CONSERVATION ADVISORY COUNCIL
NOVEMBER 28, 1995
The Southold Town Conservation Advisory Council met Thursday,
November 28, 1995.

APPROVAL OF MINUTES
Moved by Stephen Angell, seconded by Bruce 'Loucka, it was
RESOLVED to approve the minutes of September 21, 1995 and October 19, 1995
as submitted.
Vote of Council: Ayes: All
Motion carried.
REPORTS
Allan Connell brought up a situation which is occurring at the 'erid of
South Harbor Road. Due to the increased activity with moorings in that area
the spartina is being killed. The secretary was directed to send a letter to
the Board of Trustees requesting that it consider restricting the use of
moorings in the present quantity at that location.
Bruce Loucka reported that he made two samplings since the last meeting.
Robert Keith has been working on the permit handbook and it should be
finished soon.
Scott Hilary, the CAC representative to the Shellfish Advisory Committee has-
been attending meetings and has his notes and copies of the minutes available
to anyone who is interested.

SELECTION OF NEW CHAIRMAN
Moved by Stephen Angell, seconded by Bruce Loucka, it was
RESOLVED to recommend to the Southold Town Board that Allan Connell be
appointed Chairman of the Southold Town Conservation Advisory Council for
1996.
RECOMMENDATION OF WETLAND APPLICATIONS
No. 1309
Moved by Allan Connell, seconded by Bruce Loucka, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH CONDITIONS of the Wetland Application of ROBERT SCHISSEL
80-1-46 for maintenance repairs to reconstruct 90' of timber bulkhead within
18"; replace 30' return, in kind, in place; remove upper concrete retaining
wall to landfill; backfill with clean sand approximately 40 cubic yards.
The CAC recommends approval with the condition the applicant plant the
flat area behind the bulkhead with beachgrass.

Moved by Stephen Angell, seconded by Robert Keith, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH STIPULATIONS of the Wetland Application of ROBERT F. COADY and
BARBARA A. COADY 103-9-1 to construct a single family dwelling and related
improvements including driveway, sanitary system, well, deck, shed, elevated
timber walkway, gangway, and floating dock.
The Council recommends approval with the stipulation .that the applicant
move walkway 1'5' from the property line and turn the proposed floating dock so
it is straight and not in a "T" formation; also place hay bales at the 7'
contour line.

Moved by Bruce Loucka, seconded by Allan Connell, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH STIPULATIONS of the Wetland Application of CHRISTIAN BURKE
71-1-41 to remove and replace (in kind/in place) 46 I-f. timber bulkhead.
Construct a 5' extension to east side of bulkhead. Backfill with 15 c.y. of
clean material to be trucked in from upland source. Construct a dock
consisting of: 3' x 28' catwalk; 3' x 12' ramp; 6' x 25' float. Also a 3' x
20' fixed walk extending landward of proposed bulkhead and 10' x10' timber
platform located east of said walkway.
A 20' buffer area landward of bulkhead will be established where no
fertilization.will occur as per the Natural Resources Conservation Services.

The CAC recommends approval with the stipulation that the catwalk be
moved 15' from the western property line and shortened to be in line with the
neighbor to the west.

Moved by Stephen Angell, seconded by Robert Keith, it was
RESOLVED to TABLE the Wetland Application of SUSAN MACC 116-7-4 to
construct a catwalk 3' in width and approximately 100' long to access Hall's
Creek.
The Council tabled the application because no plan was received for the
structure.
The Council suggests the Trustees consider whether access should be
allowed to the waterway since it is not a navigable waterway and it is a
pristine marsh with no structures.

Moved by Stephen Angell, seconded by Robert Keith, it was
RESOLVED to TABLE the Wetland Application of BERNHARD PEPER 115-11-6
to construct a single family dwelling, with attached deck and sanitary system
and enclosed storeroom under house.
Council tabled the application due to an inadequate project description
and no plans were submitted.
Council also wishes to point out to the Trustees that there has been an
apparent removal of marsh. Owner must be told to stop removing . marsh to
allow for a beach.

FISHERS ISLAND GOLF COURSE 1-1-3.13 to restore an eroded shoreline by
installing a boulder slope and reconstructing/repairing existing dune. The
proposed boulder slope shall be installed by placing two (2) four-ton stones
along eroded shoreline beginning at an existing rip-rap wall and continuing
wall and additional 200' to the east. Stones shall be placed on filter fabric
which will have a 1' rock chip base, no grout shall be used. Approximately
150 c.y. of boulders shall be used for a wall which will vary in width from 6'
- 18'. Any areas which were disturbed or eroded shall be re-vegetated with
American Beach Grass planted 12" on center.
Approximately 410' of eroded dune shall be restored by placing
approximately 750 c.y. of clean sand, which shall be trucking in form an
upland source, along eroded shoreline. In doing so, the restored dune shall
match the existing 4:1 slope.

The CAC has no recommendation; it was unable to make an inspection.

ERNEST CAEBEL 107-7-7 to regrade or "blend" 65-75 c.y. of fill to
accommodate deck and patio. The "blend" will made the rear of the property
more in-line with grade of adjacent lots while allowing landscape improvements.
NOTE: Was originally received by CAC as an Amendment to a permit. (A-24)
See comments to A-24 of meeting of 10/19/95.

RECOMMENDATION OF WAIVER REQUESTS

Moved by Bruce Loucka, seconded by Scott Hilary, it was
RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the Waiver Request of JUDITH SCHMID 70-4-12 to
construct an addition to a single family dwelling.
The Council feels this project requires a full application. The project
could have a potential negative effect being so close to the water. The
Council would possibly approve a Wetland Application if appropriate erosion and
sediment controls are addressed.
A second concern of the CAC deals with the current status of the
property.
It appears fill has been placed above the bulkhead and is allowing lawn runoff
into the creek. Applicant must be required to remove the fill and establish a
10' non-turf buffer to-meet current code.

RECOMMENDATION OF AMENDMENT TO PERMITS

Moved by Robert Keith, seconded by Stephen Angell, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the request of REV. JAMES BARR 123-4-11 to amend application to allow
for the ' proposed dock to be arranged in a linear formation rather than "T"
formation.

RESOLVED to TABLE the request of BRUCE and BARBARA BEANEY
103-3-5.1 to amend permit to add approximately 190 foot catwalk to the
existing ramp.

The Council . tabled the request because it cannot make a recommendation
without a plan. Also the applicants must be required to removed the pallets
and replant with spartina patens the area which has been destroyed.

RECOMMENDATION OF GRANDFATHER PERMITS

Moved by Bruce Loucka, seconded by Betty Wells, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH PROVISION of the Grandfather Permit request of WILLIAM, JOHN, and
AILEEN PARROTT 37-4-9 for a dock float and ramp, etc. which has been in
existence for many years.
The CAC recommends approval provided they check affidavit of prior
existence. The float appears to be of recent origin.

RECOMMENDATION OF NON-JURISDICTION REQUESTS
NJ-15 (Also see Wetland Application No. 1312)
Moved by Stephen Angell, seconded by Robert Keith, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the request for a letter of Non-Jurisdiction from SUSAN MAGG 116-7-4 to
build a single family dwelling. All structures to be at least 75' from the
edge of the wetlands.

NEXT MEETING DATE
The next meeting of the Southold Town Conservation Advisory Council was
scheduled for MONDAY, DECEMBER 18, 1995 at 4:30 P.M. at Southold Town
Hall.
There being no ,further business to come before the CAC, the meeting was
adjourned at 5:40 P.M.
