New York 11971 (516) 765-1801 . 1 SOUTHOLD -TOWN CONSERVATION ADVISORY COUNCIL THURSDAY, AUGUST 24, 1995 4:00 P.M A meeting of the Southold Town Conservation Advisory Council was held Thursday, August 24, 1995 at 4:00 P.M. at the Southold Town Hall, Main Road, Southold, New York. The meeting was called to order by Chairman Stephen Angell. Present were: Stephen Angell, Chairman Bruce Loucka, Member John Hagerty III, Member Betty Wells, Member Linda Cooper, Secretary Absent were: Robert Keith, Member Allan Connell, Member CAC member Patricia Isaksen has resigned and the seventh member will soon be appointed by the Southold Town Board. REPORTS There has been little activity with the CAC during the past month. Chairman Angell attended the Trustees' July meeting. Bruce. Loucka did water sampling once during June. APPROVAL OF MINUTES Moved by Stephen Angell, seconded by John Hagerty, it was RESOLVED to approve the minute of July 19, 1995 as submitted. Vote of Council: Ayes: All Motion carried. RECOMMENDATIONS OF WETLAND APPLICATIONS No. 1225 Moved by Stephen Angell, seconded by John Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Application of JOHN H. M.ULHOLLAND AND MICHAEL P. BONTJE 57-2-23 & 24 to maintenance dredge to 3' below MLW on Mulholland Y Meeting of 8/24/95 and Bontje parcels (privately owned bottom), dewater spoil on site and then move to upland site on Island View Lane with owners permission. Also to add and restore 3' x 30' open pile dock to Mulholland and twin pilings to each on remnant piles near waters edge of Mulholland property. 725 and 802 Island View Lane, Greenport Vote of Council: Ayes: All Motion carried. No. 1278 - TABLED 7/19/95 Moved by Stephen Angell, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATION of the Wetland Application of GERALD RUPP 51-1-21 to construct 80 feet of timber bulkhead approximately 23 feet landward of the mean high water mark. One hundred (100) cubic yards of clean fill will be utilized to backfill between the existing bluff and bulkhead. Bulkhead will tie into neighbors to the east and west as per revised survey dated August 9 1995.. CAC recommends approval with the stipulation that the fill area be planted with American Beach Grass. Also, the brush and trees currently being removed should not be. thrown over the bluff and any brush already thrown over the bluff be removed. Sound View Ave., Southold Vote of Council: Ayes: All Motion carried. No. 1279 - TABLED 7/19/95 Moved by Stephen Angell, seconded by Bruce Loucka, it was ,RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH PROVISIONS of the Wetland Application of WILLIAM TURNBULL 52-1-1 to construct 160 +/- I.f. of stone revetment against eroded bank and backfill with 85 +/- c.y. of clean sand to be trucked in form upland source. Construct a 4' x 30' stairway to connect to existing platform and stairs for pedestrian access over revetment. The CAC recommends approval provided that after reburying the revetment, all fill be planted with beachgrass. Also the Trustees should require the applicant to keep structure maintained and buried. 54005 North Road, Southold.- Vote of Council: Ayes: All Motion carried. No. 1281 - TABLED 7/19/95 Moved by Stephen Angell, seconded by Betty Wells, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Application of LOUIS BACON 134-3-5 to , construct two .board Page 2 Meeting'of 8/24/95 walkways for the purpose of crossing areas of intertidal marsh as located by the staff of the NYSDEC. The northern most walk shall be 18" x 147' and be constructed 18" over grade of the marsh. The southern most walk shall be 18" x 112' and be constructed 18" over the grade of the marsh. Robins Island. Vote of Council: Ayes: All Motion carried. No. 1282 Moved by Stephen Angell, seconded by Betty Wells,_ it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Application of WILLIAM M. and MARIA SCHENONE 114-7-11.3 to construct a 4' x 140' walk, 3' x 50' elevated catwalk, 3' x 18' ramp, 6' x 10' float and 6' x 20' float to be anchored by (4) 10" x 30' piles. Westphalia Road, Mattituck Vote of Council: Ayes: All Motion carried. No. 1283 Moved by Stephen Angell, seconded by- John Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Application of MATTITUCK PARK COMMISSION 126-5-11 to reconstruct two (2) deteriorated timber jetties (115' and 174 ) in kind/in place. The CAC recommends approval but questions why the application fee is being waived. It appears inappropriate that the Park District fee should be waived since it is not beneficial to all town residents. Peconic Bay Blvd. and Bay Avenue Road, Mattituck Vote of Council: Ayes: All Motion carried. No. 