CONSERVATION ADVISORY COUNCIL
October 19, 1995
A meeting of the Southold Town Conservation Advisory Council was held
Thursday, October 19, 1995 at 4:00 P.M. in the Meeting Hall at Southold Town
Hall, Main Road, Southold.

CHAIRMAN'S ANNOUNCEMENTS
Chairman Stephen Angell advised the CAC that he was submitting a letter of
resignation from the CAC. Stephen explained that he felt his work load had
increased and that it kept him from doing his best for the Council. Members
expressed regret and suggested that he resign as chairman but remain a
member of the CAC. Stephen reiterated that he just did not have the time to
devote to the Council.
REPORTS
Allan Connell will be attending a Brown Tide Summit on Friday, October 20,
1995.
Robert Keith reported that he has almost completed the permit booklet.
Bruce Loucka has been taking water samples and expects to be doing more due
to the recent rains

RECOMMENDATION OF WETLAND APPLICATIONS
No. 1298 (Application tabled 9/21/95)
Moved by Stephen Angell, seconded by Bruce Loucka, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH PROVISIONS of the Wetland Application of DANIEL C. MOONEY
31-17-11 to construct foundation; septic system; well; and move house onto
site.
The Council recommends approval provided the applicant has the current
septic tank pumped out and cap the intake.
The CAC suggests the Trustees advise the applicant that he will be taking
the house away and it appears he would have no right to rebuild the structure
without going through the permit process and adhere to current codes.

Moved by Stephen Angell, seconded by Robert Kieth, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Wetland Application of REVEREND JAMES BARR 123-4-11 to construct a
timber dock consisting of: 4' x 50' fixed dock (min. 4' above grade of marsh);
4' x 12' hinged ramp; and 6' x 16' float secured by two 8" diameter pilings.
Dock will be constructed at a distance of 20' from the westerly property line.
The Council recommends approval and that the catwalk be cut back to 3"
wide.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH STIPULATIONS of the Wetland Application of GREGG FISHER 114-12-4
to construct a one family dwelling, deck, sanitary system, driveway, well,
underground utilities, etc. all as shown on submitted site plan of Van Tuyl.
All work to be landward of 75' from landward edge of Tidal Wetlands.
The CAC recommends approval provided there is no disturbance within 75'
of the wetland line; should some disturbance occur, an erosion sediment
control plan be developed prior to disturbance.

Moved by Bruce Loucka; seconded by John Hagerty, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH STIPULATIONS of the Wetland Application of LINDA FENNIMORE AND
IRA MOTHNER 15-3-12 to prevent further. bluff erosion and loss of property
proposes to construct 100' of retaining wall . to connect to the wail of
Zacharious to form a continuous retaining wall and return to alleviate a .
constant washout situation.
The Council .recommends approval provided applicant move wall- back 15' to
tie in with existing, structures; to contain and help address the erosion caused
by overland runoff, install a 15' non-turf buffer at the top of the bluff back
toward house; regrade top_ edge of bluff to slope back toward house so water
flows away from the bluff; and staircase should also be rebuilt.

RECOMMENDATION OF WAIVER REQUESTS,

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Waiver Request of JOHN KRAMER 70-4-45.3 to construct new two-level
wood stoop, attached to single family residence, over existing masonry stoop;
upper level approximately 10' x 121, lower level approximately 8' x 15'8".

RESOLVED to recommend to the . Southold Town Board of Trustees APPROVAL
WITH SUGGESTIONS of the Waiver Request of RONALD AND ARLINE SMITH
78-5-7 to- install 15' diameter above ground pool. Pool to be partially (1811)
set below grade.
The CAC suggests the applicant be advised that it would not be
environmentally sound to allow the pool water into the canal and the excavated
soil be removed from the site.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Waiver Request of Charles Thorp for GORDON SCHLAEFER 37-5-20 to
add a -deck 20' x -20' on south side of house.

RESOLVED to recommend to the Southold Town Board of Trustees.
DISAPPROVAL of the Waiver Request of FRANK SCAVONE 137-4-35 to
.replace five concrete piers and complete a block skirt around the perimeter of
the structure and add a basement. (Proposed skirt would be walls to the
proposed 7' full basement)
The CAC observed that applicant is operating without a permit and silt
fence and straw bales be installed IMMEDIATELY.

RECOMMENDATION OF AMENDMENT TO PERMITS

Moved by Allan Connell, seconded by Robert Keith, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH CONDITIONS of the Amendment to Permit of MR. 5 MRS. GAEBEL
107-7-7 to provide blended grades resulting in fill to central-rear portion of
property to accommodate deck and patio. Grading shall blend rear property
grades in line with adjacent properties as swale exists currently. No filling
around trees; if required, contractor - shall utilize small tree wells to protect
trees. Approximately 65-75 c.y.
The CAC recommends approval with the condition the applicant develop an
erosion and sediment control plan which address uses of native vegetation and
that the plan be reviewed by the CAC.

RESOLVED to TABLE the Amendment request of GERALD RUPP 51-1-21 to
amend permit to include the installation of (40) Triton Marine Mattresses along
170' shoreline seaward of existing and proposed bulkhead. Mattresses to be
placed on filter fabric against toe of bulkhead and excavated into beach to
prevent scouring of beach face.
The CAC requests more information. What are the mattresses; what is the
life expectancy; is there is documentation of their usefulness?

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH STIPULATIONS of the Amendment to permit request of ROBERT AND
PATRICIA ALCUS 92-1-21 to add 1200 c.y. of fill as per DEC approved survey.

The CAC recommends approval with the stipulation that the fill be
stabilized with native grasses if fill is loamy, beach grass if sill is sandy.
Beach grass to be on 12" centers.

Moved by Robert Keith, seconded by Stephen Angell, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Amendment to permit request of LEWIS HECKER 127-6-3 to construct
deck and storage shed.
The CAC wants to know why the applicant has not yet installed the
non-turf buffer as was stipulated in the permit.

RECOMMENDATION OF GRANDFATHERS PERMITS

Moved by Bruce Loucka, seconded by John Hagerty, it was
RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the Grandfather Permit of ALEXANDER G. LITRAS 51-4-7
to build a new bulkhead (in kind/in place) to replace existing remains of
bulkhead and backfill with 350 yards clean upland sand fill. Bulkhead to be
64' plus one 27' return and one 11' return, NE corner of new bulkhead will be
relocated to be within property line.
The Council feels a permit is needed.

Moved by Stephen Angell, seconded by Allan Connell, it was
RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the Grandfather Permit of PAUL F. WOOD JR. 53-4-20 to
repair 64' seawall that was damaged in the December 1992 storm. To repair and
slightly modify the existing sea wall, plan to stay within the existing bounds
of the original wall.
The CAC recommends a permit be required due to modifications. The
Council wants to know what repairs and what modifications will be done.
Applicant should define project and provide drawings.

NEXT MEETING DATE
The CAC scheduled the next meeting of the CAC for TUESDAY, NOVEMBER
28, 1995 at 4:30 P.M. in the Conference Room at Southold Town Hall.
There being no further business to come before the Southold, Town
Conservation Advisory Council, the meeting was adjourned at 5:50 P.M.
