, Southold The CAC recommends approval with the stipulation that the sand buried rocks be planted with beachgrass and plant any backfill with non-turf buffer. Vote of Council: Ayes: All Motion carried. No. 1242 Moved by Stephen Angell, seconded by Allan Connell, it was RESOLVED to recommend to' the Southold Town Board of Trustees APPROVAL WITH STIPULATIONS of the Wetland Application of BERYL WILCOX 44-1-23 to - construct 103+/1 I.f. of stone revetment against bluff and backfill with 100+/- c.y. of clean sand to be trucked in from upland source. Construct a 4" x 35' timber walkway to stairs for pedestrian access over revetment. (See #1240 and #1241) 56305 North Road, Southold The CAC recommends approval with the stipulation that the sand buried rocks be planted with beachgrass and plant any backfill with non-turf buffer. Page 3 Meeting of 4/20/95 No. 1243 Moved by Stephen Angell, seconded by Robert Keith, it was RESOLVED to recommend to the .Southold Town Board of Trustees APPROVAL - WITH STIPULATIONS of the Wetland .Application of ROBERT K. SIMON 86-6-3.1 to build 23' x 32' garage on westerly portion of property with access bridge across wetland area. Approximate size is 10' wide x 50' long, raised 8' above wetland area, supported by concrete piers on each end. 379 Wood Lane, Peconic The CAC recommends approval with the' stipulations that the applicant use sediment barriers (silt fence; hay bales) during construction; any driveway surface be pervious- to rainwater; and all disturbed ground be, regraded and planted. ' Vote of Council: Ayes: All Motion carried. No. 1244 Moved by Jack Hagerty, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATIONS of the Wetland Application of ROBERT MALLCRAF 79-1-4 to remove and replace 75 Lf. of existing bulkhead. Bulkhead will attach to and be same height as new bulkhead to east. Backfill with 15 c.y. of clean fill to be trucked in from upland source. If 'necessary a 10' return will be built on west side if proposed wall of Keely is not constructed shortly. Repair an existing 9'- x 12' deck by replacing decking, railing, etc. as needed. Remove existing deteriorated 3' x 32' fixed pier and replace with 3' x 25' fixed section (minimum 4' above grade)' 3' x 12' hinged , ramp' 6'. x 16'. float secured by (2) pilings. 500 -Goose Creek Lane, Southold The CAC recommends approval provided . the lawn between the retaining wall and bulkhead is removed and replaced with a non-turf buffer. Vote of Council: Ayes: All Motion carried No. 1245 , Moved by Robert Keith, seconded by Patricia Isaksen, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATIONS of the Wetland Application of ANDREW FOHRKOLB 137-4-30 to install stairway= from top of slope to bottom of slope, pier 31, x 261, ramp 216" x 611, 5' x 25' float. 670 Holden Avenue, Cutchogue The CAC recommends approval provided the stairway is elevated 3' off the face of the bluff; replant to stabilize; and stop mowing the spartina at the base of the bluff (violation of Town Code) . Vote of Council: Ayes: All Motion carried. Page 4 Meeting of 4/20/95 No. 1246 ALEXANDER HARVEY 11-1-12 to regrade top of bluff in approximately 900 sq. ft. area to create more stable slope angle. Installation of erosion control mat. Seeding/planting to revegetate project area. Underpinning of approximately 24 I.f. of existing foundation at corner of house. Installation of drain line to redirect existing roof runoff to land side of house. (See submitted plans) Fishers Island The CAC did not inspect, therefore the Council has no recommendation. No. 1247 Moved by Bruce Loucka, seconded by Stephen Angell, it was RESOLVED to TABLE the Wetland Application of THOMAS RAFFERTY 20-3-11.8 to construct a single family residence of approximately 2.000 sq. ft. with septic system as provided by code, shell covered driveway and two-car garage. Little Bay Road, Orient .The CAC tabled .the application because the project needs staking. Vote of Council: Ayes: All Motion carried. No. 1248 DR. ISIS A. BERTELS 10-3-10 to construct a 4' x 50' fixed dock (elevated 4' over grade of marsh), 3' x 14' ramp, and 6' x 20' float. Fishers Island The CAC did not inspect this application and has no recommendation. No. 1249 Moved by Stephen Angell, seconded by Jack Hagerty, it was RESOLVED to TABLE the Wetland Application of THEMIS KAROUSOS 30-2-66 to construct a new deck and beach stairs from the top of the bluff to the beach. 