1284 Moved by Stephen Angell, seconded by Betty Wells, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland , Application of MATTITUCK PARK COMMISSION 126-6-17 E 18 to reconstruct existing deteriorated timber jetty (125' in length) in kind/in place. The CAC recommends approval but questions why the application fee is being waived. It appears inappropriate that the Park District fee should be waived since it is not beneficial to all town residents. No. 1285 Moved by Stephen Angell, seconded by John Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH SUGGESTIONS of the Wetland Application of DR. SELIM SAMAAM 111-9-10 to removed debris from face of bluff and construct at toe 190 +/- l.f. retaining wall and two (2) 8 I.f. returns. Restore bluff with approximately 500 c.y. of clean sand and place 2' thick layer of 12"-18" quarry stone on filter cloth between retaining wall and existing timber bulkhead. The CAC recommends approval but suggests that a buffer or berm is needed at the top of the bluff to control runoff from the lawn. The CAC suggests the Trustees request the Soil Conservation supply a plan 'to divert the runoff., 4875 Nassau Point Road, Cutchogue Vote of Council: Ayes: All Motion carried. No. 1286 Moved by Stephen Angell, seconded by John Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATIONS of the Wetland Application of WILLIAM ELS 72-1-1.10 to construct a 160' retaining wall with 40' angled return on west side. Wail to be connected to landward endof return to east. Structure to be armored with 1 +/- ton stone on filter cloth; and backfilled with 375 c.y. of sand to be trucked in from Duck Pond Road to west. A 41. x 170' stairway with two (2) 4' x 8' platforms to be built for access to beach. The Council "recommends approval, provided that applicant bury the bulkhead as per Trustees most recent bulkhead policy and plant fill with beachgrass; elevate stairs to an adequate height to allow vegetation to grow. ROW off Bridge Lane and Oregon Road, Cutchogue, Vote of Council: Ayes: All Motion carried. No. 1287 -Moved by Bruce Loucka, seconded by John Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATIONS of the Wetland Application of ELINO U. DENA, JR. 73-5-1 to install 281 +/- I.f. of steel retaining wall . as close to toe of existing eroded slope as is feasible to install tieback system. Backfill with 1200 +/- c.y. of clean fill to be trucked in from upland source and place a stone splash pad 12 +/- landward of wall.. Repair (or replace as necessary 31' wide stairways and platforms to provide pedestrian access to beach. Page 4 Meeting of 8/24/95 The Council . recommends approval with the recommendation that the retaining wall be placed the toe of the bluff and the fill planted with beachgrass. The CAC suggests the Trustees explore the possibility of burying a bulkhead. ROW off Route 48, Southold Vote of Council: Ayes: All Motion carried. No. 1288 Moved by Bruce Loucka, seconded by John Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH CLARIFICATIONS of the Wetland Application of ANN KWASNESKI 71-1-10 to reconstruct within 18", 100 +/- of timber bulkhead, to construct a 24' return along western property line and to backfill structure with 20 +/- c.y. of clean sand to be trucked in from an upland source. The CAC recommends approval of the bulkhead. According to the submitted diagram, it appears the applicant wants to reconstruct walkways, if so, the Council recommends approval of the walkway behind the bulkhead, but, the walkway located by the middle groin be disapproved. There -is not need shown and the structure should not be on the beach. North Parish Road, Southold Vote of Council: Ayes: All Motion carried. No. 1289 Moved by Bruce Loucka, seconded by John Hagerty, it was RESOLVED to recommend to the Southold. Town Board of Trustees APPROVAL of the Wetland Application of DOROTHY LUDECKER 87-5-2 to construct a 3' x 48' catwalk, (elevated 3 1/2' over grade of marsh), 3' x 14' ramp, 6' x 20' float, and two (2) pile dolphins. ROW off Main Bayview Road, Southold Vote of Council: Ayes: All Motion carried. No. 1290 Moved by Bruce Loucka, seconded by Stephen Angell, it was RESOLVED to recommend to -the Southold Town Board of Trustees DISAPPROVAL of the Wetland Application of WILLIAMD AND CHRISTOPHER CONNORS 59-5-29.3 to construct a single family dwelling. The CAC recommends disapproval for the following reasons 1 . Project is located on Wetlands 2. Lot size is inadequate. 3. 670 of the lot is wetlands. 4. Located in flood zone. Page 5 c Meeting of 8/24/95 5. Shallow watertable - septic system could impact the groundwater. 