Box 1179 Telephone • (516) 765-1801 �� Southold, New York 11971 ,�Ol � y�,a SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL MONDAY, FEBRUARY 22, 1996 A meeting of the Southold Town Conservation Advisory Council was held Monday, February '22, 1996 at 4:00 P.M. at the Southold Town Hall, Main Road, Southold, New York. Present were: Allan Connell, Chairman John Hagerty III, Member Scott Hilary, Member Kenneth Meskill, Member Betty Wells, Member -Li•nda Cooper, Secretary Absent were: Bruce Loucka, Member Robert Keith, Member Southold Town Supervisor Jean Cochran met briefly with the CAC to introduce herself and ask that. the CAC consider expanding its membership from 7 to 9 members. The two additional members would be youths. She felt the addition of the young people would be an excellent experience for them and help them in future endeavors. CHAIRMAN'S ANNOUNCEMENTS Chairman Allan Connell distributed copies of a report which was submitted to Supervisor Jean Cochran which gave an brief synopsis of the CAC's activities and projects. The Supervisor has requested the information. Chairman Connell also asked for discussion of Supervisor Cochran's proposal to expand . the Council. , Members thought it sounded like a good idea however there were concerns about the new members being able to vote on projects. 'Most members felt it would be best if the two youths were "associate members" and not voting members. Questions arose concerning the law setting up the CAC. The CAC secretary was requested to obtain a copy of the state law setting up CRCs. Further discussion would be held next month. February 22, 19'° . REPORTS Scott Hilary stated he had a copy of the minutes for the last two Shellfish Advisory Committee if anyone was interested in reading the minutes. Kenneth Meskill stated that he goes to Stony Brook on a daily basis and would be happy to drop off water samples at the DEC. RECOMMENDATION OF WETLAND APPLICATIONS No. 1319 Moved by John Hagerty, seconded by Scott Hilary, it was RESOLVED to TABLE the Wetland Application of VIVIEN SOO 90-3-0 to construct a single family- residence approximately 54' x 36' overall, with private sewage disposal system and private well. Construct dock consisting of platform 3' x 61; ramp 3' x 18'; float 6' x 20', with two (2) piles to secure float The Council continued to table the application because the project was still not staked. 265 Cedar Point Drive East, Southold Vote of Council: Ayes: All Motion carried. No. 1322 Moved by Allan Connell, seconded by John Hagerty, it was RESOLVED to TABLE the Wetland Application of MICHAEL PISACANO 59-6-16 to clear area for home and construct an 1700 s.f. single family dwelling. The Council tabled the application pending the report from the Trustee's environmental consultant. Sound Avenue, Southold Vote of Council: Ayes: All Motion carried. No. 1323 Moved by Allan Connell, seconded by John Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH CONDITIONS of the Wetland Application of ROBERT MORRISSEY' 78-5-5 to: remove and replace 139 I.f. bulkhead in same location and configuration; add two (2) returns; dredge up to 10 feet off 'bulkhead to maximum depth of 4' below ALW. Resultant spoil will be used for backfill. The CAC recommends approval with the condition that a 20' non-turf buffer be maintained. 265 Elizabeth Lane, Southold Vote of Council:, Ayes: All Motion carried. 2 February 22, 19!" No. 1324 Moved by John Hagerty, seconded by Scott Hilary, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of' the Wetland Application of CHRIS PAPPAS 51-1-20 to install 36' of timber bulkhead and (1) 413" long triton marine mattress landward of the mean high water mark. Ten (10) cubic yards of clean fill to be utilized to backfill between the. existing bluff and bulkhead. Sound View Avenue, Southold Vote of Council: Ayes: All Motion carried. No. 1325 Moved by Allan Connell, seconded by Kenneth Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH PROVISIONS of the Wetland Application of JOSEPH GRILLO, JR. 145-4-12.1 to replace (within 18") 412 Lf. of existing timber bulkhead and add two (2) 10' returns. New bulkheads will be 1' higher than existing. Approximately 275 c.y. of clean sand backfill will be trucked in from an upland source. Relocate a seasonal 12' x 20' wood platform which overhands waterway by 6'; 3' x 14' hinged ramp; 6' x 18' float secured by two (2) pilings to a point 10' in from property line. The CAC recommends approval with the provision that after backfilling the area be planted with beach grass and be.maintain .as a 20' non-turf buffer. Mesrobian Drive, Laurel Vote of Council: Ayes: All i Motion carried. RECOMMENDATION OF WAIVER REQUESTS WR-33 Moved by Allan Connell, seconded by Kenneth Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Waiver Request of RONALD F. GALLAGHER 111-5-7.2 to construct a second story, approximately 1200 square feet, with cutters and drywells. Old Cove Road, Cutchogue Vote of Council: Ayes: All Motion carried. RECOMMENDATION OF REQUESTS FOR LETTERS OF NON-JURISDICTION NJ-17 Moved by Scott Hilary, seconded by John Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the request for a Letter of Non-Jurisdiction of ALEXANDER AND CAROLINE WILLIAMS 90-3-19 for an addition to existing residence. 425 East Cedar Point Drive, Southold Vote of Council: Ayes: All Motion carried. 3 February 22, 19! RECOMMENDATION OF AMENDMENT TO PERMITS A-40 Moved by John Hagerty, seconded by Scott Hilary, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Amendment to Permit of GERALD RUPP 51-1-21 to 1 . Install 36' +/- of new timber bulkhead as an extension to the existing bulkhead. 2. Backfill area behind new bulkhead extension with 10 c.y. of clean fill and revegetate with Cape American Beach Grass on 18" centers. 