1460 The Strand, East Marion The CAC tabled the application because there drawings or plans submitted. The Council could not make a recommendation based on the material that was submitted. Vote of Council: Ayes: All Motion carried. No. 1250 Moved by Bruce Loucka, seconded by Jack Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATION of the Wetland Application of JOHN A. McCUIRE 15-1-1 to reconstruct in kind, existing 12' x 30' timber ramp, place 35 c.y. of upland fill on eroded bank which was lost during 12/94 storm, install 12' x 6' x 1' gabion mat and 3' x 3' x 12' gabion cage at toe of timber ramp, install 10' x 22' x 1' Reno mat on eroded- bank west of timber ramp, install two (high) 3' x Page 5 Meeting of 4/20/95 3" x 6" gabion cages on western return and install 21' x 6' x 1' Reno mat two (high) 3' x 3' x 21' gabion cages extending in a westerly direction from western return. 3630 North Sea Drive, Orient The CAC recommends approval with the stipulation that the applicant replant the return. Vote of Council: Ayes: All Motion carried. No. 1251 Moved by Bruce Loucka, seconded by Jack Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATIONS of the Wetland Application of PEGGY HELLER AND ANNE WYDEN 26-2-39.1 to construct a 2982+/- sq. ft. single family dwelling (base floor), a 800+/- sq. ft. attached deck, a 840 +/- gravel driveway, a 318 +/- proposed walkway, well and septic system. Majors Pond Road, Orient The CAC recommends approval with the following stipulations: 1 . Move the house for a 30' setback off the road. (75' from wetlands) 2. Maintain a non-turf buffer 20' from the 10' contour line. 3. Use hay bales and silt fence during construction. 4. Move the cesspool system to the north. Vote of Council: Ayes: All Motion carried. No. 1252 Moved by Bruce Loucka, seconded by Jack Hagerty, it was RESOLVED to ' recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATIONS of the Wetland Application of BARBARA DEFINA 26-2-7.1 to install a 40' dumped rock rip-rap for erosion control. Willow Terrace, Orient The CAC recommends approval .provided the applicant grade so the toe of the rip-rap is buried and plant with beachgrass. Also maintain a 10' non-turf buffer instead of lawn behind 'rip-rap Vote of Council: Ayes: All Motion carried. No. 1253 Moved by Stephen Angell, seconded by Patricia Isaksen, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Application of DR. MELVIN MORRELL 99-3-4.6 to extend easterly return by 20' and backfill with 20+/- c.y. of clean sand to be trucked in from upland via Bailie Beach Road to west. ` Return will be armored with 1-ton stone on filter cloth as is the remainder of the wall. Page 6 Meeting of 4/20/95 1254 Moved by Allan Connell, seconded by Jack Hagerty, it was RESOLVED ' to recommend to the Southold Town Board of Trustees PARTIAL APPROVAL WITH STIPULATIONS of the Wetland Application of JOSEPH ST. PIERRE 79-1-6 to remove and replace (in same location and configuration) 93 I.f. of existing timber bulkhead. Backfill with 10 c.y. of spoil to be taken from an area up to 10' off bulkhead and maximum depth 3' below MLW. Two existing timber groins (west 81; east 121) will be refaced with new sheathing without alteration of overall lengths. Remove (without replacement) .existing platform and stairs. Install a 3' x 12' hinged ramp off an existing off an existing walkway on top of westerly groin. Ramp will rest upon proposed 6' x 16' float secured by slides and rings to bulkhead. 