A meeting of the Southold Town Conservation Advisory Council was held Wednesday, November 13, 1996 at 4:30 P.M. in the Conference Room at Southold Town Hall. The meeting was called to order by Acting Chairman Bruce Loucka. Present were: Bruce Loucka, Acting Chairman Robert Keith, Member Shannon Reidy, Member Scott Hilary, Member Betty Wells., Member Kenneth Meskill, Member Linda Cooper, Secretary Absent was: Christy Paliouras CHAIRMAN SELECTION Bruce Loucka advised the members that Allan Connell had resigned from the CAC due to the potential conflict of interest that existed between his duties and functions as an employee of. the USDA .Natural Resources Conservation Service and his .duties as a member of the CAC. Since he was also chairman of the Council it would be necessary to select another member to recommend to the Southold Town Board to fill the position. Kenneth Meskill expressed an interest in the position .but was concerned in a possible conflict of interest if he were chairman. Mr. Meskill, on occasion, does subcontract work for JMO Consulting which represents applicants before the Board of Trustees. . Although he abstains from discussion and voting on any application that has been submitted by JMO, he expressed concern that it may appear unseemly if he appeared before the Board of Trustees as the CAC representative when a JMO application was being discussed. It was decided that Mr. Meskill would speak with Town Attorney Laury Dowd for a determination. November 13, 1996 REPORTS The CAC was also advised that John Hagerty had also resigned. Mr. Hagerty had sold his house and would be moving to another state. The two positions had been advertised in the paper with no response. The vacancies would be readvertised and members were encouraged to help find individuals to fill the openings. Bruce Loucka informed Kenneth Meskill that Maureen Davis of the DEC would be at the Shellfish Advisory Committee meeting which would be held the first Monday in December. At that meeting she would have the opportunity to determine if Kenneth would be eligible to take over the water sampling for Bruce. Shannon Reidy reported that, although the name would be changed, she would still be able to intern for what was Okeanos. APPROVAL OF MINUTES OF OCTOBER 17, 1996 Moved by Robert Keith, seconded by Scott Hilary, it was RESOLVED to approve the minutes of October 17, 1996 at submitted Vote of Council: Ayes: All Motion carried. RECOMMENDATION OF WETLAND AND COASTAL EROSION PERMITS No. 1387 Moved by Robert Keith, seconded by Shannon Reidy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Application of MICHAEL WITHERS 117-5-24 to replace (within 18") with knee-wall construction existing 160 +/- l.f. steel bulkhead. Backfill with 10 c.y. clean sand to be trucked in from upland source. Existing docks will be removed to allow construction, then replaced. 6515 New Suffolk Road, New Suffolk Vote of Council: Ayes: All Motion carried No. 1388 Moved by Bruce Loucka, seconded by Betty Wells, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Application of BRICK COVE MARINA by HOWARD ZEHNER 57-1-38.3 to place 104 feet of steel jetty bulkhead within 18" of the existing corroded steel bulkhead, dredge 75 c.y. to below 6' of MLW and use spoil to replenish behind bulkhead. 1670 Sage Blvd., Greenport Page 2 November 13, 1996 Vote of Council: Ayes: All Motion carried. No. 1389 Moved by Bruce Loucka, seconded by Scott Hilary, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Coastal Erosion application of FRANCO PURITA 51-4-6 to install a chain link fence 4' high up to house, then 6' to bluff, then across bluff 3' high. Soundview Avenue, Southold Vote of Council: Ayes: All Motion carried. No. 1390 Moved by Bruce Loucka, seconded by Scott Hilary, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Application of LOIS T. ANDERSON 70-4-45.5 to construct a 16.6' x 10' addition and 14.2' x _12' deck onto existing dwelling. 2515 Calves Neck Road, Southold Vote of Council: Ayes: All Motion carried. No. 1391 Moved by Robert Keith, seconded by Kenneth Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Application of DOUGLAS BORISKY 119-1-1 to replace (within 1811) 99 +/- linear feet of timber bulkhead and backfill with 12 c.y. of clean sand to be trucked in from an upland site. 9475 Nassau Point Road, Cutchogue Vote of Council: Ayes: All Motion carried. No. 1392 Moved by Robert Keith, seconded by Kenneth Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Application of JOSEPH AND NORA FLOTTERON 118-2-14.1 to construct an addition on the southeast side of the house within the existing "foot-print" of the deck structure. 