3. Install (1) 4.3' x 18' marine mattress at the toe of the new bulkhead extension. 4. Bring in 200 c.y. +/- of clean fill and regrade are of slope (approx. 2400 s.f.) which had been utilized as access. Regraded slope to be immediately hydroseeded and covered with erosion control blankets (TB-1000) as per manufacturer's specifications. 5. Plant level area landward of existing bulkhead on western end of Rupp property with American Beach Grass on 18" centers. Sound View Avenue, Southold Vote of Council: Ayes: All Motion carried. A-41 Moved by Allan Connell, seconded by John Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH SUGGESTIONS of the Amendment to Permit request of ELINO V. DENA, JR. 73-5-1 to scale back project due to the expense of the original permit while staying true to the original intent and purpose. The CAC recommends approval with the suggestion that the retaining wall be placed at the tow of the bluff and the fill planted with beachgrass. ROW off Route 48, Southold Vote of Council: Ayes: All Motion carried. A-42 Moved by Scott Hilary, seconded by Betty Wells, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Amendment to Permit request of DONALD ALFANO 78-4-13 to add a 3' x 26'' floating dock secured by 2 poles. The Council recommends that the Trustees deny the request and require a full Wetland Permit because the project does not appear to be amending a permit but actually seeking to add additional structures. 900 Corey Creek Lane, Southold Vote of Council: Ayes: All Motion carried. 4 t February 22, 19!- - A-43 Moved by Allan Connell, seconded by Scott Hilary, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Amendment to Permit request of JOHN C. NEVILLE 64-3-6 to add a 12 x 36 deck or possibly a brick patio. The Council recommends the Trustees deny the request and require a Wetland Application because the project is requiring additional structures, not merely amending the permitted work. Hobart Avenue, Southold Vote of Council: Ayes: All Motion carried. A-44 The CAC did not make an inspection of the project site so therefore has NO RECOMMENDATION of the Amendment to Permit request of LOUIS M. BACON to install an 8' x 30' float on the east side of the dock. Robins Island A-45 The Council TABLED the Amendment to Permit request of CATHERINE ATWAN 44-1-20 to stabilize and repair existing jetty by use and add approximately 10 rocks as in the DEC permit and to set back existing stones that were moved. The Council tabled the request until more information is supplied. The CAC does not know what the original permit allowed. A full permit may be required depending on what the past permit actually permitted. RECOMMENDATION OF GRANDFATHER PERMITS GF-16 Moved by Allan Connell, seconded by Scott Hilary, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH CONDITIONS. of the Grandfather Permit Application of CAROLINE ELFERS 81-1-9 & 10 to remove and replace (in same location and configuration) 241 +/- I.f. of existing timber bulkhead, Backfill with 150 c.y. of clean sand topped with 40 +/-c.y. of topsoil trucked in from upland source. There will be no dredging. Concrete ramp will remain. A 4' x 4' platform will be removed and replaced. The Council recommends approval with the condition that there be no topsoil and that a 20' non-turf buffer be maintained. Paradise Point Road, Southold Vote of Council: Ayes: All Motion carried. GF-17 Moved by Kenneth Meskill, seconded by Allan Connell, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Grandfather Permit-Application of PAT J. IAVARONE 5 February 22, 19 for a grandfather permit for existing bulkhead (110' long with 10 return on west side), dock (100' long) and cabana with stairway. Also requests amendment to grandfather permit to allow second bulkhead approximately 60' long and 6' high with a 8' return on east side. The CAC recommends the -applicant be fined for already completing the work on the bulkhead without first obtaining a permit. The CAC feels a full permit application is required for the retaining wall; it cannot be grandfathered because it did not previously exist. The CAC also suggests the Trustees require the shower water be disposed of appropriately into the ground and have the pipe onto the beach removed. 995 West Road, Cutchogue Vote of Council: Ayes: All Motion carried. RECOMMENDATION OF EXTENSION REQUEST E-1 Moved by John Hagerty, seconded by Kenneth Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Extension Request of SUZANNE SWICK 23-1-6.1 to extend Permit #4307, to construct a single family dwelling, issued 4/28/94 for a period of one year. Main Road, East Marion Vote of Council: Ayes: John Hagerty, Kenneth Meskill, Allan Connell, Betty Wells Abstain: Scott Hilary Motion carried. E-2 Moved by Betty Wells, seconded by John Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH CONDITIONS of the Extension Request of VICTOR E. RERISI 35-5-37 to extend Permit #4300, to construct a single family dwelling, issued 3/25/95, for a period of two years. The Council recommends approval with the condition that the extension be for one year only and the a 20' non-turf buffer be maintained. Snug Harbor Road, Greenport Vote of Council: Ayes: Betty Wells, John Hagerty, Allan Connell, Kenneth Meskill Abstain: Scott Hilary Motion carried. APPROVAL OF MINUTES Moved by John Hagerty, seconded by Scott Hilary, it was RESOLVED to accept the minutes of January 22, 1996 as submitted. Vote of Council: Ayes: All Motion carried. 6 February 22, 19'= SET NEXT MEETING DATE The next meeting of the Southold Town Conservation Advisory Council was scheduled for Monday, March 25, 1996 at 4:30 P.M. at Southold Town Hall.
