New York 11971 SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL JUNE 24, 1996 A meeting of the Southold Town Conservation Advisory Council was held Monday, June 24, 1996 at 4:30 P.M. in the Conference Room at Southold Town Hall, Main Road, Southold, New York. Present were: Allan Connell,CAC Chairman Bruce Loucka, Member Robert Keith, Member John Hagerty III, Member Linda Cooper, Secretary Absent were: Scott Hilary, Member Ken Meskill, Member Betty Wells, Member REPORTS Bruce Loucka reported that the catch basins were installed today at Waterview and Waterview Terrace. Bruce is also continuing with the water sampling. Allan Connell reported that the Hashamomaque Project design is done. The concern is finding the help for the maintenance. Robert Keith is still trying to find information concerning Grandfather Permits issued by the Board of Trustees, as to how long applicants would be allowed the opportunity to obtain a permit. The Town Board passed a resolution appointing Christy Paliouras as the first youth member of the CAC. Christy was out of town and could not attend this meeting. The Town Board will continue to advertise for the second position of youth member. . - } June 24, 1996 RECOMMENDATION OF WETLAND APPLICATIONS No. 1354 Moved by Robert Keith, seconded by John Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Application of MICHAEL RAYNOR 117-5-22 to remove existing dock and replace with bulkhead and to tie into existing bulkhead of neighbor; backfill with 450 c.y. and stabilize. The CAC recommends disapproval because there appears to be no erosion problem and no demonstrated need shown 890 Old Harbor Road, New Suffolk Vote of Council: Ayes: All Motion carried. No. 1355 Moved by Robert Keith, seconded by John Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATIONS of the Wetland Application of MARCUS and JOANN BRYAN 83-1-2 to construct a total of 90 linear feet of timber bulkhead along toe of bluff with a 15' return. Backfill 10' behind bulkhead with 125 c.y. of clean sand to be trucked in from an upland source. The Council recommends approval with the provision that the bulkhead be covered with sand and the the coverage be maintained. 155 Glen Court, Cutchogue Vote of Council: Ayes: All Motion carried. No. 1356 Moved by Robert Keith, seconded by John Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATIONS of the Wetland Application of MARCUS and JOANN BRYAN 83-1-3 to construct an 89 +/- linear foot timber bulkhead along toe of bluff to tie into proposed bulkhead to west. Add one (1) 15' return. Backfill 10' behind bulkhead with 125 c.y. of clean sand to be trucked in from an upland source. The Council recommends approval with the provision that the bulkhead be covered with sand and the the coverage be maintained. 255 Glen Court, Cutchogue Vote of Council: Ayes: All Motion carried. No. 1357 Moved by Robert Keith, seconded by Allan Connell, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH PROVISIONS of the Wetland Application of PAULETTA BROOKS CURFEIN 83-2-13.5 to build steps/stairs from top of bluff (property) to bottom of bluff (beach) . The CAC recommends approval provided the steps/stairs are 3' wide and at least 4' above grade of bluff. 2800 Dignans Road, Cutchogue Page 2 June 24, 1996 _ Vote of Council: Ayes: All Motion carried. No. 1358 Moved by Allan Connell, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Application of JOHN LYNCH 78-2-28 to construct 120 I.f. of timber bulkhead plus two (2) 8' returns. Dredge an are up to 10' in front of new bulkhead to maximum depth of 3' below ALW. Resultant 133 c.y spoil to be used for backfill. Bulkhead . to be generally at or above line of AHW. The Council recommends disapproval because no need is shown. 1020 Glenn Road, Southold Vote of Council: Ayes: All Motion carried. No. 1359 Moved by Bruce Loucka, seconded by John Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Application of KATHLEEN RIBARICH 70-4-20 to obtain a permit for existing dock measuring as follows: Platform 4'9" x 611"; ramp 2'11" x 14'; floating docks 20'2" x 411111, 9110" x 6', and 16' x 6'. 