595 Clearwater Lane, Cutchogue Vote of Council: Ayes: All Motion carried. Page 3 November 13, 199' No. 1393 Moved by Robert Keith, seconded by Betty Wells, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Application of FRANK AND SANDRA CURRAN 111-1-16 to reconstruct (within 18") an existing westerly 48 +/- linear foot bulkhead and backfill with 10 c.y. of clean sand. 560 Fisherman's Beach Road, Cutchogue Vote of Council: Ayes: All Motion carried. No. 1394 Moved by Robert Keith, seconded by Shannon Reidy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Application of EDGAR MARVIN 117-10-9 to repair in kind/in place 110' of timber groin on west side and replace 110' of damaged groin on east side and add 25' to both groins landward to reach base of slope. 1260 Jackson Street, New Suffolk Vote of Council: - Ayes: All Motion carried. No. 1395 Moved by Robert Keith, seconded by Betty Wells, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Application of LONG ISLAND LIGHTING COMPANY 122-7-6.60 to install a Gas Compressor Station. Main Road, Mattituck Vote of Council: Ayes: All Motion carried. No. 1396 Moved by Bruce Loucka, seconded by Scott Hilary, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Application of HAROLD SCHWERDT 77-2-1 to remove 94 +/- feet of concrete block retaining wall and to reconstruct in kind/in place with an 80' timber wall, construct a 7' return on either end of wall and backfill with 5+ c.y. of sand. The CAC recommends disapproval of that portion of the wetland application because there is no need shown. The CAC recommends APPROVAL WITH STIPULATIONS of the Wetland Application of HAROLD SCHWERDT to remove 4' x 4' catwalk and a 4' x 8' in shore ramp, and construct a new 4' x 52' catwalk (elev. 4' above grade) and a 3' x 11' ramp and an 8' x 16' float secured by 2 two-pile dolphins. The Council recommends approval of that section of the application with the stipulation that it extends no further than the existing catwalk and float. No. 1397 RUSSELL PLANTIZER 12-2-6.9 to restore two ponds; construct a retaining wall; and construct a utility shed. Wilderness Point, Fishers Island The CAC did not make an inspection and therefore cannot make a recommendation. No. 1398 Moved by Bruce Loucka, seconded by Robert Keith, it was RESOLVED to TABLE the Wetland Application of MATT-A-MAR, INC. (contract vendee) 139-2-5 to construct a 4' x 60' walkway, a 4' x 16' hinged ramp and a 5' x 200' float with two finger floating docks each 4' x 30' at ends of and perpendicular to main dock, install eight 12" x 35' mooring piles and approximately ten 12" x 25' piles to secure main dock as per survey. The CAC tabled the application due to inadequate information. 2655 Wickham Avenue, Mattituck Vote of Council: Ayes: All Motion carried. RECOMMENDATION OF WAIVER REQUESTS WR-54 (Also GF-37) Moved by Robert Keith, seconded by Kenneth Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Waiver Request of GARY SACKS and ALAN SCHLESINGER 145-4-7 to construct a wooden deck. Mesrobian Drive, Laurel Vote of Council: Ayes: All Motion carried. RECOMMENDATION OF GRANDFATHER PERMITS GF-33 JANET and DIXON HARVEY 9-8-3.3 for an existing dock Fishers Island Page 5 November 13, 1996 The CAC did not make an inspection and therefore have no recommendation. GF-34 ROBERT and JULIA SORENSON 10-3-20 for a 71' x 11' fixed dock and 16' x 5.5' float. Fishers Island The CAC did not make an inspection and therefore have no recommendation. GF-35 Moved by Bruce Loucka, seconded by Betty Wells, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Grandfather Permit request of GLADYS MILNE 37-5-15 for an 88' bulkhead. 240 Knoll Circle, East Marion Vote of Council: Ayes: All Motion carried. GF-36 Moved by Bruce Loucka, seconded by Betty Wells, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the request for a Grandfather Permit by JOHN TESSIER 37-5-4 for a 70' bulkhead, 4' x 20' dock and 6' x 12' float. 730 Bayview Drive, East Marion Vote of Council: Ayes: All Motion carried. GF-37 (Also WR-54) Moved by Robert Keith, seconded by Kenneth Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the request for a Grandfather Permit by GARY SACKS and ALAN SCHLESINGER 145-4-7 for a permit for bulkhead and docks. Mesrobian Drive, Laurel Vote of Council: Ayes: All Motion carried. GF-38 Moved by Scott Hilary, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH PROVISIONS of the request for a Grandfather Permit of JOHN FRANCO 90-1-25 to remove 108'+ of timber bulkhead and reconstruct bulkhead 5' landward and to backfill structure with 10 +/- c.y. of clean sand to be trucked in from an upland site. 30 West Lake Road, Southold Page 6 November 13, 1996-- The 996The CAC are unsure why this project is a Grandfather Permit. The project is not in kind/in place so it appears that it would require a Wetland Permit. However, if it is correct to issue a Grandfather Permit for the project then the CAC• recommends approval if the bulkhead is placed in line with the