THURSDAY, SEPTEMBER 21, 1995
The Southold Town Conservation Advisory Council met Thursday, September
21, 1995. at. 4:00 P.M. at the. Southold :Town Hall.
Present were: Stephen Angell, CAC Chairman

The meeting was called ` to order by Chairman Stephen Angell. Scott Hilary, .
the CAC's newest member was introduced and gave a brief. bio.
REPORTS
Bruce Loucka reported on the water sampling program.
Stephen Angell asked if anyone was interested in representing the CAC at the
Shellfish Advisory Committee meetings. Scott_ Hilary volunteered.
Stephen Angell reminded members to call if they felt a group inspection was
necessary and check with the CAC secretary the day of the meeting if any
have been scheduled.
RECOMMENDATION OF WETLAND APPLICATIONS
No.. 1294
Moved by Stephen Angell, seconded by Bruce Loucka, it was
RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the Wetland Application of DR. EARL A. LOOMIS, JR.
49-1-18 to construct approximately 101' of timber bulkheading, a 20' return
and to backfill structure with approximately 20. c.y. of clean sand which shall
be trucked in from an upland source.

Private Road, Greenport
The Council recommends disapproval because the house is not in danger and
the proposed plan is not necessary to stabilize the bluff. Instead the Council
recommends the application use a "soft" approach. The applicant should
regrade and plant with native vegetation; maintain a non-turf buffer 20'
landward of the current bluff to prevent runoff and erosion from site; and
contact the Natural Resource Conservation Service for a planting plan.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Wetland Application of MARY IRENE BURNS 70-4-10 to construct 130+/-
linear feet of revetment/rip 'rap utilizing 100-150 Ib. quarry stone installed
to grade in accordance with the survey dated 8/8/94; also to plant beach grass
one foot on center between the seaward tow of the proposed revetment/rip rap
and the landward edge of tidal wetlands.

Moved by Allan Connell, seconded by Stephen Angell, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH PROVISIONS of the Wetland Application of CHARLES CAPPELLINO
99-3-2 to construct 100' of timber bulkhead in line with similar structures on
adjacent properties. Structure shall be backfilled with 200 +/- c.y. of clean
sand to be trucked in from an upland source.

The Council recommends approval with the provision that the applicant control.
runoff by constructing a berm at the top of the bluff and planting with salt
tolerant vegetation (i.e. beachgrass)

RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL AS SUBMITTED the Wetland Application of NICOLA
DIBARTOLO 127-3-6.1 & 6.2 to construct a bridge to allow access from
existing residence to public street (Condor Ct.) .

The Council recommends disapproval of the application as submitted because it:
1 . Disturbs the environment to a great extent.
2. The proposed ,bridge configuration is restrictive to water flow.
3. The amount of fill would degrade the estuary.
The Council suggests the applicant consider an open bridge concept.

RESOLVED to TABLE FOR ADDITIONAL INFORMATION the Wetland
Application of DANIEL C. MOONEY 31-17-11 to construct foundation; septic
system; well; and move house onto site.
Rabbit Lane, East Marion
The Council needs the following information:
1 . What house is being moved to what location. The survey was unclear.
2. What will happen to the current septic system.
3. What are the future plans for the site, if there are no plans, how
will the site be rehabitated?

Moved by Stephen Angell, seconded by Allan Connell, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH CONDITIONS of the Wetland Application of STANLEY CHASE
115-12-12 to construct a timber dock a minimum of 4' above grade of marsh
and 3' x 30' fixed catwalk extending from top of "bank" as shown on survey; 3'
x 12' hinged ramp; 6' x 16' float arranged in "T" formation and secured by two
(2) 8" pilings.
Deep Hole Drive, Mattituck
The Council recommends approval provided the project does not interfere or
impede the navigation in the creek.
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH PROVISIONS of the Letter of Non-Jursidiction requested by STANLEY
CHASE 115-12-12 for the construction of a one family dwelling, deck sanitary
system, driveway, which are all shown on the submitted site plan. All work to
be in excess of 75' from nearest wetland/water.
Deep Hole Drive, Mattituck
The Council recommends approval provided the applicant respects the required
buffer area during clearing and construction.

