Box 1179 Telephone p Southold, New York 11971 (516) 765-1892 SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL THURSDAY,APRIL 15, 1999 5:00 PM A meeting of the Southold Town Conservation Advisory Council was held Thursday, April 15, 1999 at 5:00 PM in the Conference Room at Southold Town Hall, 53095 Main Rd., Southold, New York. Present Were: Scott Hilary, Chairman Melvyn Morris, Member Richard Smith, Member Bret Hedges, Member Kenneth Meskill, Member Abby Cochran, Junior Member Jaclyn VanBourgondien, Junior Member Absent Was: Mary Griffin, Member CHAIRMAN'S ANNOUNCEMENTS There will be a joint meeting with the Trustees on April 27, 1999 at 5:00 PM in the Conference Room. Scott Hilary will be having an interview with a possible new member on Friday, April 23, 1999. REPORTS Richard Smith reported that he had an interview with Don Frederic, who interested in becoming a CAC member. He also reported that he is currently working with Greg Yakaboski and John Sepenoski on the new computer system. APPROVAL OF MINUTES Moved by Scott Hilary; seconded by Bret Hedges to approve the Minutes of March 23, 1999, as submitted. ,r 2 DISCUSSION AND RECOMMENDATIONS OF WETLAND PERMIT AND COASTAL EROSION PERMIT APPLICATIONS Moved by Scott Hilary, seconded by Richard Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of THOMAS &PATRICIA NADHERNY 70-5-34 & 35 to construct a 4'X 92' fixed timber catwalk with a 4'X 6' timber deck at landward end and a ladder on the seaward end. 1085 Pine Neck Rd., Southold Vote of Council: Ayes: All Motion Carried Moved by Scott Hilary, seconded by Richard Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees, APPROVAL of the Wetland Permit Application of DENNIS &RITA GALLAGHER 87-3-40 to construct a dock consisting of a 4'X 28' fixed dock, 32"X 16' removable aluminum ramp and a 6'X 20' floating dock. Fixed dock secured to concrete steps on land-side and supported by three 3-pile bents spaced 9.3' apart. Floating dock secured with 2 pilings at opposite ends. Pilings, fixed dock, and floating dock constructed of CCA treated lumber. 3140 Minnehaha Blvd., Southold Vote of Council: Ayes: All Motion Carried Moved by Bret Hedges, seconded by Scott Hilary to TABLE the Wetland Permit Application of SALVATORE PALACINO 136-1-38 to construct a single-family dwelling approx. 1800 s.f with deck. 790 Oak St., Cutchogue The CAC Tabled the application because the property was not staked. Vote of Council: Ayes: All Motion Carried Moved by Richard Smith, seconded by Melvyn Morris, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of SUSAN&PHILIP BACON 111-09-02 to construct a set of beach stairs. 3335 Nassau Point Rd., Cutchogue 3 The CAC recommends Approval provided that the Trustees approve the dimensions of the stairs, which were unavailable to the CAC. Vote of Council: Ayes: All Motion Carried Moved by Scott Hilary, seconded by Richard Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of ROBERT KELLER 37-5-11 to construct a 480 s.f deck with attached stairs and to recommend DISAPPROVAL of the application to re-vegetate 330 s.f. of shoreline in native wetland shrubs. 380 Knoll Circle, East Marion The CAC recommends Disapproval of the re-vegetation because an adequate planting plan was needed stating what types of plants were going to be used and who would be responsible for planting them. Vote of Council: Ayes:. All Motion Carried Moved by Richard Smith, seconded by Scott Hilary, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit Application of JON KERBS 54-6-4.4 to build a single-family home with 30' setback from freshwater wetlands. 400 Rene's Drive, Southold The CAC recommends Disapproval because the construction would adversely affect the wetlands. This is a valuable freshwater wetland resource for the Town of Southold. Vote of Council: Ayes: All Motion Carried Moved by Richard Smith, seconded by Scott Hilary, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application for LESZEK T. GESIAK 53-5-11.2 to construct a 1150 s.f second floor addition and 128 s.f second floor deck,to be built in the confines of existing footprint. 1490 Sage Blvd., Southold Vote of Council: Ayes: All Motion Carried Moved by Richard Smith, seconded by Melvyn Morris, it was � J 4 RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit Application of CHARLES &BARBARA RODIN 103-10-16 to construct a 4'X 196' fixed CCA timber dock, 3'X 20' ramp, and a 6'X 20' timber float. The proposed dock is to be elevated a minimum of 4' above grade and will utilize (48) 6" Dia. CCA timber pilings with a depth of penetration to be 8'+. The float is proposed to be supported by (2) 8" Dia. CCA timber pilings with a depth of penetration 10"+. 