neighbor to the east. GF-40 Moved by Robert Keith, seconded by Kenneth Meskill, It was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the request for a Grandfather Permit by JAMES and MARILYN McBURNEY 111-14-16 for bulkhead and wood walk. 1060 Little Peconic Bay Road, Cutchogue Vote of Council: Ayes: All Motion carried. GF-41 Moved by Robert Keith, seconded by Shannon Reidy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the request of a Grandfather Permit of JAMES MILTON 116-6-2 to reconstruct in kind/in place, 315 +/- ' of timber bulkhead and to backfill structure with 10 +/- c.y. of clean sand to be trucked in from an upland site. 10090 New Suffolk Avenue, Cutchogue Vote of Council: Ayes: Scott Hilary, Bruce Loucka, Betty Wells, Robert Keith, Shannon Reidy Abstain: Kenneth Meskill Motion carried. Page 7 November 13, 1996 GF-42 Moved by Scott Hilary, seconded by Bruce Loucka, it was RESOLVED to make no recommendation to the Southold Town Board of Trustees concerning the request for a Grandfather Permit by CLARENCE POWELL 34-5-14 for a dock, ramp and floating dock. 380 Robinson Road, Greenport The CAC is unable to decide because the structures look like they are much newer that something that was installed in 1962. The CAC questions whether work has been done since the original structure in 1962. Because of these questions, the Council cannot recommend approval or disapproval. Vote of Council: Ayes: All Motion carried. RECOMMENDATION OF AMENDMENT TO PERMITS A-76 Moved by Scott Hilary, seconded by Betty Wells, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the request to amend permit by ROBERT MELCHIONE 77-1-8 to remove existing 3' x 70' timber dock and to construct a 4' x 57' timber catwalk, elevated 3.5' over grade, 4' x 12' ramp, and 8' x 18' float. 1130 Oak Avenue, Southold Vote of Council: Ayes: Scott Hilary, Bruce Loucka, Betty Wells, Robert Keith, Shannon Reidy Abstain: Kenneth Meskill Motion carried. A-77 Moved by Scott Hilary, seconded by Bruce Loucka, it was RESOLVED to recommend DISAPPROVAL of the request to amend permit by MONIQUE MORRIS 47-2-29 to reconstruct dock facility: install 4' x 55' fixed dock, 3' x 20' ramp, reinstall 6' x 20' float secured with three 2-pile dolphins. 1555 Shore Drive, Greenport The Council recommends disapproval due to the passage of time since the original permit was issued. A wetland permit should be required for this project. Vote of Council: Ayes: All Motion carried. A-78 Moved by Robert Keith, seconded by Kenneth Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the request to amend permit by ROBERT COADY 103-9-1 to relocate dock on property. A-79 Moved by Kenneth Meskill, seconded by Robert Keith, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATIONS of the request to amend permit by GLENDALOUGH PROPERTIES, INC. c/o BARBARA BRAATZ 111-10-14 for deposition basin and placement of the dredge material as beach nourishment. 5250 Vanston Road, Cutchogue The CAC recommends approval with the stipulation that the work be done prior to March 15 because the area may be a plover and tern nesting area. Vote of Council: Ayes: All Motion carried. REVIEW No. 1354 Moved by Bruce Loucka, seconded by Robert Keith, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit of MICHAEL RAYNOR 117-5-2 to remove existing dock; replace with a bulkhead and to tie into existing bulkhead of neighbor; backfill with 450 c.y. and stabilize; and build a house with sanitary system as shown on plans dated 10/13/96. 890 Old Harbor Road, New Suffolk The CAC recommends disapproval of the bulkhead because there appears to be no erosion problem and no demonstrated need shown. The CAC recommends disapproval of the house and septic system is too close to,the water. Vote of Council: Ayes: All Motion carried. No. 1362 CRESCENT BEACH CONDOMINIUMS 38.01-1-22. The CAC has not changed its opinion since its original recommendation to disapprove at the Conservation Advisory Council meeting of June 24, 1996. No. 1383 CHRISTINE ANDERSON 43-4-3.The CAC has not changed its opinion since its original recommendation at the Conservation Advisory Council meeting of September 23, 1996 to approve the replanting but disapprove the placement of boulders, etc. Page 9 November 13, 1996 No. 1385 Moved by Scott Hilary, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Application of JAMES and CAROL CASSEL 56-5-40 to place a platform on lawn as shown on survey dated October 23, 1996. 800 Willow Point Road, Southold Vote of Council: Ayes: All Motion carried. GENERAL BUSINESS Trustee Jim King will be taking a boat to Fishers Island on Friday and wants to know if anyone interested in going with him to the island. SET NEXT MEETING DATE The next meeting of the Southold Town Conservation Advisory Council will be held Friday, December 13, 1996 at 4:00 P.M.
