Southold, New York 11971 (516) 765-1892, SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL MINUTES Monday, September 20, 1999 5:30 PM A meeting of the Southold Town Conservation Advisory Council was held Monday, September 20, 1999 at 5:30 PM in the Conference Room at Southold Town Hall, 53095 Main Rd., Southold, New York. Present Were: Scott Hilary, Chairman Richard Smith, Member Kenneth Meskill, Member Bret Hedges,Member Melvyn Morris, Member William McDermott, Member Abby Cochran, Junior Member Absent Was: Jaclyn VanBourgondien CHAIRMAN'S ANNOUNCEMENTS Chairman Scott Hilary introduced the council to Kevin McAllister, the Baykeeper. Kevin gave the council an overview on the current baykeeper programs. He mentioned that there are currently 37 baykeeper programs throughout the country and soon to be more and that all their funding is local. His goal is to build support for these programs and act as a neighborhood watchdog for the Peconic Estuary. He covers all areas from Brookhaven National Lab to Montauk to Orient. They have had success with the no-discharge zone. The Estuary is currently forming a committee for farm problems with regards to road run-off and pesticides. Kevin also mentioned that he is an advocate on shoreline hardening. He welcomes any support and/or participation from the CAC. The council would like to take part in the no-discharge project. They will be working on setting- up a joint seminar. Scott Hilary announced that the NYS Assoc. of CAC Conference will be held Sept. 24; 25, & 26th. Scott spoke with Chris Pickerall regarding the salt marsh tour to identify wetland species. A tour of Cedar Beach is tentative for Friday, October 1'`, or October 8th. Scott will invite the bay constables to a future meeting. REPORTS Melvyn Morris is continuing to look for a student to do compliance checks. Ken Meskill reported that water-sampling is picking-up and any volunteers would be greatly appreciated. APPROVAL OF MINUTES Moved by Richard Smith, seconded by Scott Hilary, to approve the Minutes of August 12, 1999; as submitted. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT AND COASTAL EROSION PERMIT APPLICATIONS GEORGE KALOGERAS 99-1-8.1 to repair and rebuild the existing retaining wall. 900 Sound Beach Dr., Mattituck The CAC did not make an inspection, therefore no recommendation was made. . Moved by Melvyn Morris, seconded by Richard Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit Application of EDWARD FOX 1122-9-9.4 to construct a single-family dwelling (3,000 sq.ft.footprint), deck(1,497 sq.ft. +/-) and swimming pool (800 sq.ft.) a minimum of 82' landward of the tidal wetlands boundary locat6d to the north of the subject lot. The proposed septic system will be located a minimum of 155' landward of said tidal wetlands boundary and will be enclosed by a proposed concrete retaining wall (top of wall =e. 9.0)Approx. 125 c.y. of clean fill will be required for the proposed sanitary system. 2503 Camp Mineola Rd., Mattituck Vote of Council: Ayes: All Motion Carried Moved by Melvyn Morris, seconded by Bret Hedges, it was 3 RESOLVED to recommend to the Southold Town Board of Trustees APROVAL WITH A STIPULATION of the Wetland Permit Application of EDGEMERE PARK ASSOC. c/o ARTHUR SMITH 145-4-14 to remove and replace in same location approx. 105' of timber bulkhead. Recover lost backfill from a 10'X 105' area for approx. ? c.y. and place behind new bulkhead. R.O.W: off Peconic Bay Blvd., Edgemere Lane/McDonald Rd., Laurel The CAC recommends Approval with the stipulation that there be a 10' non-turf buffer behind the bulkhead. Vote of Council: Ayes: All Motion Carried Moved by Melvyn Morris, seconded by Bret Hedges, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A STIPULATION of the Wetland Permit Application of ROBERT KNAPP 145-4-4 to replace approx. 185' bulkhead within 18". Install a 4'X 8' platform, 2.5'X 14' ramp and 8'X 30' floating dock. Recover from a 10'X 185' area approx. 75 c.y. of material and place as backfill. 2260 Peconic Bay Blvd., Laurel The CAC recommends Approval of the application with the stipulation that there be a 10' non- turf buffer placed behind the bulkhead. Vote of Council: Ayes: All Motion Carried Moved by Scott Hilary, seconded by Ken Meskill, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of FRANK GUMPER 87-3-58 to construct 63' of vinyl bulkhead in , front of existing bulkhead. 2400 Minnehaha Blvd., Southold Vote of Council: Ayes: All Motion Carried Moved by Scott Hilary, seconded by Richard Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of DOUGLAS FOERTH 97-7-6 to construct an 8' catwalk to a 16' ramp to a 5'X 20' floating dock. 700 Beebe Dr., Cutchogue The CAC recommends Approval but suggests that the structure be moved-in closer landward and further had a concern about the float sitting on the bottom at low tide. - 4 Vote of Council: Ayes: All Motion Carried JEAN N. CALHOUN 3-2-7 to construct a 4'X 150' catwalk, 4'X 15' ramp, 6'X 30' float and to install (4) out piles as per plans prepared by Chandler, Palmer& King last dated 7/8/99. Private Rd., No. #, Fishers Island The CAC did not make an inspection, therefore no recommendation was made. Moved by Bret Hedges, seconded by Richard Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of MATTITUCK INLET MARINA& SHIPYARD, INC. 106-6- 13.3 to reconstruct within 18", +/- 685' of timber bulkheading utilizing vinyl sheathing and to backfill structure with+/- 100 c.y. of clean sand which shall be trucked in from an upland source. 