370 Goose Creek Lane, Southold The CAC recommends approval for most of the project. There is no need for the dredging therefore the Council recommends disapproval of that portion of the application. The applicant should maintain a 20' non-turf buffer 20' behind the bulkhead. Vote of Council: Ayes: All Motion carried. ` No. 1255 FISHERS , ISLAND YACHT CLUB 10-1-9 to install two 10' x 16' floats, four 12' x 16' floats, four- 4' x 18' floats, to replace one pile lost in 12/94 storm, to relocate two existing piles and to install four new spring piles at existing yacht club. Fishers :Island ,The CAC did not inspect the , project, therefore, the Council has no recommendation. No: 1256 Moved by Bruce Loucka, seconded by Robert Keith, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Application of STEVE GREENBAUM 56-5-38 to install 4' x 100' pier, two elevator lifts, 3' x 20' ramp, 7' x 30' float, 4 float piles and 4 mooring piles. 1073 Bay Home Road Ext., Southold Vote of Council: Ayes: . All Motion carried. No. 1257 ' Moved by Stephen Angell, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Application of URAL TALGAT or ARTO KHRIMIAN 44-2-13 to renovate an existing greenhouse structure and encompass the wood frame building and greenhouse structure under one new roof. 583 County Road 48, Greenport Page 7 Meeting of 4/20/95 The CAC recommends disapproval because it is an ill conceived plan of that location and the cesspools are a problem. The CAC is concerned with the pollution from an inadequate septic system. Vote of Council: Ayes: All Motion carried. No. 1258 Moved by Robert Keith, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH CONDITIONS " of the Wetland Application of JOHN F. PETERSEN 31-12-5.2 to enlarge second floor of house for more living space. 970 Trumans Path, East Marion The CAC approvals provided the applicant use hay bales and silt fence during construction. Vote of Council: Ayes: All Motion carried. RECOMMENDATION OF GRANDFATHER PERMITS GF-1 Moved by Stephen Angell, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the request for a Grandfather Permit by SUSAN NORRIS 123-9-1 to reconstruct jetties and dock structures. Existed prior to 4/6/76. 2790 New Suffolk Avenue, Mattituck The CAC recommends disapproval because it is a substantial project with additional new work included. A Wetland Permit, should be required and' the application should include plans for the dock. Vote of Council: Ayes: All Motion carried. CF-2 Moved by Stephen Angell, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the request for a Grandfather Permit by JUNE DUFFNER 123-3-11.1 to remove a dilapidated 32" x 34' fixed dock, replace with a 3' x 34' fixed dock, reconstruct 'existing 3' x 12' ramp and reinstall existing 6' x 20' float. 915 Bungalow Lane, Mattituck The CAC recommends disapproval of the Grandfather Permit request. NEW BUSINESS Fishers Island Recommendations The CAC discussed the problem of Fishers Island inspections and as a result of the discussion developed the following policy Moved by Stephen Angell,- seconded by Bruce Loucka, it was RESOLVED that it shall be the policy of the Southold Town Conservation Advisory Council to agree with the recommendation of an individual CAC member if said member of the CAC makes an inspection of a Fishers Island - project on behalf of the other members of the CAC. Vote of Council: Ayes: All Motion carried. Bay Home Road Runoff Problem Bruce Loucka requested that the CAC send a letter to the Southold . Town Trustees to make them aware of the severe road runoff situation which is occurring at the end of Bay Home Road. The CAC agreed that the secretary should send a memo to the Trustees concerning this matter. SET NEXT MEETING AND INSPECTION DATE The next meeting of the Southold Town Conservation Advisory Council was scheduled for Thursday, May 18, 1995 at 4:30 P.M. -- Members will advise the secretary if any Group Inspections are required. 4 There being no further business to come before the Council, the meeting was adjourned at 7:05 P.M.
