New York 11971 SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL TUESDAY, DECEMBER 15, 1998 5:30 P.M. A meeting of the Southold Town Conservation Advisory Council was held Tuesday, December 15, 1998 at 5:30 P.M. in the Conference Room at Southold Town Hall, 53095 Main Road, Southold, New York. Present were:, Scott Hilary, Chairman Kenneth Meskill, Member Melvyn Morris, Member Richard Smith, Member Sharon Shine, Member Linda Cooper, Secretary Absent were: Bret Hedges, Member Mary Griffin, Member CHAIRMAN'S ANNOUNCEMENTS Chairman Scott Hilary passed along a suggestion made Bret Hedges concerning the problem with absenteeism. He suggested that when someone is going to. be absent, that member should call the other members of his/her group so an extra effort is made by the others to make the inspections and attend the meeting. Scott also requested a member volunteer to attend the Shellfish Advisory Committee meeting, which is scheduled for December 17, 1998 at 7:00 P.M. Kenneth Meskill and Richard Smith will try to attend. REPORTS Richard Smith advised members that the Peconic Estuary Program was looking for to add to its list of_ properties for protection and/or restoration. The deadline is fast approaching but he is sure that another window for submission would occur. Kenneth Meskill pointed out to the membership that the Trustees did not agree with the CAC concerning the drainage on a particular piece of property on December 15, 1998 -F- Yennecott Drive. He suggested the CAC not wait until a Trustee meeting to voice its opinion of a project, it would be better to voice concerns ahead of time. Kenneth also reported that the water sampling was continuing and CAC members were welcome to join him. On a final note, Kenneth expressed concern over the problem of litter in the Goose Creek area. APPROVAL OF MINUTES Moved by Richard Smith, seconded by Melvyn Morris, it was RESOLVED to accept the minute of November 12, 1998 with the following additions: 1) Page 3 - add the work "bird" to the first sentence of No. 1605 "NOTE: The CAC suggests that this may be a perfect opportunity, if the spoil is appropriate, to place the dredged spoil on the spoil island to help increase the bird habitation on the island. . . ." 2) Page 4 - add the words "the impact of" to the second paragraph of No. 1607- "The CAC recommends approval of a determination of non-jurisdiction but has concerns about the impact of the pool and pool maintenance on the wetlands". Vote of Council: Ayes: All Motion Carried RECOMMENDATION OF WETLAND PERMIT AND COASTAL EROSION PERMIT APPLICATIONS No. 1609 Moved by Kenneth Meskill, seconded by Richard Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATION of the Wetland Permit Application of NANCY L. WALZOC 31-14-15 to construct 4' x 20' ramp from top of bulkhead continuing with a level 80' dock, 32" x 16' aluminum ramp, 6' x 20' floating dock secured by three (3) 2-pile dolphins. 12832 Main Road, East Marion The CAC recommends approval with the stipulation that the project plan is shortened to conform to the Trustees' policy concerning docks on the bay. (Trustees' meeting April 25, 1996: "RESOLVED that the Southold Town Board of 'Trustees adopt a policy to restrict the length of residential docks on the Peconic and Gardeners Bays such that they shall extend no further out than 100' from Mean High Water." Vote of Council: Ayes: All Motion Carried Page 2 r December 15, 1998 No. 1610 Moved by Melvyn Morris, seconded by Kenneth Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of BUD HOLMAN 123-7-8 to reconstruct three (3) low profile jetties, 1 jetty 65' and two jetties 50' each. 350 Park Avenue, Mattituck Vote of Council: Ayes: All Motion Carried No. 1611 Moved by Kenneth Meskill, seconded by Scott Hilary, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit and Coastal Erosion Permit Application of ANDREAS KARACOSTAS 135-1-2 to place on filter cloth within 4' of existing timber retaining wall 40+/-' of 1 - 3 ton toe armor stone. 21275 Sound View Avenue, Southold The CAC recommends disapproval based on the following: 1 . Concern about the environmental impact of putting stones below the Mean High Water 2. Is this the best solution to the problem? The CAC believes fixing the bulkhead and bluff management may be a more appropriate solution. 3. Concerns with existing framed sheds on bulkhead. 