Box 1179 Telephone O Southold, New York 11971 (516) 765-1892 SOUTHOLD TOWN - CONSERVATION ADVISORY COUNCIL MINUTES Monday, October 18, 1999 5:30 PM A meeting of the Southold Town Conservation Advisory Council was held Monday, October 18, 1999 at 5:30 PM in the Conference Room at Southold Town Hall, 53095 Main Rd., Southold, New York. Present Were: Scott Hilary, Chairman Melvyn Morris, Member Bret Hedges, Member William McDermott, Member Absent Were: Richard Smith Ken Meskill Jaclyn VanBourgondien Abby Cochran CHAIRMAN'S ANNOUNCEMENTS Chairman Scott Hilary announced that the wetland workshop with Chris Pickerall had been cancelled and that a new date will be set for a Friday or Saturday in November. Jim McMahon was invited to the meeting as a guest speaker for the Management of Natural Resources. Currently there is no management plant for Marratooka Lake, Fort Corchaug, the Bloom and Levin properties, the Arshamomaque Wetland Preserve, and the property around Hummel's Pond. Jim invited the members to contribute to the management plan and welcomed any ideas they had. The members agreed that Fort Corchaug would be a priority and would discuss a management plan at their future meetings. Scott discussed with the members the idea of alternating inspection months in order to be able to work on special projects. Scott spoke with Don Dzenkowski, the Bay Constable, and expressed to him the need to improve communication when reporting violations. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT AND COASTAL EROSION PERMIT APPLICATIONS Moved by Scott Hilary, seconded by Melvyn Morris, it was RESOLVED to TABLE the Wetland Permit Application of LETTIERI, LETTIERI& GAZZA 22-3-19,20,21 & 22 for improvements to an existing right-of-way. 5 acre parcel off Main Rd., East Marion The CAC Tabled the application because there was not enough background information to make a recommendation. Vote of Council: Ayes: All Motion Carried Moved by Scott Hilary, seconded by Bret Hedges, it was RESOLVED to TABLE the Wetland Permit Application of MICHAEL CORDASCI 59-9-4.2 to construct a single-family, private dwelling. 435 Private Rd., #26 off Soundview Ave., Southold The CAC Tabled the application because the proposed house was not staked and properly labeled. Vote-of Council: Ayes: All Motion Carried Moved by Scott Hilary, seconded by William McDermott, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of ULYSSES GALLANOS 64-1-28 for a driveway 10'-12in width, on-grade and pervious surface over common easement—culvert built by Town and Trustees. 660 Hobart Rd., Southold - ~ 3 Vote of Council: Ayes: All Motion Carried Moved by William McDermott, seconded by Scott Hilary, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of E. BROWNELL& KAREN B. JOHNSTON 86-1-9.4 to construct a+/- 3854 sq.ft. two-story house, a+/-2815 sq.ft. driveway, and a+/- 800 sq.ft. pool. Richard Creek Farms R.O.W. (adjacent to Wells Rd.), Peconic. Vote of Council: Ayes: All Motion Carried Moved by Scott Hilary, seconded by William McDermott, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit Application of CONRAD & JESSIE VEROSTEK 135-3- 30.1 to remove existing structure from existing foundation, and remove existing locust post/concrete foundation, excavate for new poured concrete foundation within existing building footprint, and relocate existing structure on new foundation. 415 Mill Creek Rd., Southold The CAC recommends Approval with the condition that haybales be placed down before construction. Vote of Council: Ayes: All Motion Carried Moved by Scott Hilary, seconded by Bret Hedges, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of DANIEL C. MOONEY 37-4-16 to replace pipes, floating dock, and ramp. Dock 3'X 18' and ramp 21/2'X8'. 