Southold, New York 11971 (516) 765-1801 SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL THURSDAY,AUGUST 12, 1999 5:30 PM A meeting of the Southold Town Conservation Advisory Council was held Thursday, August 12, 1999 at 5:30 PM in the Conference Room'at Southold Town Hall, 53095 Main Rd., Southold, New York. Present Were: Scott Hilary, Chairman Richard Smith, Member Kenneth Meskill, Member Abby Cochran, Junior Member Jaclyn Van Bourgondien, Junior Member Absent Were: Melvyn Morris, Member Bret Hedges,Member CHAIRMAN'S ANNOUNCEMENTS Scott Hilary announced that the budget was due and he reviewed it with the members. He also announced that the Baykeeper, Kevin McAllister, will be joining us at our meeting next month. REPORTS Ken Meskill has beenfdoing the water sampling. He reported that many of the shellfish areas have been closed due to the heavy rainfall. Ken also reported that he called for information regarding the CAC meeting in upstate New York. When the information is received, he will let us know the details. APPROVAL OF MINUTES .2 Moved by Richard Smith, seconded by Ken Meskill to approve the Minutes of July 19, 1999, as submitted. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT AND COASTAL EROSION PERMIT APPLICATIONS Moved by Scott Hilary, seconded by Ken Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A STIPULATION of the Wetland Permit Application of WILLIAM WALSH 137-4-34 to remove 5'X 8' section of existing stairs to grade. Construct a fixed timber dock consisting of a 4'X 50' fixed catwalk; a 3'X 12' ramp; and a 6'X 20' timber float supported by(2) 8" diameter dolphin piles. 1555 Fleetwood Road, Cutchogue The CAC recommends Approval with the stipulation that the catwalk be reduced. Vote of Council: Ayes: All Motion Carried Moved by Scott Hilary, seconded by Richard Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit Application of ARTHUR TORELL 33-2-11 to construct a single-family dwelling with attached garage, pervious driveway, associated septic system and drywell. 365 Westwood Lane, Greenport The CAC recommends Disapproval because the structure will have a potential negative impact on the freshwater wetlands. Vote of Council: Ayes: All Motion Carried Moved by Scott Hilary, seconded by Jaclyn VanBourgondien,.it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A STIPULATION of the Wetland Permit Application of HAROLD &DOTTIE BAER 116-7-6 to construct a single-family dwelling, driveway, decks and sanitary system. 1425 Meadow Lane, Mattituck The CAC recommends Approval with the stipulation that there be a 20' non-turf buffer west of the dirt road, as stated on the previous permit dated June 4, 1997. Vote of Council: Ayes: All Motion Carried 3 Moved by Scott Hilary, seconded by Ken Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit Application of JAMES BLACKLEY 117-1-13 & 117-4-5 for a re-built dock consisting of a 5'X 30' dock, a 5'X 6' catwalk, and a 5'X 10' float with 4" pilings, and, construct a 10'X 32' deck on the front of the house. 1455 Grathwohl Rd.,.New Suffolk The CAC recommends Disapproval because of the following reasons: 1. The structure would have an adverse affect on the wetlands. 2. There is no need shown. 3. Creek access exists at the Town ramp for small boat use. The CAC further recommends removal of the structure. The deck is non jurisdictional. Vote of Council: Ayes: All Motion Carried Moved by Scott Hilary, seconded by Ken Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit Application of ARIF HUSSAIN 31-9-11 to remove a deck and above-ground pool and install a new in-ground pool and drywells. 420 Lakeside Terrace, East Marion The CAC recommends Disapproval because the structure is excessive for the unstable area. Vote of Council: Ayes: All Motion Carried Moved by Scott Hilary, seconded by Richard Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A STIPULATION of the Wetland Permit Application of SAMUEL DELUCA 78-2-31 to remove all dimensional timber and yard debris and dispose of same at an approved upland disposal site prior to construction/planting. Existing 72' +/- of timber bulkhead adjacent to ramp proposed to be cut to grade. 26' +/- of existing deteriorated bulkhead debris to be removed at the Southwest corner of property, and 41' +/- of existing timber bulkhead to be removed at existing float location. The existing pile of sand is proposed to be moved off site. The proposed planting will consist of the following: 550 sq.ft. +/-to be planted with native high marsh species (Spartina patens, 2" peat pots planted on 18" centers). 