A meeting of the Southold ' Town Conservation Advisory Council was held Monday, March, 23, 1998 at $q30' P.M. in the Conference Room at Southold Town' Hall, 53095 Main Road, Southold, New York 11971 Present were: Scott Hilary, Chairman Mary Griffin, Member Sharon Shine, Member Bret Hedges, Member Alicia Marin, Youth Member Betty Wells, Member Kenneth Meskill, Member Linda Cooper, Secretary ; Absent were: Melvin Morris, Member (submitted written comments) Shannon Reidy, Youth Member CHAIRMAN'S ANNOUNCEMENTS Chairman Scott Hilary discussed the joint meeting held between the CAC and the Board of Trustees on Friday, March 13 '- 1998. Both groups found the meeting to be very helpful and positive. REPORT OF POSSIBLE VIOLATIONS None REPORTS .Mary Griffin reported that the next topic at the . Stony Brook series of seminars would be Earthquakes on Long Island. Alicia Marin that April 4, 1998 the Audubon will be sponsoring a "Bird Day" would be held at Southold High School. • `� ` March 23, 1998 APPROVAL OF MINUTES Moved by Sharon Shine, seconded by Mary Griffin, it was RESOLVED to accept the minutes of February 23, 1998 as submitted. Vote of Council: Ayes: All Motion Carried RECOMMENDATION OF WETLAND PERMIT AND COASTAL EROSION PERMIT APPLICATIONS No. 1535 (Tabled 2/23/98) Moved by Scott Hilary, seconded by Kenneth Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of NEIL McGOLDRICK 116-4-16.4 to hydraulically dredge an irregular area (+/-55' max. width) through the inlet of Hall's Creek to a maximum depth of -5" at MLW at a 1 :3 .slope; approximately 2000 c.y. of 100% sand spoil to be pumped: 1 . updrift of existing 80' groin on subject property and 2. downdrift -of groin at end of Dean Drive to east. RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit Application of NEIL McGOLDRICK 116-4-16.4 to extend existing 70' groin on west side of inlet by 801. The Council recommends disapproval of the groin. It has not been proven that extending the groin would improve the situation. Private Road off New Suffolk Avenue, Mattituck Vote of Council: Ayes: All Motion Carried No. 1538 Moved by Scott Hilary, seconded by Kenneth Meskill, it was RESOLVED to TABLE the. Wetland Permit Application of CLIFFORD and RUTH CORNELL 79-5-20.9 to construct a single family, two story, wood frame residence with decks and garages; clear lot as required and regrade. The Council could not make a recommendation and tabled the application because: 1 . The proposed structure needs to be staked 2. CAC requests additional information on project history and proposed mitigation project. Lot #2, "Plock Shellfisher Preserve" at Bayview, Southold Vote of Council: Ayes: All Motion Carried No. 1539 Moved by Mary Griffin, seconded by Sharon Shine, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of RUSSELL and ROBERT McCALL 116-1-6 to construct 1750 s.f. single family residence with full basement, attached Page 2 March 23, 1998 2-car garage, water supply and sewage disposal system. The CAC recommends approval provided the usual runoff containment standards are followed (haybales, etc.) . New Suffolk Avenue, Cutchogue Vote of Council: Ayes: All . Motion Carried No. 1540 CYNTHIA WARREN SPURDLE 3-1-6 to construct a 4' x 100' fixed dock 3 1/2' above grade of marsh, 4' x 20' ramp and 8' x 20' float; also to cut an 4' x 50' path and construct a 4' x 15' set of steps to access dock. Fishers Island The CAC did not make an inspection, therefore, it does not have a recommendation. N o. 1541 Moved by Betty Wells, seconded by Sharon Shine, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of WILLIAM L. and CHRISTINE M. EISENREICH 53-3-10 to construct a single family dwelling with sanitary system and driveway. The CAC recommends approval provided haybales are used during construction and applicant maintain a-non-turf buffer. 805 Bay Shore Road, Greenport Vote of Council: Ayes: All Motion Carried No. 1542 Moved by Sharon Shine, seconded by Alicia 'Marin, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH PROVISIONS of the Wetland Permit Application. of GEORGE MAYER 70-10-61.1 to construct a single family residence, driveway, septic system and well; to fill approximately 387.2 c.y. under the proposed house to raise its first floor elevation to eight feet. The Council recommends approval provided haybales are used during construction; stay within the proposed clearing limits; and any additional clearing be done only to allow a view. The CAC also has concerns about the proximity of the well to the wetlands. Pine Neck, Southold Vote of Council: Ayes: All Motion Carried No. 1543 Moved by Betty Wells, seconded by Sharon Shine, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of JOSEPH and ELIZABETH BRITTMAN 78-2-10 to construct a 48" wide x 30' long open piling dock. Page 3 March 23, 1998 The Council's approval contingent upon neighbor's navigation. Council also suggests a non-turf buffer be installed. 