CONSERVATION ADVISORY COUNCIL
JULY 29, 1996
A meeting of the Southold Town Conservation Advisory Council was held
Monday, July 29, 1996 at 4:30 .P.M. in- the Conference Room at Southold Town
Hall, Main Road, Southold, New York.

The meeting was called to order by Acting Chairman Scott Hilary. s
REPORTS
Scott Hilary reported that he noticed some disturbance of wetlands at the Old
Barge Seafood Restaurant. It appeared that wetland vegetation had been cut
on the front and side of the eatery. He will bring this matter to the Trustees
attention.
Robert Keith had been trying to get a determination from the Trustees as to
the limitation 'of Grandfather Permits (for structures build prior to 1974) . As
a result of his research and inquiries, the Board of Trustees will discontinue
issuing Grandfather Permits in creeks only. Grandfather Permits will continue
to be issued on the Sound and Bay because the. Trustees took jurisdiction of
those areas at a later date.
Betty Wells requested that a note be sent after each meeting to those who
missed the meeting to let them know when the next meeting will be held.

Kenneth Meskill reported that he was asked to check Deephole Creek to
determine is there were any Piping Plover or Terns nesting in the area that
would interfere with a dredging project.
Kenneth was happy to report that it appears that the plovers and terns are
returning to Mattituck Inlet. He had spotted three nests where there were
none in the past couple of years.
The two new youth members of the Conservation Advisory Council, Christy
Paliouras and Shannon Reidy, were each given an opportunity to introduce
themselves to the Council.
APPROVAL OF MINUTES
Moved by Robert Keith, seconded by Bruce Loucka, it was
RESOLVED to approve the minutes of May 20, 1996 and June 24, 1996 as
submitted

RECOMMENDATION OF WETLAND APPLICATIONS
No. 1366
Moved by Robert Keith, seconded by Betty Well, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH RECOMMENDATIONS of the Wetland Application of LOUIS M. BACON
117-8-20 to maintenance dredge to -6' below ALW two times per year over 10
year period (3700 c.y. yearly) . Dredge by clam shell and excavator. Dredge
material to be trucked to approved upland site.
First Street, New Suffolk
The Council recommends approval with the recommendation that applicant dredge
as much as possible to include the Southold Town ramp area.

Moved by Kenneth Meskill, seconded by Robert Keith, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH STIPULATIONS of the Wetland Application of BARBARA BRAATZ
111-10-14 to continue maintenance dredging of boat basin, create 60' x 65'
deposition basin (1150 c.y.) to a depth of 7.5' below AMLW. Dredge spoil to
be placed on approved upland site.
5250 Vanston Road, Cutchogue
The Council recommends approval with the stipulation that there be no action
from March 15 to September to protect the nesting of the Piping Plover and
Least Tern.

Moved by Robert Keith, seconded by Kenneth Meskill, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH STIPULATIONS of the Wetland Application of SHAWN WILLIAMS
106-11-20 to construct a 4' x 50' catwalk off existing bulkhead to a 20' x 8'
float with a 3' x 12' ramp and two 3' x 20' finger piers.
405 South Drive, Mattituck
The Council recommends approval with the stipulation that the project extend
no further into the creek than the neighbors to the north and south
(approximately 501) .

Moved by Robert Keith, seconded by Kenneth Meskill, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Wetland Application of STRONG MARINE 122-4-44.2 to make the
configuration of the showroom smaller and different, no closer to the water; to
install a catch basin and add additional parking as -per Planning Board.
Camp Mineola Road, Mattituck
The CAC recommends approval with the assumption that the catch basin can
filter runoff adequately.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH PROVISIONS of the Wetland Application of THEODORE MAGEN 21-5-1
to construct approximately 100' of access stairs with one 12' x 12' sitting
area at top and four 4' x 4' landing
610 The Strand, Pebble Beach Farms, East Marion
The CAC recommends approval provided that there be a minimum of disturbance
of the vegetation.

