Box 1179 (516) 765-1801 ��- Southold, New York 11971 SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL THURSDAY, MAY 18, 1995 4:30 P.M. A meeting of the Southold Town Conservation Advisory Council was held Thursday, May 18, 1995 at the Southold Town Hall, Main Road, Southold, New York. The meeting was called to order at 4:30 P.M. by Chairman Stephen. Angell. Present were: Stephen Angell., Chairman Bruce Loucka, Member Robert Keith, 'Member John Hagerty III, Member Patricia Isaksen, Member Betty Wells, Member • Allan Connell, Member CHAIRMAN'S ANNOUNCEMENTS Stephen Angell reported that he has been attending the Trustee meetings and has decided that instead of attending all the meetings which are taken up with the work session, he will now only attend the Public Hearings. Stephen Angell has requested that the_ CAC devise a policy or guideline for determining the width of catwalks T vs'. 41. Allan Connell volunteered to check with his sources and Stephen would check with the Trustees and a policy would be devised at the next meeting. Stephen also reported that he had:"been approached to have the CAC work on a booklet for permits of Southold Town. The CAC discussed the matter and decided that ,the council would provide input but would not compile such a booklet. Meeting of MAY 18, 1995 REPORTS Bruce Loucka reported that he has been taking samplings from Arshamomaque Pond. The has been discussion that a property owner may donate an easement on Arshamonaque for use a a recharge basin. APPROVAL OF MINUTES Moved by Robert Keith, seconded by Bruce Loucka, it was RESOLVED to approve the minutes of April 20, 1995 as submitted. Vote of Council: Ayes: All Motion carried. RECOMMENDATION OF WETLAND APPLICATIONS No. 1239 Moved by Robert Keith, seconded by Patricia I saksen, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Application of NEW SUFFOLK SHIPYARD 117-5-29.1 to replace bulkheading on southwest side of marina/shipyard. From east to west: replace (within 18") 3 sides of travel lift slip, 361, 26', 341; 34' section on south side of boat storage building and 22' section on west side of boat storage building; construct 103' section, easterly 43' of which will be located immediately south of one story frame office building to replace a deteriorated retaining wall located on the north side of that structure; remaining 60' west will be built 18"-30" in front of existing bulkhead due to bulges in present bulkhead; replace (within 18") 33' and 15' bulkhead sections. Dredge an area up to 10' off 118' of bulkheading to maximum depth of 4' below MLW. Resultant 100 +/- c.y. of spoil will be used to backfill between new and old bulkheads. Remove existing 3' x 60' of fixed walk located along southerly bulkhead. Build a 4' x 4' platform, 3' x 20' hinged ramp, 6' x 60' float. Pour a new 6' x 12' concrete pad for a gasoline dispenser which will replace a prior gas pump which was removed. Existing tank buried in upland will be retained and used. Purpose of project is to create a stable base for one story frame office building now suspended over the water on locust posts. There and deteriorated bulkhead at north side of building are allowing building to settle and crack. As new foundation cannot be installed under building without moving it, applicant believes this to be the only method to correct problem. Page 2 Meeting of MAY 18, 1995 No. 1260 Moved by Bruce Loucka, seconded by Allan Connell, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Application of ARNOLD BLAIR AND KAREN BLAIR 37-7-10.2 to construct a six foot chain link fence to mark the boundary lines of applicant's property as shown on survey. The CAC recommends disapproval because the fence would deny access to the beach and it appears from the survey provided that the fence is going across Beach Court which does not appear to be the applicant's property. Also the proposed fence could possibly destroy beach vegetation. Cedar Lane, East Marion Vote of Council: Ayes: All Motion carried. No. 1261 Moved by Allan Connell, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Board of Trustees the following for the Wetland Application of VIRGINIA CROPPER AND CECELIA KEMPLER 66-3-9 to 1) construct single family residence, 2)timber bulkhead along westerly bank of Pettys Pond, 3) catwalk and dock as per submitted plans. 