CONSERVATION ADVISORY COUNCIL
SEPTEMBER 23, 1996
The Southold Town Conservation Advisory Council met Monday, September 23,
1996 at 4:30 P.M. in the Conference Room at Southold Town Hall, Main Road,
Southold, New York.

CHAIRMAN'S ANNOUNCEMENTS
Allan Connell reported on the Trustees' August meeting. He also advised
members that there will be a two day workshop on October 23 and 24, 1996 at
Sheraton Long Island Hotel in Smithtown entitled STORMWATER QUALITY
IMPACT MITIGATION DESIGN WORKSHOP sponsored by the Nassau and
Suffolk County Soil and Water Conservation Districts.
REPORTS
Bruce Loucka stated that there will be an increase in water sampling Goose
_. Creek, Hashamomaque and 'Mattituck Creeks. Since he will be away for the
months of January, February, and March, someone else will be needed to do
thesampling. Kenneth Meskill said he would check his schedule and he may be
able to .fill in for .Bruce during those months.

Bruce also reported that the Highway Department has cleaned up the sand at
Cedar Beach.
APPROVAL OF MINUTES OF AUGUST 26, 1996
Moved by Robert Keith, seconded by Bruce Loucka, it was
RESOLVED to approve that minutes of August 26, 1996 as submitted with a
correction of a typographical error.
Vote of Council: Ayes: All

RECOMMENDATION OF WETLAND AND COASTAL EROSION APPLICATIONS

Moved by Kenneth Meskill, seconded by Robert Keith, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH CONDITIONS of the Wetland Application of DR. MELVIN MORREL
99-3-4.6 to construct a 11 l.f. retaining wall extension to connect to
neighbor's retaining wall per submitted plans. Approximately 50 c.y. of clean
sand will be trucked in from an upland source and used for backfill.
Lloyd's Lane, Mattituck
The Council recommends approval with the condition that access on the west
side of Bailey Beach Road be limited to September 1 through March 15. The
area is an active plover nesting site.

Moved by Allan Connell, seconded by Kenneth Meskill, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH A CONDITION of the Wetland Permit Application of JOSEPH COLAHAN
118-6-7 to remove and replace (in same location and configuration) 100 l.f. of
timber retaining wall; 4' x 20' stairway; upper 5' x 100' boardwalk. Backfill
wall with 10 +/- c.y. clean fill to be trucked in from an upland site.
9480 Nassau Point Road, Cutchogue
The Council recommends approval provided a non-turf buffer in installed. The
Council has no problem with the replacement of the retaining wall even though
it appears to be in excellent condition and the CAC sees no reason to remove
and replace it.

Moved by Robert Keith, seconded by Betty Wells, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Wetland Permit Application of BRUNO CIPPITELLI 104-10-7 to construct
a timber dock consisting of a 4' x 88' fixed elevated (4' above grade of marsh)
walk; 3' x 14' hinged ramp; 6' x 20' float secured by (2) pile dolphins.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH CONDITIONS of the Wetland Permit Application of PREM CHATPAR
90-2-9.1 to construct addition and porch onto existing two-story, one-family
dwelling. Remove an existing garage and build a 1 1/2 story guest cottage and
porch in approximate location. Construct a brick patio and walks. Existing
driveway will be redesigned but will remain as pervious stone.
Midway Road, Southold
The CAC approves with the following conditions:
1 . If filling is required it must be stabilized on site.
2. Erosion and sediment control be required during and after
construction.

Moved by Bruce Loucka, seconded by Robert Keith, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH STIPULATIONS of the Wetland Permit Application of DONALD AND
LORNA TUTHILL 55-3-28 for a building envelope for a single family dwellin.g.
Long Creek Drive, Southold
The Council recommends approval provided the building envelope is moved
forward, away from the creek, so that it is 50' from the top of the bank and
35' from the road. This will allow more buffer area in the rear for runoff.

