As you may recall the Board had concerns with our original submission because of the "pier line" in this portion of West Harbor. The new proposal is "The applicant proposes to reconstruct the existing 5'x52' fixed dock and raise it 0.5' in elevation and extend it 19' seaward; remove the existing ramp, float and remove two (2) piles; remove existing 11'x11' portion of the fixed dock and two (2) piles; install a new 4'x20' ramp with rails, a 8'x16' float secured by four (4) piles and install three (3) tie off plies." With the revised proposal the entire docking facility will be located within the existing "pier line". Upon your review of the enclosed plans please feel free to contact me at any time should the Board have any comments or questions. Environmental Consulting Services May 18, 2022 Mr. Glenn Goldsmith, President Board of Town Trustees Gu Town of Southold Town Hall AnnexSouthold Town Board of Trustees 54375 Main Road P.O. Box 1179 Southold, NY 11971 Re: Application for W. Harbor Bungalow, LLC., c/o Craig Schultz 371 Hedge Street, Fishers Island S.C.T.M.No. 1000-10-7-18 Dear Mr. Goldsmith- I am writing you in response to the Board's findings (copy enclosed) that the new proposed dock exceeds the "pier line" and recommends that the length of the should be reduced to fall within the "pier line". Under Chapter 275-2 (Definitions; word usage) of the Town Code a "pier line" is defined as" The average seaward projection of one or more existing permitted docks, piers, wharves or floats." I have reviewed aerial photographs of the portion of West Harbor where the applicants property is located. With this it was noted that there are 5 existing docks located iinrnediately north of the applicant's property and three located immediately south of the applicant's property. These docks are located approximately 350' north and 350' south of the applicant's property. I have enclosed a copy of the Google Earth snap for the area and starting with the Phone (631 ) 653-0607 -, Email Gjustl02l5@aol.com 121 Jessup Ave o 2nd Floor a P.O. Box 447 Quogue, New York 11959-0447 The following are the lengths of those docks: A. 127' B. 110' E C E W E C. 103' D. 112' E. 85' MAY 1 8 2022 * Applicant 73 Southold Town F. 40' Board of Trustees G. 61 ' H. 113' The average length of the existing docks is 98.22' The applicant is seeking to extend the length of their dock by 14' for an overall length of 87' which would be less than the average lengths of docks for this area. The following should also be noted: Navigation: The proposed dock meets standards and does not extend beyond 1/3 across the water body. Depths for dock tenninus are within Town Trustees, New York State Department of Environmental Conservation and United States Army Corps. Of Engineers guidelines and there is no recognized Federal/New York State/Town navigation channel in the immediate vicinity of the proposed structure. Scope: The proposed dock is comparable to docks on neighboring properties in an area where docks historically are used for commercial and recreational purposes. Scope in relation to the riparian rights of shell fishers: The plan allows a standard fixed catwalk to float design that will not impede access for those seeking shellfish and crustacea in season. Environmental upkeep: The dock design projects a usual lifespan of 30 years with minimal pile replacement so as to minimize disturbance of the bottom. We have also reviewed the USFWS Eelgrass Survey 2002-2017, the TNC Aerial Vessel Survey 2017 and personally inspected the subject and adjacent properties and have found no evidence of Eelgrass. With this we respectfully request that the Board approves the application as submitted.
