Box 1179 Telephone O � � (516) 765-1801 Southold, New York 11971 '�.�IOl � ���� SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL TUESDAY, FEBRUARY 16, 1999 5:30 PM A meeting of the Southold Town Conservation Advisory Council was held Tuesday, February 16, 1999 at 5:30 PM in the Conference Room at Southold Town Hall, 53095 Main Road, Southold, New York Present were: Scott Hilary, Chairman Melvyn Morris, Member Richard Smith, Member Bret Hedges, Member Mary Griffin, Member Kenneth Meskill, Member CHAIRMAN'S ANNOUNCEMENTS Scott Hilary reminded the members that there will be a meeting with the Trustees on March 3, 1999 at 5:00 PM in the Meeting Hall. Interviews for a Youth Member will be conducted on February 23, 1999 at 4:00 PM in the Conference Room. The SAC meeting with be held on Thursday, February 18, 1999 in the Conference Room if anyone would like to attend. Scott mentioned that Lloyd Harbor CAC has invited the Southold CAC to attend their next meeting if anyone was interested. REPORTS Richard Smith reported that he attended the last SAC meeting. One of the topics was the possibility of putting a moratorium on shellfish licenses. He also wanted to make a change to the mailing of the SAC notices. All notices should be mailed to him now instead of Scott. f s 2 Bret Hedges reported that Kevin McAllister, the baykeeper, would like to get together with the CAC. Mary Hedges mentioned that there will be a dinner on Thursday, March 4, 1999 hosted by the Long Island Geologists. Ken Meskill stated that he would like to have some assistance with the water sampling. If anyone could help him transport the samples to Setauket, it would be greatly appreciated. Ken also mentioned that if anyone has a chance, to take a look at the project on Jamesport Town Beach on the north side of the road and the project on Peconic Bay Blvd. Ken also commented on the article in the NY Times regarding the Heron. The NYSACC Newsletter contained many interesting articles which if anyone has the time, should read. Ken mentioned that the osprey poles will be going up at the end of February and volunteers are needed. APPROVAL OF MINUTES Moved by Melvyn Morris, seconded by Scott Hilary to approve the Minutes of January 19, 1999, as submitted. Vote of Council: Ayes. All Motion Carried Moved by Scott Hilary, seconded by Richard Smith to draft a letter to Jim McMahon supporting the proposal for the Nature Preserve. Vote of Council: Ayes. All Motion Carried RECOMMENDATION OF WETLAND PERMIT AND COASTAL EROSION PERMIT APPLICATIONS FRANK B. & VIRGINIA A. ZIMMER 19-1-18.3 to construct a 4'X 40' dock on the east side of the 77 acre farm property on Little Bay. Size of boat is 21' which draws maximum of 1 '/z' of water depth. 34600 Main Road, Orient The CAC did not make an inspection, therefore, it has no comment. However, the following concerns were expressed: 3 1. The impact the dock would have on the shellfish beds. 2. Question on whether or not the State owns the wetlands. 3. Navigational concern. 4. Unclear of dock location. Moved by Scott Hilary, seconded by Ken Meskill it was RESOVLED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATION of the Wetland Permit Application of CHERYL HANSEN 78-5-3 to replace with new 112 linear ft. of southerly bulkhead within 23" seaward and 25" higher than south bulkhead; replace in-kind and in-place 147 linear ft. of bulkhead along east side at same height; widen existing boat slip by excavating 9'X 25' section bulkhead-upland area and construct new bulkhead at walls; backfill bulkheads with 100 c.y. of excavated material. Return lawn area to level ground (filling depressions where necessary behind excavated bulkhead); related activities to finish project. 446 Elizabeth Lane, Southold The CAC recommends approval with the following stipulations: 1. The construction not exceed seaward into the wetland/marsh bottom. 2. Non-turf buffer be placed behind the bulkhead. Vote of Council: Ayes: All Motion Carried Moved by Scott Hilary, seconded by Ken Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATION of the Wetland Permit Application of LESLIE GAZZOLA 78-5-2 to replace 82.5 linear ft. of bulkhead within 23" seaward and 25" higher than existing; widen existing slip by excavating 2.5'X 25' section and constructing new bulkhead at walls; backfill bulkheads with 100 c.y. of excavated material; related activities to complete. 495 Elizabeth Lane, Southold The CAC recommends approval with the following stipulations: 1. The construction not to exceed seaward into wetland/marsh bottom. 2. A non-turf buffer be placed behind the bulkhead. Vote of Council: Ayes: All Motion Carried Moved by Scott Hilary, seconded by Ken Meskill to TABLE the Wetland Permit Application of WILLIAM H. PRICE, JR. 43-5-10 to construct a 1725 s.f single family dwelling (footprint) with a 550 s.f. attached deck, an 865 s.f gravel driveway, septic system and water line and place 125 c.y. o fill to elevate the septic system house. 100 Bay Road, Greenport 4 The property was not properly staked and labeled. Vote of Council: Ayes: All Motion Carried Moved by Scott Hilary, seconded by Ken Meskill to TABLE the Wetland Permit Application of ROBERT ROCKEFELLER 44-1-8 to construct approx. 