350 West Drive, Southold Vote of Council: Ayes: All Motion carried. No. 1291 Moved by Bruce Loucka, seconded by Stephen Angell, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Application of GERARD H. BELLESHEIM 15-3-9 to construct 100' of bulkhead (as per plan) . The CAC recommends disapproval as submitted. - The Council suggests a rock revetment as per the DEC letter of July 14, 1995 or bury the bulkhead as per Trustees' policy for bulkheads on the Sound. 122 Sound View Drive, Orient Vote of Council: Ayes: All Motion carried. No. 1292 Moved by Bruce Loucka, seconded by John Hagerty, it was RESOLVED to recommend to the Southold Town Board` of Trustees APPROVAL WITH PROVISIONS of the Wetland Application of WILLIAM J. AND MARK S. McDONALD 135-1-5 to rebuild existing bulkhead and replace existing decks, stairs, etc. as necessary The Council recommends approval with the provision that a non-turf buffer on the embankment be installed to prevent further erosion. 21515 Soundview Avenue, Southold Vote of Council: Ayes: All Motion carried. No. 1293 Moved by Bruce Loucka, seconded by Betty Wells, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATIONS of the Wetland Application of THOMAS APREA, SR. 37-7-9.1 to construct 190' +/- of upland retaining walls and to reconstruct in kind in place 60' of timber groin and 20' of timber groin. The Council recommends approval the groin reconstruction for the 25' groin as submitted. The 60' groin should be cut back to equal the length of those to the east. The CAC recommends approval of the retaining walls only if the fill has been placed there legally, if the fill has not been legally placed then the fill should be removed and there would then be no need for the retaining walls. Page 6 Meeting of 8/24/95 Beach Court, East Marion Vote of Council: Ayes: All Motion carried. RECOMMENDATION OF WAIVER REQUESTS WR-23 Moved by Stephen Angell, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Board of Trustees DENIAL of the Waiver Request of SALLY GUIDO 73-5-20 to raise house and construct an addition and deck as shown on submitted survey. The CAC recommends denial of the Waiver Request because the project could have an impact on the bay without the proper protections required by the Trustees. If a waiver were granted the Trustees would not have jurisdiction to protect the bay. By denying the waiver, the Trustees could require a permit and require the standard protections of hay bales, silt fences, runoff containment, etc. Should the Trustees require a permit, the. CAC would not object to the project provided the standard protection were required. Bay Shore Road, Southold Vote of Council: Ayes: All Motion carried. WR-24 Moved by Stephen Angell, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Board of Trustees DENIAL of the Waiver Request of MR. and MRS. RICHARD DRAKE JR. 139-3-35 to erect 8' x 10' utility shed. The' CAC recommends denial of the waiver request because it allows the Trustees to relinquish their jurisdiction over the project. The CAC would approve the project if it were a Wetland Application provided there was a stipulation that the shed not be used for storage of any pollutants (such as, but not limited to oil, gas, paints, insecticides and herbicides) which could possibly pollute the creek. 65 Freeman Road, Mattituck Vote of Council: Ayes: All Motion carried. WR-25 Moved by Stephen Angell, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Waiver Request of ARTHUR HAF 103-10-25 to construct a split rail fence. RECOMMENDATION OF AMENDMENT TO PERMIT A-16 Moved by Stephen Angell, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Amendment Request of ROBERT J. and PATRICIA F. MELCHIONE 77-1-8 to extend dock from 60' x 216" to 70' x 3'. Permit issued 6/4/73. Oak Avenue, ,Southold Vote of Council: Ayes: All Motion carried. RECOMMENDATION OF GRANDFATHER PERMITS GF-5 Moved by Stephen Angell, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Grandfather Permit of THE ELEANOR S. NOHE REVOCABLE TRUST 118-2-6.2 for wood. bulkhead and wood dock. Bridge Lane, Cutchogue Vote of Council: Ayes: All Motion carried. GF-6 Moved by Betty Wells, seconded by Stephen Angell, it was . RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH CONDITIONS of the Grandfather Permit of GEORGE W. KOCH 31-18-6 to replace all existing deteriorated cedar poles under building that was built approx. 1932 The Council recommends approval provided applicant uses hay bales and silt fence around the bulkhead during construction and care be taken not to allow silt or sediment to wash into the adjacent tidal waters. 270 Rabbit Lane, East Marion Vote of Council: Ayes: All Motion carried.
