New York 11971 SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL MONDAY, JANUARY 26, 1998 4:30 P.M. A meeting of the Southold Town Conservation Advisory Council was held Monday, January 26, 1998 at 4:30 P.M. in the Conference Room at Southold Town Hall, 53095 Main Road, Southold, New York. Present were: Scott Hilary, CAC Chairman Bret Hedges, CAC Member Mary Griffin, CAC Member Kenneth Meskill, CAC Member Sharon Shine, CAC Member Linda Cooper, CAC Secretary Absent were: Melvyn Morris, CAC Member (Mr. Morris did make inspections and submitted his recommendations in writing) Alicia Marin, CAC Youth Member Betty Wells, CAC Member Shannon .Reidy, GAC Youth Member CHAIRMAN'S ANNOUNCEMENTS Chairman Scott Hilary advised members that CAC member Melvyn Morris would not be able to attend the next few meetings if they were held on Mondays because of a scheduling conflict. Scott reported on a Suffolk County Cooperative Extension Wetland Workshop. A joint meeting of the Southold Town Board of Trustees and the CAC is due to be held. Due to scheduling conflicts no date has yet been set. Among the topics to be discussed are: Non-turf buffers (description); alerting Trustees to possible violations; and .environmental consultant/resource staff. January 26, 1998 REPORTS CAC member Kenneth Meskill reported that he has been busy doing water sampling. He stated that Brauns has been very helpful and generous in suppling ice for the sampling project and Kenneth feels a thank you letter would be appropriate. There was a discussion as to whether the letter should be from the CAC or the Trustees, some members feeling that the Trustees, as an elected body, would be more appropriate. This matter will be discussed with the Trustees. CAC member Mary Griffin advised members that Stony Brook would be hosting. a monthly open house. . The topic of discussion for February 27, would concern glacier formations on Long Island. All are welcome to attend. APPROVAL OF MINUTES Moved by Kenneth Meskill, seconded by Mary Griffin, it was RESOLVED to approve the minutes of the December 15, 1997 minutes as submitted. Vote of Council: Ayes: All Motion Carried RECOMMENDATION OF WETLAND PERMIT AND COASTAL EROSION' PERMIT APPLICATIONS No. 1511 (from 12/15/97) Moved by Scott Hilary, seconded by Kenneth Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees CONDITIONAL APPROVAL of the Wetland Permit application of PECONIC LANDING 35-1-25 for construction of residential life care community complex buildings consisting of 118 single family detached cottages, 132 apartment units, a 24 unit assisted living center and a 32 bed skilled care center. Route 25, Greenport The CAC recommends approval with the condition cited in the Long Environmental Assessment Form date September 1997 (page 24) that all future construction including beach access points should be placed in a location that does not support rare plant, and possibly animal, species and that will protect wetland areas. Vote of Council: Ayes: All Motion Carried No. 1513 (Tabled 12/15/97) Moved by Bret Hedges, seconded by Mary Griffin, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit . application of KRISTIN POWERS (contract vendee) 123-8-26.1 to relocate existing house noPth of existing location and place on Page 2 i January 26, 1998 piles; construct a roofed porch on south side; a 12' x 38' deck; a deck and addition on north side. Existing garage to be rebuilt and relocate existing walkway. 220 Park Ave., LILCO Pole #32, Mattituck Vote of Council: Ayes: All Motion Carried No. 1514 Moved by Kenneth Meskill, seconded- by Sharon Shine, it was RESOLVED to recommend to the Southold Town Board of Trustees CONDITIONAL APPROVAL of the Wetland Permit application of ANTHONY IENNA (Contract Vendee) 78-2-41 to construct a fixed' "T" shaped timber dock, consisting of a 4' x 24' fixed catwalk (minimum of 3.5' above grade of marsh); a 3' x 12' ramp; and a 6' x 16' float secured by (2) 8" diameter pilings. 2400 Glenn Road, Southold The Southold Town CAC recommends approval provided the walkway is elevated to 4' above grade of marsh. NOTE: Clearing of woodland lot within 75' of the wetlands must not occur. Vote of Council: Ayes: All Motion Carried No. 1515 Moved by Mary Griffin, seconded by Bret Hedges, it was RESOLVED to recommend to the Southold Town Board of Trustees CONDITIONAL APPROVAL of the Wetland Permit application of SUSAN OIESTAD 104-9-4 to construct a fixed timber dock, consisting of a 4' x 14' fixed ramp at the landward end; a 4' x 66' fixed catwalk' a 4' x 12' hinged ramp; and an 8' x 20' float to be secured by (2) 8" diameter pilings. 