CONSERVATION ADVISORY COUNCIL
TUESDAY, JANUARY 19, 1999
5:30 PM
A meeting of the Southold Town Conservation Advisory Council was held Tuesday, January 19,
1999 at 5:30 PM in the Conference Room at Southold Town Hall, 53095 Main Road, Southold,
New York
Present were: Scott Hilary, Chairman

CHAIRMAN'S ANNOUNCEMENTS
JAMES McMAHON was a guest speaker introducing the first draft of the Nature Preserve. He
expressed concerns about the upcoming Bill, effective March 1, which allows $1,000,000 for
open space. The major concern was the need for a management plan, as there are no policies in
place. Jim wanted a sense of support from the CAC members, as well as from the Land
Preservation Comm., Peter Trexler, and the Trustees as well, so that he can then take the ideas to
the Town Board. Chairman Scott Hilary felt that he would have their support but he needed to
discuss the idea with the other members that were absent.
Scott Hilary suggested that members should consider attending the 1999 Fisherman's Forum in
Riverhead on January 22, 1999.
Scott requested a meeting with the Trustees in March. A date in the first week of the month is
pending.
Scott also brought to the member's attention the problems the Canadian Geese are causing. The
noise, their aggressiveness, and the health risks concerning water quality. He passed out a
pamphlet with some possible solutions because these problems will just increase because of the
increase of Geese.
Scott mentioned that the next Shellfish Advisory Committee meeting will be held on January 21,
1999 at 7:00 PM if anyone would like to attend.

REPORTS
Sharon Shine announced to the members that this was going to be her last meeting as she is
resigning as a CAC member.
Bret Hedges questioned on how you can tell where the Freshwater Wetlands actually are. He
also questioned the job description of the Baykeeper and would like to contact him to set up a
meeting.
Scott Hilary noted that there were several applications for a junior member.
APPROVAL OF MINUTES
Moved by Richard Smith, seconded by Sharon Shine to approve the Minutes of December 15,
1998, as submitted.

RECOMMENDATION OF WETLAND PERMIT AND COASTAL EROSION PERMIT
APPLICATIONS
Moved by Richard Smith, seconded by Melvyn Morris, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the
Wetland Permit Application, of WUNNEWETA POND ASSOC. 118-1-11 to dredge a 20'X
170' area in channel to max. depth of 4' below ALW, and approx. 375 c.y. of resultant spoil will
be spread evenly over irregularly shaped area on adjacent property to southeast.
Bridge Lane, Cutchogue.
The CAC recommends approval based on the following:
1. The work should be done outside of nesting season.
2. The spoil should be better manipulated in order to replenish the beach area.

Moved by Melvyn Morris, seconded by Richard Smith, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL with
Stipulation of the Wetland Permit Application of JAMES RILEY 111-5-12 to install a 4'X 35'
catwalk (4' above marsh), a 4'X 60' fixed dock, a 3'X 12' ramp and a 6'X 20' float with two 2-
pile dolphins 20' offset from each side of the float.

The CAC recommends approval with the stipulation that the catwalk begins outside the Wetland
boundary.

DAVID PATTERSON 6-4-5 to construct 114+ of a 6' wide fixed dock and install new tie-off
piling and ladder.
Central Ave., Fishers Island
The CAC did not make an inspection, therefore, it has no comment.
Moved by Scott Hilary, seconded by Richard Smith, to TABLE the Wetland Permit Application
of BERNICE LETTIERI, ANDREW LETTIERI AND JOE GAZZA 22-3-19,20,21 & 22 to
improve an existing access road to 4 parcels.
5 Acre Parcel off Main Road, East Marion
The application was Tabled based on the following:
1. The proposed road was not staked out.
2. It was unclear where the proposed road was in relation to existing dirt road
and Wetland delineation line.

Moved by Bret Hedges, seconded by Melvyn Morris, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the
Wetland Permit Application of GEORGE CHRISTNIANN, JR. 126-5-4 to construct a 90+ `
timber retaining wall to be tied into adjacent structures to east and west. Backfill with approx.
100 c.y. of clean sand trucked in from upland source and replant with Cape American beach
grass and remove existing timber landing and stairs and construct a 4'X 5' seasonal set of stairs
to beach.

Wetland Permit Application of ANDREAS KARACOSTAS 135-1-2 to remove/replace failing
structure.

DISCUSSION AND RECOMMENDATION OF WAIVER REQUESTS
Moved by Scott Hilary, seconded by Melvyn Morris, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the
Waiver Request of DANIEL JENNINGS 90-3-10 for an existing 6' high stockade fence along
the south side of the property.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the
Waiver Request for WORTH ENTERPRISES 92-1-8 to place two split rail fences from the
bulkhead to high water mark as indicated on survey.

dormer and approx. a 40' long split rail fence along west side of property.

DISCUSSION AND RECOMMENDATION OF GRANDFATHER REQUESTS
Moved by Scott Hilary, seconded by Richard Smith, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the
Grandfather Permit Application of BARBARA BODKIN 37-5-2 for an existing bulkhead,
wood deck, stairs, cement seawall and floating dock.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the
Grandfather Permit Application of THOMAS FALCO 70-6-32 to do maintenance repair on
dock by replacing 18 inside pilings, about 30 pieces of decking, replace stringers and install one
2-pile dolphins.

The CAC recommends Approval provided that the maintenance repair on the dock is
inkind/inplace.

RONALD CASSARA 73-4-1 for an existing set of stairs down the bluff and to repair any
damage to them.
30185 Cabot Woods Rd., Peconic
The CAC did not make an inspection, therefore, it has no comment.
Moved by Scott Hilary, seconded by Richard Smith, to TABLE the Grandfather Permit
Application of NANCY WALZOG 31-14-15 for an existing 36.4' jetty, a 41' jetty, a 5' wide
X 31' stairway from top of bulkhead to lower dock, a pre-existing portion of decked dock from
bulkhead, 4 undecked pile bents existing encompassing 26' in length, an existing deck over the
beach 6'X 36.8', an existing bulkhead 115' long with a 29.8' east return, and an existing house.

The CAC Tabled the application based on the fact that there was no proof that structures were
existing before 1991 in order to Grandfather.

DISCUSSION AND RECOMMENDATION OF AMENDMENT REQUEST
Moved by Melvyn Morris, seconded by Sharon Shine, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the
Amendment Request of ALAN CARDINALE 111-9-6.1 to amend Permit #4787 to include a
set of stairs down the bluff.

Moved by Bret Hedges, seconded by Richard Smith, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the
Amendment Request of MATTITUCK INLET MARINA 106-6-13.3 to amend Permit 94857
to reconstruct within 18" 200+' of bulkhead and backfill structure with 100 c.y. of clean sand
trucked in from upland source.

SET NEXT MEETING DATE
The next meeting of the Southold Town Conservation Advisory Council is scheduled to meet
Tuesday, February 16, 1999 at 5:30 PM in the Conference Room at Southold Town Hall, 53095
Main Road, Southold, New York.
There being no further business to come before the Council, the meeting was adjourned at 8:30
PM.
