A meeting of the Southold Town Conservation Advisory Council was held Thursday, May 21, 1998 at 4:30 P.M. in the Conference Room at Southold Town Hall, 53095:Main Road, Southold, New York. Present were: Scott Hilary, _Chairman Melvyn Morris, Member Bret Hedges, Member Sharon Shine, Member Kenneth Meskill; Member Linda Cooper, Secretary Absent were: Betty Wells, Member Mary Griffin, Member , Alicia Marin, Youth Member Shannon Reidy, Youth Member CHAIRMAN'S ANNOUNCEMENTS Chairman Scott Hilary discussed an activities program for youth that would be held Saturday, May 23. The program, sponsored by Ducks Unlimited and SOAR, offers various sporting and environmental projects for youth. He also spoke with members about guiding the CAC' .into a different direction; less emphasis on inspections -and application recommendations and more focus on projects and activities. Scott distributed copies of the draft for a NATURE PRESERVE chapter which has been proposed to be added to the Town Code. The chapter would address the protection and management of town-owned properties with the CAC chairman having an active part on the committee. REPORTS Members were advised that Betty Wells has- decided not to seek , reappointment to the Council. . Her term will expire June 18, 1998 and the Town will be advertising for resumes. Both Youth Members' terms are due to expire at the same time as Betty's' term. Neither member has responed as to whether they wish to be reappointed. May 21, 1998 -' Kenneth Meskill reported on several enviromental violations and' concerns that he has witnessed while working as the : "resident environmentist" on Plum Island during a special project taking place on the island. Sharon- Shine was the CAC representative at the April meeting of the Southold Town Board of Trustees and reported on that meeting. POSSIBLE VIOLATIONS None reported. APPROVAL OF MINUTES Moved by Sharon Shine, seconded by Kenneth Meskill, it was RESOLVED to accept the Conservation Advisory Council minutes . of April 20, 1998 as submitted. Vote of Council: Ayes: All Motion Carried RECOMMENDATION OF WETLAND PERMIT AND COASTAL EROSION PERMIT , APPLICATIONS No. 1549 Moved by Melvyn Morris, seconded by Kenneth Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of CHARLES and JANICE BOVINO 119-1-5 E 6 to construct a 206 +/-' secondary retaining wall generally along toe of bluff slope landward of existing retaining wall; southerly end of wall to tie into existing southerly return on adjacent property to south; a 10' return to be constructed on the northerly end; approximately 45 c.y. of clean sand to be trucked in and used for backfill. 9775 Nassau Point Road, Cutchogue Vote of Council: Ayes: All Motion Carried No. 1558 Moved by Sharon Shine, seconded by Kenneth Meskill, it was RESOLVED to make' NO COMMENT concerning the construction of the Wetland Permit application of DANIEL FOX 35-4-28.28 to construct a 6' x60' floating dock and install (1) 8" x 20' mooring pile; existing dock to be removed. 470 Wiggins Lane, Greenport The CAC � has no comment on the construction, the work has already been completed, but, since a Wetland Permit is required prior to construction, the CAC recommends a violation be issued. Vote of Council: Ayes: All Page 2 May 21, 1998 Motion Carried No. 1559 Moved by Scott Hilary, seconded by Kenneth Meskill, it was RESOLVED to recommend to the Southold .Town Board of Trustees DISAPPROVAL of the Coastal Erosion Permit application of JOHN C. WEISBROD 15-3-6 to expand the top most-landing of bluff stairs by constructing a 12' x 18' platform with a rail fence around it. 435 Soundview Road, Orient The CAC recommends disapproval pursuant to the Town Code which disallows structures on top of Sound bluffs. Vote of Council: Ayes: All Motion Carried No. 1560 Moved by Kenneth Meskill, seconded by Scott Hilary, it was RESOLVED to make NO COMMENT concerning the Wetland Permit application of MR. and MRS. PATRIC MORTIMER 81-1-8 to obtain permit for pool, deck and patio around pool, utility building, walk to water, fencing around property and pool, 10' x 51' deck attached to back of house, and bay window at back of dining room extension. 3895 Robinson Road, Southold The CAC could not comment because it was unable to determine what the applicant was requesting; the application was too vague. Vote of Council: Ayes: All Motion Carried No. 1561 Moved by Melvyn Morris, seconded by Bret Hedges, it was RESOLVED to TABLE the Wetland Permit application of ALFRED and MARIANNE SUESSER 110-8-32.8 to construct beach stairs. 5055 New Suffolk Road, New Suffolk The application was tabled because the project description does not reflect the proposed project plans Vote of Council: Ayes: All Motion Carried No. 1562 Moved by Sharon Shine, seconded by Scott Hilary, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of RICHARD and JANE ROHMAN 43-5-9 to construct a 225 square foot two=story addition and 280 square foot second story addition to and over an existing one-story one-family dwelling; place Page 3 May 21, 1998 . approximately 370 cubic yards of sand fill to raise first floor elevation of house to 10'. 