CONSERVATION ADVISORY COUNCIL
MONDAY, AUGUST 24, 1998
4:30 P.M.
A meeting of the Southold Town Conservation Advisory Council was held
Monday, August 24, 1998 at 4:30 P.M. in the Conference Room at Southold
Town Hall, 53095 Main Road, Southold, New York.
Present were: Scott Hilary, Chairman

CHAIRMAN'S ANNOUNCEMENTS
Scott gave a brief recap of last month's Trustees meeting. He also requested
that members look over the proposed Nature Preserve Program. If the CAC is
in agreement with the draft, a letter should be written to the Town Board
recommending its adoption.
REPORTS
Scott Hilary suggested the CAC consider writing a fact sheet concerning
shellfishing that could be distributed by local merchants when someone comes
in to buy shellfishing paraphernalia (i.e. crabbing or clamming nets) . It
would alert those about to shellfish in Town waters to the need of a permit
and the restrictions.

RESOLVED to accept the minutes of July 16, 1998. as submitted.

RECOMMENDATION OF WETLAND PERMIT AND COASTAL EROSION PERMIT
APPLICATIONS

Moved by Sharon Shine, seconded by Scott Hilary, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Wetland Permit Application of KEVIN R. MIDDLETON and MARIE JONES
87-5-23.10 to construct a single family dwelling, garage, driveway and septic
system.

Moved by Sharon Shine, seconded by Scott Hilary, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Wetland Permit Application of PATRICK LOHN 87-3-57 to remove
existing timber bulkhead and install approximately 142' of Shoreguard Series
500 vinyl; relocate (2) 4' x 8' lower platforms; maintenance dredge to -4' at
ALW, approximately 25 c.y. of spoil to be trucked to approved upland area.

Vote of Council: Ayes: All

ROBERT MILLER 111-15-8.1 to build a secondary retaining wall approximately
11' behind an existing bulkhead; backfill with clean sand fill and plant with
beachgrass.

THOMAS J. McCARTHY 77-3-17.1 to construct a single family dwelling,
associated sanitary system, driveway, garage, decks, pool, retaining wall, pool
drywell, 4' x 15' elevated catwalk, 3' x 8' ramp and (3) 6' x 25' floats.

Moved by Scott Hilary, seconded by Bret Hedges, it was
RESOLVED to recommend to the Southold Town . Board of Trustees
DISAPPROVAL of the Wetland Permit Application of JON and ROSEMARY
SCHNEIDER 59-6-16 to clear land and plant grass, wildflowers and shrubbery.
8095 Soundview Avenue, Southold
The ' CAC recommends disapproval because the clearing should never had been
done and, as per the violation, the CAC recommends the property be restored
to its natural state.

Moved by Sharon Shine, seconded by Kenneth Meskill, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH A SUGGESTION of the Wetland " Permit Application of AQUAFOOD
PROPERTY LTD. 38-7-7.1 to replace 1438' (within 18") of existing bulkhead
and maintenance dredge (with 10 year maintenance) 228+' x 245' (max.) basin
and 50+' x 179+' of channel to a maximum depth of 7' below ALW; approximately
3000 c.y. of resultant spoil to be used both for backfill and temporarily
deposited on 'open field site; spoil deposited in stated location to be removed
and deposited at approved upland site after dewatering.

The CAC suggests that care be taken to remove the waste on the property.

to TABLE the Wetland Permit Application of BRAVO CONTRACTING CORP.
135-1-26 to create a dune by backfilling property on both sides, place marine
mattresses and filling with stones and sand.
22655 Soundview Avenue, Southold
The CAC tabled the application because it needs clarification: retaining wall
or mattress; size of structure; specs for retaining wall; is there a house
involved as mentioned in some of the paperwork?

porches approximately 40' from existing locations and replace sanitary system.

No comment, the CAC did not make an inspection.

Moved by Kenneth Meskill, seconded by Sharon Shine,
to TABLE the Wetland Permit Application of LARRY KULICK 87-3-61 to
clear undergrowth from eastern portion of property; plant eroded area behind
bulkhead return with s. alterniflora or other suitable wetland vegetation;
construct 140' stone wall above ordinary high water line; dredge approximately
10 c.y. from boat slip; and add 4' x 18' ramp at landward end of existing
dock.

The CAC tabled the application pending clarification of the amount of clearing
proposed, especially along the shoreline; it also a description and size of the
the proposed stone wall.

RECOMMENDATION OF AMENDMENTS TO PERMITS
A-137
TABLED the Amendment to Permit request of DONALD LESLIE 34-5-13 to
remove a 4' x 36' section of fixed dock and 16 pilings and replace it with a 6'
x 36' float and 5 pilings; add a 6' x6' float to connect to existing floats
that are to remain; and 2 existing ramps to be replaced by one new ramp.
340 Robinson Road, Greenport
The request was tabled because the CAC was unable ' to determine what is
being amended. A copy of the original permit is required.

HOWARD and DEBORAH WIGGINS 103-3-51 to construct a 3' x 190' catwalk
down to an existing dock.

TABLED the Amendment to Permit request of ROBERT K. SCRIPPS 104-3-6
to increase the length of the ramp from 14' to 16'; change the orientation of
the float to perpendicular to shore, instead of parallel; relocate the 2-pile
dolphins to secure the float in its new location
2745 Pine Tree Road, Cutchogue
The project appears environmentally sound, however, the CAC is unable to
determine what is being amended. A copy of the original permit is needed.

RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the Amendment to Permit request of JOHN and KELLY
LOMBARD 105-5-1 to extend the dock by adding a 5' x 16' float onto an
existing float.
6125 Skunk Lane, Cutchogue
The CAC recommends disapproval because the project requires a Wetland
Permit. The project is too old and to extensive to warrant an amendment.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Amendment to Permit request of MATTITUCK INLET MARINA 8
SHIPYARD 106-6-13.3 to extend the bulkhead replacement approximately 106'
further to the south 18" +/- in front of existing deteriorated bulkhead; and
build and 8' return connecting to existing bulkhead.
End of West Mill Road, west side of Mattituck Creek.
Vote of Council: Ayes: All

RECOMMENDATION OF WAIVER REQUESTS
WR-112
Moved by Kenneth Meskill, seconded by Scott Hilary, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH COMMENTS of the Waiver Request of LAUGHING WATERS PROPERTY
OWNERS ASSOCIATION 87-3-65 to install approximately 500' of zigzag snow
fence; plant spartina patens (salt hay) and .pine shrubs along the outer beach
high water line.
Hog Neck Bay at Corey Creek Inlet, Southold
The CAC recommends approval because the project is environmentally sound,
however, it feels, due to the extensive nature of the project, that a Wetland
Permit should be required.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Waiver Request of DAVID PAGE and BARBARA SHINN 51-4-5.1 for an
existing wood picket fence along the easterly portion of the property.

edge of the cliff; a series of wooden stairs leading down the slope and a set
of steps that will -extend about 25' down from the edge of the cliff to the
stones on the beach below.

SET NEXT MEETING DATE
The next meeting of the Southold Town Conservation Advisory Council was
scheduled for Monday, September 21, 1998 at 4:30 P.M. in the Conference
Room at Southold Town Hall, Main Road, Southold, New York.
There being no further business to come before the Council, the meeting was
adjourned at 6:50 P.M.
