SOUTHOLD TOWN
CONSERVATION ADVISORY COUNCIL
MARCH 25, 1996.
The Southold Town Conservation Advisory met Monday, March 25, 1996 at 4:30
P.M. at the Southold Town Hall.
Present were: Allan Connell, Chairman .

The Council was joined briefly by Peter Wenczel, Southold Town Trustee. 'Mr.'
Wenczel asked the Council to consider the policies of the Board of Trustees
which were scheduled for Public Hearings at the Trustee's next meeting. He
also spoke of other matters .of mutual interest to the CAC.
CHAIRMAN'S ANNOUNCEMENT
Chairman Allan Connell advised members of a one day conference entitled
"Innovative Uses of Breakwaters in Coastal Erosion Control: Integrating
Shoreline Protection and Estuarine Habitat, Enhancement", presented by New
York Sea Crant on Friday, March 29, 1996,- from .8.:30 A.M. to 4:00 P.M., at
the. Ronkonkoma Holiday Inn. Allan stated that he planned to go and that if
any one else was interested, perhaps- they could car pool. The secretary
advised them that the Town Board had granted permission for the CAC's
attendance.
Allan also congratulated Robert Keith in the "great job .' he did with the Permit
Booklet.
REPORTS
Allan Connell reported on some of the actions at the February Board of
Trustees meeting.

Members were advised of the disposition of applications which were tabled by
the CAC:

John Hagerty reported that Maureen Davison (NYSDEC) had been in contact
with him and is hoping to do some more water testing.
APPROVAL OF MINUTES
Moved by Betty Wells, seconded by John Hagerty, it was
RESOLVED to approve the minutes of the Southold Town Conservation Advisory
Council held February 26, 1996 as submitted.

RECOMMENDATION OF WETLAND APPLICATIONS

Moved by Scott Hilary, seconded by John Hagerty, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Wetland Application of FRANK PIROLO 80-3-19.1 to construct a 6' x 20'
floating dock with a 3' x 14' ramp connected to existing bulkhead and
installation of 2 CCA piles to secure float.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH SUGGESTIONS of the Wetland Application of ROBERT E. AND BARBARA
C. HOLLEY 53-3-13 to construct an 8' x 22' addition and .8' x 12' deck.
The CAC recommends approval and suggests applicant maintain existing
hay bales and sediment barriers in the northwest corner.

RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the Wetland Application of JOHN BRAIDER 35-3-p/o 12.5
and 12.6 to construct 245 +/- linear feet of plastic retaining wall entirely
landward of AHW plus a 15' return on south side and 10' return on north
side. Construct 204 +/- Linear feet 'of stone rip-rap wall 15' +/- landward
north of dock; fill intervening areas with 275 +/- cubic yards of clean fill
and plant with beach grass.

The CAC recommends disapproval because there is no need shown, erosion
should be controlled with vegetation. Plant the area below the mean high tide
with spartina alterniflora. The area above the mean high tide should be
planted with spartina patens after grading. The rip rap wall is not needed,
the area should be stabilized with beach grass. All exposed upland areas
should be planted between April 15 and May 15. Applicant should contact the
Natural Resource Conservation Services for planting recommendations.
NOTE: Sediment barriers are needed immediately to prevent sediment into
the creek because of the exposed and unstable area.

RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the Wetland Application of ARMANDO and JACQUELINE
GRASSI 128-4-21 to remove (3) existing timber groins and construct (1) 40'
timber groin. New structure will be similar in length and construction to
others to the east and west.
The Council recommends disapproval because there is no need shown.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH CONDITIONS of the Wetland Application of ROBERT W. KUHNE and
VIRGINIA HARMS 90-1-8 to construct a 3' x 30' walk, 3' x 12' ramp and 6' x
16' floating dock.
The CAC recommends approval with the condition that the walkway is 3'
above the natural grade.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH STIPULATIONS of the Wetland Application of RICHARD S. BURDEN and
LORRAINE BURDEN 122-4-15 and 16 to dredge creek in front of bulkhead to a
depth of three feet at low tide.
The CAC recommends approval with the stipulation that the spoil be
removed to an approved upland site.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH STIPULATIONS of the Wetland Application of VINCENT and CAROL
MANAGO 118-4-10 to
(a) Restore the primary bulkhead (150' x 15'), adding a new retaining
wall and fill in the eroded sand.
(b) Erect a 10' x 8' supply shed on the bulkhead.
(c) Restore steps down to the bulkhead and to the beach.
The Council recommends approval with the following stipulations:
1 . The bulkhead must align with both neighbors
2. Plant fill area to beach grass
3. Stairs must be 3' above grade