2295 Wells Avenue, Southold Vote of Council: Ayes: All Motion carried. No.1360 Moved by Robert Keith, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Application of STEVEN BELLAVIA 115-11-21 to construct a 4' x 12' open pile dock and steps and to install a 4' x 12' ramps and 5' x 16' floating dock and associated pilings. 380 Lupton Point Road, Mattituck Vote of Council: Ayes: All Motion carried. No. 1361 Moved by Robert Keith, seconded by Allan Connell, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Application of WILLIAM PYMM 122-9-7.9 to reconstruct in kind/in place 150' of timber groin and to construct a 50' timber groin in the same location as deteriorated 50' groin. The CAC recommends disapproval because there is no demonstrated need shown. Vote of Council: Ayes: All Motion carried. Page 3 June 24, 1996 No. 1362 Moved by Allan Connell, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Application of CRESCENT BEACH CONDOMINIUM ASSOCIATION 38.1-1-22 to add 68' of fixed dock to an existing dock with 7 piles; a 4' x 48' "T"; a 3' x 10' ramp; and a 6' x 20' float. The Council recommends disapproval because the project is excessive and extends into a productive scallop area. The Council recommends denial of the current proposal but suggests that the applicant develop an east/west configuration instead of a north/south into the bay. Off of Maple Lane, Orient Harbor, Greenport Vote of Council: Ayes: All Motion carried. No. 1363 Moved by Allan Connell, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH PROVISIONS of the Wetland Application of DAVID McELROY 52-8-2 to construct docking facility consisting . of platform 3' x 101; steps 3' x 91; fixed dock 3' x 601; ramp 3' x 16'; and float 6' x 20' with two 2-pile dolphins to secure float. Construct walkway 3' x 108'. Construct gazebo with footprint area 99 sq. ft. The Council recommends approval provided the walkway and fixed dock are a minimum of 3' above grade. 2565 Long Creek Drive, Southold Vote of Council: Ayes: All Motion carried. No. 1364 Moved by Allan Connell, seconded by Robert Keith, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH PROVISIONS of the Wetland Application of WILLIAM A. HANDS JR. 26-2-21 to construct a single family dwelling with garage, driveway, well, and septic system. The Council recommends approval provided there is a 20' non-turf buffer back from the edge of the bulkhead and the gutters and downspouts go into d rywe I I s. Willow Terrace, Orient Vote of Council: Ayes: All Motion carried. No. 1365 Moved by Allan Connell, seconded by John Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH PROVISIONS of the Wetland Application of ROBERT AND CHRISTA BROWN 45-4-6.1 to construct an 1800 s.f. office building with sanitary system and 18 parking spaces with bluestone surface. The Council recommends approval provided runoff be contained on site during and after construction and that applicant protect the wetlands from sedimentation during construction. Page 4 June 24, 1996 The CAC also recommends the applicant be fined for commencing work without a permit. Route 25, Greenport Vote of Council: Ayes: All Motion carried. RECOMMENDATION OF AMENDMENT TO PERMITS A-64 MICHAEL P. BONTJE 57-2-23 to amend permit to add a 12' long x 3' wide floating extension to the 16' fixed return with 2 pilings on the "J" shaped dock. The Council will support Chairman Allan Connell's recommendation at the . Trustees' meeting once he receives some clarification of the request. A-65 Moved by Robert Keith, seconded by Allan Connell, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH SUGGESTION of the Amendment to Permit request of CHRISTOPHER J. DOROSKI 143-5-13.1 (Permit originally issued to George Hesse) to change size of ramp from 3' x 6' to 3' x 8' and the float from 6' x 18' to 6' x 201, secured with 3 piles. The CAC recommends approval of the project but suggests -that it should be a Wetland Permit and not an amendment to a permit. 650 Riley Avenue, Mattituck Vote of Council: Ayes: All Motion carried. A-66 Moved by Robert Keith, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the request to amend permit by JOHN LA FORCE 113-9-16 to amend permit to construct a 4' x 95' fixed walk instead of 3'. 