CONSERVATION ADVISORY COUNCIL
APRIL 22, 1996
A meeting of the Southold Town Conservation Advisory Council was called to
order at 4:30 P.M. on Monday, April 22, 1996.

CHAIRMAN'S ANNOUNCEMENTS
Chairman Allan Connell reported that the ;Hashamomaque project will be moving
along.
Allan also said that in' the future the CAC members will receive a copy of the
Trustees' meeting minutes so- that the members will know what happened at. the
meeting.
REPORTS
Members discussed the Grandfather Permit situation. Some members feel that
structure owners were given ample opportunity to obtain the Grandfather Permit
during the grace period and are now benefiting from their failure to take care
of the permit at the proper time. It was stated that the Trustees' cannot deny
a functioning structure. Robert Keith volunteered to do some research to see
if the Trustees could/should at least charge a fee for Grandfather Permits
issued past the grace period.
Scott Hilary mentioned that there is a Federal Jr. Duck Stamp Program which
requires that entries be submitted by students. It was discussed' that a
program like that would be a good project for the new junior CAC, members,
they could supply each school district the particulars for participation.

Scott also questioned whether ID tags could be supplied to members. ' Note: In
the past, ID tags were issued. The CAC secretary will check into this
matter. Allan Connell suggested that the members go to the door and introduce
themselves before making an inspection.
Bruce Loucka reported that he is continuing the water sampling in Goose Creek
and Arshamomaque and a new station has been added.
Jack Hagerty expressed concern about the lack of town action in regards to
clearing up the. runoff problem at Goose Creek. He will check with Jim
McMahon to find out the state of the town's clean up efforts.
Kenneth Meskill had checked with the State and found that the use of creosote
in pilings is legal, the DEC is aware of the problem with creosote and
encourages the use of CCA. Kenneth will check with East Hampton to find out
what is banned and what is used in that area.
Kenneth also reported that the DEC will not be doing an osprey survey in the
future but he intends to continue as a volunteer and would like any help he
can get. Scott Hilary stated he would be glad to help.
APPROVAL OF MINUTES OF MARCH 25, 1996
Moved by Robert Keith, seconded by Kenneth Meskill, it was
RESOLVED to approve the minutes of March 25, 1996 with the following
correction:
Wetland Application No. 1337, motion made by Kenneth Meskill not Allan
Connell.

RECOMMENDATION OF WETLAND APPLICATIONS
No.1339
Moved by Bruce Loucka, seconded by John Hagerty, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH STIPULATIONS of the Wetland Application of SOUTHOLD PARK
DISTRICT 64-1-19.1 to 1) Dredge creek to remove silt caused by drainage
system. 2) To make south side of seawall usable for mooring of residents'
boats. 3) To redredge channel to provide access to Southold Bay.
The CAC recommends approval provided the dredge spoils are placed on an
approved upland site.

Moved by Bruce Loucka, seconded by Scott Hilary, it was
RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the Wetland Application of STANLEY 'J. CIAPUTA 50-2-7
to install a 200' timber bulkhead to attach to neighbors to east and west in
the future and backfill with clean fill from approved upland source.
The CAC recommends disapproval because there is no need shown.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH PROVISIONS of the Wetland Application of JOHN LaFORCE 113-9--16 to
construct a timber dock consisting of a 3' x 95' fixed elevated (4' above grade
of marsh) walk; 32" x 20' hinged ramp; 6' x 20' float secured by (2) 2 pile
dolphins.
The Council recommends approval provided the dock does not exceed the
neighbor's dock to the west nor interfere with navigation.

RESOLVED to 'recommend to the Southold Town Board of Trustees APPROVAL
WITH AN EXPLANATION of the Wetland Application of JOHN MANNING
117-10-11 'to replace two existing groins on beach damaged by storms,
removing same and construction 2 new ones each 110' long from foot of upland
bank.
The Council normally does not recommend approval of groins however, it
recommends approval for this project because it is an improvement over the
current situation:
1 . The high profile groins are being replaced by low profile groins.
2. Reducing the number of groins from five (5) to four (4) .

WITH STIPULATIONS of the Wetland Application of HAROLD HEPENSTEIL

123-3-14 to construct an 881. x 4' raised catwalk; a 4' x 14' ramp; and a 6' x
20' floating dock.
The Council recommends approval provided the project is shortened so the
length does not exceed the the neighbor's dock to the north.

The CAC did not inspect and therefore has no recommendation for the Wetland
Application of CHARLES VAN VOORHIS by SCRIBNER L. FAUVER as TRUSTEE
10-3-1 to construct a rock revetment and a single family dwelling.