5780 West Mill Rd., Mattituck Vote of Council: Ayes: All Motion Carried R.VINCENT LYNCH, JR. &REBECCA H. LYNCH 6-1-15 to construct a 4'X 130' fixed dock, 4'X 4' steps, 4'X 18' ramp, 6'X 20' float and to install (4)tie off poles. Crescent Ave., Fishers Island The CAC did not make an inspection, therefore no recommendation was made. c Moved by Melvyn Morris, seconded by Richard Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of ADRIAN& JACKIE EDWARDS 123-8-2 to construct a+/-112' timber bulkhead (within 12" of existing concrete seawall) with a 6' westerly return, and backfill with approximately 150 c.y. of clean sand fill to be trucked in from an upland source. New bulkhead to be 1' higher in elevation than existing seawall. Gather existing quarry stone from failed groin(s) as toe stone. 1392 Park Ave., Mattituck The CAC recommends Approval as written+/- 12". Vote of Council: Ayes: All Motion Carried 5 Moved by Scott Hilary, seconded by Richard Smith, to TABLE the Wetland Permit Application of SUSAN TASKER 44-2-11 to construct a one-family dwelling, deck, revetment, sanitary system, bluestone (or similar pervious) driveway, underground utilities, all as shown on attached site plan of VanTuyl. Approx. 265 c.y. of clean sand fill will be trucked in. 58235 Middle Rd., (CR.48), Greenport The CAC Tabled the application because the property was not staked and there-was a question as to whether or not a new survey was required and if there was going to be a SEQRA review. Vote of Council: Ayes: All { Motion Carried Moved by Melvyn Morris, seconded by Richard Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of MICHAEL CURTIN& OLGA KANEIl IERER 123-8-3 to construct a+/- 132 timber bulkhead (within 12" of existing concrete seawall)with an 8' easterly return,.and backfill with approx. 150 c.y. of clean sand fill to be trucked in from an upland source. New bulkhead to be F higher in elevation than existing seawall. 1470 Park Ave., Mattituck The CAC recommends Approval as written+/- 12". Vote of Council: Ayes: All Motion Carried Moved by Scott Hilary, seconded by Richard Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of WILLIAM EDWARD&AMEI WALLACH 123-8-4 to remove and replace (in-place) +/- 42 linear feet of existing timber bulkhead with C-Loc vinyl bulkhead and backfill with approx. 50 c.y. of clean sand to be trucked in from an upland source. 1600 Park Ave., Mattituck Vote of Council: Ayes: All Motion Carried DISCUSSION AND RECOMMENDATION OF WAIVER REQUESTS Moved by Bret Hedges, seconded by Scott'Hilary, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Waiver Request of EDWIN&MARGARET PISANI 126-11-9.1 to build a 12' deep deck in the front of the house. 7180 Peconic Bay Blvd., Laurel Vote of Council: Ayes: All 6 Motion Carried ELIOT H. PORTER 1110-6-12.3 to reconstruct/relocate timber walk and deck. Private Rd., No.#, Fishers Island The CAC did not make an inspection, therefore no recommendation was made. MICHAEL L. .LAUGHLIN 6-7-16.1 to reconstruct existing timber deck which was constructed prior to.1980 and to construct(2) 10'X 15' additions to deck. Crescent Ave., Fishers Island The CAC did not make an inspection, therefore no recommendation was made. DISCUSSION AND RECOMMENDATION OF AMENDMENT REQUESTS Moved by Melvyn Morris, seconded by Richard Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Amendment Request of VIRGINIA R. CONWAY 115-10-4 to Amend Permit#1812 to allow for the replacement of pilings and to Transfer the Permit from Robert.Garben to Virginia R. Conway. 5150 New Suffolk Ave., Mattituck Vote of Council: Ayes: All Motion Carried Moved by Melvyn Morris, seconded by Bret Hedges, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Amendment Request of JANE MASTER 94-1-4 to allow for the construction of the stairs and platforms straight down the bluff, and transfer permit from Herbert Jacobs to Jane Master. 605 Sound View Ave., Mattituck Vote of Council: Ayes: All Motion Carried DISCUSSION AND RECOMMENDATION OF GRANDFATHER REQUESTS Moved by Scott Hilary, seconded by Bret Hedges, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Grandfather Permit Request of ELLEN I. PIHL 37-4-7 for an existing boat ramp from the basement of the house to Spring Pond, a bulkhead between the property and r ` 7. Spring Pond and a retaining wall between the lawn and the flat gravel area adjacent to the bulkhead. 2235 Cedar Lane, East Marion The CAC recommends Approval with the Condition that a 10' non-turf buffer is placed behind the bulkhead and that necessary documents are provided in order to meet the criteria for a Grandfather Permit. Vote of Council: Ayes: All Motion Carried SET NEXT MEETING DATE The next meeting of the Southold Town Conservation Advisory Council is scheduled to meet Monday, October 18, 1999 at 5:30 PM in the Conference Room.