2200 Broadwater Road, Cutchogue The Southold Town CAC recommends approval provided the walkway is elevated to 4' above grade of marsh. Vote of Council: Ayes: All Motion Carried No. 1516 Moved by Scott Hilary, seconded by Kenneth Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees CONDITIONAL APPROVAL of the Wetland Permit application of KEN SWANSON 26-1-25 to construct a single family residence with an attached garage and porch, driveway, well, and septic system. 1390 Willow Terrace Lane, Orient The Council recommends approval. provided a 10' nonturf buffer is maintained. Page 3 January 26, 1998 Vote of Council: Ayes: All Motion Carried No. 1517 Moved by Kenneth Meskill, seconded by Mary Griffin, it was RESOLVED to recommend 'to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application -of GARDINERS BAY ESTATES HOMEOWNERS ASSOCIATIONS, INC. 37-4-18 to maintenance dredge an existing bulkheaded canal to a depth of -31ALW; resultant spoil 900 +/- c.y. of sand to be placed in buried spoil sites on adjacent uplands. Old Orchard Lane, East ,Marion Vote of Council: Ayes: All Motion Carried No. 1518 Moved by Bret Hedges, seconded by Mary Griffin, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of MARIA ELENA SANTIGATE 123-3-21 to construct 4' x 55' fixed open walkway, 4' x 16' hinged ramp, 8' x 20' floating dock; install two 2-pile dolphins to secure floating dock. 2305 Park Avenue, Mattituck Vote of Council: Ayes: All Motion Carried No. 1519 Moved by Mary Griffin, seconded by Bret Hedges, it was RESOLVED to recommend to the Southold Town Board of Trustees. APPROVAL WITH CONCERNS of the Wetland Permit application of ROBERT AND ANN SHANK 111-1-19.1 to raise existing house and decks, add new decks as indicated on site plan, cover existing and new decks. 5 Haywaters Road, Cutchogue The CAC recommends approval but is concerned with the filtration and runoff of the proposed parking elevation. Vote of Council: Ayes: All Motion Carried No. 1520 Moved by Mary Griffin, seconded by Sharon Shine, it was RESOLVED to recommend to the Southold Town Board, of Trustees APPROVAL of the Wetland Permit . application of BENJAMIN SUGLIA 137-3-7 to construct a 14' x 37' wood deck attached to seaward side of existing house; renovate 8' x 13' section on seaward side of existing house within existing footprint; construct two additions to house, one 6' x 16' and one 8' x 13', both on landward side of house and both on concrete block foundations; construct dock consisting of a 4' x 75' fixed open walkway; a 4' x 16' hinged ramp; two floats, one 8' x 10' and one 4'6" x 10'. ALLAN and WINABETH SMITH 97-6-2 to construct a fixed timber dock, consisting of a 4' x 20' catwalk (including steps at landward end); a 3' x 12' ramp; and a 6' x 14' float secured by (2) 8" diameter pilings. Private Road' off Route 25, Cutchogue The CAC recommends approval provided the walkway is elevated 4' above grade of marsh. Vote of Council: Ayes: -All Motion Carried No. 1522 Moved by Bret Hedges, seconded by Mary Griffin, it was RESOLVED to recommend to the Southold Town Board of Trustees CONDITIONAL APPROVAL of the Wetland Permit application of ROBERT 'DiDEMENICO 104-3-5.1 8 5.2 to construct a single family dwelling with garage, deck, and sanitary system; a fixed walkway 4' x 471; hinged ramp 4' x 16'; floating dock 6' x 201; install two piles to secure floating dock. 2725 Pine Tree Road, Cutchogue The Council recommends approval provided the walkway is raised 4' above grade of marsh. The Council is concerned that there may be existing moorings or lobster/crab pots in same area as the proposed dock. Vote of Council: Ayes: All Motion Carried No. 1523 Moved by Kenneth Meskill, seconded by Scott Hilary, to TABLE the Wetland Permit application of LINDA DAMBASSIS 83-2-7.2 to extend an existing return landward approximately 161; extension to be armored with 1-3 ton stone placed on filter cloth; backfill with approximately 5 c.y. of clean sand trucked in from upland source. ROW off Oregon Road, Cutchogue The Council ,did not make an inspection, therefore, it has no recommendation at this meeting. Vote of Council: Ayes: All Motion Carried Page, 5 January 26, 1998 No. 1524 