Box 1179 Telephone (516) 765-1801 ��' 0�- Southold, New York 11971 ��1 � y� SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL MAY 20, 1996 A meeting of the Southold Town Conservation Advisory Council was held Monday, May 20, 1996 at 4:30 P.M. in the Conference Room at Southold Town Hall, Main Road, Southold, New York. Present were Allan Connell, Chairman Bruce Loucka, Member Robert Keith, Member John Hagerty III, Member Scott Hilary, Member Linda Cooper, Secretary Absent were: Kenneth Meskill, Member Betty Wells, Member REPORTS - Scott Hilary reported that , he had been working, with his father Richard Hilary, on a project "SOAR" Stewards of American's Resources which is to involve youth in the protection and understanding of our environment and natural resources. The Council reviewed and agreed that it supported the project. Jack Hagerty reported that the Goose Creek project would be starting soon. The permits have been obtained and he was informed that the work would commence by the Southold Town Highway Department as soon as it finished the Annual Spring Clean-Up. Bruce Loucka is continuing the water sampling. Allan Connel brought up a problem which exists at the Southold Park District South Harbor Park. The district has slips there and the boaters are destroying the spartina. Allan requested and received the support of the other 1 May 20, 1996 members to write a letter as CAC Chairman requesting that something be done about the situation. RECOMMENDATION OF WETLAND APPLICATIONS No. 1348 Moved by Robert Keith, seconded by Allan Connell, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH CONDITIONS of the Wetland Application of JAMES DEERKOSKI 114-10-2 to build a single family 2-story dwelling with garage. 260 Deer Drive, Mattituck The CAC recommends approval if runoff is contained using hay bales, drywells, etc. and that there be no clearing within 75' of the wetlands. Vote of Council: Ayes: All Motion carried. No. 1349 Moved by Allan Connell, seconded by Scott Hilary, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATIONS of the Wetland Application of MICHAEL J. LEAHY 64-3-4 to construct .within 18" of existing functional bulkhead 113 I.f. of bulkhead and place approximately 15 c.y. of backfill. 2200 Hobart Ave., Southold The CAC recommends approval with the stipulations that there be a non-turf buffer and that the top edge of the bulkhead be elevated 6" higher than the ground surface to allow runoff to percolate into the ground. The Council also suggests the applicant be advised that the bulkhead is not needed. The bulkhead could be removed, the area graded and stabilized with plantings. Vote of Council: Ayes: All Motion carried. No. 1350 Moved by Allan Connell, seconded by Robert Keith, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATIONS of the Wetland Application of GREGG and BERNARD FISHER 114-12-4 to build a catwalk and dock to access James Creek: 4' x 327' catwalk; 4 x 20' ramp; 6' x 20' float. New Suffolk Avenue, Mattituck The Council recommends approval provided the catwalk is as narrow as possible, (3' or less); be a minimum of 3' above the natural grade; applicant do away with the ramp and float and put a mooring in deeper water. Y No. 1351 Moved by Bruce Loucka, seconded by Allan Connell, it was RESOLVED to recommend to the Southold Town Board of Trustees- DISAPPROVAL of the Wetland Application of LUCIEN ARCAS 50-2-6 and 8 to install 200' +/- timber bulkhead, 14' and 16' returns, armored with rock revetment, 300 c.y. of clean fill. Soundview Avenue, Southold The Council recommends disapproval because there is no need shown for the project. Vote of Council: Ayes: All Motion carried. No. 1352 Moved by Bruce Loucka, seconded by Scott Hilary, it was RESOLVED to recommend to the Southold Town Board. of Trustees APPROVAL of the Wetland Application of ALEXANDER SPIRIDAKIS 135-1-4 to construct approximately 30' retaining wall to attach to neighbors and access stairs. Soundview Avenue, Southold There is illegal fill on the property. The CAC recommends that the applicant be fined for the violation. Vote of Council: Ayes: Bruce Loucka, Robert Keith, Jack Hagerty, Scott Hilary Abstain: Allan Connell Motion carried. No. 1353 STEVE MALINOWSKI 10-11-3 to replace/modify existing dock to include utility shed Fishers Island The CAC did not make an inspection on Fishers Island therefore it has no recommendation. RECOMMENDATION OF AMENDMENT TO PERMITS A-54 Moved by Bruce Loucka, seconded by John Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Amendment request of PEGGY HELLER 8 ANNE WYDEN 26-2-39.1 to Page 3 May 20, 1996 amend permit to reduce the size of the house as noted on survey dated April 1, 1996 and reconfigure the driveway. Majors Pond Road, Orient Vote of Council: Ayes: All Motion carried. A-55 Moved by Moved by Allan Connell, seconded by Jack Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Amendment request of EDWIN J. BERNHARDT 87-5-4 to amend permit to add 4' x ,29' "L" with a 4' x 14' ramp, 8' x 23' float with two piles as per submitted survey. 500 Koke Drive, Southold The -Council recommends disapproval because the proposal would cover more bay bottom and applicant has a functional dock. Vote of Council: Ayes: All Motion carried. A-56 Moved by Robert Keith, seconded by Allan Connell, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Amendment request of WILLIAM SCHENONE 114-7-11.3 to amend permit to change width of dock from 3' to 41. Westphalia Road, Mattituck Vote of Council: Ayes: All Motion carried. A-57 Moved by Bruce Loucka, seconded by Allan Connell, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Amendment request of ROBERT SCHISSEL 80-1-46 to add an 8' x 12' deck landward of the bulkhead. 