RECOMMENDATION OF WAIVER REQUESTS
WR-40
Moved by Bruce Loucka, seconded by Betty Wells, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH STIPULATIONS of the Waiver Request of HERBERT MANDEL 36-2-26 to
remove existing deck and extend house as per submitted plans.
1000 Inlet Lane, Greenport
The Council recommends approval provided all expansion is on the second story.

Moved by Bruce Loucka, seconded by John Hagerty, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Waiver Request of GEORGE BAMBRICK 49-4-7 to construct a 12' 32'
two-story addition on west side of house (enclosing existing deck) and an 8' x
20' one-story addition of the north side of the house (enclosing existing deck) .

RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the Waiver Request of DONALD and JEAN VAZQUEZ
31-17-5 for a 11' x 16' deck that was constructed in 1984.

The CAC believes this should have a permit and not a waiver and the CAC
would approve the Permit.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Waiver Request of ANDREW AURICHIO 56-4-16 to construct a 22' gate
across ROW, approximately 80' from Route 25, also to construct approximately
165' of split rail or similar fence on southeast property line as shown on map
Main Road, Southold

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Waiver Request of WILLIAM and DOLORES KREITSEK 114-9-14.1 to
place a sprinkler system and do lawn maintenance within 75'. (Received
violation for work being done)

RECOMMENDATION OF AMENDMENT TO PERMIT REQUESTS

Moved by Bruce Loucka, seconded by John Hagerty, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH STIPULATIONS of the Amendment to Permit Request of HUGH J.
MURPHY 70-6-8 to totally reconstruct house instead of partially reconstruct.
Oaklawn Avenue, Southold
The Council recommends approval with the stipulations that hay bales be used
during construction to prevent runoff into the creek from the area that is not
bulkheaded, and that there be a 10' non-turf buffer behind the bulkhead.

RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the Amendment to Permit Request of CAROL CASSEL
56-5-40 to amend permit to add two 12' x 12' platforms on either side of the
existing dock over existing rocks.
Willow Point Road, Southold
The Council believes this project should go through the full application
process to obtain a permit. (Note: If the Trustees do not agree with the
CAC's recommendation requiring a permit, then the CAC feels the project
should be cut in half and only one 12' x 12' platform be allowed.)

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
with PROVISIONS of the Amendment to Permit Request of RAY GOODWIN
104-3-3 to make dock 4' x 50' instead of 3' x 50'.

RECOMMENDATION OF LETTERS OF NON-JURISDICTION

Moved by Bruce Loucka, seconded by John Hagerty, it was
RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the request for a letter of non-jurisdiction of ROBERT
ADIPIETRO 34-1-18 to construct a single family dwelling and sanitary system.
North Road and Route 25, Greenport
The Council feels a permit is required.
Vote of Council: Ayes: All

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the request for a letter of non-jurisdiction of FRANK MONTELEONE 57-1-30
for a 14' x 42' deck on an existing cement slab approximately 80' from the
bulkhead.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the request for a letter of non-jurisdiction of NORMAN and JUDY TAYLOR
38-2-35 to construct a 10' x 18' balcony over existing deck.

RECOMMENDATION OF GRANDFATHER PERMITS

RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the Grandfather Permit Request of ANGELO SPETSIOTES
56-5-13.1 for a 4' x 20' float, 5' x 15' float, 4' x 4' platform and a 3' x 8'
ramp.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Extension Request of WILLIAM MANOS 54-5-46.1

GENERAL BUSINESS
The annual Fishers Island Town Board meeting will be held Wednesday, August
14, 1996. The boat will leave the Plum Island dock at 10:00 A.M. and will
return at approximately 6:00 P.M. As this is an excellent opportunity for CAC
members to make inspections of Fishers Island applications several members plan
to go. Members Bruce Loucka, John Hagerty, Kenneth Meskill, Scott Hilary
and Shannon Reidy all stated that they would attend.
NEXT MEETING DATE
The next meeting of the Southold Town Conservation Advisory Council will be
held MONDAY, AUGUST 26, 1996 at 4:30 P.M. in the Conference Room at
Southold Town Hall.