Moved by Stephen Angell, seconded by Allan Connell, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH CONDITIONS AND PROVISIONS of - the Wetland Application of
BROADWATERS COVE MARINA 104-8-2.5 to remove an existing 14' x 14'
wood-surfaced launching ramp and replace it with a 1616" x 53'
concrete-surfaced ramp by removing bulkhead on west side of ramp. Ramp will
be extended seaward to prevent trailers from going off end of ramp at low
tide. New west side will consist of 24' upland bulkhead which will connect to
existing bulkhead. and 25' free-standing wall with 3' wide walk atop.
Excavated upland (10 c.y.) will be used to backfill new bulkhead. Also to
modify an existing 12' x 20' concrete block tool shed by increasing its height
by 5' and extending 5' to the south. Lower 4' of existing shed will be filled
in and new floor poured. A 4' x 4' platform and 4' x 6' staircase will be
added on west side to allow access from that side. A doorway will be added on
east side for access from parking area. (Purpose of project is to avoid flood
damage to contents of shed and improve accessibility.) There is no sanitary
system for this building nor si on proposed. It is used solely for storage of
tools and equipment.
8000 Skunk Lane, Cutchogue
The Council recommends approval of the ramp with the stipulation that runoff is
controlled. The Council suggests the applicant regrade so the water is
directed to the parking lot or install a catch-basin trough to direct the water
away from the ramp.
The CAC recommends approval of the shed with the condition that is be
prohibited to use for storage of gas, oils, chemical, etc. The CAC also feels
the applicant needs to address, to the Trustees, the issue of the gas pump.
(Where is the tank located, will is be disturbed, etc.?)

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Wetland Application of FLORENCE TILDEN 115-17-14 to construct one
and 1/2 garage and storage shed attached to house in front yard.
3100 Deep Hole Drive, Mattituck
The CAC recommends approval with the reminder of the policy of containing
runoff during construction through the use of hay bales, filter cloth, etc.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH CONDITIONS of the Wetland Application of WILLIAM J. POTTS, JR.

80-1-4 to reconstruct approximately 57' bulkhead within 18" and 18" higher
with one 12' return. Backfill with approximately 30 c.y. of clean fill.

The Council recommends approval provided the applicant maintain a 10' non-turf
buffer.

Moved by Bruce Loucka, seconded by Betty Wells, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH STIPULATION AND SUGGESTIONS of the Wetland Application of DR.
THOMAS J. McDONAGH 90-1-6 to construct a 10' x 60' x 2' earthen berm,
which shall be fronted by a rock revetment consisting of 200-500 lb. rock
placed 2' below grade on filter cloth. Berm shall then be planted with Rosa
rugosa; 18" o.c. Proposed berm and revetment shall be constructed on what
is known lawn area. Purpose is for storm and flood protection.
Cedar Beach Drive West, Southold.
The CAC recommends approval with the stipulation that all construction be
landward of the current stakes. Also applicant should add beach grass to the
plantings to stabilize berm. The CAC also suggests the applicant that the rock
revetment is not necessary.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH CONDITIONS of the Wetland Application of ROBERT SHANK , 111-1-19.1
to raise existing house and decks to Federal flood plane levels; approximately
20 c.y. of clean fill to be brought to site; to upgrade septic system.

The Council recommends approval with the condition that the applicant use silt
fence and extreme care so no silt goes into the water
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Grandfather Permit request of ROBERT SHANK 111-1-19-1 for a
bulkhead and dock. Bulkhead approximately 75' with 2 returns; dock is 10' x
5' platform; ramp 12' x 3' and float 20' x 6 .

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Waiver Request of JOSEPH POTTCEN 57-1-27 to add deck to house.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Waiver Request of JOAN TECHET 144-5-11 to renovate interior and add
small addition with garage.

The Council recommends approval with the reminder that a non-turf buffer
behind the bulkhead is required by law.

RECOMMENDATION OF AMENDMENTS TO PERMITS

Moved by Stephen Angell, seconded by Allan Connell, it was
RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the request for an amendment to the Wetland Permit of
JOSEPH FOELSCH 103-3-3 to increase width of the fixed open walkway and
ramp from three feet to four feet to be as follow: 4' x 80' catwalk, a 4' x
16' ramp.
Beebe Drive, Cutchogue
The Council recommends disapproval because 3' is adequate; the addition of a
handrail would be more appropriate.
The Council also wishes to advise the Trustees that the work has already been
completed, therefore a violation has occurred.