70 Strohson Rd., Cutchogue The CAC recommends Disapproval because the dock would adversely affect the wetlands. It would also obstruct the scenic vista of the area and be fragmenting the wetland habitat. Vote of Council: Ayes: All Motion Carried Moved by Bret Hedges, seconded by Scott Hilary, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of SCOTT PATCHELL 70-4-24 to construct a 4'X 6' platform attached to existing bulkhead, supported by two piles; 3'X 16' hinged ramp; 6'X 20' floating dock secured to galvanized pipes attached to seaward side of piles of existing bulkhead. 1075 West Hill Rd., Southold The CAC recommends Approval and recommends a 10' non-turf buffer. Vote of Council: Ayes: All Motion Carried DISCUSSION AND RECOMMENDATIONS OF WAIVER REQUESTS Moved by Melvyn Morris, seconded by Scott Hilary, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATION of the Waiver Request of PATRICK KELLY 71-2-6 to install an in-ground swimming pool 50' from bulkhead and construct an at-grade patio 45' from the bulkhead. 215 Harbor Lights Drive, Southold The CAC recommends Approval with the Stipulation that the pool not be drained into the canal. Vote of Council: Ayes: All Motion Carried Moved by Scott Hilary, seconded by Richard Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Waiver Request of BARBARA&RAYMOND TERRY 70-5-11 to construct a deck addition to residence on water side of home approx. 62' from the existing bulkhead. 5 610 Jockey Creek Dr., Southold The CAC also recommends that the garden be setback further away from the bulkhead. Vote of Council: Ayes: All Motion Carried Moved by Richard Smith, seconded by Scott Hilary, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Waiver Request of ISKENDER EREY& ANGELICA BENGOLEA 38-6-7 to extend the current deck (eastwards) of the house behind a continuous bulkhead of no less than 300 continuous feet. 680 South Lane, East Marion Vote of Council: Ayes: All Motion Carried Moved by Richard Smith, seconded by Scott Hilary, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Waiver Request of DOMINICK PARRELLA 135-3-41 to raise a porch roof approx. one foot and add a front door. 1275 Mill Creek Dr., Southold Vote of Council: Ayes: All Motion Carried MARGARET BRYAN 10-6-12.4 requests a Waiver to install a split-rail fence along westerly property line including a portion within 25 ft. of bluff line and to remove encroaching deck and boardwalk build by neighbors at edge of bluff. Isabella Beach Rd., Fishers Island The CAC did not make an inspection, therefore no recommendation was made. DISCUSSION AND RECOMMENDATION OF GRANDFATHER REQUESTS Moved by Scott Hilary, seconded by Richard Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Grandfather Request of ROBERT &VIRGINIA DIETRICH 44-1-15 to reface existing bulkhead inkind/inplace using Shiplap plastic sheathing. 55755 County Rd. 48, Southold 6 Vote of Council: Ayes: All Motion Carried Moved by Scott Hilary, seconded by Richard Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Grandfather Request of ARIF HUSSAIN 31-9-11 to repair the wood retaining wall and dock, install wood stairs, and install stockade fence along the northwest side of the property. 420 Lakeview Terrace, East Marion Vote of Council: Ayes: All Motion Carried DISCUSSION AND RECOMMENDATION OF AMENDMENT REQUESTS Moved by Melvyn Morris, seconded by Richard Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Amendment Request for WILLIAM FELIX 136-1-39 to amend Permit#552 to construct a 4'X 16' addition to existing walkway, which will result in a walkway 4'X 52'; dock also includes existing 3'X 10' ramp and existing 8'X 24' float. Relocate two 2-pile dolphins 16' seaward to secure float in new location and to transfer Permit 4552 from James Long to William Felix. 760 Oak Street, Cutchogue Vote of Council: Ayes— Scott Hilary, Richard Smith, Melvyn Morris, Bret Hedges, Jaclyn VanBourgondien, Abby Cochran No - Ken Meskill Motion Carried SET NEXT MEETING DATE The next meeting of the Southold Town Conservation Advisory Council is scheduled to meet Monday, May 24, 1999 at 5:00 PM in the Conference Room. There being no further business to come before the Council, the meeting was adjourned at 7:35 PM.