430 sq.ft. +/- to be planted with native inter-tidal species (Spartina alterniflora, 2" peat pots planted on 18" centers). 1350 Glen Rd., Southold 4 The CAC recommends Approval with the stipulation that the telephone pole be removed as well as the float. Vote of Council: Ayes: All Motion Carried Moved by Scott Hilary, seconded by Richard Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of WILLARD & THERESA LESTER 50-1-20 to construct a 3'X 97' stairway leading to the beach, which would include a 3'X 6' platform, and two (2) 3'X 8' platforms. In addition, a proposal to trim the top of the existing bluff to arrive at a natural angle of repose and to replant the bluff face to provide the needed stability and erosion protection. 1300 Hyatt Rd., Southold The CAC further recommends that the applicant look for a more effective management plan for the bank. Vote of Council: Ayes: All Motion Carried Moved by Abby Cochran, seconded by Jaclyn VanBourgondien, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of VIRGINIA RUMPLER 79-1-5 to construct a 4'X 8' platform with steps; a 4'X 12' ramp and a 6'X 16' float secured by four 8" piles. 470 Goose Creek Lane, Southold Vote of Council: Ayes: All Motion Carried Moved by Scott Hilary, seconded by Richard Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit Application of RICHARD SANSOVERE 59-6-5.1 for an as-built fixed dock 7' in width. 7433 Soundview Ave., Southold The CAC recommends Disapproval and recommends removal and a fine for the violation. However, the CAC would recommend Approval to replace the original structure. Vote of Council: Ayes: All Motion Carried Moved by Scott-Hilary, seconded by Richard Smith, it was 5 RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH STIPULATIONS the Wetland Permit Application of HELEN PAPAGIANAKIS 33-4-2 to construct a 4'X 78' stairway including a 4'X I P landing, three(3)4'X 4' landings, a 6'X 10' shed (8' tall)with a 4'X 14' landing. 1050 Sound Dr., Greenport The CAC recommends Approval with the stipulations that there be no shed and that the 4'X 14' landing be reduced. Vote of Council: Ayes: All Motion Carried BROOKSIDE ENVIRONMENTAL 99-4-13.1 to remove derelict barge from site. Floating boom and silt screen to be installed around barge and anchored to shore during removal as a sediment and erosion control device. Lone Star Properties 25 Naugles Dr., Mattituck The CAC did not make an inspection, therefore no recommendation was made. Moved by Richard Smith, seconded by Scott Hilary, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of MATTITUCK ASSOCIATES 126-11-11 to replace (within 18") approx. 104' of existing timber bulkhead with 104' C-Loc vinyl bulkhead and backfill with approx. 50 c.y. of clean sand fill to be trucked in from an upland source. Peconic Bay Blvd., Laurel Vote of Council: Ayes: All Motion Carried Moved by Scott Hilary, seconded by Richard Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A STIPULATION of the Wetland Permit Application of ROLAND &KAREN GRANT 86-5-9.1 to construct a fixed timber dock, consisting of a 4'X 74' fixed timber catwalk; 3'X 14' ramp; and a 6'X 20' float to be secured by(2) 8" diameter pilings. 1775 Indian Neck Lane, Peconic The CAC recommends Approval with the stipulation that there be no disturbance on the vegetation during construction. The CAC also expressed concerns about the structure being excessive and having an impact on the navigation of the channel. 6 Vote of Council: Ayes: All Motion Carried Moved by Richard Smith, seconded by Abby Cochran, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit Application of BRIAN&MARTINA FAERBER 78-5-16 to construct a two- story, one-family dwelling and attached garage; two-story deck; and sanitary system to be retained by concrete retaining walls; install drywells, place approx. 350 c.y. of sand fill to achieve required base flood elevation of 8% connect public water service; all as depicted on the site plan prepared by Joseph A. Ingegno, last revised 3 August 1999. Williamsburg Rd., Southold The CAC recommend's Disapproval because of the following reasons: 1. The location is too close to the creek. 2. There are concerns with regards to the proximity of the septic system in relation to the wetlands. 3. The entire structure would have a negative impact on Corey Creek. Vote of Council: Ayes: All Motion Carried Moved by Scott Hilary, seconded by Abby Cochran, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of ROBERT SOMERVILLE 89-2-8 to construct fixed open walkway 4'X 45', hinged ramp 4'X 16', and floating dock 6'X 20% install two 2-pile dolphins to secure floating dock, and, to transfer Permit 4867 from Robert D'Urso to Robert Somerville. 