240 Bay Road, Greenport Vote of Council: Ayes: All Motion Carried No. 1563 Moved by Bret Hedges, seconded by Sharon Shine, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH CONCERNS of the Wetland/Coastal Erosion Permit application of INGRID MALLEY 94-1-12.1 to construct a +/-115' timber retaining wall to be tied into existing retaining wall to east; to restore and stabilize bluff, slope to be filled with approximately 1000 c.y. of clean sand (trucked in from an upland source) and planted with beach grass (Ammophila brefiligulata), Rosa rugosa, and bayberry (Myrica pensylvanica); construct 4' x +/-87' stairs from crest of bluff to beach. 2635 Sound View Avenue, Mattituck The CAC recommends approval but has concerns about the potential plover nesting sites. The Council suggests that the access to the potential plover nesting sites be restricted or monitored. The nesting season is April 15 through August 15. Vote of Council: Ayes: All Motion Carried No. 1564 Moved by Bret Hedges, seconded by Melvyn Morris, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH PROVISIONS of the Wetland Permit application of JOHN and JACQUELINE ANDREJACK 122-4-7 to construct a 2 story single family dwelling with standard septic system and driveway, and brick patio within bui.lding envelope. Ole Jule Lane, Mattituck The CAC recommends approval provided: 1 . The hardwood trees outside the building envelope remain in place (limbs may be cut back or removed for view) 2. Applicant adhere to the submitted plans, especially concerning measurements and distances. 3. Runoff control measures, i.e. haybales, must be utilized during construction. Vote of Council: Ayes: All Motion Carried No. 1565 Moved by Melvyn Morris, seconded by Kenneth Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees CONDITIONAL APPROVAL of the Wetland Permit application of PETER IZZO Page 4 May 21, 1998 and ARNOLD BLAIR 111-10-1.1, 1.2, and 5 to maintenance dredge a 30' - 55' wide x 1.28' Fong area within a dredged canal of Horseshoe Cove; approximately 200 c.y. of dredged sand spoil will be placed on upland, adjacent to previous spoil disposal site; access to site will be gained via Vanston Road, through Blair property and along Lowland Road. Dredged canal of Horseshoe Cove, off Lowland Road, Cutchogue The CAC recommends approval contingent upon an approved, appropriate spoil site. Vote of Council: Ayes: All Motion Carried No. 1566 Moved by Sharon Shine, seconded by Scott Hilary, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the of the Wetland Permit application of EDWIN M. LATSON 57-2-12 to construct an 18' wooden dock in SE direction from bulkhead; six (6) 4" x 4" pilings with 4" x 4" frame; dock to be 12' Fong x 3' wide; plus three (3) 4" x 4" boat stakes. 1495 Island View Lane, Greenport Vote of Council: Ayes: All Motion Carried No. 1567 Moved by Melvyn Morris, seconded by Bret Hedges, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of ROBERT and KAREN CIRARDS 117-10-12.3 to construct timber stairs consisting of a 5' x 5' platform at crest of bluff; 4' x 18' steps; 6' x 8' platform; 4' x 6' steps; and 4' x 10' platform behind existing bulkhead. 1600 Jackson Street, New Suffolk Vote of Council: Ayes: All Motion Carried No. 1568 Moved by Melvyn Morris, seconded by Sharon Shine, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of MARCRET REINHARD 116-4-23 to move existing house 8' to north in order that. 8' deep deck may be built on south side; house raised to required elevation of 8'; new access stair; new concrete foundation built below house; existing porch to be enclosed to be part of house; one ring of sanitary system relocated; grade raised one foot on west, north and east sides of relocated house 505 Beachwood Road, Cutchogue Vote of Council: Ayes: All Motion Carried Page 5 - May 21, 1998 No. 1569 Moved by Melvyn Morris, seconded by Sharon Shine, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of JEANNE BARTOS 67-7-14 to construct a two story frame addition to east side of existing structure with small single story addition on south and west sides. 1820 Mill Lane, Peconic Vote of Council: Ayes: All Motion Carried No. 1570 Moved by Melvyn Morris, seconded by Sharon Shine, it was RESOLVED to make, NO COMMENT concerning the current construction of the Wetland Permit application of JAMES MINOGUE 115-10-6 to addition and renovations to first floor of existing one story frame residence and new second floor construction. 5550 New Suffolk Avenue, Mattituck The CAC has no comment on the construction, the work has already commenced, but, since a Wetland Permit is required prior to construction, the CAC recommends a violation be issued. Vote of Council: Ayes: All Motion Carried No. 1571 HEYDON ALLEN 97-6-3 to remove an existing garage and replace with new garage in the same location. 