Monday, July 19, 1999

A meeting of the Southold Town Conservation Advisory Council was held Monday', July 19,
1999 at 5:30 PM in the Conference Room at Southold Town Hall, 53095 Main Rd., Southold,
New York.

CHAIRMAN'S ANNOUNCEMENTS
REPORTS
Richard Smith commented on the last Trustee meeting. He reported that the application for
Sircusano in Southold was issued a violation. He also commented on the last SAC meeting. A
representative from Aquaculture Technologies was present.
100,000 oysters and 30,000 soft clams were recently stocked in the local waters.
Ken Meskill reported that the use of pesticides being spread by helicopters is disappointing.
There is currently a dam removal project taking place in Maine.
During a recent Fire Island job assignment, 60% of the work was already done endangering the
terns and plovers and the bird habitat was basically destroyed. Ken expressed his
disappointment.
Osprey numbers are down.

There is an upcoming CAC conference in Rochester if any one is interested.
He also commented on the need for woodland management. There is a project in Mattituck that
consists of several homes that will destroy the woodlands.
Abby Cochran reported that she recently returned from a DEC camp in Warrensberg.
APPROVAL OF MINUTES
Moved by Bret Hedges, seconded by Richard Smith to approve the Minutes of June 21, 1999, as
submitted.
DISCUSSION AND RECOMMENDATION OF WETLAND AND COASTAL EROSION
PERMIT APPLICATIONS
Moved by Richard Smith, seconded by Ken Meskill, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A
STIPULATION of the Wetland Permit Application of WILLIAM S. KELLY& SANDRA
SIKORSKI 79-4-24 to construct a single-family dwelling with a 1250 s.f. footprint. Construct
trelace (open) attached to house, install private well, install on-site sanitary system, and install
picket fence in front yard.
1840 Brigantine Dr., Southold
The CAC recommends Approval as per the survey received in the Trustee's Office dated June 8,
1999, with the stipulation that haybales be placed along the construction site.

Moved by Melvyn Morris, seconded by Richard Smith, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A
STIPULATION the Wetland Permit Application of JAMES E. &KAREN A. HOEG 115-17-
17.10 to construct a single-family dwelling, associated sanitary system, concrete patio, pool and
asphalt driveway, with no off-site fill required and with a 50' non-disturbed buffer area to align
with neighbors on both sides. All proposed structures shall be located a minimum of 60'
landward of existing tidal wetlands. A line-of staked haybales or snow fencing shall be placed at
a point 50' landward of the existing tidal wetlands prior to and maintained during construction.
The project as proposed shall result in 20.07% lot coverage at the adjacent area.

The CAC recommends Approval with the Stipulation that drywells be installed for the pool
backwash.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A
STIPULATION the Wetland Permit Application of RALPH LEVY 66-3-4 to remove existing
fixed dock and catwalk and replace with 6'X 30' float and 3'X 10' hinged ramp in same
location.
885 Arshamomoque Ave., Southold
The CAC recommends Approval with the Stipulation that the float be 6'X 20' to keep consistent
with the Trustee's standards.

RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the
Wetland Permit Application of CATHERINE &RICHARD HART 114-7-12.1 to construct a
4'X 88' catwalk, a 32" X 20' ramp with a 5'X 5' "T" and a 6'X 40' float.
1900 Westphalia Rd., Mattituck
The CAC recommends Disapproval of the application as submitted but would Approve a 6'X 20'
float and with the condition that the structure be in line with the neighbors. New plans should be
submitted.

RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the
Wetland Permit Application of STEFANIE LINAKIS 122-9-7.18 to construct a single-family
dwelling and install an on-site sewage disposal system.
2304 Private Rd. off Camp Mineola Rd., Mattituck
The CAC recommends Disapproval based on inadequate information.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A
STIPULATION of the Wetland Permit Application of RONALD & CATHERINE QUINN 115-
1-13 to construct a fixed timber dock, consisting of a 4'X 12' landward ramp; 4'X 68' fixed
catwalk; 3'X 14' ramp; and a 6'X 20' float to be secured by(2) 8" diameter pilings.

The CAC recommends Approval with the Stipulation that the structure be in line with the
neighbors' and that the total length of the structure should not exceed 40' from average high
water.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the
Wetland Permit Application of RICHARD PIZZICARA 90-3-1 to construct a 4'X 6' catwalk, a
3'X 8' ramp and a 4'X 16' float.
150 Lakeside Drive, Southold
Vote of Council: Ayes: All

GEORGE &DEMETRA TSIRNIKAS 40-3-10.1 for clearing of dead trees, poison ivy, and
garbage on property.

The CAC did not make an inspection, therefore, no recommendation was made.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A
STIPULATION of the Wetland Permit Application of WALTER GAIPA 36-9-12 to build a set
of stairs from the existing deck to the edge of Marion Lake.
360 Lakeview Terrace, East Marion
The CAC recommends.Approval with the Stipulation that one landing be removed and size of
the second landing be reduced.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A
STIPULATION of the Wetland Permit Application of EMANUEL XEFOS 31-114-7 to resheath
and repair approx. 200' of existing bulkhead and place a 30' return on landward side.