485 Breezy Path, Southold The CAC expressed concerns about the structure being too excessive and that there be no disturbance to the high and low marsh vegetation. Vote of Council: Ayes: All Motion Carried KATHLEEN H. DEVORE 70-6-30 for an existing bulkhead, to repair existing dock by adding a 6'X 24' float, and to plant beach grass. 635 Lighthouse Lane, Southold 4 The CAC did not make an inspection, therefore no recommendation was made. THOMAS &PATRICIA FRENZ 104-9-4.2 to construct a single-family residence with attached porch, septic system, and two-car garage with driveway, and, to construct a catwalk approx. 4'X 225' with a 6'X 20' floating dock. 1260 Broadwaters Rd., Cutchogue The CAC did not make an inspection, there no recommendation was made. DISCUSSION AND RECOMMENDATION OF WAIVER REQUESTS STEFANIE LINAKIS 122-9-7.18 to install a private drinking-water well. 2304 Private Rd. off Camp Mineola Rd., Mattituck The CAC did not make an inspection, therefore no recommendation was made. Moved by Richard Smith, seconded by Scott Hilary, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Waiver Request of MICHAEL & CORINNE SLADE 110-7-26 to construct a partial second floor addition with a master bedroom, bath, and deck. 1435 West Rd., Cutchogue Vote of Council: Ayes: All Motion Carried Moved by Scott Hilary, seconded by Richard Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Waiver Request of PAUL & JUDITH FRIED 23-1-4 to renovate two existing bathrooms and kitchen, replace existing roof, renovate existing upstairs bedroom, replace North wall with new structural framing and glazing, and replace jack columns in the basement with structural pipe columns. 15155 North Rd., East Marion Vote of Council: Ayes: All Motion Carried Moved by Scott Hilary, seconded by Richard Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Waiver Request of DONALD &MARYANN DECARLO 70-13-20.9 to install a split-rail fence between boundary and high water mark for security and privacy purposes. 1425 Kimberly Lane, Southold The CAC recommends Disapproval because the structure is unnecessary and will not increase privacy or security. 8 Vote of Council: Ayes: All Motion Carried Moved by Richard Smith, seconded by Scott Hilary, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Waiver Request of MICHAEL MITCHELL 115-11-18.1 to construct a house addition, a new screened porch, and an addition to the existing deck. 750 Lupton Point Rd., Mattituck Vote of Council: Ayes: All Motion Carried Moved by Richard Smith, seconded by Jaclyn VanBourgondien, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Waiver Request of THOMAS & SUSAN HUDGINS 128-2-12 to construct a room over an existing 18.4'X 15' second floor deck as shown on survey and plans. 1755 Sigsbee Rd., Mattituck Vote of Council: Ayes: All Motion Carried MARLENE LANE CIVIC ASSOC. 126-6-10 to place a portable sunfish boat rack on their privately owned beach. The racks will be removed at the end of each sailing season. 11-12 Peconic Bay Blvd., Mattituck The CAC did not make an inspection, therefore no recommendation was made. DISCUSSION AND RECOMMENDATION OF AMENDMENT REQUESTS RICHARD & JUDITH DIBLASI 37-4-1 to Amend Permit#4818 to include the existing bulkhead. 360 Bayview Dr., East Marion The CAC did not make an inspection, therefore no recommendation was made. Moved by Scott Hilary, seconded by Richard Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Amendment Request of PAUL&PATRICIA AHLERS 35-4-16 to Amend Permit#1437 to turn existing float 90 degrees and extend existing float of 20' to a length of 30' to accommodate two boats. 1905 Gull Pond Lane, Greenport 9 Vote of Council: Ayes: All Motion Carried Moved by Richard Smith, seconded by Scott Hilary, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Amendment Request of CHARLES & BARBARA RODIN 103-10-16 to Amend Permit#5000 to extend the length of the split rail fence already permitted to include the entire length of the property from the sea wall to the end of the road, including reconstruction of approx. 30' split rail already existing at the west side of the property line. All new top soil and planting along the fence line will be removed. 70 Strohson Rd., Cutchogue The CAC further supports a planting plan. Vote of Council: Ayes: All Motion Carried SET NEXT MEETING DATE The next meeting of the Southold Town Conservation Advisory Council is scheduled to meet Monday, September 20, 1999 at 5:30 PM in the Conference Room.