320 Eugene's Road, Cutchogue The CAC did not make an inspection and, therefore, has no recommendation . No. 1572 Moved by Scott Hilary, seconded by Sharon Shine, it was RESOLVED to TABLE the Wetland Permit application of LAUGHING WATERS PROPERTY OWNERS ASSOCIATION 87-3-2.1 & 60 to dredge to irregularly shaped areas used for marina to maximum depth of -4' MHW; approximately 3950 c.y. of sand/silt spoil to be deposited on two spoil sites. Minnehaha Blvd., Southold The CAC tabled the application' because no plans were submitted. Vote of Council: Ayes: All Motion Carried Page 6 May 21, 1998 RECOMMENDATION OF WAIVER REQUESTS WR-107 Moved by Scott Hilary, seconded by Sharon Shine, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Waiver Request of GAIL and GEORGE STARKIE 57-1-7 to construct a storage shed. 630 Tarpon Drive, Southold Vote of Council: Ayes: All Motion Carried WR-108 Moved by Bret Hedges, seconded by Melvyn Morris, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Waiver Request of MOIRA GOGINS-MASTRO 126-11-3 to obtain permit for existing 90' x 18'6" and extension of fence 105' x 221. 6760 Peconic Bay Blvd., Laurel Vote of Council: Ayes: All Motion Carried WR-109 Moved by Melvyn Morris, seconded by Scott Hilary, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Waiver Request of HARRY and JANET HOHN 118-6-3.2 to construct a 350 square foot deck on the northwest corner of an existing single family dwelling. Aborn Lane, Cutchogue Vote of Council: Ayes: Melvyn Morris, Scott Hilary, Sharon Shine, Bret Hedges Nays: Kenneth Meskill (Mr. Meskill feels the project too large and too close to the Wetlands to be allowed a waiver, it needs a Wetland Permit.) Motion Carried WR-110 JANET FITZGERALD 6-4-11 to erect a 183+/-' picket fence along border of property. Central Avenue, Fishers Island The CAC did not make an inspection, therefore, it has no comment. WR-111 Moved by Scott Hilary, seconded by Kenneth Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Waiver Request of CHARLES D. SNYDER 35-4-28.24 to build a 14' x 21' garage. Page 7 May 21, 1998 704 Wiggins Lane, Greenport Vote of Council: Ayes: All Motion Carried RECOMMENDATION OF AMENDMENT TO PERMITS A-127 Moved by Kenneth Meskill, seconded by Sharon Shine, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Amendment to Permit request of BERNARD ROBINS 103-10-20 to install planking of 20' x 4' area of tier between concrete block wall and wood bulkhead. Strohson road, Cutchogue The CAC recommends .disapproval because if feels the project should,-,not be an'' amendment to a Grandfather Permit. The Council feels the project would not have an adverse effect on the environment and would recommend approval if it were submitted as a Wetland Permit or Waiver Request. Vote of Council: Ayes: All Motion Carried A-128 Moved by Kenneth Meskill, seconded by Melvyn Morris, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Amendment to Permit request of SUSAN NORRIS 123-9-1 to install a boat lift on the east end. of her dock. New Suffolk Avenue, Mattituck The Council approves the project environmentally, however, it questions the appropriateness of an amendment to a permit issued three (3) years ago. Vote of Council: Ayes: All Motion Carried A-129 Moved by Kenneth Meskill, seconded. by Sharon Shine, it was RESOLVED to TABLE the Amendment to Permit request of EUGENE KESSLER 35-4-15 to extend length of existing float 30'. 1835 Gull Pond Lane, Greenport. The CAC tabled the request because it needs the Wetland Permit being amended to provide additional information,. Vote of Council: Ayes: All Motion Carried Page 8 May 21, 1998 A-130 Moved by Kenneth Meskill, seconded by Sharon Shine, it was RESOLVED to make NO COMMENT concerning the - Amendment to Permit request of GREGORY POULOS 15-3-3 & 4 to relocate existing stairway to within 15' from his property line. Soundview Road, Orient The CAC has no comment due to lack of information. Vote of Council: Ayes: All Motion Carried A-131 Moved by Scot Hilary, seconded by Bret Hedges, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Amendment to Permit request of CHARLES BOCKLETT 98-5-2, 3, and 4 to cage rocks on inside area of sea wall; recoup any rocks pulled down to sea edge without entry onto beach area; sand bag, nylon with ties 4' high by 196' long; cover with 8" x 12" of area with beach sand and plant vegetation suitable to grow for retention; to install 1275 yards of beach sand on inside sea wall area back to second retaining wall. 1295 Robinson Lane, Peconic The CAC recommends disapproval because the scope of the project requires a full Wetland Permit application and process. Vote of Council: Ayes: All ' Motion Carried No. A-132 Moved by Kenneth Meskill, seconded by Melvyn Morris, it was RESOLVED to TABLE the Amendment to Permit request of VINCENT MANAGO 118-4-10 install water from main house to existing beach house.. 8225 Nassau Po.int Road, Cutchogue The application was incomplete and lacking information. Vote of Council: Ayes: All Motion Carried A-133 JAMES F. KING 106-4-6 to add a 5' x 25' float with one pile at southern end to existing floating docks. 220 East Mill Road, Mattituck The CAC did not make an inspection, therefore, it has no recommendation.