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH CONDITIONS of the Wetland Application of HUGH J. MURPHY 70-6-8 to
(1) Raise existing house to required FEMA elevation.
(2) New Pile foundation to replace deteriorating foundation of locust
posts and stacked concrete blocks.
(3) Proposed addition on south side of existing house.
(4) Proposed porch and addition on west side of house.
(5) Possible rebuilding of approximately 10 feet of west side of existing
house if found to be in deteriorated condition.
The CAC recommends approval with the condition that the applicant put
silt fence or staked hay bales around the perimeter of the property to prevent
sedimentation.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH CONDITIONS of the Wetland Application of ELAINE McDUFFEE
118-5-2.2 to construct a bluestone patio on two-level elevated bed, not
exceeding 18" above grade; stones set in sand base with mortared joints; with
steps to grade. Total area approximately 517 s.f.
The Council recommends approval provided the applicant directs the runoff
away from the bluff. The CAC suggests grading to have runoff flow south.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH PROVISIONS of the Wetland Application of KAREN DALY 51-4-2 to
replace 130' timber bulkhead, 16' return, 3' x 8' access stairs, backfill with
52 c.y. clean fill from approved upland source. " Reconstruction to be in-kind,
in-place.
The Council recommends approval provided the reconstruction is in-kind
and in-place.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH SUGGESTIONS of the Wetland Application of MARDIK and LOUISE
DOIKYAN 52-1-4 to construct a wood bulkhead an elevation of approximately 6'
above the existing beach level.
The CAC recommends approval of the application as submitted and
suggests the slope be planted with beach grass.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH STIPULATIONS of the Wetland Application of Alfonso Torres,
U.S.D.A., PLUM ISLAND ANIMAL DISEASE CENTER 16-2-1 and 132-1-30 to
install new cable.
The CAC recommends approval with the stipulation that no overhead work
be done within 300' of an osprey nest between March 15 and July 15 to prevent
disturbance of the osprey nests.

RESOLVED to recommend to the Southold Town Board of Trustees
CONDITIONAL APPROVAL of the Wetland Application of PAT J. IAVARONE
110-7-3 to obtain permit for existing 111' bulkhead with a 10' return on west
side, stairs, 4' x 100' dock, deck, and 8' x 12' cabana and to construct second
bulkhead, approximately 60' long and 6' high with an 8' return on east side.
The Council recommends approval of the retaining wall provided the
applicant is fined for construction of the bulkhead without a permit. The CAC
also suggests the Trustees require the shower water be disposed of
appropriately into the ground.

RECOMMENDATION OF REQUESTS FOR AMENDMENTS TO PERMITS

Moved by John Hagerty, seconded by Allan Connell, it was
RESOLVED to recommend to the Southold Town Board of Trustees PARTIAL
APPROVAL of the Amendment to Permit request of DAVID CICHANOWICZ
66-3-16 to amend Permit No. 4483 as follows:
(1) Move the entire structure in a northerly direction about 24 feet.
(2) Shorten the fixed walkway from 35' to 341.
(3) Shorten the ramp from 16' to 121.
(4) Add a second float, 6' x 201.
(5) Add a third two-pile dolphin.
The Council recommends the Trustees amend the permit to ALLOW the
structure be moved in a northerly direction about 24 feet; shorten the fixed
walkway from 35' to 34'; and to shorten the ramp from 16' to 12'; and to
DENY the request to add a second 6' x 20' and a third two-pile dolphin.

RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the Amend Permit request of CHRISTIAN BURKE 71-1-41
to amend permit to allow a 28' catwalk to reach adequate depths.
The CAC recommends disapproval because no need is shown, there is
adequate water at mean low tide.

RECOMMENDATION OF GRANDFATHER PERMITS REQUESTS

Moved by Allan Connell, seconded by Robert Keith, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Grandfather Permit request of KENT POEY 51-4-5.1 to, maintain
existing wood bulkhead.
The CAC recommends approval however, the Council questions whether the
new work was done without a permit. If a permit was not obtained, the
Council feels a fine would be appropriate.

RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the Grandfather Permit request of KAREN DALY 51-4-2.

GENERAL BUSINESS
The CAC discussed the request of Supervisor Cochran to expand the Council
to nine members. The members reviewed the charges to the CAC as defined
in Town Law. Since there is a provision for additional members, and since the
supervisor is looking to expand the group to include youths the following
resolution was passed:.
Moved by Robert Keith, seconded by Scott Hilary, it was
RESOLVED to recommend to the Southold Town Supervisor Jean Cochran that
the Southold Town Conservation Advisory Council be expanded to nine members
with the following requests:
1) The two new members would always be between the ages of 16 and 21
and must reside within the Town of Southold.
2) Once a "youth" members passes the age of 21 he must be removed and
replaced with someone the proper age.
Vote of Council: Ayes: All
Motion carried.
The Council also requested that the CAC chairman or his designee sit in on the
interviews for the "youth" members.
Allan Connell discussed .a request he had received from Mark Lubbers of Mark
Lubbers Associates of Old Lyme, Connecticut. Mr. Lubbers had requested the
CACs assistance as volunteers to participate in a demonstration project for
stormwater treatment known as STORMTREAT. STORMTREAT SYSTEMS has
received a small grant from the Peconic Estuary Program (PEP) administered by
the Suffolk County Department of Health Services (DOHS) . The proposed site
for the project is the Southold Park' District parking lot on Youngs Avenue.
The project schedule calls for quarterly sampling after a suitable rain. The .
CAC would collect the influent and effluent samples and transport to the
designated lab. If funding allows, there may be six rounds of sampling instead
of the quarterly schedule.
The Council discussed the project and felt it would be a worthwhile
project.
Moved by Allan Connell, seconded by Scott Hilary, it was
RESOLVED to have Chairman Allan Connell respond to Mark Lubbers that the
Southold Town Conservation Advisory Council would assist in the implementation
of the STORMTREAT water quality project. A member would be available to
collect a maximum of 12 water samples during 6 storm events and transport
them to a selected lab for analysis.

SET NEXT MEETING DATE
The Southold Town Board of Trustees are scheduled for Wednesday, April
24, 1996
The CAC will meet MONDAY, APRIL 22, 1996 at 4:30 P.M. ' at the
Southold Town Hall.
ADJOURN
There being no further business to come before the Council, the meeting was
adjourned at 6:50 P.M.