Moved by Sharon Shine, seconded by Kenneth Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of BREEZY SHORES, INC. AND JAMES SAGE 53-5-12.5 to remove 305' of bulkhead, including two 50' returns and replace with 265' of rock revetment; fill behind rock revetment with concrete rubble existing on site and approximately 500 c.y. of clean fill from an upland source. Sage Boulevard, Greenport Vote of Council: Ayes: All Motion Carried No. 1525 Moved by Mary Griffin, seconded by Bret Hedges to TABLE the Wetland Permit application of RICHARD and CHERYL CORAZZINI 118-5-4.1 to repair existing bulkhead, construct a 6 x 10 floating dock and a 4 x 14 ramp. 8500 Nassau Point Road, Cutchogue The Council did not make an inspection, therefore, it could not make a recommendation at this meeting. Vote of Council: Ayes: All Motion Carried No. 1526 Moved by Bret Hedges, seconded by Mary Griffin, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of RICHARD CORREIA 107-6-5 to construct a fixed open walkway 4' x 125', hinged ramp 4' x 16' and floating dock 6' x 20'; install two 2-pile dolphins to secure floating dock. 855 Kno.11wood Lane, Mattituck Vote of Council: ' Ayes: All Motion Carried No. 1527 Moved by Bret Hedges, seconded by Mary Griffin, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of MATTITUCK INLET MARINA & SHIPYARD 106-6-1.3.3 to replace within 18", 94 feet of new bulkhead; widen existing travel lift 7 feet; replace existing west and south side of travel lift slip with 48' of new bulkhead; install dry well catch basin in haul out apron and a 2' wide pervious buffer on north and south side of travel lift slip. West Mill Road, Mattituck . Vote of Council: Ayes: All Motion Carried Page 6 January 26, 1998 No. 1528 Moved by Kenneth Meskill, seconded by Sharon Shine, it was RESOLVED to support the recommendation of Conservation Advisory Council Chairman Scott Hilary of the Wetland Permit application of CHRIS PICKERELL. for 52-5-59.9 for restoration of tidal salt marsh. Albertson Lane and Hashamomuck Pond Chairman Scott Hilary will be meeting with the applicant to inspect the area prior to the Trustees meeting on Wednesday, January 28. He will make the recommendation at the January 28, 1998 meeting. Vote of Council: Ayes: All Motion Carried RECOMMENDATION OF WAIVER REQUESTS WR-94 Moved by Scott Hilary, seconded by Bret Hedges, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Waiver Request of RICHARD MAKELY 81-1-16.3 to build a 12' x 16' shed. 3537 Paradise Point Road, Southold Vote of Council: Ayes: Scott Hilary, Bret Hedges, Sharon Shine, Mary Griffin Abstain: Kenneth Meskill Motion Carried WR-95 PETER ENNERS 106-4-2 to relocate well. 15 East Mill Road, Matti'tuck The CAC has NO COMMENT concerning this waiver request. WR-96 Moved by Scott Hilary, seconded by Kenneth Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Waiver Request of DAVID KELLERAN 135-3-6 to install a split rail fence; relocate outdoor shower; and extend existing porch. 570 Richmond Road East, Southold Vote of Council: Ayes: All Motion Carried WR-97 WALTER WILM 137-3-5 to repair the foundation, replace decking, replace stairs and replace the roof of the porch attached to residence 4605 Stillwater Avenue, Cutchogue Page 7 - January 26, 1998 The CAC has NO COMMENT concerning this waiver request. WR-98 PATRICK COLAGIURI 123-8-18 for a chain link fence along property, constructed prior to 1991 . 2950 Park Avenue, Mattituck The CAC has NO COMMENT concerning this waiver request. RECOMMENDATION OF GRANDFATHER PERMIT REQUESTS GF-58 (from 11/13/97) Moved by Kenneth Meskill, seconded by Scott Hilary, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Grandfather Permit Request and Amendment to Grandfather Permit Request of ALBERTSON MARINA 56-6-2.3, 3, 3.2, and 3.3 for an existing 4' x 75' catwalk with a 4' x 22' ramp attached to a 6' x 250' floating dock with 8 finger floats measuring 6' x 3' and one measuring 6' x 271; also to amend the permit to make all finger floats 6' x 27' and replace and repair as needed, in kind/in place. Route 25, Southold The Council recommends disapproval because the scope of the project should require a wetland permit. Vote of Council: Ayes: All Motion Carried NEXT MEETING DATE The next meeting of the Southold Town Conservation Advisory Council was scheduled for Monday, February 23, 1998 at 4:30 P.M. in the conference room at Southold Town Hall.
