The regular monthly meeting of the Southold Town Conservation Advisory Council was held Thursday, November 12, 1998 at 5:30 P.M. in the Conference Room at Southold Town Hall, Main Road, Southold,: ,N,ew York. Present were: Scott Hilary, CAC Chairman Kenneth Meskill, CAC Member Sharon Shine, CAC Member Melvyn Morris, CAC Member Richard Smith, CAC Member Linda Cooper, CAC Secretary Absent were: Mary Griffin, CAC Member Bret Hedges, CAC Member CHAIRMAN'S ANNOUNCEMENTS Chairman Hilary introduced new CAC member Richard Smith. Soctt discussed the October meeting of the Board of Trustee and the problem created by excessive absenteeism by CAC members. A brief discussion was held concerning the setting of guidelines for attendance and absences at CAC monthly meetings. REPORTS Kenneth Meskill briefly discussed the problem which recently occurred at the Oyster Bay Oyster Festival. A bacteria has plagued the oyster population in Oyster. Bay and the festival had to import oysters from other,areas. Kenneth also touched on the need for open space management, especially after the success of the 2% Land Bank Tax and the Open Space Preservation Bond in the recent elections. Novmeber 12, 1998 APPROVAL OF MINUTES Moved by Sharon Shine, seconded by Kenneth Meskill, it was RESOLVED to accept the minutes of October 19, 1998 as submitted. Vote of Council: Ayes: All Motion Carried RECOMMENDATION OF WETLAND PERMIT AND COASTAL EROSION PERMIT APPLICATIONS No. 1599 WALTER CHADWICK 86-6-25 to construct catwalk 4' wide x 140 +/-' in length, plus 3' x 14' ramp and 6' x 20' float; 8" diameter pilings; and two pile dolphins; to construct 840' of Locust Polst 8 Rail fencing along the perimeter (with exception of waterfront area) 6565 Indian Neck Road, Peconic The CAC did not make an inspection, therefore, it has no comment. No. 1600 Moved by Kenneth Meskill, seconded by Richard Smith, it was RESOLVED to TABLE the Wetland Permit Application of PETER DENICOLA 55-4-26.3 to construct a two story single family dwelling. 1505 Yennecott Drive, Southold The CAC tabled the application because it has concerns about the "drainage area" which meets the criteria of the definition of a Freshwater Wetland and appears to be a tributary flow to Long Creek; the project may have a negative impact to the Long Creek/Hashamomaque system. Vote of Council: Ayes: All Motion Carried No. 1601 Moved by Melvin Morrris, seconded by Kenneth Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit Application of PAT ROMANELLI 128-6-9.1 & 9.2 to reconstruct three jetties (451, 501, 481) using "C-LOC" vinyl sheathing. 3204 Creat Peconic Bay Blvd., Laurel The CAC recommends disapproval because there is no evidence of existing functioning groins. Vote of Council: Ayes: All Motion Carried Page 2 Y f Novmeber 12, 1998 No. 1602 Moved by Melvyn Morris, seconded by Sharon Shine, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATION of the Wetland Permit Application of CHARLES RODIN 103-10-16 to install an addition at rear of first floor; second floor addition and deck over existing sun porch; addition of 50' length (estimated) of split rail fence along Little Neck Road. 70 Strohson Road, Cutchogue Vote of Council: Ayes: All Motion Carried No. 1603 SCUDDER H. SINCLAIR 10-3-21 to construct a second floor addition to existing house. Peninsula Road, Fishers Island The CAC did not make an inspection, therefore, it has no recommendation. No. 1604 Moved by Melvyn Morris, seconded by Sharon Shine, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit and Coastal Erosion Permit Application of TERRY TRIADES 94-1-12.2 to construct, landward of existing gabion wall, 101 +/-' of timber retaining wall to be tied into existing retaining walls to east and west; backfill with approximately 100 c.y. of clean sand fill to be trucked in from an upland source and planted with Ammophila breviligulata. 2595 Sound View Avenue, Mattituck Vote of Council: Ayes: All Motion Carried No. 1605 Moved by Richard Smith, seconded by Kenneth Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATIONS of the Wetland Permit Application of BUDD POND MARINE (ALBERTSON MARINA) 56-6-2.2, 8.2 E 8.3 to replace existing docks at same number of slips; to further replace any and all rotting poles and to dredge under water approximately 100' x 30' area to 4' mean low water. Route 25 between Bay Home Road and Port of Egypt, Southold The CAC recommends approval with the stipulation that the applicant confine the dredging strictly to the area described in the application; stay away from the upland wetland area when dredging. NOTE: The CAC suggests that this may be a perfect opportunity, if the spoil