1) The CAC recommends APPROVAL OF THE SINGLE FAMILY DWELLING. 2) The CAC recommends DISAPPROVAL OF THE BULKHEAD. There is no demonstrated need for the bulkhead. The area is well stabilized; there is no erosion problem; and the house is far enough back so that it is not in danger. Since there is no need for the bulkhead then there is also no need for bring in clean fill and/or sand to backfill. 3) The CAC recommends APPROVAL OF THE DOCK AND THE CATWALK IF OF AN APPROPRIATE LENGTH TO REACH UPLAND. Arshamomaque Avenue, Southold Vote of Council: Ayes: All Motion carried. No. 1262 Moved by Allan Connell, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATIONS of the Wetland Application of FRANK PASSARO 44-1-26 to construct 102 =/ l.f. of stone revetment against eroded bank and backfill with 75 +/- c.y. of clean sand to be trucked in from upland source. Construct a 4' x 35' fixed walk and stairway for pedestrian access over revetment. (Project with Clarke, Schlecht, and Wilcox) The CAC recommends approval with the stipulation that the sand buried rocks be planted with beachgrass and plant any backfill with non-turf buffer. 5665 North Road, Southold Vote of Council: Ayes: All Page 3 Meeting of MAY 18, 1995 Motion carried. No. 1263 Moved by Bruce Loucka, seconded by Robert Keith, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Application of LOUIS MOORE BACON 134-3-5 to Dredge approximately 2700 c.y. 10-15% brick, 20% gravel and 65% sand to 5' below MLW. Material to -be trucked away to approved upland site. Ferry berthing area to be maintained at 7" below AMLW. Robins Island Vote of Council: Ayes: All Motion carried. No. 1264 Moved by Robert Keith, seconded by Patricia I saksen, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Application of DORIS COSGROVE 86-5-9.4 to install 4' x 40' catwalk, 6' x 20' float, 3' x 18' aluminum ramp, and two (2) 2-pile dolphins. Indian Neck Lane, Peconic Vote of Council: Ayes: All Motion carried. No. 1265 Moved by John Hagerty, seconded by Betty Wells, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH PROVISIONS of the Wetland Application of MYLES SCHNEIDER 37-5-11 to 1 . Construct deck 16 x 16 and 3' wide catwalk on south end of house. 2. Remove existing dolphins (approx. 25' from bulkheading) and construct a platform (4x4 and a ramp 3'x10' wide) to a floating dock 5' x 26'. Floating dock to have 2 pilings. 3. Create an enclosure on the east side of the garage 30" wide for garbage cans and storage. 4. Install Bilco down into basement. 36" x 5' across. 5. Grandfather permit for approx. 100' bulkhead, built approx. 40 years ago. The CAC recommends approval of the deck and walkway (not catwalk) subject to zoning regulations. Also the CAC's approval for the enclosure on the east side of the garage is subject to zoning regulations. All other aspects of the application are approved as submitted. Knoll Circle, East Marion Vote of Council: Ayes: All Motion carried. Page 4 Meeting of MAY 18, 1995 No. 1266 Moved by Bruce Loucka, seconded by John Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Application of NICK ARONIADIS 15-9-1.6 to construct 185 I.f. (plus (2) 15' returns) of stone revetment using 3-5 ton stone on 100-1000 core, 10-50 Ib. blanket. Approx. 375 c.y. of clean sand will be trucked in for backfill. A 12' wide area of revetment will be made suitable for a boat launching ramp for owner's private use. 1090 Latham Lane, Orient Vote of Council: Ayes: All Motion carried. No. 1267 Moved by Robert Keith, seconded by Patricia I saksen, it was RESOLVED to recommend to the Southold Town Board of Trustees the following for the Wetland Application of ARTHUR AXBERG, Jr. 123-5-34 for A. Proposed 37' x 27' x 10' renovation and two story additions to existing one story residence. Existing house to be raised 24". B. Proposed timber bulkhead to replace existing timber bulkhead. The CAC recommends APPROVAL OF THE RENOVATION TO HOUSE as submitted. The CAC recommends APPROVAL WITH PROVISIONS OF THE BULKHEAD. The CAC approves provided the bulkhead is replaced within 18" of existing bulkhead and if applicant wishes, it can be higher to match the neighbor to the west. Camp Mineola Road, Mattituck Vote of Council: Ayes: All Motion carried. No. 1268 Moved by Robert Keith, seconded by John Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees the following for the Grandfather Permit and Wetland Application of LORRAINE WENDT 115-12-14 to Grandfather 31'2" x 4' catwalk with associated pilings and a permit to add a ,3' x 12' ramp and 6' x 20' float in an "L". The CAC recommends APPROVAL OF THE PERMIT FOR THE RAMP AND FLOAT. The CAC recommends APPROVAL OF THE GRANDFATHER PERMIT FOR THE CATWALK IF THE CATWALK IS RAISED TO 4' WHEN IT NEEDS TO BE REPLACED. 