74' of toe armor stone and backfill with 50 yds. of upland fill. 55185 North Road, Southold No drawing was available to reference the proposed change in the construction. Vote of Council: Ayes: All Motion Carried Moved by Bret Hedges, seconded by Melvyn Morris, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of CHARLES KLEIN 122-4-17 to repair wooden bulkhead and boat slip inkind/inplace. 16' extension is proposed on the north side perpendicular to the shoreline and necessary to prevent silting in boat slip and to prevent impacts on the Spartina marsh. Existing boat slip will be dredged to 3' below mean low water. 2980 Ole Jule Lane, Mattituck CAC expressed concern as to the depth of the dredging. Vote of Council: Ayes: All Motion Carried Moved by Ken Meskill, seconded by Richard Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit Application of LOUIS SIRCUSANO 71-1-9 to construct +/- 100' of timber bulkhead with a 30' return at the western terminus and to backfill structure with +/- 25- c.y. of clean sand trucked in from an upland source. 895 North Parish Dr., Southold The CAC recommends disapproval and recommends that vegetation be used to stabilize the slope. Vote of Council: Ayes: All Motion Carried Moved by Melvyn Morris, seconded by Mary Griffin, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of ELLEN KASSCHAU 118-1-1.2 to replace (within 18") +/- 160' of existing timber bulkhead'and backfill with approx. 135 c.y. of clean sand trucked in from an 5 upland source. Remove and replace (inkind/inplace) existing TX 8' frame shed; 6'X 20' wood deck; 3'X 7' wood steps; and +/- 160' timber retaining wall. 5800 Vanston Road, Cutchogue Vote of Council: Ayes: All Motion Carried Moved by Melvyn Morris, seconded by Richard Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of MARK LOWENHEIM AND WALTER CHADWICK 86-6- 25 to construct a one-story addition to existing one-story residence with partial full basement and unfinished attic space. 6565 Indian Neck Lane, Peconic Vote of Council: Ayes: All Motion Carried RECOMMENDAITON OF WAIVER REQUESTS Moved by Melvyn Morris, seconded by Richard Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATION of the Waiver Request of JOHN LOCKWOOD 117-5-48.1 to clear trees and brush from the property. 906 Old Harbor Rd., New Suffolk CAC recommends approval with the stipulation that the area should be maintained as non-turf. Vote of Council: Ayes: All Motion Carried Moved by Scott Hilary, seconded by Ken Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATION of the Waiver Request of ELLEN VIOLETT 90-2-17 to install a 16'X 34' swimming pool in the rear of the yard. 650 Cedar Point Dr., East, Southold CAC recommends approval but with the stipulation that the pool maintenance not be discharged into the wetlands. Vote of Council: Ayes: All Motion Carried RECOMMENDATION OF GRANDFATHER REQUESTS 6 Moved by Melvyn Morris, seconded by Ken Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Grandfather Request of SUSAN SOUNDER 128-6-8 to remove and replace (1P) existing +/- 34' timber groin with low profile groin to be constructed with C-Loc Vinyl Sheathing. 3270 Peconic Bay Blvd., Laurel The CAC recommends disapproval based on the fact that the groin is less than 50% functional. Vote of Council: Ayes: All Motion Carried RECOMMENDATION OF AMENDMENT REQUESTS Moved by Scott Hilary, seconded by Richard Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Amendment Request of PATRICK LOHN 87-3-57 to resheath (within 18" using plastic vinyl sheathing) the east and south bulkhead walls located within the smaller basin. Amendment to Permit#4954 2335 Minnehaha Blvd., Southold CAC recommends a non-turf buffer behind the bulkhead. Vote of Council: Ayes: All Motion Carried Moved by Melvyn Morris, seconded by Ken Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Amendment Request of LOUIS & ELIZABETH FORMICA 114-7-10.6 to change the configuration of the dock back to the way it was originally approved by the Trustees. Amendment to Permit#1658. 2422 Westphalia Rd., Mattituck CAC recommends Disapproval as an Amendment. Application should be resubmitted as a Wetland Permit as it is a new structure. Vote of Council: Ayes: All Motion Carried Moved by Scott Hilary, seconded by Ken Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Amendment Request of CLEAVES POINT CONDO. 38-7-4.2 & 8 AND 38.2-1-45 to install four 4'X 30' fingers, four 4'X 25' fingers and construct an 8'X 66' "T" floating dock. Amendment to Permit#4224. Shipyard Lane, East Marion 7 CAC recommends Disapproval as an Amendment. Application should be resubmitted as a Wetland Permit. Vote of Council: Ayes: All Motion Carried MATTITUCK INLET MARINA 106-6-13.3 to relocate existing southern float assembly 80' +/-to south and install new 6'X 20' ramp for access float, remove existing 30' float on southerly side and attach to south side of existing float assembly to north, install an additional 30' to west end of said float and install 10'X 310' of floating docks and a 20'X 20' float. Amendment to Permit#4857. West Mill Road, Mattituck The CAC did not make an inspection, therefore, it has no comment. SET NEXT MEETING DATE The next meeting of the Southold Town Conservation Advisory Council is scheduled to meet Tuesday, March 23, 1999 at 5:00 PM.