is appropriate, to place the dredged spoil on the the spoil island to help increase the bird habitation on the island. If the spoil is appropriate, it could be placed on the island to increase the elevation. The project would have to be carefully supervised to assure proper placement and to avoid harming the current environment of the island. Page 3 .r Novmeber 12, 1998 Vote of Council: Ayes: All Motion Carried No. 1606 Moved by Melvyn Morris, seconded by Kenneth Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A SUGGESTION of the Wetland Permit Application of WALTER WIM 137-3-5 to repair or replace as necessary the foundation for the covered porch, stairs leading to the porch, porch decking, railing and roof; convert 10' x 24' crawl space to full basement, remove two chimneys, install fireplace and two flue chimneys, relocate bilco cellar entrance; enlarge front entry and cellar, convert 3' x 8' and 6' x 8' crawl spaces to full cellar resulting in additional first floor space approximately 66 s.f. and cellar 138 s.f.; expand one car+ garage and carport to two care garage; install 24" to 30" landscape retaining wall (stone). 4605 Stillwater Ave., Cutchogue The CAC recommends approval and suggests that a non-turf buffer be placed behind the bulkhead. Vote of Council: Ayes: All Motion Carried No. 1607 Moyed by Melvyn Morris, seconded by Kenneth Meskill, it was RESOLVED to recommend to the Southold Town Board of. Trustees APPROVAL of the application of JAMES and EILEEN KASSCHAU 118-1-1.2 to construct a 20' x 40' pool with deck around it. 5800 Vanston Road, Nassau Point, Cutchogue The CAC recommends approval of a determination of non-jurisdiction but has concerns about the impace of the pool and pool maintenance on the wetlands. Vote of Council: Ayes: All Motion Carried RECOMMENDATION OF AMENDMENT TO PERMIT REQUESTS A-150 Moved by Melvyn Morris, seconded by Richard Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Amendment to Permit Request of WALTER and MILDRED SILBERNAGEL 118-1-4.1 to relocate a new sanitary system as per DEC specifications. 1652 Bridge Lane, Cutchogue Vote of Council: Ayes: All Motion Carried Page 4 Novmeber 12, 1998 A-151 Moved by Melvyn Morris, seconded by Richard Smith, it was RESOLVED to TABLE the Amendment to Permit Request of PETER BELL 136-2-10 to change the catwalk from 30" wide to 36" wide and the float from 4' wide to 6' wide. 3365 Stillwater Ave., Cutchogue The CAC tabled the request for clarification. The applicants request and the issued permit contradict one another. Vote of Council: Ayes: All Motion Carried A-153 Moved by Melvyn Morris, seconded by Kenneth Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Amendment to Permit Request of JAMES DONOHUE 115-17-17.9 to construct a 15' x 54 1/2' deck instead of a pool and patio. 230 Willis Creek Drive, Mattituck Vote of Council: Ayes: All Motion Carried A-154 Moved by Melvyn Morris, seconded by Kenneth Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Amendment to Permit Request of MARTIN KOSMYNKA 98-1-11.2 to install two (2) dolphins, consisting of four(4) 8" diameter pilings approximately 20' seaward of existing float. 1985 Pine Tree Road, Cutchogue The CAC feels the permit is too old (issued 1990) to be amended. Action would require a new permit. Vote of Council: Ayes: All Motion Carried DISCUSSION OF WAIVER REQUESTS WR-124 (from 10/98 meeting, Trustees will be discussing at November meeting - in October, the CAC did not make an inspection and did not make a recommendation) JOHN ALOIA 118-4-9 to construct 96' of stockade fencing along the south side of the house and to construct an addition to an existing deck. 8145 Nassau Point Road, Cutchogue Again the CAC did not make an inspection and does not have a recommendation. Page 5 Novmeber 12, 1998 1 RECOMMENDATION OF GRANDFATHER PERMIT REQUESTS GF-74 JOSEPH and JOAN CHISHOLM 128-4-26 to remove and replace (in-kind, in-place) existing 60' low-profile timber groin. 4170 Peconic Bay Blvd., Laurel The CAC did not make an inspection, therefore, it has no recommendation. GF-75 Moved by Melvyn Morris, seconded by Richard Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Grandfather Permit Application of DOUGALL FRASER 118-4-7 to remove and replace (in-kind, in-place) existing 63 +/-' timber groin; new groin to be constructed with low profile design. 7955 Nassau Point Road, Cutchogue Vote of Council: Ayes: All Motion Carried SET NEXT MEETING DATE The next meeting of the Southold Town Conservation Advisory Council is scheduled for Tuesday, December 15, 1998 at 5:30 P.M. in the Conference Room at Southold Town Hall, Main Road, Southold, New York.