980 Deep Hole Drive, Mattituck Vote of Council: Ayes: All Motion carried. Page 5 Meeting of MAY 18, 1995 No. 1269 Moved by Allan Connell, seconded by Stephen Angell, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Application of RUSSELL E. MANN 70-4-48 to restore sand to spoil area. In 1987 sand was dredged from the north side of the dock and deposited in the spoil area. In recent years storms have washed sand from the spoil area to the north side of the dock. The CAC recommends disapproval because no need is shown. If soundings are done to prove there is a need for the dredging the CAC recommends a minimum of dredging to a 4' depth at low tide. 1775 Calves Neck Road, Southold Vote of Council: Ayes: All Motion carried. No. 1270 Moved by Stephen Angell, seconded by Allan Connell, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Application of JOHN XIKIS 44-1-13 to construct 1 10' x 200 +/-' wood walk between existing gabion wall and timber retaining wall. The CAC recommends disapproval because decking of this magnitude is not in keeping with the spirit of the non-turf, vegetative buffer requirement. The Council recommends the area be planted or filled with rocks to allow for percolation of runoff. Middle Road, Southold Vote of Council: Ayes: All Motion carried. RECOMMENDATION OF WAIVER REQUESTS WR-22 Moved by Stephen Angell, seconded by Allan Connell, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATIONS of the Wetland Application of JOSEPH MARRAPODI 137-1-9 for proposed renovations - 2 story additions to 24 x 32 existing 1 1/2 story house and addition to existing deck, 7 x 18. The CAC recommends approval only if the septic system is acceptable. The septic system should be properly located and of sufficient size, if not, the system must be brought up to current code to lessen its impact to the creek. Stillwater Avenue, Cutchogue Vote of Council: Ayes: All Motion carried. Page 6 Meeting of MAY 18, 1995 RECOMMENDATION OF GRANDFATHER PERMITS GF-3 Moved by Stephen Angell, seconded by Allan Connell, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH COMMENTS of the Grandfather Permit of NICHOLAS MAZZAFERRO 37-4-6 to perform maintenance repairs; resheath 188' (lower half) timber bulkhead on outside, replace 188' lower wale, replace 32 pilings and reweld tie roads. The CAC recommends approval but wishes to bring the Trustees' attention of a problem located on the property. There are two pipes running through the north side of the property providing drainage from the road. The situation needs remedy. 2125 Cedar Lane, East Marion Vote of Council: Ayes: All Motion carried. GF-4 Moved by Allan Connell, seconded by Stephen Angell, it was, RESOLVED to TABLE the Grandfather Permit request of CHARLES W. RIESTERER 70-4-47 to 1 . Rebuild 4 damaged jetties 2. Rebuild boat ramp to it preexisting condition. The CAC tabled the application because it is unclear whether the X's on the plans show extensions to the existing or areas to be rebuilt. If X's indicate areas to be rebuilt how many feet out for each? The CAC cannot make a recommendation with clarification. 1945 Calves Neck Road, Southold Vote of Council: Ayes: All Motion carried. RECOMMENDATION OF AMENDMENTS TO PERMITS A-14 Moved by Stephen Angell, seconded by Allan Connell, it was RESOLVED to TABLE the Amendment request of JOHN AND AMY MURPHY 43-5-4 E 18 to increase catwalk width from 3' to 4'. The CAC is presently researching the scientific viewpoint for determining the proper width. Vote of Council: Ayes: All Motion carried. Page 7 Meeting of MAY 18, 1995 SET NEXT MEETING DATE The next meeting of the Southold Town Conservation Advisory Council was scheduled for WEDNESDAY, JUNE 21, 1995 at 4:30 P.M. at the Southold Town Hall.