710 West Shore Road, Southold The Council recommends the applicant be fined. The work was done without a permit. Vote of Council: Ayes: All Motion carried. A-58 Moved by Allan Connell, seconded by Scott Hilary, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Amendment request of SILVANA CADEDDU 35-5-23 to install 15' x 23' deck on top of existing ramp Page 4 May 20, 1996 1380 Wiggins Lane, East Marion The Council recommends the applicant be fined. - The work has commenced without a permit. Vote of Council: •Ayes: All Motion carried. A-59 Moved by Bruce Loucka, seconded by Allan Connell, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Amendment request of CRESCENT BEACH CONDOMINIUM ASSOCIATION 38.1-1-22 to add 4' x 68' dock with a 4' x 48' "T"; a 3' x 10' ramp; a 6' x 20' float; 7 piles on west side of dock forming 7 slips for small boats. Existing ramp and float will be used in new location. Maple Lane, East Marion The Council feels the project is excessive and recommend that the applicant apply for a permit, not an amendment to a permit. Vote of Council: Ayes: All Motion carried. A-60 Moved by Bruce Loucka, seconded by Jack Hagerty, it was. RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Amendment request of NICHOLAS ARONIADIS 15-9-1.6 to construct a 12' x 50' wood ramp over existing stone ramp, as stone ramp is too uneven. 1090 Latham Lane, Orient The CAC recommends the applicant be fined. Work has already commenced. Vote of Council: Ayes: All Motion carried. A-61 (Also GF-21) Moved by Allan Connell, seconded by Jack Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATIONS of the Amendment and Grandfather Permit request of JOSEPH POTTGEN 57-1-27 to add a 4' x 4' platform on top of bulkhead with stairs leading to beach. (Grandfather Permit for 100' bulkhead) 550 Blue Marlin Drive, Southold The Council recommends approval with the stipulation that applicant install a 20' non-turf buffer. Vote of Council: Ayes: All Motion carried. Page 5 May 20, 1996 A-62 Moved by Robert Keith, seconded by Allan Connell, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Amendment request of NASSAU POINT PROPERTY OWNERS ASSOCIATION 104-8-8.1 to replace fence with boulders. Nassau Point Road, Cutchogue Vote of Council: Ayes: All Motion carried. A-63 LOUIS BACON to add a platform and ramp. Robins Island The Council did not make an inspection, therefore, it has no recommendation. A-64 Moved by Robert Keith, seconded by Allan Connell, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Amendment request of VINCENT MANAGO 118-4-10 to move decking and 8' x' 10' storage shed to center of property. 8225 Nassau Point Road, Cutchogue Vote of Council: Ayes: All t Motion carried. RECOMMENDATION OF WAIVER REQUESTS WR-37 Moved by Bruce Loucka, seconded by Jack Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH CONDITIONS of the Waiver Request of SANDRA KIERSKY 66-2-35 to construct a 15' x 15' deck attached to existing dwelling. 620 Rogers Road, Southold The Council recommends approval if and only if it is a wooden deck that will allow infiltration into the ground and that the envelope under and 1' around the deck be sand or stone to allow percolation so no runoff will be allowed in the creek If these conditions cannot be met, the council recommends DISAPPROVAL of the Waiver Request and require the applicant to apply for a permit. NOTE: There is a violation on the property. Ornamental vegetation is being planted in the high marsh. The Council suggests the Trustees order the plantings be removed and the area restored and that the applicant be fined. Vote of Council: Ayes: All Motion carried. Page 6 May 20, 1996 WR-38 Moved by Robert Keith, seconded by Allan Connell, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH CONDITIONS of the Waiver Request of JOHN J. SAMPIERI 118-2-12 to extend deck. 1380 Bayberry Road, Cutchogue The Council recommends approval if, and only if, it is a wooden deck that allows infiltration into the ground; and that the envelope area under the deck and 1' around the deck be sand or stone to allow percolation so no runoff will be allowed into the wetland; and add a non-turf buffer at the edge of the lagoon. If these conditions cannot be met, the CAC recommends DISAPPROVAL of the Waiver Request and suggest the Trustee require the applicant apply for a Wetland Permit. Vote of Council: Ayes: All Motion carried. DISCUSSION AND RECOMMENDATION OF GRANDFATHER PERMIT REQUESTS GF-21 - See A-61 GF-22 Moved by Robert Keith, seconded by Allan Connell, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Grandfather Permit request of HELEN & ROBERT RUST 111-14-34 to amend grandfather permit to add the 120' bulkhead and the dock not included in the original grandfather application. Wunneweta Road, Cutchogue The CAC recommends disapproval because it feels this is not a Grandfather Permit but should be treated as a Wetland Permit which the CAC would approve. Vote of Council: Ayes: All Motion carried. NON-JURISDICTION NJ-19 Moved by Bruce Loucka, seconded by Allan Connell, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH CONCERNS for a Letter of Non-Jurisdiction of NIKOLA GALJANIC 31-9-1 to construct a single family dwelling. Bay Avenue, East Marion This application appears to be out of the Trustees' jurisdiction, however, the CAC is very concerned about the septic system and the danger that all runoff (including that from the septic system) will be diverted into Marion Lake due to the slope of the property. SET NEXT MEETING The next meeting of the Southold Town Conservation Advisory Council will be held MONDAY, JUNE 24, 1996 at 4:30 P.M. in the Conference Room at Southold Town Hall, Main Road, Southold.
