MINUTES
November 17, 1999
5:30 PM
A meeting of the Southold Town Conservation Advisory Council was held Wednesday,
November 17, 1999 at 5:30 PM in the Conference Room at Southold Town Hall, 53095
Main Rd., Southold,New York

CHAIRMAN'S ANNOUNCEMENTS
Chairman Scott Hilary invited the Bay Constable to join our meeting possibly next
month.
Scott showed the board members the Comprehensive Conservation&Management Plan
by the Peconic Estuary. Rich Smith further explained the plan and the goals. He also
mentioned that he was part of a"grass roots project".
Scott passed around several e-mails regarding themer�am and the DEC Justice
Program.
The wetlands workshop with Chris Pickerall has been rescheduled for December 17th at
3:00 PM at Cedar Beach.
REPORTS
Rich Smith reported that East Creek opened for shellfishing for the wintermonths.
Ken Meskill reported that because there is a shortage of DEC employees,there are going
to be more conditionals.
MINUTES
Moved by Richard Smith, seconded by Scott Hilary,to approve the Minutes of October
18, 1999, as submitted.
DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT AND
COASTAL EROSION PERMIT APPLICATIONS
Moved by Scott Hilary, seconded by Ken Meskill, it was
RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of
the Wetland Permit Application of PAT SCOLLARD 123-10-3 to construct 102'
retaining wall of"C-Loc" series 4700 vinyl sheathing.

The CAC Disapproved the application because the bulkhead would impact the natural
hydrology of the tidal system and have a potential impact on the habitat. The CAC
recommends an alternative such as re-vegetation.
Vote of Council: Ayes: All
Motion Carried
Moved by Ken Meskill, seconded by Richard Smith, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH
STIPULATIONS the Wetland Permit Application of JOHN HURTADO, JR. 79-5-20 to
construct a single-family dwelling, sanitary system and access drive on a 23.77 acre
parcel. Driveway construction incorporates grading between(2) small freshwater
wetland areas not regulated by DEC.

The CAC recommends Approval with the following Stipulations:
1. All construction is to be 75' landward with no disturbance.
2. The driveway be re-routed to existing right-of-way in order
to avoid a negative impact on the freshwater wetlands and
fragmentation of the habitat.
3. A new site plan to be submitted prior to final Approval.
Vote of Council: Ayes: All
Motion Carried
Moved by Scott Hilary, seconded by Richard Smith, it was
RESOLVED to TABLE the Wetland Permit Application of LISA EDSON 87-5-25 to
clear an upland area up to 30' landward of the tidal wetland boundary and establish a 30'
wide non-disturbance buffer adjacent to the wetlands. Letter of non jurisdiction
requested to.construct a two-story, one-family dwelling, attached deck, and swimming
pool, all on pilings and a pervious driveway; connect to public water; install a sanitary
system and place 600 c.y. of clean sand fill for sanitary system.

The CAC Tabled the application because the property was not staked and had concerns
regarding the wetlands delineation's to the west and the north within 75' of proposed
structure.
Vote of Council: Ayes: All
Motion Carried
Moved by Scott Hilary, seconded by Ken Meskill, it was
RESOLVED to TABLE the Wetland Permit Application of PHYLLIS GUNN 90-1-15 to
clear an upland area up to 50' landward of the tidal wetlands boundary; establish a 50'
wide non-fertilization/non-disturbance buffer adjacent to the wetlands; and install a
drinking water well. Letter of non jurisdiction requested for construction of proposed
house, deck, and driveway and sanitary system, as all work will be conducted more than
75' landward of the tidal wetland boundary.

Moved by Richard Smith, seconded by Ken Meskill, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH
A CONDITION of the Wetland Permit Application of MICHAEL J. CORDASCI
59-9-4.2 to construct a single-family private dwelling.
435 Private Rd. off Soundview Ave., Southold
The CAC Approved the application with the condition that there be a 50' non-turf buffer.
Vote of Council: Ayes: All

Moved by Scott Hilary, seconded by Richard Smith, it was
RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of
the Wetland Permit Application of FRANK&INGEBORG FLYNN 63-5-8 to construct a
fixed timber dock, consisting of a 4'X 12' inclined ramp, leading to a 4'X 42' fixed
catwalk(to be elevated 4' above marsh grade); a 3'X 20' hinged ramp; and a 6'X 30'
float(with a 4'X 4' extension for ramp),to be secured by(2)two-pile(8" diameter)
dolphins. Dock will be constructed over owner's privately-owned underwater parcel,
known as SCTM#1000-57-1-39.2

The CAC recommended Disapproval because the structure is too excessive as per
Trustee's policies.

Moved by Richard Smith, seconded by Abby Cochran, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the
Wetland Permit Application of WILLIAM BAYLIS 66-3-1 to construct approx. 91 linear
ft. of vinyl low-sill bulkhead and create approx. 930 sq. ft. of intertidal marsh landward
thereof by placing approx. 75 c.y. of clean sand fill to be trucked in from an upland
source and planted with Spartina alterniflora(12"on center)on a 1:7 slope. Remove
existing 10'X 35' fixed timber dock and associated pilings and construct a fixed timber
dock, consisting of a 4'X 28' fixed catwalk(elevated a minimum of 4' above proposed
marsh grade); a 3'X 14' ramp; and a 6'X 20' float to be secured by(2) 8" diameter
pilings.

DISCUSSION AND RECOMMENDATION OF AMENDMENT REQUESTS
CHARLES BRIENZA 15-9-1.5 to Amend Permit#4476 to extend rock revetment 40' as
drawn.
1240 Latham Lane, Orient
The CAC did not make an inspection,therefore no recommendation was made.
CHARLES BOVINO 119-1-5&6 to Amend Permit to provide a freshwater line down the
bank to the deck area between the lower and upper bulkheads. The proposed water line
will be seasonal only in nature, and drained during the cold seasons.
9775 Nassau Point Rd., Cutchogue
The CAC did not make an inspection,therefore no recommendation was made.
DISCUSSION AND RECOMMENDATION OF WAIVER REQUESTS
JOHN HENRY 26-1-16.1 for a renovation of residence consisting of new windows and
doors a the corner and deck/stoop between existing house and concrete wall viewed from
the northwest.

The CAC did not make an inspection,therefore no recommendation was made.
SET NEXT MEETING DATE
The next meeting of the Southold Town Conservation Advisory Council is scheduled for
Monday,December 6, 1999 at 5:00 PM in the Conference Room.
There being no further business to come before the Council,the meeting was adjourned
at 7:20 PM.
