Box 1179 Telephone 765-1892 O� O� Southold, New York 11971 (516) �l SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL TUESDAY, MARCH 23, 1999 5:00 PM A meeting of the Southold Town Conservation Advisory Council was held Tuesday, March 23, 1999 at 5:00 PM in the Conference Room.at Southold Town Hall, 53095 Main Road, Southold, New York. Present were: Scott Hilary, Chairman Melvyn Morris, Member Richard Smith, Member Bret Hedges, Member Kenneth Meskill, Member Abby Cochran, Junior Member Jaclyn VanBourgondien, Junior Member Absent was: Mary Griffin, Member CHAIRMAN'S ANNOUNCEMENTS Scott Hilary commented on last month's Trustee meeting regarding the recommendations. A few dates have been set aside for the CAC/Trustee joint meeting. April 20, 22, or 27th at 5:00 PM. These dates will be brought before the Trustees at their March 24, 1999 meeting. Scott Hilary also suggested that perhaps someone would want to create a letterhead logo for the CAC. Richard Smith said he could create something on his computer. REPORTS Bret reported that Kevin McAllister couldn't make the meeting but perhaps he will be able to attend next month. Ken Meskill reported that East Creek is going to be open. If anyone is interested in helping him do water sampling, he would greatly appreciate it. 2 Ken also reported that a project permit has been denied because of an aesthetic problem. He also mentioned the fact that there has been a road salt study in Denver because of the many problems they have been experiencing. The Wild Bird Depot is closing and Ken will be acquiring their inventory to start his own shop. Richard Smith reported that at the last Shellfish Advisory Committee meeting, it was announced that Dan Lewis is now in charge of the water quality. Also, East Creek will be opening for shellfishing. He also reported that Southold has damage money left from a project on Fisher's Island that they can utilize for restoration of shellfish in Cutchogue Harbor. Maureen Davidson is now in charge of a new leasing project in the Sound. If anyone has any questions or concerns, they can contact her. Melvyn Morris mentioned the possibility of college students helping or assisting the CAC with any of the upcoming projects. APPROVAL OF MINUTES Moved by Richard Smith, seconded by Ken Meskill to approve the Minutes of February 16, 1999, as submitted. Vote of Council: Ayes: All Motion Carried DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT AND COASTAL EROSION PERMIT APPLICATIONS Moved by Richard Smith, seconded by Bret Hedges, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of THOMAS MASTRO 126-11-3.1 to replace (within 18") +/- 113 linear feet of existing timber bulkhead with C-Loc vinyl bulkhead. Construct+/- 16' westerly return using C-Loc vinyl sheathing, and remove and replace (inkind/inplace) 5'X 12' timber stairs to beach. Approx. 45 c.y. of clean sand will be trucked in from an upland source and used for backfill. 6760 Peconic Bay Blvd., Laurel Vote of Council: Ayes: All Motion Carried KEVIN R. MIDDLETON AND MARIE JONES 87-5-23.1 to construct a swimming pool and floating dock. 3 8516 Main Bayview Road, Southold The CAC did not make an inspection, therefore no recommendation was made. Moved by Melvyn Morris, seconded by Richard Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of SEBASTIANS COVE PROP. OWNERS ASSOC. 100-11.11 & 11.12 to install 11 pilings to create 10' wide boat slips. Maintenance dredge along existing bulkhead a width of 10' and to a depth of 4'. This requires the removal of approx. 1.5' in depth of bottom for a total volume of 50 +/- c.y. Sebastian's Cove Road N/o Mill Rd., Mattituck The CAC expressed a concern regarding the concentration of boats allowed in that particular area for an,association application. Vote of Council: Ayes: All Motion Carried JOHN AND MARILYN DEVEAU 78-2-30 to construct a single- family dwelling with driveway. 1240 Glenn Road, Southold The CAC did not make an inspection, therefore no recommendation was made. MICHAEL F. COLAVITO 78-4-44.2 for a 4'X 4' platform, 3'X 15' ramp, three(3) 8' floats parallel to bank of dredged canal secured by three(3) piles. 6150 Main Bayview Road, Southold The CAC did not make an inspection, therefore'no recommendation was made. Moved by Richard.Smith, seconded by Melvyn Morris, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of JOANNE BLUM AND WILLIAM SCHAEDEL 122-4-25 to replace (within 18") +/- 52' of existing timber bulkhead, and remove and replace (inkind/inplace) +/- 157' of existing timber bulkhead. Dredge up to 10' off boat slip bulkheading to a maximum depth of 3' ALW and use approx. 63 c.y. of resultant spoil as backfill. 3830 Ole Jule Lane, Mattituck CAC recommends a 10' non-turf buffer behind the bulkhead. Vote of Council: Ayes: All Motion Carried 4 Moved by Scott Hilary, seconded by Ken Meskill to TABLE the Wetland Permit Application of JON C. KERBS 54-6-4.4 to construct a single family home with 80' setback from wetland for construction and 60' setback from wetlands for clearing. 