Moved by Allan Connell, seconded by John Hagerty, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH PROVISIONS of the Wetland Application of ARNOLD NEUER 56-4-16 to
clear road.
The Council recommends approval provided the applicant secure an erosion and
sediment control plan for runoff.
NOTE: The Council recommends the applicant be fined for work already
completed.

RESOLVED to TABLE the Wetland Application of ARNOLD NEUER 56-1-6 to
clear debris from property and leave natural.
The CAC tabled the application until it receives specific information as to
what, where, and how much debris is to be removed.

The Council did not inspect and therefore do not have a recommendation for the
Wetland Application of ROBERT and ELLEN WHITE 10-3-9 to install +43' of
revetment, which shall consist of 1 - 1 1/2 yard rock which shall be placed on
filter fabric, and backfilled with +75 c.y. of soil and then planted with
native vegetation.

RECOMMENDATION OF AMENDMENT TO PERMITS

The Council did not inspect and therefore does not have a recommendation for
the request of LOUIS M. BACON to amend permit to allow the construction of
a 2' x 90' timber walkway to span the newly reconstructed dune.

Moved by Allan Connell, seconded by John Hagerty, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH PROVISIONS of the request of WILLIAM AND COLLEEN CONNORS
59-5-29.3 to amend permit to add a deck on the western side of the house.
Deck would be on the second story, a height of approximately 16'-17' above
grade; 8' x 40' with additional pilings; or cantilever a 4' deck on the west
side for the length of the house (40') and 16'-17' above grade.
The Council recommends approval of the 4' deck on the west side of the house
provided there is no additional disturbance to the wetlands in the form of
additional pilings.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the amendment to permit request of TOLLEWOOD COMMUNITY 113-8- to
replace catwalk, ramp, floating dock in kind and add 10'6" to landward end and
elevated 3'6" as per Dept. of State.

The CAC did not inspect and, therefore do not have a recommendation for the
request of GREY CULLS PARTNERSHIP and KATHERINE duPONT 7-4-5 amend
permit to relocate an existing floating dock (approx. 14' x 22') and restraint
piles (4) and installing a new floating dock approximately 8' x 54' adjacent to
the existing fixed wood pile and timber pier, including ramps and 9 float
restraint piles, extend the existing 9' wide "L" shaped end dock by 6' and
install two dual tie-off piles.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH PROVISIONS of the request of MICHAEL BONTJE 57-2-23 to amend
permit to allow the Bontje dock extension to make a "J" shape rather than an
"L" shape.
The Council recommends approval provided the existing section of the fixed
dock is raised 3' above grade.

The CAC recommends disapproval because there is no need and the additions
would cover excessive creek bottom.

RECOMMENDATION OF WAIVER REQUESTS

Moved by Robert Keith, seconded by Betty Wells, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Waiver Request of LOIS McGOWAN 116-6-18.1, 19.1 and 20.1 to
construct a driveway made of loose gravel or stone and a small parking area.

Moved by John Hagerty, seconded by Scott Hilary, it was
RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the Waiver Request of GERALD P. REDDY 57-2-33 to
replace front cement stoop with 6' x 12' wood deck west side of house; install
8' x 4' walk-in Bay Window west side of house.
The Council recommends disapproval of the Waiver Request and recommends that
a Wetland Permit be required. The Council recommends disapproval of the
waiver request because there would be no control over the project and there
has already been changes from the plans submitted.

The Council did not inspect and therefore cannot make a recommendation for
the Waiver Request of the FISHERS ISLAND FERRY DISTRICT 12-1-10 to
reconstruct the east ramp in the Silver Eel Cove including the installation of
65 +/- I.f. of steel sheetpile bulkhead with backfill (70 +/- c.y. over 250 +/-
s.f. ), new counterweight supports, and protective dolphins, waterward of the
high tide line.

RECOMMENDATION FOR LETTERS OF NON-JURISDICTION

Moved by Robert Keith, seconded by Betty Wells, it was
RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the request for a Letter of Non-Jurisdiction for RICHARD
NEMSCHICK and SUZANNE AUER 100-3-11.14 for a lot to build a home.
The CAC recommends the applicant obtain a permit because there will be
clearing within 75' of the wetlands and there exists a potential of severe
erosion problems to the bluff face due to the slope of the land.

RECOMMENDATION OF GRANDFATHER PERMITS

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the request for a Grandfather Permit by EDNA McCALLION 116-5-13 to
resheath an existing functional timber groin.

RECOMMENDATION OF EXTENSION REQUESTS

Moved by Robert Keith, seconded by Allan Connell, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH PROVISIONS of the extension request of LOUIS M. BACON 117-8-20
which allows relocation of existing dolphins and installation of buffer piles.
The Council recommends approval with the stipulation that the extension be
only for the period of time allowed under Trustee extension policy (usually 1
year) .