NOTE: The CAC wishes to informed as to what action is taken for the
violation by the applicant.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the request for an amendment to :the Wetland Permit of ROBERT MELCHIONE
77-1-8 to raise the new retaining wall on the northeast corner approximately
5" to retain 5-10 yards of clean fill to prevent run over onto the beach.

RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the request to amend the Wetland Permit of CHARLES
MILLMAN 123-4-10 to construct fixed open walkway 4' x 72' , hinged ramp 4' x
16' , and floating dock 6' x 20'; install two 2-pile dolphins to secure
floating dock.
2760 Deep Hole Drive, Mattituck
The CAC recommends disapproval because the applicant currently has a permit
to reconstruct a short dock to the east which will give access to the water.
If the applicant wants to relocate the structure to the west the the Council
would approve but it must be of the same configuration as is currently
permitted and reconstruction must be to current standards.

RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the request for an amendment to the Wetland Permit of
PAOLO LAVAGETTO 104-7-7 to modify the floating portion of an existing
dock. The two (2) existing 6' x 20' floats in a "T" configuration will be
relocated and a 4' x 23' float added to form a "U" shape. Floats will be
secured by a total of (8) pilings. Existing fixed walk and ramp will be
retained. Proposed float arrangement will afford more protection to boat and
will allow easier access.

The Council recommends disapproval because the amendment would allow for
excess bottom coverage and there is no need shown.

RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the request for to amend the Wetland Permit of
MATT-A-MAR MARINA 114-3-1 to place fence on south retaining wall
approximately 350'
Wickham Avenue, Mattituck
The Council recommends disapproval because there is no need shown and the
conditions of the permit allows for no further activity at the site.
NOTE: The CAC wishes to bring to the attention of the Trustees the
possibility of a violation. The berm is not being maintained as per the
requirements of the permit.

DISAPPROVAL of the request to amend the Wetland Permit of JOHANNA
SMITH 104-7-5 to construct a timber dock consisting of: 3' x 12' ramp and 6'
x 18' float secured by two (2) 8" pilings.

The Council recommends disapproval of the request to amend the Wetland
Permit. The Council recommends the Trustees require a full Wetland
Application for the this project. The CAC would recommend approval to a
Wetland Permit.

RESOLVED to. recommend to the Southold Town Board of Trustees APPROVAL
of the request to amend the Wetland Permit of HENRY H. TRANENDLY
31-14-12 to construct 24' extension to existing return and to backfill return
and existing bulkhead with 100+/- c.y. of clean sand to be trucked in from an
upland source.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH PROVISIONS of the Grandfather Permit HERBERT BRADFORD 53-6-17
to reconstruct in kind/in place 50' of timber bulkhead and to backfill
structure with 5 +/- c.y. of clean sand to be trucked in from an upland source.

The Council recommends approval provided a 20' non-turf buffer is installed
and maintained.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Grandfather Permit of ALICE AND WILLIAM LEHMANN 31-18-16 to
reconstruct in kind/in place approximately 16' off shore end of timber jetty.

The Council recommends approval only for the reconstruction of what is there
with nothing added.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Grandfather Permit of KIMOGENOR POINT CO. (by Wilmoth Uellendahl)
116-6-24 to remove and replace, in kind/in place, 39 I.f. of bulkhead.
Approximately 50 c.y. of clean sand will be trucked in from an upland source
for backfill. Removed and replace, in kind/in place, 25 I.f. which will be
jetty type construction without tie rods and deadmen.

construction of single family dwelling, decks, etc.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the request for a letter of non-jurisdiction for GRUEN UNGERLEIDER
31-13-9 to construct residence within building envelop which is more than 75'
from the edge of the wetlands.

storage shed landward of the 75' distance required from the tidal wetlands
300 Deep Hole Drive, Mattituck

SET NEXT MEETING DATE
The next meeting of the Southold Town Conservation Advisory Council is
scheduled for Thursday, October 19, 1995 at 4:00 P.M. in the Meeting Hall.