4. Concerns about the storage of outboard gasoline in shed. Vote of Council: Ayes: All Motion Carried No. 1612 JOHN SKI 10-10-8.1 to construct 93+/- linear feet of stone revetment; approximately 30 cubic yards of clean fill to be trucked in from upland source for backfill; maintain an existing gravel road by periodically adding gravel. Oriental Avenue, Fishers Island The CAC did not make an inspection, therefore, it has no comment. No. 1613 Moved by Kenneth Meskill, seconded by Richard Smith to TABLE the Wetland Permit Application of JOSEPH CERCYES 70-5-41 to take down existing house and in same place build a two-story colonial approximately 2300 s.f. 1575 Pine Neck Road, Southold More information is required before the CAC can make a recommendation. The CAC requests the Board of Trustees TABLE its decision until the CAC receives and reviews: a) site survey and plans, and b) a complete application. Vote of Council: Ayes: All Motion Carried Page 3 December 15, 1998 No. 1614 Moved by Scott Hilary, seconded by Richard Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH PROVISION of the Coastal Erosion Permit Application of JOSEPH KANE 33-1-8 to construct stairs from top of bluff to beach. 3100 Sound Drive, Greenport CAC approves the plan indicated on the application survey and dimensions of 40" wide and 70' long. Vote of Council: Ayes: All Motion Carried No. 1615 Moved by Richard Smith, seconded by Sharon Shine, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATIONS of the Wetland Permit Application of VICTOR and MARY ZUPA 81-1-13.1 to remove and replace (in place) 117 +/-' of existing timber bulkhead with C-Loc vinyl sheathing and backfill with approximately 10 c.y. of clean sand to be trucked in from an upland source; remove and replace (in kind/in place) 4' x 4' fixed timber platform cantilevered to bulkhead; remove and replace (in kind/in place) existing concrete walk as necessary; maintain existing dock consisting of 4' x 4' fixed platform;, 3' x 15' ramp, - 8' x 10' float and 4' x 20' float. 365 Basin Road, Southold The CAC recommends approval provided the project is strictly in kind/in place and that a 10' nonturf buffer is placed behind the bulkhead. Vote of Council: Ayes: Richard Smith, Sharon Shine, Scott Hilary, Melvyn Morris Abstain: Kenneth Meskill Motion Carried No. 1616 Moved by Melvyn Morris, seconded by Sharon Shine, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATION of the Wetland Permit Application of THOMAS and RUBY GLUCKMAN 111-5-2 to construct a fixed timber dock consisting of a 4' x 98' fixed catwalk; 3' x 14' ramp; and 6' x 20' float to be secured by two (2) 8" diameter pilings. 1350 West Cove Road, Cutchogue The CAC recommends approval with the stipulation that applicant shorten the project plan to conform to the Board of Trustees' policy concerning docks. (Trustees'- meeting April 25, 1996: "RESOLVED that the Southold Town Board of Trustees adopt a policy to restrict the length of residential docks on the Peconic and Gardeners Bays such that they shall extend no further out than 100' from Mean High Water." Vote of Council: Ayes: All Motion Carried Page 4 December 15, 1998 RECOMMENDATION OF WAIVER REQUESTS WR-128 Moved by Melvyn Morris, seconded by Kenneth Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Waiver Request of JOHN and LINDA SCOPAZ 86-7-2.1 to construct a new master bath and dormer on second floor; new roof to existing house. 6300 Indian Neck Road, Peconic Vote of Council: Ayes: All Motion Carried WR-129 Moved by Scott Hilary, seconded by Sharon Shine, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Waiver Request of ROBERT BRUCE 34-1-9 to remove existing garage and replace with a storage shed with a smaller footprint. 1155 Main Road, Greenport Vote of Council: Ayes: All Motion Carried WR-130 Moved by Melvyn Morris, seconded by Kenneth Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Waiver Request of THOMAS E. UHL 110-1-7.3 to add new second floor dormer with a bedroom, study and bath to existing house; one new bay window in living room; existing footprint to remain as is. 1730 West Creek Road, Cutchogue Vote of Council: Ayes: All Motion Carried SET NEXT MEETING DATE The next meeting of the Southold Town Conservation Advisory Council is scheduled for Tuesday, January 19, 1999 at 5:30 P.M. in the Conference Room at Southold Town Hall, 53095 Main Road, Southold, New York.