80 Glenn Road, Southold Vote of Council: Ayes: All Motion Carried No. 1544 Moved by Mary Griffin, seconded by Kenneth Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit Application of WALTER and MILDRED SILBERNAGEL 118-1-4.1 for renovation to existing house and garage and an addition to existing house. The CAC recommends disapproval because project would cause further encroachment into a buffer zone. 1652 Bridge Lane, Cutchogue Vote of Council: Ayes: All Motion Carried No. 1545 Moved by Bret Hedges, seconded by Mary Griffin, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the of the Wetland Permit Application of VILLAGE MARINE 122-3-15.1 to reconstruct within 18" 340 +/-' of timber bulkhead and to backfill structure with 75 +/- c.y. of clean sand to be trucked in from an upland source. The CAC recommends approval but does have concerns about the runoff. Bay Avenue, Mattituck Vote of Council: Ayes: All Motion Carried No. 1546 Moved by Scott Hilary, seconded by Betty Wells, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of HOWARD EILENBERG 78-8-1 to construct deck attached to house and swimming pool 12' x 24' with surrounding deck. The Council recommends approval but is concerned about the backwash, it should not go into the creek but be diverted to an upland area. 800 Goose Creek Drive, Southold Vote of Council: Ayes: All Motion Carried No. 1547 Moved by Mary Griffin, seconded by Bret Hedges, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of PETER IZZO 111-10-1.1 to construct fixed open walkway 4' x 107', hinged ramp 4' x 16', and floating dock 6' x 201; install two 2-pile dolphins to secure floating ramp. Meadow Beach Road, Cutchogue Page 4 March 23, 1998 Vote of Council: Ayes: All Motion Carried No. 1548 Moved by Scott Hilary, seconded by Sharon Shine, it .was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of BOBETTE GARBEN SUTER 70-4-5 to construct a fixed timber dock, consisting of a 4' x 30' fixed catwalk; a 3' x 14' ramp; and a 6' x 16' float to be secured by two(2) eight inch (8") diameter pilings; resheath existing 102+/-' timber retaining wall and backfill with approximately fifteen (15) c.y. of clean; construct a 3' wide wood walk landward of retaining wall. CAC recommends approval provided applicant maintain a non-turf buffer. 3575 Wells Avenue, Southold Vote of Council: Ayes: All Motion Carried RECOMMENDATION OF WAIVER REQUESTS WR-101 Moved by Betty Wells, seconded by Kenneth Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Waiver Request of DORIS E. SPAHR 31-7-12 to enlarge an existing deck to measure 27' x 15' with a 4' return around the side of the house. The Council recommends disapproval of the waiver request because there needs to be some control placed on any land and tree clearing and that would require a wetland permit application. 125 North Lane, East Marion Vote of Council: Ayes: All Motion Carried WR-102 Moved by Mary Griffin, seconded by Scott Hilary, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Waiver Request of VINCENT MANAGO 118-4-10 to erect a split rail fence around the perimeter of his house. 8225 Nassau Point Road, Cutchogue Vote of Council: Ayes: All Motion Carried RECOMMENDATION OF GRANDFATHER PERMITS GF-63 Moved by Betty Wells, seconded by Sharon Shine, it was Page 5 -�� March 23, 1998 RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Grandfather Permit request of INNA HOULBREQUE 37-5-16 for existing bulkhead approximately 58 that was built prior to 1971 on private pond. 210 Knoll Circle, East Marion Vote of Council: Ayes: All Motion Carried CF-64 Moved by Betty Wells, seconded by Sharon Shine, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Grandfather Permit request of HOWARD REICH 37-4-3 for existing bulkhead and docks, total bulkhead 165'. 180 Bayview Drive, East Marion Vote of Council: Ayes: All Motion Carried CF-65 Moved by Betty Wells, seconded by Sharon Shine, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Grandfather Permit request of JOAN ELAN 37-5-12 to grandfather in existing bulkhead for repair and replacement of bulkhead. Knoll Circle, East Marion Vote of Council: Ayes: All Motion Carried CF-66 Moved by Bret Hedges, seconded by Sharon Shine, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Grandfather Permit request of PETER and JEANINE WARNS 126-5-2 for a grandfather permit for bulkhead. 8740 Peconic Bay Blvd., Mattituck Vote of Council: Ayes: All Motion Carried RECOMMENDATION OF AMENDMENT TO PERMITS A-125 Moved by Betty Wells, seconded by Kenneth Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Amendment to Permit request of BARBARA DeFina 26-2-7.1 to relocate second story of house towards center of house; existing chimney to be removed; and propose to build a 6' x 10' stoop towards the east elevation of the house. 192 Willow Terrace, Orient Page 6 March 23, 1998 Vote of Council: Ayes: All Motion Carried A-126 CATHY HART 107-4-5 to amend the following: approved catwalk 4' x 25' - amend to 4' x 20'; approved ramp 3' x 15' - amend to 3' x 20'; approved for 6' x 20' floating dock - amend to 6' x 20' with small 6' x 4' section for ramp to roll on. 70 Jackson Landing, Mattituck The Council has no recommendation. SET NEXT MEETING DATE Trustees are scheduled to meet Wednesday, April 22, 1998, therefore, the next CAC meeting will be Monday, April 20, 1998 at 4:30 P.M. in the Conference Room at Southold Town Hall, 53095 Main Road, Southold, New York.