550 Rene's Drive, Southold No survey was available at the time of inspection. CAC will re-inspect when the survey is available. Vote of Council: Ayes: All Motion Carried Moved by Scott Hilary, seconded by Ken Meskill to TABLE the Wetland Permit Application of JON C. KERBS 54-6-4.4 to construct a single family home with 30' setback from wetlands. 400 Rene's Drive, Southold - No survey was available at the time of the inspection. CAC will re-inspect when the survey is available. Vote of Council: Ayes` All Motion Carried Moved by Richard Smith, seconded by Melvyn Morris, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATION of the Wetland Permit Application of JAMES ECKERT 116-7-8 to construct a single family private residence with decks and private sewage disposal system. 1635 Meadow Beach,Lane, Mattituck The CAC recommends Approval with the Stipulation that there be no clearing within 75' of the wetlands. Vote of Council: Ayes: All Motion Carried CHARLES RODIN 103-10-16 to construct a 4'X 196' fixed timber dock, (elev. a min. of 4' above grade) a 3'X 20' ramp and a 6'X 20' float. 70 Strohson Road, Cutchogue The CAC did not make an inspection, there no recommendation was made. Moved by Richard Smith, seconded by Melvyn Morris, it was 5 RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit Application of VINCENT FREDA 86-6-p/o 26 to construct a 4'X 30' set of steps leading to a 4'X+/- 311' catwalk to be constructed a minimum of 3.5" above grade and a 4'X 40' set of steps as per enclosed plans. 7715 Indian Neck Lane, Southold CAC recommends Disapproval because the length of the catwalk would adversely affect the wetlands. Vote of Council: Ayes: All Motion Carried JOHN T. FARRIS, JR. 26-2-20.1 to remove a deteriorated 3.5'X 75' dock. Install a new 4'X 100' dock with a 6'X 20' "L" section. Dock to be constructed of CCA treated timber. Install 3 2-pile dolphins. 750 Willow Terrace Lane, Orient The CAC did not make an inspection, therefore no recommendation was made. Moved by Richard Smith, seconded by Melvyn Morris to TABLE the Wetland Permit Application of KENNETH B: ZAHLER 116-1-9 to construct a single-family dwelling with garage, deck and pool 11595 New Suffolk Ave., and Linden Ave.,.New Suffolk CAC Tabled the application because a new survey was needed and all structures were not property staked out. Vote of Council: Ayes: All Motion Carried DISCUSSION AND RECOMMENDATIONS OF WAIVER REQUESTS Moved by Richard Smith, seconded by Melvyn Morris, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Waiver Request of ROBERT AND DOROTHY BAUMANN 127-6-5 to repair roof, change doors and windows, and replace the siding. 2050 North Oakwood Road, Laurel The CAC expressed concerns regarding the possibility of a violation. The applicant has cleared the wetlands. CAC recommends that a violation be issued and the wetlands be restored to their pre-existing condition. Vote of Council: Ayes: All 6 Motion Carried BARRY SHAPIRO 86-6-7 to construct a 26'X 21' deck.. 625 Wood Lane, Southold The CAC did not make an inspection, therefore no recommendation was made. Moved by Richard Smith, seconded by Melvyn Morris, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Waiver Request of JOSEPH AND LAURA ROBINSON 113-9-2.1 for renovations and additions to existing house. 935 Meday Ave., Mattituck Vote of Council: Ayes: All Motion Carried ROBERT KAPLAN 92-1-7 to construct an addition to an existing house. 1700 Inlet Way, Southold The CAC did not make an inspection; therefore no recommendation was made. Moved by Richard Smith, seconded by Richard Smith to TABLE the Waiver Request for CAROL MAGGIO 99-3-11.9 for an existing 8'X 16' deck. 1350 Bailie Beach Road, Mattituck The CAC Tabled the application because of insufficient information. DISCUSSION AND RECOMMENDATION OF GRANDFATHER REQUESTS JOHN AND JEAN WEBER 56-5-17 for wood deck, float and bulkhead built in 1966. 590 Budd's Pond Road, Southold The CAC did not make an inspection, therefore no recommendation was made. DANIEL JENNINGS 70-5-54.1 to repair wood dock with float (inkind/inplace). 3340 Oaklawn Ave., Southold The CAC did not make an inspection, therefore no recommendation was made. A'* 7 DISCUSSION AND RECOMMENDATION OF AMENDMENT REQUESTS Moved by Bret Hedges, seconded by Ken Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Amendment Request of VILLAGE MARINE 122-3-15.1 to amend Permit#4882 to reconstruct inkind/inplace+/- 340' of timber bulkhead and to dredge a 10'X 268" area adjacent to the bulkhead to a depth of 4' ALW. The resultant spoil +/- 200 c.y. of sand to be utilized as backfill for structure. Bay Ave., Mattituck Vote of Council- Ayes: All Motion Carried Moved by Richard Smith, seconded by Ken Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Amendment Request of ROBERT AND PATRICIA ALCUS 92-1-2.1 to amend Permit 44279 to add 10' to the existing 6'X 20' floating dock for a total length of 30'. 1457 Cedar Point Dr. East, Southold CAC recommends Disapproval based on the Trustees Policy of docks being no larger than 6'X 20'. Vote of Council: Ayes: All Motion Carried SET NEXT MEETING DATE The next meeting of the Southold Town Conservation Advisory Council is scheduled to meet Thursday, April 15, 1999 at 5:00 PM.