575 Pine Place, East Marion Vote of Council: Ayes: All Motion Carried Moved by Bret Hedges, seconded by Melvyn Morris, it was RESOLVED to TABLE the Wetland Permit Application of MATT-A-MAR, INC. 114-3-1 to construct a boat basin at the southeast side of marina. Boat basin will be 16,900 sq.ft with an average depth of 15' to be excavated; construction of 320' of bulkhead, and 355' of floating docks. Excavated material is clean gravel and sand, which will be used to create a burro at the east side border of the marina and will be available for clean backfill for new bulkhead area. 2255 Wickham Ave., Mattituck 4 The CAC Tabled the application until a more detailed job description is presented with regard to the disturbance and siltation. Vote of Council: Ayes: All Motion Carried Moved by Scott Hilary, seconded by William McDermott, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of JOHN FARRIS 26-2-20.1 to remove deteriorated 3.5'X 75' dock, install new 4'X 75' dock in same location, install two 2-pile mooring dolphins. 750 Willow Terrace Lane, Orient Vote of Council: Ayes: All Motion Carried Moved by Scott Hilary, seconded by William McDermott, it was RESOLVED to TABLE the Wetland Permit Application of PHYLLIS GUNN 90-1-15 to clear an upland area up to 50' landward of the tidal wetlands boundary; establish a 50' wide non- fertilization/non-disturbance buffer adjacent to the wetlands; and install a drinking water well. 2145 Little Peconic Bay Lane, Southold The CAC Tabled the application because the property was not properly staked and labeled. Vote of Council: Ayes: All Motion Carried Moved by William McDermott, seconded by Scott Hilary, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of KIMOGENOR POINT CO. 116-6-24.1 to construct 85' of new timber bulkhead 18" in front of existing deteriorated bulkhead; remove 21' of existing deteriorated bulkhead, construct 21' of new timber bulkhead in same location; backfill as required with clean sand from upland source, approx. 70 c.y. 50 Jackson St.,New Suffolk Vote of Council: Ayes: All Motion Carried Moved by Scott Hilary, seconded by William McDermott, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of RUTH E. MILLER 86-7-2 to construct a 7'X 22' deck addition, including a 7'X 9' gazebo, and repair/replace existing wood deck and stairs in kind. 5 6400 Indian Neck Lane, Peconic Vote of Council: Ayes: All Motion Carried Moved by Scott Hilary, seconded by Bret Hedges, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit Application of TED DOWD 92-1-8 to dredge the entrance . to Fairhaven Inlet which has closed in due to dredging by Suffolk Co. Dredged material to be used as fill nearby. 100-150 c.y. Cedar Beach, 1775 Inlet Way, Southold The CAC recommends Approval with the condition that the natural vegetation isn't disturbed with the spoil. Vote of Council: Ayes: All Motion Carried Moved by Melvyn Morris, seconded by Bret Hedges, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of WILLIAM A. MALLINS 113-4-3 & 4 to construct a single- family dwelling with a garage, an asphalt driveway, sanitary system, and a recreational dock facility consisting of a 4'X 40' fixed timber dock, 3'X 20' ramp, and a 6'X 20' timber float. 70 Jackson's Landing, Mattituck The CAC recommends Approval but had questions regarding the placement of the dock and a navigational concern. Vote of Council: Ayes: All Motion Carried Moved by Scott Hilary, seconded by William McDermott, it was RESOLVED to TABLE the Wetland Permit Application of LISA EDSON 87-5-25 to clear an upland area up to 30' landward of the tidal wetland boundary and establish a 30' wide non- disturbance buffer adjacent to the wetlands. 9326 Main Bayview Rd., Southold The CAC Tabled the application because the property was not properly staked and labeled. Vote of Council: Ayes: All Motion Carried 6 Moved by Melvyn Morris, seconded by William McDermott, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit Application of WILLIAM KILLEN 83-2-6.2 to construct approx. 113 linear ft. of timber retaining wall to be tied into adjacent retaining walls to east and west. Approx. 125 c.y. of clean sand fill will be trucked in from an upland source, used as backfill, and planted with Ammorphila breviligulata. 