The CAC recommends Approval with the Stipulation that a non-turf buffer be placed behind the
bulkhead.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH
STIPULATIONS the Wetland Permit Application of RICHARD O'TOOLE 122-4-10 to
construct a 20'X 40' in-ground pool.
2280 Ole Jule Lane, Mattituck
Although the pool was not staked, the CAC recommends Approval with the Stipulation that the
pool be moved back as close to the house as possible and drywells be installed.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A
STIPULATION the Wetland Permit Application of MARY KIRSCH 87-5-24 to construct a
1,716 sf octagon, two-story dwelling with deck and concrete foundation.

The CAC recommends Approval with the Stipulation that haybales be placed along the
construction area and that there be no clearing within 50' of the freshwater wetlands.

RESOLVED to Table the Wetland Permit Application of FRANCIS &ELIZABETH H.
MURPHY 114-12-13.1 to construct a single-family home with septic system and well.

The CAC Tabled the application because the property was not staked and no survey was
available. The CAC requests to re-inspect the property when the survey becomes available.

RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the
Wetland Permit Application of GERALD GELBWAKS 111-1-23.1 & 28.1 to attach a 3'X 12'
timber ramp and 6'X 20' float secured by(2) 8" diameter piles to existing timber dock.

The CAC recommends Disapproval because the proposed structure in addition to the existing
would result in an excessive structure.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A
STIPULATION of the Wetland Permit Application of CHARLES LoCASTRO 123-8-12 to
replace (within 18") approx. 124' of existing timber bulkhead and backfill with approx. 25 c.y.
of clean sand to be trucked in from an upland source. Remove and replace (inkind/inplace)
existing+/- 61' low-profile timber groin. Remove and replace (inkind/inplace) existing wood
deck over bulkhead and wood steps to beach. Remove existing wood deck at top of bank;
construct a 12'X 20' wood deck; and reconstruct wood steps down bank.

The CAC recommends Approval with the Stipulation that the wood deck be relocated to the top
of the bank rather than overhanging over the edge of the bank.

armor to three sides of the existing beach house.

RESOLVED to recommend tot he Southold Town Board of Trustees APPROVAL of the
Wetland Permit Application of PICKERALL, HASBROUCK&BROUSSEAU for marsh
restoration in order to improve water quality. Long Beach Bay Tidal Wetlands Restoration.
Orient Point, Harris' Creek at the end of Little Bay

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH
STIPULATIONS of the Wetland Permit Application of CHARLES V. SALICE 104-3-1 to
rebuilt stairs, remove 8'X 8' deck and replace with 12'X 12' deck. Install 4'X 60' catwalk, 3'X
12' ramp and 6'X 40' float secured with(3) 2-pile dolphins.
2315 Pine Tree Rd., Cutchogue
The CAC recommends Approval with the Stipulations that the float be reduced to 6'X 20' and
that the dock does not go out more than 1/3 into the channel.

DISCUSSION AND RECOMMENDATION OF WAIVER REQUESTS
Moved by Scott Hilary, seconded by Ken Meskill, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Waiver
Request of RAYMOND B. HAYES 70-6-21 to construct a 10' octagon gazebo 75' back from
Jockey Creek.

RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the
Waiver Request of RICHARD K. &PAMELA FRERKING 115-12-09 to construct a 21'X 15'
screen house and 4'X 7' storage area approx. 25' from MHW.

The CAC recommends Disapproval of the Waiver and recommends a Wetland Permit
application.

and to install a freeform 8'X 8' ornamental garden pool.

DISCUSSION AND RECOMMENDATION OF AMENDMENT REQUESTS
PETER ENNERS 106-4-2 to Amend Permit#4689 to construct a timber.bulkhead @ 45 degree
angle to existing bulkhead for a total of 24' to end erosion.

The CAC did not make an inspection, therefore, no recommendation was made.

Amendment Request of JOHN XIKIS 4471-13 to Amend Permit#4454 to extend the existing
deck out approx. 6' in width.

fixed dock 16'.

The CAC recommends Disapproval because there is already an existing structure and an
extension would be excessive.

DISCUSSION AND RECOMMENDATION OF GRANDFATHER REQUESTS
Moved by Ken Meskill, seconded by Scott Hilary, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A
PROVISION of the Grandfather Request of BENNETT KLEINMAN 37-4-2 for an existing 4'X
20' catwalk; a 30"X 12' ramp and a 6'X 20' float.
250 Bayview Ave., Southold
The CAC recommends Approval provided that the application meets the Grandfather
requirements.

Motion Carried
ALBERT PALUMBO 21-2-14 to make necessary repairs to existing wood steps that lead from
bluff to beach. Repairs are necessary due to an emergency situation caused by rotted/rotting
steps that creates a dangerous condition. Homeowner will make all repairs inkind/inplace.

The CAC did not make an inspection, therefore, no recommendation was made.
SET NEXT MEETING DATE
The next meeting of the Southold Town Conservation Advisory Council is scheduled to meet
Thursday, August 12, 1999 at 5:30 PM in the Conference Room.
There being no further business to come before the Council, the meeting was adjourned at 9:30
PM.