855 Home Pike Road, Mattituck Vote of Council: Ayes: All Motion carried. A-67 Moved by Allan Connell, seconded by John Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATIONS of the Amend Permit request of MICHAEL SLADE 110-7-26 to amend permit to construct approximately 135' x 12' to 20' wide rock revetment instead of bulkhead to tie into two existing bulkheads and dredge area around docks to depth of 4' below MLW to 7' below MLW yielding approximately 350 c.y. of spoil and a ten year maintenance permit as necessary. Page 5 June 24, 1996 The CAC recommends approval with the stipulation that the area be zoned M1; if it is not, then the CAC recommends disapproval of the dredging. 1435 West Road, Cutchogue Vote of Council: Ayes: All Motion carried. A-68 Moved by Robert Keith, seconded by John Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Amend Permit request of JAMES KING 106-4-6 to amend permit to include a 3 1/2' x 20' ramp to the existing 6' x 60' float on the northwest side of dock. Ramp to be suspended from a platform on the fixed dock. The CAC recommends approval of the project but feels it should be a wetland application and not an amendment. 220 East Mill Road, Mattituck Vote of Council: Ayes: All Motion carried. DISCUSSION AND RECOMMENDATION OF WAIVER REQUESTS WR-39 Moved by Allan Connell, seconded by Robert Keith, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Waiver Request of Doroski Nursery for ANGEL SHORES 88-6-4 E 13.1 to clear the underbrush, vines, bramble bushes and dead debris from park area. The CAC recommends disapproval of the waiver request and suggest the project go through the Wetland Application process and the an appropriate description of the location be supplied. Bayview Road, Southold Vote of Council: Ayes: All Motion carried. RECOMMENDATION OF GRANDFATHER PERMITS GF-23 Moved by Allan Connell, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Grandfather Permit request of DAVID WIRTZ 37-4-13 to replace 15 rotted bulkhead pilings in kind/in place on 160' bulkhead installed in 1951 . 2805 Cedar Lane, East Marion Vote of Council: Ayes: All Motion carried. GF-24 Moved by Allan Connell, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH CONDITIONS of the Grandfather Permit request of CAROL STANCS Page 6 June 24, 1996 88-6-16 to reconstruct in kind/in place 100' of timber bulkhead and to backfill structure with 10 c.y. of clean sand trucked in from an upland source. The CAC approves with the condition that a 20' buffer to beachgrass be maintained behind the bulkhead. The Council also questions whether it is a Grandfather Permit and if so, why?. 1120 West Lane Road, Southold Vote of Council: Ayes: All Motion carried. GF-25 Moved by Allan Connell, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Grandfather Permit request of GARDINERS BAY ESTATES HOME OWNER ASSOCIATION 37-5-23.2 for a 77' jetty and a 368 bulkhead. West end of beach, Orient Harbor, East Marion Vote of Council: Ayes: All Motion carried. GF-26 Moved by Allan Connell, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Grandfather Permit request of GARDINERS BAY ESTATES HOME OWNER ASSOCIATION 37-5-23.2 for a 6' wide 76'7" long foot bridge to beach. 148'4" from Knoll Circle to bridge on 10' ROW, East Marion Vote of Council: Ayes: All Motion carried. GF-27 Moved by- Allan Connell, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Grandfather Permit request of GARDINERS BAY ESTATES HOME OWNER ASSOCIATION 37-4-18 for a 5'6" wide x 5614" long foot bridge to Fox Island. East Marion Vote of Council: Ayes: All Motion carried. RECOMMENDATION OF EXTENSION REQUESTS E-4 Moved by Allan Connell, seconded by Robert Keith, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Extension of Permit request of ARTHUR R. TORELL 33-2-10 E 11 to extend permit to build single family dwelling with driveway. Sound Drive, Greenport Vote of Council: Ayes: All Motion carried. Page 7 June 24, 1996 SET NEXT MEETING DATE The next meeting of the Southold Town Conservation Advisory Council will be held MONDAY, JULY 29, 1996 at 4:30 P.M. in the Conference Room at Southold Town Hall, Main Road, Southold, New York Chairman Allan Connell informed the Council that he would not be able to attend the July 1996 meeting as he would be out of town.