2710 Dignan's Rd., Cutchogue Vote of Council: Ayes: All Motion Carried DISCUSSION AND RECOMMENDATION OF AMENDMENT REQUESTS ROSE MARIE &LESLIE WINDISCH 70-5-39 to Amend Permit #4378 to add a 4'X 10' ramp and a 6'X 20' floating dock to existing catwalk;and Transfer the Permit from Henry Barry to Rose Marie&Leslie Windisch. 1375 Pine Neck Rd., Southold The CAC did not make an inspection, therefore no recommendation was made. Moved by Scott Hilary, seconded by Bret Hedges, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Amendment Request of DANIEL V. JENNINGS 70-5-54.1 to reconstruct access stairs (4'X 6' upper platform and 4'X 15' stairs) install 3'X 16' ramp and replace 6'X 10' float with a 6'X 20' float secured with two 2-pile dolphins. 3340 Oaklawn Ave., Southold The CAC recommends Approval but had a concern that the structure is excessive, the possibility of a navigational concern and bottom coverage concern. Vote of Council: Ayes: All Motion Carried DISCUSSION AND RECOMMENDATION OF WAIVER REQUESTS Moved by Scott Hilary, seconded by Bret Hedges, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Waiver Request of JANE DELYNN 59-1-4 for an addition of second-story to an existing one-story house to encompass landward (road) side of house for two bedrooms. 930 Leeton Dr., Southold Vote of Council: Ayes: All Motion Carried 7 Moved by Scott Hilary, seconded by Bret Hedges, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Waiver Request of LEWIS P. JONES 40-1-19 for a proposed fence between lower bank and high water mark. 63429 County Rd. 48, Greenport The CAC recommends Disapproval because of their concern of a potential environmental hazard and it impeding the natural corridors. Vote of Council: Ayes: All Motion Carried Moved by Bret Hedges, seconded by Melvyn Morris, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Waiver Request of RAYMOND GADDIS 126-11-6 to reduce rear deck from 18' in depth to 12' in depth. Construct a one-story addition on landward or north side of residence 16'X 28'. Rear deck to be covered. The excavated area will be approx. 108' from the bulkhead/highwater mark. 7020 Great Peconic Bay Blvd., Laurel Vote of Council: Ayes: All Motion Carried Moved by Melvyn Morris, seconded by William McDermott, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Waiver Request of IAN SHAND 127-6-11 to construct an open deck 43' from tidal wetlands. 1460 North Oakwood Drive, Laurel The CAC recommends Approval but had a concern about the debris from the construction running into the marsh. Vote of Council: Ayes: All Motion Carried DISCUSSION AND RECOMMENDATION OF GRANDFATHER REQUESTS Moved by Scott Hilary, seconded by Melvyn Morris, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Grandfather Permit Request of HOWARD & VALERIE MICHELSEN 31-18-18 for an existing deck, stairs, house and shed, and to Transfer Permit#31-18-18 from Hazen Cook to Howard& Valerie Michelsen. 860 Rabbit Lane, East Marion t � 8 The CAC recommends Approval as long as the structures existed prior to 1971 and proof is submitted. Vote of Council: Ayes: All Motion Carried Moved by Melvyn Morris, seconded by William McDermott, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Grandfather Permit Request of MICHAEL BRUCE 111-14-24 for three docks existing on the property prior to December 12, 1969. 4150 Wunneweta Rd., Cutchogue The CAC recommends Approval as long as the structures existed prior to 1971 and proof is submitted. Vote of Council: Ayes: All Motion Carried Moved by William McDermott, seconded by Melvyn Morris, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Grandfather Permit Request of JOHN L. KIRCHNER 118-2-8 for an existing dock. 705 Bridge Lane, Cutchogue The CAC recommends Approval as long as the structure existed prior to 1971 and proof is submitted. Vote of Council: Ayes: All Motion Carried - SET NEXT MEETING DATE The next meeting of the Southold Town Conservation Advisory Council is scheduled to meet Wednesday, November 17, 1999 at 5:30 PM in the Conference Room.