Moved by Allan Connell, seconded by Bruce Loucka, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH STIPULATIONS of the Wetland Permit Application of VINCENT AND
LINDA BASILICE 53-6-8 to renovate existing house. Construct a 4' x 21'
addition on water side of the house and install an 18' x 51' on grade patio.

The Council recommends approval provided that a 20' non-turf buffer be
installed behind the bulkhead and 6" - 12" below the top of the bulkhead to
allow the storing and percolation of runoff.

Moved by Bruce Loucka, seconded by Kenneth Meskill, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Coastal Erosion Permit Application of DEAN STEFANIDES 31-18-17 to
reconstruct 45' jetty.
780 Rabbit Lane, East Marion
The CAC recommends approval although it feels the jetty is not necessary,
there is no need for the structure.

Moved by Allan Connell, seconded by Bruce Loucka, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
OF EVERYTHING BUT THE GROIN of the Wetland Permit Application of
NORMAN WENK 31-16-2.2 to replace (within 18") 142 l.f. of existing timber
retaining wall including return on west side. Backfill with 50 +/- c.y. of
clean spoil to be trucked in from upland source. Remove and replace existing
4' x 12' stairway seaward of wall; and 4' x 15' platforms and stairs landward
of wall and down face of bank. Remove existing 68' timber groin and replace
with a low profile structure of same length.
415 South Street, East Marion
The CAC recommends approval of the project with the exception of the groin.
The Trustees should disapprove the groin because it can cause damage down
gradient of the littoral drift and low profile groins are not maintained.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH CONDITIONS of the Wetland Permit Application of EDWARD THORP
31-7-10 to construct a two-story, one family dwelling, swimming pool, decks,
pervious driveway, underground utilities, sanitary system, and well.
North Lane, East Marion
The CAC recommends approval provided proper erosion and sediment controls
are used during and after construction.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH RECOMMENDATIONS of the Wetland Permit Application of KENNETH AND
CONCETTA SCHOEN 31-7-11 to add deck on north side of house.
255 North Lane, East Marion
The CAC recommends approval but recommends the Trustees fine the applicant
because the deck is already completed. The CAC also recommends the applicant
be fined and required to obtain a permit for the dock which is not shown on
the survey

Moved by Allan Connell, seconded by Bruce Loucka, it was
RESOLVED to recommend to the Southold Town Board of Trustees PARTIAL
APPROVAL of the Coastal Erosion Permit Application of CHRISTINE
ANDERSON 43-4-3 to replant the bank, leading down from the north lawn of
the property, to the beach below and place boulders along foot of bank for
protection.
1000 Sound Drive, Greenport
The Council recommends approval of the replanting of vegetation and suggests
the applicant contact the Natural Resource Conservation Service for a planting
guide. The Council recommends DISAPPROVAL OF THE RECONFIGURATION
OF THE BOULDERS. The toe of the bluff is stable. Erosion problems
occurred at the top of the bluff, not the toe.
Vote of Council: Ayes: All

RECOMMENDATION OF WAIVER REQUESTS

MICA McCANN AND TONY PANZARINO 103-10-23 for addition and renovations.
800 Strohson Road, Cutchogue
The CAC was advised by the applicant that the request would be refiled at a
later date, therefore, the Council has no comments.

Moved by Bruce Loucka, seconded by Kenneth Meskill, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Waiver Request of DR. ANTHONY BENNARDO 119-1-15 for an addition

of approximately 5' of post and rail added to existing fence and repair to
existing fence.

RECOMMENDATION OF GRANDFATHER PERMITS

Moved by Bruce Loucka, seconded by Kenneth Meskill, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Grandfather Permit of DEAN STEFANIDES 31-18-17 for a 60' bulkhead,
4' x 8' access stairs and a 40' x 35' wooden deck.

Motion carried.
SET NEXT MEETING DATE
The Board of Trustees will be meeting Wednesday, October 23, 1996. The CAC
scheduled its next meeting for Thursday, October 17, 1996 at 4:30 P.M. .
There being no further business to come before the Council, the meeting was
adjourned.
